63chapterandwithinthelimitationsimposedbythedonorthereof. 64 2.Allpowersanddutiesofthedivisionshall,sofarasapplicable,applytothe 65administrationofanyotherlawwhereindutiesareimposeduponthedivisionactingas 66astateagency. 207.102.1.Thedivisionshallestablisha"MissouriAdoptiveResourcesServices 2System"fortheentirestate. 3 2.TheMissouriadoptiveresourcesservicessystemshallpromotethesafeand 4healthybirthofchildreninMissourithroughtheutilizationofexistingresourcesfor 5expectantmothersandtheadoptionofchildreninMissouribyfitandproperpersons 6seekingtoadopt.Thesystemshallcoordinatecommunityresourcesandprovide 7assistanceorservicestoexpectantmothersidentifiedtobeatriskforseekingabortion 8servicesandtopreventabortionsthroughtheadoptionofchildrenbyfitandproper 9personsseekingtoadopt. 10 3.InfurtheranceoftheMissouriadoptiveresourcesservicessystem,thedivision 11shall: 12 (1)Maintainacentralregistryofeachexpectantmotherwhoisatriskfor 13seekinganabortionofherunbornchildandmakethesameavailabletoaprospective 14adoptiveparentwhohascompletedscreeningsasprovidedinsubdivision(2)ofthis 15subsection; 16 (2)Maintainacentralregistryofaprospectiveadoptiveparentwhohas 17successfullycompletedscreenings,backgroundchecks,homestudies,andother 18investigationsdeterminingtheparenttobefitandpropertoadoptachildin 19Missouriandmakethesameavailabletosuchanexpectantmotherwhohasbeen 20identifiedasbeingatriskforseekinganabortionofherunbornchild; 21 (3)Maintainmechanismsasarenecessarytofacilitatetheintroductionand 22mutualagreementsofanexpectantmotheratriskforseekinganabortionofherunborn 23childandafitandproperprospectiveadoptiveparent; HB807 5 24 (4)Facilitateadoptiveproceedingswhereinafitandproperprospectiveadoptive 25parentadoptsachildwhowouldotherwisebeabortedpriortohisorhernaturalbirth; 26 (5)Assistanexpectantmotherwhoisatriskforseekinganabortionofher 27unbornchildinapplyingforexistingservicesandresourcesprovidedbystateandlocal 28governmentagencies; 29 (6)Collaboratewiththecommunitytoidentifycomprehensivelocalservicesand 30assureaccesstothoseservicesforanexpectantmotherwhoisatriskforseekingan 31abortionofherunbornchild; 32 (7)Maintainarecordthatcontainstheservicesprovidedtoanexpectantmother 33andalladoptiveproceedingsforachildborntoanexpectantmotherseekingservices 34fromthedivision;and 35 (8)Wheneveravailableandappropriate,contractfortheprovisionofservices 36throughchildren'sservicesprovidersandagenciesinthecommunity.Inalllegal 37proceedingsinvolvingtheadoptionofachildfacilitatedbythedivision,thedivision 38shallberepresentedincourtbyeitherdivisionpersonnelorpersonswithwhomthe 39divisioncontractswithforsuchlegalrepresentation.Allprovidersandagenciesof 40servicesunderthissectionshallbesubjecttocriminalbackgroundchecksunderchapter 4143andshallsubmitnamesofallemployeestothefamilycaresafetyregistry. 207.103.1.Itisthepolicyofthisstateanditsagenciestoimplementasystemto 2reducethenumberofpreventableabortionsinMissouribyassistinganexpectant 3motherinidentifyingandaccessingexistingresourcesfordailyneedsandprenatalcare 4toensurethehealthofboththeexpectantmotherandthechildandfacilitatingthe 5adoptionofachildwhowouldhaveotherwisebeenabortedbyafitandproperperson 6inMissouri.Thedepartmentofsocialservicesshallimplementsuchsystemsubjectto 7thefollowingprinciples: 8 (1)Thesafetyandwelfareofexpectantmothersandchildrenareparamount; 9 (2)Allexpectantmothersandfathersshallbetreatedwithrespectandshallnot 10bepenalizedforseekingservicesfromthedivision; 11 (3)Allprovidersofdirectservicestoexpectantmothers,fathers,andchildren 12shallbeevaluatedinauniform,transparent,objective,andconsistentbasisbasedonan 13evaluationtoolestablishedinthissection; 14 (4)Servicestoexpectantmothersandchildrenshallbeprovidedinatimely 15mannertomaximizetheopportunityforsuccessfuloutcomes,andsuchservicesshallbe 16trackedandroutinelyevaluatedthroughaqualityassuranceprogram; 17 (5)Anyproviderofdirectservicestoexpectantmothers,fathers,andchildren 18shallhavetheappropriateandrelevanttraining,education,andexpertisetoprovidethe HB807 6 19highestqualityofservicespossiblethatshallbeconsistentwithfederalandstate 20standards;and 21 (6)Resourcesandeffortsshallbecommittedtopursuethebestpossible 22opportunityforasuccessfuloutcomeforeachexpectantmotherandchild.Successful 23outcomesmayincludeassistingexpectantmotherswithaccessingavailableresourcesfor 24dailyneedsandprenatalcare,identifyingresourcesandpreparingexpectantmothers, 25fathers,andprospectiveadoptiveparentsfortheadoptionprocess,andtheprovisionof 26continuedassistancetoexpectantmothers,fathers,andprospectiveadoptiveparents 27duringthechildren'sfirstyearoflife. 28 2.(1)Inconjunctionwiththeresponseandevaluationteamestablishedunder 29subsection3ofthissection,aswellasotherindividualsthedivisiondeemsappropriate, 30thedivisionshallestablishanevaluationtoolthatcomplieswithstateandfederal 31guidelines. 32 (2)Theevaluationtoolshallincludemetricssupportingbestpracticesforcase 33managementandserviceprovisionincluding,butnotlimitedto,thefrequencyofface- 34to-facevisitswiththechild. 35 (3)Thereshallbeamechanismwherebyprovidersmayproposedifferent 36evaluationmetricsonacase-by-casebasisifsuchcasemayhavecircumstancesfar 37beyondthosethatwouldbeexpected.Suchcasesshallbeevaluatedbytheresponseand 38evaluationteamundersubsection3ofthissection. 39 (4)Dataregardingallevaluationmetricsshallbecollectedbythedivisionona 40monthlybasis,andthedivisionshallissueaquarterlyreportregardingtheevaluation 41dataforeachprovider,bothpublicandprivate,bycounty.Theresponseandevaluation 42teamshalldeterminehowtoaggregatecasesforthedivisionandlargecontractorsso 43thatperformanceandoutcomesmaybecomparedeffectivelywhilealsoprotecting 44confidentiality.Suchreportsshallbemadepublicandshallincludeinformationby 45county. 46 (5)Thestandardsandmetricsdevelopedthroughthisevaluationtoolshallbe 47usedtoevaluatecompetitivebidsforfuturecontractsestablishedundersubsection4of 48thissection. 49 3.Thedivisionshallcreatearesponseandevaluationteam.Membershipofthe 50teamshallbecomposedofthreestaffmembersfromthedivisionwithexperiencein 51prenatalcare,adoptionproceedings,orcommunityresourcesforexpectantmothers 52appointedbythedirectorofthedivision;twostaffmembersfromthedepartmentof 53socialservicesorchildren'sdivisionappointedbythedirectorofthedepartmentof 54socialservices;fourexpertswithrelatedexperienceinmedical,socialwork,legal,or 55otherrelevantareas,appointedbythegovernor;andonejuvenileorfamilycourtjudge HB807 7 56appointedbytheMissourisupremecourt.Thedivisionshallprovidethenecessary 57staffingfortheteam'soperations.Allmembersshallbeappointedasprovidedinthis 58subsection,andtheteamshallmeetforthefirsttimebeforeJuly1,2026. 59 4.Theteamshall: 60 (1)Reviewtheevaluationtoolandmetricssetforthinsubsection2ofthissection 61onasemiannualbasistodetermineanyadjustmentsneededorissuesthatcouldaffect 62thequalityofsuchtoolsandapproveordenyonacase-by-casebasis: 63 (a)Casesthataproviderfeelsareanomalousandshouldnotbepartof 64developingthecasemanagementtoolundersubsection2ofthissection; 65 (b)Alternativeevaluationmetricsrecommendedbyprovidersbasedonthebest 66interestsoftheexpectantmothersandchildrenundersubsections2and5ofthissection; 67or 68 (c)Reviewandrecommendanystructureforincentivesorotherreimbursement 69strategiesundersubsection6ofthissection; 70 (2)Developandexecuteperiodicproviderevaluationsofcasesmanagedbythe 71divisionandserviceproviderscontractedwiththestatetoprovidecasemanagement 72servicesunderthissectionundertheevaluationtoolcreatedundersubsection2ofthis 73sectiontoensurerequirementsaremet,whichshallinclude,butarenotlimitedto, 74randomfilereviewtoensuredocumentationregardingcasemanagementplansand 75outcomesofcasesaremaintained;and 76 (3)Developasystemforreviewingandworkingwithprovidersidentifiedunder 77subdivision(2)ofthissubsectionorproviderswhorequestsuchassistancefromthe 78divisionwhoshowsignsofperformanceweaknesstoensuretechnicalassistanceand 79otherservicesareofferedtoassisttheprovidersinachievingsuccessfuloutcomesfor 80theircases. 