electronicsignaturesoninitiativepetitions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter116,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection116.055,toreadasfollows:
116.055.1.Thesecretaryofstateshallcreateandmaintainawebsiteallowing
2forthesubmissionofelectronicsignaturesforeveryinitiativeandreferendumpetition.
3Anyvotermaychoosewhethertosubmithisorherelectronicsignatureforpetitionor
4signthepetitionmanually.
5 2.Thesecretaryofstateandeachlocalelectionauthorityshallacceptan
6electronicsignaturemeetingtherequirementsofthissectionandincludethesignature
7inthecountofsignaturesnecessarytovalidatethepetition.Nocirculatorsignatureor
8notarizationshallberequiredforelectronicsignatures.
9 3.Theuseofanelectronicsignatureshallhavethesameforceandeffectasthe
10useofamanualsignatureonapetitiononlyiftheelectronicsignaturecomplieswiththe
11followingrequirements:
12 (1)Theelectronicsignatureissubmittedbyavotertoawebsiteestablished
13undersubsection1ofthissection;
14 (2)Avoter,atthetimeofsubmittingtheelectronicsignature,alsosubmits:
15 (a)Hisorhername,address,countyofresidence,anddateofbirthasshownon
16hisorhervoterregistrationrecord;
17 (b)Hisorherassenttothepetitiondocument;and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (c)Auniqueidentifierthatshallbeprovidedtoeachregisteredvoterbythe
19secretaryofstate;
20 (3)Theelectronicsignatureiscorrelatedwiththevoterasevidencedbya
21reasonablematchwithvoterregistrationrecordsandvotingrecordsthatcorrespondto
22atleastoneitemofstate-qualifieddata;
23 (4)Theelectronicsignaturehasnotbeensubsequentlyrepudiatedbythevoter
24throughaprocessestablishedbythesecretaryofstate;
25 (5)Theelectronicsignaturehasnotbeenpreviouslysubmittedandverifiedasa
26signatureonthesamepetition;and
27 (6)Theelectronicsignatureconformstoreasonablerulespromulgatedbythe
28secretaryofstate.
29 4.Thesecretaryofstateshallpromulgaterulestocarryoutthissection.The
30rulesandregulationsshallrequire,ataminimum,themaintenanceofanaudittrailof
31publicinternetprotocoladdressesidentifiedwiththesessioninwhichtheelectronic
32signaturewassubmitted,thedatasubmittedbythevoter,thetimeanddateofthe
33submission,andthestate-qualifieddatausedforverification.
34 5.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
35createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
36complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
37section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
38vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
39effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
40thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
4128,2025,shallbeinvalidandvoid.
