324.001.1.Forthepurposesofthissection,thefollowingtermsmean:
2 (1)"Department",thedepartmentofcommerceandinsurance;
3 (2)"Director",thedirectorofthedivisionofprofessionalregistration;and
4 (3)"Division",thedivisionofprofessionalregistration.
5 2.Thereisherebyestablisheda"DivisionofProfessionalRegistration"assignedto
6thedepartmentofcommerceandinsuranceasatypeIIItransfer,headedbyadirector
7appointedbythegovernorwiththeadviceandconsentofthesenate.Allofthegeneral
8provisions,definitionsandpowersenumeratedinsection1oftheOmnibusState
9ReorganizationActof1974andExecutiveOrder06-04shallapplytothisdepartmentand
10itsdivisions,agencies,andpersonnel.
11 3.Thedirectorofthedivisionofprofessionalregistrationshallpromulgaterulesand
12regulationswhichdesignateforeachboardorcommissionassignedtothedivisionthe
13renewaldateforlicensesorcertificates.Aftertheinitialestablishmentofrenewaldates,no
14directorofthedivisionshallpromulgatearuleorregulationwhichwouldchangetherenewal
15dateforlicensesorcertificatesifsuchchangeinrenewaldatewouldoccurpriortothedateon
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16whichtherenewaldateineffectatthetimesuchnewrenewaldateisspecifiednextoccurs.
17Eachboardorcommissionshallbyruleorregulationestablishlicensingperiodsofone,two,
18orthreeyears.Registrationfeessetbyaboardorcommissionshallbeeffectivefortheentire
19licensingperiodinvolved,andshallnotbeincreasedduringanycurrentlicensingperiod.
20Personswhoarerequiredtopaytheirfirstregistrationfeesshallbeallowedtopaytheprorata
21shareofsuchfeesfortheremainderoftheperiodremainingatthetimethefeesarepaid.
22Eachboardorcommissionshallprovidethenecessaryformsforinitialregistration,and
23thereafterthedirectormayprescribestandardformsforrenewaloflicensesandcertificates.
24Eachboardorcommissionshallbyruleandregulationrequireeachapplicanttoprovidethe
25informationwhichisrequiredtokeeptheboard'srecordscurrent.Eachboardorcommission
26shallhavetheauthoritytocollectandanalyzeinformationrequiredtosupportworkforce
27planningandpolicydevelopment.Suchinformationshallnotbepubliclydisclosedsoasto
28identifyaspecifichealthcareprovider,asdefinedinsection376.1350.Eachboardor
29commissionshallissuetheoriginallicenseorcertificate.
30 4.Thedivisionshallprovideclericalandotherstaffservicesrelatingtotheissuance
31andrenewaloflicensesforalltheprofessionallicensingandregulatingboardsand
32commissionsassignedtothedivision.Thedivisionshallperformthefinancialmanagement
33andclericalfunctionsastheyeachrelatetoissuanceandrenewaloflicensesandcertificates.
34"Issuanceandrenewaloflicensesandcertificates"meanstheministerialfunctionof
35preparinganddeliveringlicensesorcertificates,andobtainingmaterialandinformationfor
36theboardorcommissioninconnectionwiththerenewalthereoftoincludeverifyingifthe
37applicanthassubmittedallrequireddocumentationandthatthedocumentationislegible.It
38doesnotincludeanydiscretionaryauthoritywithregardtotheoriginalreviewofan
39applicant'squalificationsforlicensureorcertification,orthesubsequentreviewoflicensee's
40orcertificateholder'squalifications,oranydisciplinaryactioncontemplatedagainstthe
41licenseeorcertificateholder.Thedivisionmaydevelopandimplementmicrofilmingsystems
42andautomatedormanualmanagementinformationsystems.
43 5.Thedirectorofthedivisionshallmaintainasystemofaccountingandbudgeting,in
44cooperationwiththedirectorofthedepartment,theofficeofadministration,andthestate
45auditor'soffice,toensureproperchargesaremadetothevariousboardsforservicesrendered
46tothem.Thegeneralassemblyshallappropriatetothedivisionandotherstateagenciesfrom
47eachboard'sfundsmoneyssufficienttoreimbursethedivisionandotherstateagenciesforall
48servicesrenderedandallfacilitiesandsuppliesfurnishedtothatboard.
49 6.Foraccountingpurposes,theappropriationtothedivisionandtotheofficeof
50administrationforthepaymentofrentforquartersprovidedforthedivisionshallbemade
51fromthe"ProfessionalRegistrationFeesFund",whichisherebycreated,andistobeused
52solelyforthepurposedefinedinsubsection5ofthissection.Thefundshallconsistof
HB766	2 53moneysdepositedintoitfromeachboard'sfund.Eachboardshallcontributeaprorated
54amountnecessarytofundthedivisionforservicesrenderedandrentbaseduponthesystemof
55accountingandbudgetingestablishedbythedirectorofthedivisionasprovidedinsubsection
565ofthissection.Transfersoffundstotheprofessionalregistrationfeesfundshallbemadeby
57eachboardonJulyfirstofeachyear;provided,however,thatthedirectorofthedivisionmay
58establishanalternativedateordatesoftransfersattherequestofanyboard.Suchtransfers
59shallbemadeuntiltheyequaltheproratedamountforservicesrenderedandrentbythe
60division.Theprovisionsofsection33.080tothecontrarynotwithstanding,moneyinthis
61fundshallnotbetransferredandplacedtothecreditofgeneralrevenue.
62 7.Thedirectorofthedivisionshallberesponsibleforcollectingandaccountingfor
63allmoneysreceivedbythedivisionoritscomponentagencies.Anymoneyreceivedbya
64boardorcommissionshallbepromptlygiven,identifiedbytypeandsource,tothedirector.
65Thedirectorshallkeeparecordbyboardandstateaccountingsystemclassificationofthe
66amountofrevenuethedirectorreceives.Thedirectorshallpromptlytransmitallreceiptsto
67thedepartmentofrevenuefordepositinthestatetreasurytothecreditoftheappropriate
68fund.Thedirectorshallprovideeachboardwithallrelevantfinancialinformationinatimely
69fashion.Eachboardshallcooperatewiththedirectorbyprovidingnecessaryinformation.
70 8.Alleducationaltranscripts,testscores,complaints,investigatoryreports,and
71informationpertainingtoanypersonwhoisanapplicantorlicenseeofanyagencyassigned
72tothedivisionofprofessionalregistrationbystatuteorbythedepartmentareconfidentialand
73maynotbedisclosedtothepublicoranymemberofthepublic,exceptwiththewritten
74consentofthepersonwhoserecordsareinvolved.Theagencywhichpossessestherecordsor
75informationshalldisclosetherecordsorinformationifthepersonwhoserecordsor
76informationisinvolvedhasconsentedtothedisclosure.Eachagencyisentitledtothe
77attorney-clientprivilegeandwork-productprivilegetothesameextentasanyotherperson.
78Provided,however,thatanyboardmaydiscloseconfidentialinformationwithouttheconsent
79ofthepersoninvolvedinthecourseofvoluntaryinterstateexchangeofinformation,orinthe
80courseofanylitigationconcerningthatperson,orpursuanttoalawfulrequest,ortoother
81administrativeorlawenforcementagenciesactingwithinthescopeoftheirstatutory
82authority.Informationregardingidentity,includingnamesandaddresses,registration,and
83currencyofthelicenseofthepersonspossessinglicensestoengageinaprofessional
84occupationandthenamesandaddressesofapplicantsforsuchlicensesisnotconfidential
85information.
86 9.Anydeliberationsconductedandvotestakeninrenderingafinaldecisionaftera
87hearingbeforeanagencyassignedtothedivisionshallbeclosedtothepartiesandthepublic.
88Onceafinaldecisionisrendered,thatdecisionshallbemadeavailabletothepartiesandthe
89public.

