ofelectricvehicles,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter34,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection34.630,toreadasfollows:
34.630.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Electricvehicle",amotorvehiclethatispropelledtoasignificantextentby
3anelectricmotorthatdrawselectricityfromabatterycapableofbeingrechargedfrom
4anexternalsourceofelectricity;
5 (2)"Forcedlabor",allworkorservicethatis:
6 (a)Obtainedbyforce,fraud,orcoercion,includingbythreatofseriousharmto,
7orphysicalrestraintagainst,anyperson;bymeansofanyscheme,plan,orpattern
8intendedtocausethepersontobelievethatifsuchpersondidnotperformsuchlaboror
9services,suchpersonoranotherpersonwouldsufferseriousharmorphysicalrestraint;
10orbymeansoftheabuseorthreatenedabuseofthelaworthelegalprocess;
11 (b)Imposedonthebasisofaprotectedcharacteristic;
12 (c)Notofferedorprovidedvoluntarilybytheworker;or
13 (d)Producedthroughoppressivechildlabor;
14 (3)"Governmentalentity",astateagencyorpoliticalsubdivisionofthisstateor
15anyschool,college,university,administration,authority,orotherenterpriseoperated
16bythestateoranypoliticalsubdivisionthereof;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (4)"Oppressivechildlabor",aconditionofemploymentunderwhichany
18personunderfourteenyearsofageisemployedinanoccupationhazardousforthe
19employmentofchildren,suchasmanufacturingormining;
20 (5)"Protectedcharacteristic",anycharacteristicprotectedbytheMissouri
21humanrightsact.
22 2.Nogovernmentalentityshallenterintoacontractfortheprocurementof
23electricvehicles,oranycomponentofanelectricvehicle,unlessthegovernmentalentity
24isprovidedasworncertificationfromthemanufactureroftheelectricvehicleorthe
25componentofanelectricvehiclethatdoesthefollowing:
26 (1)Consentstothepersonaljurisdictionbythestateoverthemanufacturer;and
27 (2)Certifiesthatnoentityinvolvedintheproductionoftheelectricvehicleor
28componentofanelectricvehicle,includingtheproductionofanyconstituentpartorthe
29miningorothersourcingofanymaterials,usedforcedlabororoppressivechildlaborin
30itsactivities.
31 3.(1)Inadditiontoanyotherremediesavailableatlaworequity,ifthe
32manufacturerorsellerprovidesfalseormisleadinginformationundersubsection2of
33thissection,theindividualprovidingthefalseormisleadinginformationshallbeliable
34foracivilpenaltyoftenthousanddollarsperfalseormisleadingstatementorone-half
35thetotalpricepaidbythegovernmentalentityforthevehiclesorcomponents,
36whicheverisgreater.
37 (2)Anygovernmentalentitythatknowinglyviolatessubsection2ofthissection
38shallbesubjecttoafineoftenthousanddollarsperfalseormisleadingstatementorthe
39totalpricepaidbythegovernmentalentityforthevehiclesorcomponents,whicheveris
40greater.Thefinesunderthissubdivisionshallbepayabletothegeneralrevenuefund.
41 (3)Anystateemployeethatknowinglyviolatessubsection2ofthissectionshall
42personallypayafineoffivethousanddollarstotheMissouriveteranscommission.
43 (4)Anyemployeeofalocalgovernmentorpoliticalsubdivisionthatknowingly
44violatessubsection2ofthissectionshallpersonallypayafineoffivethousanddollarsto
45theschooldistrictsinthecountyinwhichtheviolationoccurred.Suchfundsshallbe
46allocatedinproportiontotheaveragedailyattendanceofeachschooldistrictinthe
47county.
48 (5)Eachmemberofastatewideboardwhovotesintheaffirmativetoauthorize
49apurchasethatviolatessubsection2ofthissectionshallpersonallypayafineoffive
50thousanddollarstotheMissouriveteranscommission.
51 (6)Eachmemberofalocalgovernmentorpoliticalsubdivisionboardwhovotes
52intheaffirmativetoauthorizeapurchasethatviolatessubsection2ofthissectionshall
53personallypayafineoffivethousanddollarstotheschooldistrictsinthecountyin
HB779	2 54whichtheviolationoccurred.Suchfundsshallbeallocatedinproportiontotheaverage
55dailyattendanceofeachschooldistrictinthecounty.
56 (7)AnycitizenwithinthejurisdictionofthestateofMissourioranypolitical
57subdivisionthereofshallhavestandingtobringenforcementofthissection.