81 5.Thedivisionandanyotherstateagencydeemednecessarybythedivision 82shall,inconsultationwithserviceprovidersandotherrelevantparties,enterintoand 83implementcontractswithqualifiedchildren'sservicesprovidersandagenciestoprovide 84acomprehensiveanddeliberatesystemofservicedeliveryforexpectantmothers, 85fathers,andchildren.Contractsshallbeawardedthroughacompetitiveprocessand 86providedbyqualifiedpublicandprivatenot-for-profitorlimitedliabilitycorporations 87ownedexclusivelybynot-for-profitcorporationchildren'sservicesprovidersand 88agenciesthathave: 89 (1)Aprovenrecordofprovidingresourcestoexpectantmothersandchildren 90withinthestateofMissourithatshallbeconsistentwiththestandardsandpoliciesthat 91shallbeestablisheddivision;and HB807 8 92 (2)Theabilitytoprovidearangeofservicesincluding,butnotlimitedto,case 93managementservices,socialworkservices,recruitmentandretentionservicesfor 94expectantmothersandprospectiveadoptiveparents,andadoptionservices. 95 6.Anycontractsenteredintobythedivisionshallbeinaccordancewithallstate 96andfederallawsandregulationsandshallseektomaximizefundingwhereavailable. 97Children'sservicesprovidersandagenciesundercontractwiththedivisionshallbe 98subjecttoallfederal,state,andlocallawsandregulationsrelatingtotheprovisionof 99suchservicesandshallbesubjecttooversightandinspectionbyappropriatestate 100agenciestoassurecompliancewithstandards,whichshallbeconsistentwithstateor 101federalstandards. 102 7.Thedivisionshallacceptasprimafacieevidenceofcompletionofthe 103requirementsforlicensureundersections210.481to210.511proofthatanagencyis 104accreditedbyanyofthefollowingnationallyrecognizedbodies:theCouncilon 105Accreditation,ChildrenandFamilies,Inc.,ortheJointCommissiononAccreditationof 106Hospitals. 107 8.Paymenttothechildren'sservicesprovidersandagenciesshallbemadebased 108onthereasonablecostsofservices,includingresponsibilitiesnecessarytoexecutethe 109contract.Anyreimbursementincreasesmadethroughenhancedappropriationsfor 110servicesshallbeallocatedtoprovidersregardlessofwhethertheproviderispublicor 111private.Suchincreasesshallbeconsideredadditivetotheexistingcontracts.In 112additiontopaymentsreflectingthecostofservices,contractsshallincludeincentives 113providedinrecognitionofperformancebasedontheevaluationtoolcreatedunder 114subsection2ofthissectionandthecorrespondingsavingsforthestate.Theresponse 115andevaluationteamundersubsection3ofthissectionshallreviewaformulato 116distributesuchpayments,asrecommendedbythedivision. 117 9.Thedivisionshallconsiderimmediateactionsthatareinthebestinterestsof 118expectantmothers,fathers,andchildrenservedincluding,butnotlimitedto,placingthe 119agencyonacorrectiveplan,haltingnewreferrals,transferringcasestoother 120performingproviders,orterminatingtheprovider'scontract.Thedivisionshalltake 121stepsnecessarytoevaluatethenatureoftheissueandactaccordinglyinthemosttimely 122fashionpossible. 123 10.ByJuly1,2026,thedivisionshallpromulgateandhaveineffectrulesto 124implementtheprovisionsofthissectionand,underthissection,shalldefine 125implementationplansanddates.Anyruleorportionofarule,asthattermis 126definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection 127shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof 128chapter536and,ifapplicable,section536.028.Thissectionandchapter536are HB807 9 129nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto 130chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare 5207.103shallhavequalifiedimmunityfromcivilliabilityforprovidingsuchservicesto 6thesameextentthatthedivisionhasqualifiedimmunityfromcivilliabilitywhenthe 10promulgatedbythedivision,oranystatelawdirectlyrelatedtotheprovisionofservices 11bythedivision. 