71 (11)Anymemberofafiredepartmentorfireprotectiondistrictwhoisemployedona 72full-timebasisasafireinvestigatorandwhohasavalidconcealedcarryendorsementissued 73priortoAugust28,2013,oravalidconcealedcarrypermitundersection571.111whensuch 74usesarereasonablyassociatedwithorarenecessarytothefulfillmentofsuchperson'sofficial 75duties;and 76 (12)Uponthewrittenapprovalofthegoverningbodyofafiredepartmentorfire 77protectiondistrict,anypaidfiredepartmentorfireprotectiondistrictmemberwhois 78employedonafull-timebasisandwhohasavalidconcealedcarryendorsementissuedprior 79toAugust28,2013,oravalidconcealedcarrypermit,whensuchusesarereasonably 80associatedwithorarenecessarytothefulfillmentofsuchperson'sofficialduties. 81 3.Subdivisions(1),(5),(8),and(10)ofsubsection1ofthissectiondonotapply 82whentheactoristransportingsuchweaponsinanonfunctioningstateorinanunloadedstate 83whenammunitionisnotreadilyaccessibleorwhensuchweaponsarenotreadilyaccessible. 84Subdivision(1)ofsubsection1ofthissectiondoesnotapplytoanypersonnineteenyearsof 85ageorolderoreighteenyearsofageorolderandamemberoftheUnitedStatesArmed 86Forces,orhonorablydischargedfromtheUnitedStatesArmedForces,transportinga 87concealablefirearminthepassengercompartmentofamotorvehicle,solongassuch 88concealablefirearmisotherwiselawfullypossessed,norwhentheactorisalsoinpossession 89ofanexposedfirearmorprojectileweaponforthelawfulpursuitofgame,orisinhisorher HB719 3 90dwellingunitoruponpremisesoverwhichtheactorhaspossession,authorityorcontrol,oris 91travelinginacontinuousjourneypeaceablythroughthisstate.Subdivision(10)ofsubsection 921ofthissectiondoesnotapplyifthefirearmisotherwiselawfullypossessedbyaperson 93whiletraversingschoolpremisesforthepurposesoftransportingastudenttoorfromschool, 94orpossessedbyanadultforthepurposesoffacilitationofaschool-sanctionedfirearm-related 95eventorclubevent. 96 4.Subdivisions(1),(8),and(10)ofsubsection1ofthissectionshallnotapplytoany 97personwhohasavalidconcealedcarrypermitissuedpursuanttosections571.101to571.121 98orsections571.205to571.230, avalidconcealedcarryendorsementissuedbeforeAugust 9928,2013,oravalidpermitorendorsementtocarryconcealedfirearmsissuedbyanotherstate 100orpoliticalsubdivisionofanotherstate. 101 5.Subdivisions(3),(4),(5),(6),(7),(8),(9),and(10)ofsubsection1ofthissection 102shallnotapplytopersonswhoareengagedinalawfulactofdefensepursuanttosection 103563.031. 104 6.Notwithstandinganyprovisionofthissectiontothecontrary,thestateshallnot 105prohibitanystateemployeefromhavingafirearmintheemployee'svehicleonthestate's 106propertyprovidedthatthevehicleislockedandthefirearmisnotvisible.Thissubsection 107shallonlyapplytothestateasanemployerwhenthestateemployee'svehicleisonproperty 108ownedorleasedbythestateandthestateemployeeisconductingactivitieswithinthescope 109ofhisorheremployment.Forthepurposesofthissubsection,"stateemployee"meansan 110employeeoftheexecutive,legislative,orjudicialbranchofthegovernmentofthestateof 111Missouri. 112 7.(1)Subdivision(10)ofsubsection1ofthissectionshallnotapplytoapersonwho 113isaschoolofficercommissionedbythedistrictschoolboardundersection162.215orwhois 114aschoolprotectionofficer,asdescribedundersection160.665. 115 (2)Nothinginthissectionshallmakeitunlawfulforastudenttoactuallyparticipate 116inschool-sanctionedgunsafetycourses,studentmilitaryorROTCcourses,orotherschool- 117sponsoredorclub-sponsoredfirearm-relatedevents,providedthestudentdoesnotcarrya 118firearmorotherweaponreadilycapableoflethaluseintoanyschool,ontoanyschoolbus,or 119ontothepremisesofanyotherfunctionoractivitysponsoredorsanctionedbyschoolofficials 120orthedistrictschoolboard. 