BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section571.030,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection571.030,toreadasfollows:
571.030.1.Apersoncommitstheoffenseofunlawfuluseofweapons,exceptas
2otherwiseprovidedbysections571.101to571.121andsections571.205to571.230, ifheor
3sheknowingly:
4 (1)Carriesconcealeduponorabouthisorherpersonaknife,afirearm,ablackjack
5oranyotherweaponreadilycapableoflethaluse[intoanyareawherefirearmsarerestricted
6undersection571.107]; or
7 (2)Setsaspringgun;or
8 (3)Dischargesorshootsafirearmintoadwellinghouse,arailroadtrain,boat,
9aircraft,ormotorvehicleasdefinedinsection302.010,oranybuildingorstructureusedfor
10theassemblingofpeople;or
11 (4)Exhibits,inthepresenceofoneormorepersons,anyweaponreadilycapableof
12lethaluseinanangryorthreateningmanner;or
13 (5)Hasafirearmorprojectileweaponreadilycapableoflethaluseonhisorher
14person,whileheorsheisintoxicated,andhandlesorotherwiseusessuchfirearmorprojectile
15weaponineitheranegligentorunlawfulmannerordischargessuchfirearmorprojectile

EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis

33 2.Subdivisions(1),(8),and(10)ofsubsection1ofthissectionshallnotapplytothe
34personsdescribedinthissubsection,regardlessofwhethersuchusesarereasonably
35associatedwithorarenecessarytothefulfillmentofsuchperson'sofficialdutiesexceptas
36otherwiseprovidedinthissubsection.Subdivisions(3),(4),(6),(7),and(9)ofsubsection1
37ofthissectionshallnotapplytooraffectanyofthefollowingpersons,whensuchusesare
38reasonablyassociatedwithorarenecessarytothefulfillmentofsuchperson'sofficialduties,

40 (1)Allstate,countyandmunicipalpeaceofficerswhohavecompletedthetraining
41requiredbythepoliceofficerstandardsandtrainingcommissionpursuanttosections590.030
42to590.050andwhopossessthedutyandpowerofarrestforviolationofthegeneralcriminal
43lawsofthestateorforviolationofordinancesofcountiesormunicipalitiesofthestate,
44whethersuchofficersareonoroffduty,andwhethersuchofficersarewithinoroutsideofthe
45lawenforcementagency'sjurisdiction,orallqualifiedretiredpeaceofficers,asdefinedin
46subsection12ofthissection,andwhocarrytheidentificationdefinedinsubsection13ofthis
47section,oranypersonsummonedbysuchofficerstoassistinmakingarrestsorpreservingthe

101 5.Subdivisions(3),(4),(5),(6),(7),(8),(9),and(10)ofsubsection1ofthissection
102shallnotapplytopersonswhoareengagedinalawfulactofdefensepursuanttosection

104 6.Notwithstandinganyprovisionofthissectiontothecontrary,thestateshallnot
105prohibitanystateemployeefromhavingafirearmintheemployee'svehicleonthestate's
106propertyprovidedthatthevehicleislockedandthefirearmisnotvisible.Thissubsection
107shallonlyapplytothestateasanemployerwhenthestateemployee'svehicleisonproperty
108ownedorleasedbythestateandthestateemployeeisconductingactivitieswithinthescope
109ofhisorheremployment.Forthepurposesofthissubsection,"stateemployee"meansan

121 8.Apersonwhocommitsthecrimeofunlawfuluseofweaponsunder:

152impositionofsentenceifsuchpersonhaspreviouslyreceivedasuspendedimpositionof
153sentenceforanyotherfirearms-orweapons-relatedfelonyoffense.
154 12.Asusedinthissection"qualifiedretiredpeaceofficer"meansanindividualwho:
155 (1)Retiredingoodstandingfromservicewithapublicagencyasapeaceofficer,
156otherthanforreasonsofmentalinstability;
157 (2)Beforesuchretirement,wasauthorizedbylawtoengageinorsupervisethe
158prevention,detection,investigation,orprosecutionof,ortheincarcerationofanypersonfor,
159anyviolationoflaw,andhadstatutorypowersofarrest;
160 (3)Beforesuchretirement,wasregularlyemployedasapeaceofficerforan
161aggregateoffifteenyearsormore,orretiredfromservicewithsuchagency,aftercompleting
162anyapplicableprobationaryperiodofsuchservice,duetoaservice-connecteddisability,as
163determinedbysuchagency;

165suchaplanisavailable;