207.105.Thedivisionmayshareanyrecords,information,andfindingswith 2federal,state,orlocalchildwelfareagencypersonnelandlawenforcementagencies, 3includingthosefromoutsidethestate,oranyagentofsuchagencies,intheperformance 4ofthedivision'sduties,uponareasonablebeliefthatsuchinformationisneededto 5protectanexpectantmother,father,orchildfromabuseorneglectortoassistsuch 6agencyinprovidingchildwelfareservices.Suchinformationmayinclude,butisnot 7limitedto: 8 (1)Identifyinginformationaboutanexpectantmother,father,orchild; 9 (2)Familyassessments; 10 (3)Homestudies; 11 (4)Criminalbackgroundandchildabuseorneglectreports;and 12 (5)Anyotherdocumentsorinformationthedivisiondeemsnecessaryfor 13anotheragencytohaveaccesstoinordertoprotectanexpectantmother,father,orchild 14andtoeffectthepolicyofthestateprovidedforinsection207.103. 15 16Identifyinginformationmaybesharedonlyifthedivisionreasonablybelievesthe 17receivingentitywillpreventtheunauthorizeddisseminationoftheinformation 18containedtherein. 207.106.1.Thedivisionshallensuretheconfidentialityofallreportsand 2recordsmadeundersections207.100to207.108andmaintainedbythedivision,itslocal 3offices,thecentralregistry,andotherappropriatepersons,officials,andinstitutions 4undersections207.100to207.108.Toprotecttherightsofexpectantmothers,fathers, HB807 10 5andchildrenparticipatingintheMissouriadoptiveresourcesservicessystem,the 6divisionshallestablishguidelinesthatwillensurethatanydisclosureofinformation 7concerninganyparticipantinthesystemismadeonlytopersonsoragenciesthathavea 8righttosuchinformation.Thedivisionmayrequirepersonstomakewrittenrequests 9foraccesstorecordsmaintainedbythedivision.Thedivisionshallonlyrelease 10informationtopersonswhohavearighttosuchinformation.Thedivisionshallnotify 11personsreceivinginformationundersubdivisions(2),(7),(8),and(9)ofsubsection2of 12thissectionofthepurposeforwhichtheinformationisreleasedandofthepenaltiesfor 13unauthorizeddisseminationofinformation.Suchinformationshallbeusedonlyforthe 14purposeforwhichtheinformationisreleased. 15 2.Onlythefollowingpersonsshallhaveaccesstoinvestigationrecordscontained 16inthecentralregistry: 17 (1)Appropriatefederal,state,orlocalcriminaljusticeagencypersonnel,orany 18agentofsuchentity,withaneedforsuchinformationunderthelawtoprotectchildren 19fromabuseorneglect; 20 (2)Aphysicianoradesignatedagentwhoprovidesprenatalorothermedicalor 21psychologicalcaretoanexpectantmother,father,orchildparticipatingintheMissouri 22adoptiveresourcesservicessystem; 23 (3)Appropriatestaffofthedivisionandofitslocaloffices,including 24interdisciplinaryteamsthatareformedtoassistthedivisionincarryingoutitsduties 25undersections207.100to207.108; 26 (4)Anychildadoptedundertheprovisionsofsections207.100to207.108and 27chapter453.Priortothereleaseofanyidentifyinginformation,thedivisionshall 28determineifthereleaseofsuchidentifyinginformationmayplaceaperson'slifeor 29safetyindanger.Ifthedivisionmakesthedeterminationthataperson'slifeorsafety 30maybeindanger,theidentifyinginformationshallnotbereleased; 31 (5)Agrandjury;juvenileofficer;prosecutingattorney;lawenforcementofficer 32involvedintheinvestigationofchildabuseorneglect;juvenilecourtorothercourt 33conductingabuseorneglectorchildprotectiveproceedingsorchildcustody 34proceedings;andotherfederal,state,andlocalgovernmententities,oranyagentof 35suchentity,withaneedforsuchinformationinordertocarryoutitsresponsibilities 36underthelawtoprotectachildfromabuseorneglect; 37 (6)Anypersonengagedinabonafideresearchpurpose,withthepermissionof 38thedirector;provided,however,thatnoinformationidentifyingtheexpectantmother, 39father,orchildnamedintherecordsshallbemadeavailabletotheresearcherunlessthe 52purposesofprovidingbirthrecordinformationundersection210.156. 53 3.Anypersonwhoknowinglyviolatestheprovisionsofthissection,orwho 54permitsorencouragestheunauthorizeddisseminationofinformationcontainedinthe 55informationsystemorthecentralregistryandinreportsandrecordsmadeunder 56sections207.100to207.108,shallbeguiltyofaclassAmisdemeanor. 