91section536.025forlicensurefeestobereducedbyemergencyrule,iftheprojectedfund
92balanceofanyagencyassignedtothedivisionofprofessionalregistrationisreasonably
93expectedtoexceedanamountthatwouldrequiretransferfromthatfundtogeneralrevenue.

105 (2)Theboardsandcommissionsassignedtothedivisionshallexercisealltheir
106respectivestatutorydutiesandpowers,exceptthoseclericalandotherstaffservicesinvolving
107collectingandaccountingformoneysandfinancialmanagementrelatingtotheissuanceand
108renewaloflicenses,whichservicesshallbeprovidedbythedivision,withintheappropriation
109therefor.Nothinghereinshallprohibitemploymentofprofessionalexaminingortesting
110servicesfromprofessionalassociationsorothersasrequiredbytheboardsorcommissionson
111contract.Nothinghereinshallbeconstruedtoaffectthepowerofaboardorcommissionto
112expenditsfundsasappropriated.However,thedivisionshallreviewtheexpensevouchersof
113eachboard.Theresultsofsuchreviewshallbesubmittedtotheboardreviewedandtothe
114houseandsenateappropriationscommitteesannually.
115 (3)Notwithstandinganyotherprovisionsoflaw,thedirectorofthedivisionshall
116exerciseonlythosemanagementfunctionsoftheboardsandcommissionsspecifically
117providedintheReorganizationActof1974,andthoserelatingtotheallocationand
118assignmentofspace,personnelotherthanboardpersonnel,andequipment.