121 8.Apersonwhocommitsthecrimeofunlawfuluseofweaponsunder: 122 (1)Subdivision(2),(3),(4),or(11)ofsubsection1ofthissectionshallbeguiltyofa 123classEfelony; 124 (2)Subdivision(1),(6),(7),or(8)ofsubsection1ofthissectionshallbeguiltyofa 125classBmisdemeanor[, exceptwhenaconcealedweaponiscarriedontoanyprivateproperty 126whoseownerhaspostedthepremisesasbeingoff-limitstoconcealedfirearmsbymeansof HB719 4 127oneormoresignsdisplayedinaconspicuousplaceofaminimumsizeofeleveninchesby 128fourteenincheswiththewritingthereoninlettersofnotlessthanoneinch,inwhichcasethe 129penaltiesofsubsection2ofsection571.107shallapply]; 130 (3)Subdivision(5)or(10)ofsubsection1ofthissectionshallbeguiltyofaclassA 131misdemeanorifthefirearmisunloadedandaclassEfelonyifthefirearmisloaded; 132 (4)Subdivision(9)ofsubsection1ofthissectionshallbeguiltyofaclassBfelony, 133exceptthatiftheviolationofsubdivision(9)ofsubsection1ofthissectionresultsininjuryor 134deathtoanotherperson,itisaclassAfelony. 135 9.Violationsofsubdivision(9)ofsubsection1ofthissectionshallbepunishedas 136follows: 137 (1)Forthefirstviolationapersonshallbesentencedtothemaximumauthorizedterm 138ofimprisonmentforaclassBfelony; 139 (2)Foranyviolationbyaprioroffenderasdefinedinsection558.016,apersonshall 140besentencedtothemaximumauthorizedtermofimprisonmentforaclassBfelonywithout 141thepossibilityofparole,probationorconditionalreleaseforatermoftenyears; 142 (3)Foranyviolationbyapersistentoffenderasdefinedinsection558.016,aperson 143shallbesentencedtothemaximumauthorizedtermofimprisonmentforaclassBfelony 144withoutthepossibilityofparole,probation,orconditionalrelease; 145 (4)Foranyviolationwhichresultsininjuryordeathtoanotherperson,apersonshall 146besentencedtoanauthorizeddispositionforaclassAfelony. 147 10.Anypersonknowinglyaidingorabettinganyotherpersonintheviolationof 148subdivision(9)ofsubsection1ofthissectionshallbesubjecttothesamepenaltyasthat 149prescribedbythissectionforviolationsbyotherpersons. 150 11.Notwithstandinganyotherprovisionoflaw,nopersonwhopleadsguiltytooris 151foundguiltyofafelonyviolationofsubsection1ofthissectionshallreceiveasuspended 152impositionofsentenceifsuchpersonhaspreviouslyreceivedasuspendedimpositionof 153sentenceforanyotherfirearms-orweapons-relatedfelonyoffense. 154 12.Asusedinthissection"qualifiedretiredpeaceofficer"meansanindividualwho: 155 (1)Retiredingoodstandingfromservicewithapublicagencyasapeaceofficer, 156otherthanforreasonsofmentalinstability; 157 (2)Beforesuchretirement,wasauthorizedbylawtoengageinorsupervisethe 158prevention,detection,investigation,orprosecutionof,ortheincarcerationofanypersonfor, 159anyviolationoflaw,andhadstatutorypowersofarrest; 160 (3)Beforesuchretirement,wasregularlyemployedasapeaceofficerforan 161aggregateoffifteenyearsormore,orretiredfromservicewithsuchagency,aftercompleting 162anyapplicableprobationaryperiodofsuchservice,duetoaservice-connecteddisability,as 163determinedbysuchagency; HB719 5 164 (4)Hasanonforfeitablerighttobenefitsundertheretirementplanoftheagencyif 165suchaplanisavailable; 166 (5)Duringthemostrecenttwelve-monthperiod,hasmet,attheexpenseofthe 167individual,thestandardsfortrainingandqualificationforactivepeaceofficerstocarry 168firearms;