57 4.Nothinginthissectionshallprecludethereleaseoffindingsorinformation 58regardingcasesthatresultedinachildfatalityornearfatality.Suchreleaseisatthe 59solediscretionofthedirectorofthedepartmentofsocialservices,baseduponareview 60ofthepotentialharmtootherchildrenwithintheimmediatefamily. 61 5.Notwithstandinganyprovisionsofthissectionorchaptertothecontraryand 62undersection210.115,ifthedivisionreceivesareportoforanydivisionpersonnel 63suspectsthatachildhasbeenormaybesubjectedtoabuseorneglectorobservesa 64childbeingsubjectedtoconditionsorcircumstancesthatwouldreasonablyresultin 65abuseorneglect,thatpersonshallimmediatelyreporttothedivisioninaccordancewith 66theprovisionsofsections210.109to210.183andmayreleasesuchrecordsaswouldbe 67necessarytoproperlyinvestigatesuchallegations. 68 6.Notwithstandingtheprovisionsofsubsection5ofthissection,participationin 69theMissouriadoptiveresourcesservicessystemshallnot,byitself,begroundsfor 70suspicionofchildabuseorneglect. 207.107.1.Thedivisionshallcreateandmaintainadatabaseofexpectant 2mothersandprospectiveadoptiveparentswhohaveregisteredwiththedivisionfor 3participationinthesystemforthepurposesofidentifyingchildrenwhomaybesuitable 4foradoption. 5 2.Thedivisionshallmaintainadatabaseofattorneyswhoareproperlylicensed 6andingoodstandingwiththeMissourisupremecourtandwhowillagreetoprovide HB807 12 7legalservicesinconjunctionwiththeadoptionofchildrenidentifiedthroughthesystem 8undertheprovisionsofsections207.100to207.108. 9 3.ThecontentsoftheMissouriadoptiveresourcesservicessystemdatabase 10createdundersection207.102shallbesubjecttotheconfidentialityrequirements 11providedforinsections207.105and207.106. 207.108.1.Anyemployeeofthedivision,includingsupervisorypersonneland 2children'sservicesprovidersoragenciescontractingwiththedivision,whoisinvolved 3withtheprovisionofservicesundersections207.100to207.108,purposely,knowingly, 4andwillfullyviolatesastatedorwrittenpolicyofthedivision,anyrulepromulgatedby 5thedivision,oranystatelawdirectlyrelatedtotheactivitiesofthedivisionshallbe 6dismissediftheviolationdirectlyresultsinseriousphysicalinjuryordeathofan 7expectantmother,fatherorchild,subjecttotheprovisionsofsubsection2ofthis 8section.Anypersonemployedinapositiondescribedundersubdivision(2)of 9subsection1ofsection36.030,ifany,shallhavetherightofappealundersections36.380 10and36.390. 11 2.Ifanemployeeofthedivisionorchildren'sservicesprovidersoragencies 12contractingwiththedivisionpurposely,knowingly,andwillfullyviolatesastatedor 13writtenpolicyofthedivision,anyrulepromulgatedbythedivision,oranystatelaw 14directlyrelatedtotheactivitiesofthedivisionandtheviolationdirectlyresultsin 15seriousphysicalinjuryordeath,theemployee'sgoodfaitheffortstofollowthestatedor 16writtenpoliciesofthedivision,therulespromulgatedbythedivision,orthestatelaws 17directlyrelatedtotheactivitiesofthedivisionshallbeamitigatingfactorindetermining 18whetheranemployeeofthedivisionoraprivatecontractorwiththedivisionis 19dismissedundersubsection1ofthissection. 453.014.1.Thefollowingpersonsmayplaceaminorforadoption: 2 (1)Thechildren'sdivisionordivisionofmaternalandchildresourcesofthe 3departmentofsocialservices; 4 (2)Achildplacingagencylicensedpursuanttosections210.481to210.536; 5 (3)Thechild'sparents,withoutthedirectorindirectassistanceofanintermediary,in 6thehomeofarelativeofthechildwithinthethirddegree; 7 (4)Anintermediary,whichshallincludeanattorneylicensedpursuanttochapter484; 8aphysicianlicensedpursuanttochapter334;oraclergymanoftheparents. 9 2.Allpersonsgrantedtheauthoritytoplaceaminorchildforadoptionasdesignated 10insubdivision(1),(2)or(4)ofsubsection1ofthissectionshallcomplywiththerulesand 11regulationspromulgatedbythechildren'sdivisionofthedepartmentofsocialservicesfor 12suchplacement.
