radioactivewaste.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section260.558,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection260.558,toreadasfollows:
260.558.1.Thereisherebycreatedinthestatetreasurythe"RadioactiveWaste
2InvestigationFund".Thestatetreasurershallbecustodianofthefund.Inaccordancewith
3sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefundshallbe
4adedicatedfundand,uponappropriation,moneysinthefundshallbeusedsolelybythe
5departmentofnaturalresourcestoinvestigateconcernsofexposuretoradioactivewaste.
6Uponwrittenrequestbyalocalgoverningbodyexpressingconcernsofradioactivewaste
7contaminationinaspecifiedareawithinitsjurisdiction,thedepartmentofnaturalresources
8shallusemoneysintheradioactivewasteinvestigationfundtodevelopandconductan
9investigation,usingsoundscientificmethods,forthespecifiedareaofconcern.Therequest
10byalocalgoverningbodyshallincludeaspecifiedareaofconcernandanysupporting
11documentationrelatedtotheconcern.Thedepartmentshallprioritizerequestsintheorderin
12whichtheyarereceived,exceptthatthedepartmentmaygiveprioritytorequeststhatarein
13closeproximitytofederallydesignatedsiteswhereradioactivecontaminantsareknownor
14reasonablyexpectedtoexist.Theinvestigationshallbeperformedbyapplicablefederalor
15stateagenciesorbyaqualifiedcontractorselectedbythedepartmentthroughacompetitive
16biddingprocess.Inconductinganinvestigationunderthissection,thedepartmentshallwork
17withtheapplicablegovernmentagencyorapprovedcontractor,aswellaslocalofficials,to

19concernexceedfederalstandardsforremedialactionduetocontamination.Withina
20residentialarea,thisplanmayincludedustsamplescollectedinsideresidentialhomesonly
21afterobtainingpermissionfromthehomeowners.Thesamplesshallbeanalyzedforthe
22isotopesnecessarytocorrelatethesampleswiththesuspectedcontamination,asdescribedin
23thesamplingandanalysisplan.Withinforty-fivedaysofreceivingthefinalsamplingresults,
24thedepartmentshallreporttheresultstotheattorneygeneralandthelocalgoverningbody
25thatrequestedtheinvestigationandmakethefinalizedreportandtestingresultspublicly
26availableonthedepartment'swebsite.
27 2.[Thetransfertothefundshallnotexceedonehundredfiftythousanddollarsper
28fiscalyear.Investigationcostsexpendedfromthisfundshallnotexceedonehundredfifty
29thousanddollarsperfiscalyear.]Anymoneysremaininginthefundattheendofthe
30bienniumshallreverttothecreditofthehazardouswastefund.
31 3.Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother
32fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto
33thefund.
34 4.Thedepartmentshallseekreimbursementofexpensesincurredduring
35radioactivewastecleanupfromanyfederalagencyresponsibleforthesite.
