HB745--TOWINGOFCOMMERCIALVEHICLES SPONSOR: Griffith ThisbillrequirestheDepartmentofTransportation toestablish procedurestoaddresscertainnonconsensualtowingpractices relatedtotheremovalofcommercialvehiclesfromroadways,a complaintfilingandadjudicationprocess,andprovisionsfor permanentlyortemporarilyprohibitingtowingcompaniesfrom performingnonconsensualtowsiftheyviolatetheprovisionsofthe bill. Thedepartment mayestablisha"TowingandRecoveryReviewBoard" toassistinimplementingtheprovisionsofthebill,with membershipandfunctionsasspecified. Ifanowneroroperatorofacommercialvehiclerequeststheuseof aspecifictowingcompany,lawenforcementagenciesmusthonorthat request,exceptundercertainconditions. ThebillalsospecifiesthattheDepartmentortheBoardcandecide ifavehicleisreleasedwhenthefeesaredisputed,prohibits perpoundchargesfornonconsensualtows,providesthatstorage chargesceaseaccruinguponthedateacomplaintisfiledwiththe Department,andprohibitsnonconsensualtowsfromcreatinglienson commercialvehiclesorcargo. Towingcompaniesmustprovidereasonableaccesstocommercial vehiclesthatarethesubjectofanonconsensualtow,forpurposes specifiedinthebill.Atowingcompanyperforminganonconsensual towwhenprohibitedfromdoingsobytheDepartmentwillbesubject toacivilpenaltyof$25,000perviolation.