133 (5)Boardpersonnelforeachboardorcommissionshallbeemployedbyandserveat
134thepleasureoftheboardorcommission,shallbesupervisedastheboardorcommission
135designates,andshallhavetheirdutiesandcompensationprescribedbytheboardor
136commission,withinappropriationsforthatpurpose,exceptthatcompensationforboard
137personnelshallnotexceedthatestablishedforcomparablepositionsasdeterminedbythe

144divisionofprofessionalregistrationofthedepartmentofeconomicdevelopment,such
145referencesshallbedeemedtorefertothedivisionofprofessionalregistration.
146 14.(1)Thestateboardofnursing,boardofpharmacy,Missouridentalboard,state
147committeeofpsychologists,stateboardofchiropracticexaminers,stateboardofoptometry,
148Missouriboardofoccupationaltherapy,orstateboardofregistrationforthehealingartsmay
149individuallyorcollectivelyenterintoacontractualagreementwiththedepartmentofhealth
150andseniorservices,apublicinstitutionofhighereducation,oranonprofitentityforthe
151purposeofcollectingandanalyzingworkforcedatafromitslicensees,registrants,orpermit
152holdersforfutureworkforceplanningandtoassesstheaccessibilityandavailabilityof
153qualifiedhealthcareservicesandpractitionersinMissouri.Theboardsshallwork
154collaborativelywithotherstategovernmentalentitiestoensurecoordinationandavoid

4 2.Thecommitteeshallissueadocumentsimilartothedocumentdescribedin
5subsection2ofsection173.1400toanyindividualwho:
6 (1)Submitsanapplicationtotheboard;
7 (2)Holdsacredentialinschoolsocialworkissuedbyanationallyrecognized
8credentialingorganizationinsocialwork,ordemonstratescompetencyinschoolsocialwork
9bysuccessfulpassageofaschoolsocialworkerexamapprovedbythecommittee;
10 (3)Holdsalicenseissuedbythecommittee;and
11 (4)Submitsthefeeasrequiredbyruleofthecommittee.
12 3.Thecommitteeshallpromulgaterulesandshallchargefeesnecessarytoimplement
13thissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis

15withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
16Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
17generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
18disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
19rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2012,shallbeinvalid

21 4.Notwithstandinganyprovisionoflawtothecontrary,anyschoolsocialwork
22programverificationandacknowledgmentofcompletionissuedbythecommitteeunder
23subsection2ofthissectionshallnotbedeemedalicense,certificate,registrationorpermitfor
24anypurpose,andsuchdocumentsconveynoauthoritytopracticesocialworkinMissouriand
25conveynoauthoritytouseanysocialworktitleinMissouri.Eachschoolsocialwork
26programverificationandacknowledgmentofcompletionissuedbythecommitteeunder
27subsection2ofthissectionshallstateonitsfacethatit:
28 (1)Isnotalicense,certificate,registrationorpermit;
29 (2)ConveysnoauthoritytopracticesocialworkinMissouri;and
30 (3)ConveysnoauthoritytouseanysocialworktitleinMissouri.
31 5.Notwithstandinganyprovisionoflawtothecontrary,schoolsocialworkprogram
32verificationandacknowledgmentofcompletionissuedbythecommitteeundersubsection2
33ofthissectionshallnot:
34 (1)Expire;
35 (2)Besubjecttorenewal;
36 (3)Besubjecttodenialordisciplineundersection337.630;or

[324.010.Allgovernmentalentitiesissuingprofessionallicenses,
2 certificates,registrations,orpermitspursuanttosections209.319to209.339,
3 sections214.270to214.516,sections256.010to256.453,section375.014,
4 sections436.005to436.071,andchapter317andchapters324to346shall
5 providethedirectorofrevenuewiththenameandSocialSecuritynumberof
6 eachapplicantforlicensurewithorlicenseeofsuchentitieswithinonemonth
7 ofthedatetheapplicationisfiledoratleastonemonthpriortotheanticipated
8 renewalofalicensee'slicense.Ifsuchlicenseeisdelinquentonanystatetaxes
9 orhasfailedtofilestateincometaxreturnsinthelastthreeyears,thedirector
10 shallthensendnoticetoeachsuchentityandlicensee.Inthecaseofsuch
11 delinquencyorfailuretofile,thelicensee'slicenseshallbesuspendedwithin
12 ninetydaysafternoticeofsuchdelinquencyorfailuretofile,unlessthe
13 directorofrevenueverifiesthatsuchdelinquencyorfailurehasbeenremedied
14 orarrangementshavebeenmadetoachievesuchremedy.Thedirectorof
15 revenueshall,withintenbusinessdaysofnotificationtothegovernmental

17 orarrangementshavebeenmadetoremedysuchdelinquency,sendwritten
