intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17thereportisnotfiled,untilthefirstdayafterthedateoftheelection.Aftersuchelectiondate,
18theamountofsuchlatefilingfeeshallaccrueattherateoftendollarsperdaythatsuchreport
19remainsunfiled,exceptasprovidedinsubdivision(2)ofthissubsection.

38amountoflatefilingfeesassessed,attheperson'soption,byfilingapetitionwithinfourteen
39daysafterreceiving[actual] noticeofassessmentwiththeadministrativehearing
40commission,orwithoutexhaustingtheperson'sadministrativeremediesmayseekreview
41ofsuchissueswiththecircuitcourtofColeCounty.
42 5.TheexecutivedirectoroftheMissouriethicscommissionshallcollectsuchlate
43filingfeesasareprovidedforinthissection.Unpaidlatefilingfeesshallbecollectedby
44actionfiledbythecommission.Thecommissionshallcontractwiththeappropriateentityto
45collectsuchlatefilingfeesafterathirty-daydelinquency.Ifnotcollectedwithinonehundred
46twentydays,theMissouriethicscommissionshallfileapetitioninColeCountycircuitcourt
47toseekajudgmentonsaidfees.Alllatefilingfeescollectedpursuanttothissectionshallbe
48transmittedtothestatetreasureranddepositedtothegeneralrevenuefund.
49 6.Thelatefilingfeesprovidedbythissectionshallbeinadditiontoanypenalty
50providedbylawforviolationsofsections105.483to105.492orchapter130.
51 7.Ifanycandidatefailstofileacampaigndisclosurereportinatimelymannerand
52thatcandidateisassessedalatefilingfee,thecandidate,candidatecommitteetreasureror
53assistanttreasurermayfileanappealoftheassessmentofthelatefilingfeewiththe
HB85	2 54commission.Thecommissionmayforgivetheassessmentofthelatefilingfeeupona
55showingofgoodcause.Suchappealshallbefiledwithintendaysofthereceiptofnoticeof
56theassessmentofthelatefilingfee.
143.611.1.Assoonaspracticalafterthereturnisfiled,thedirectorofrevenueshall
2examineittodeterminethecorrectamountoftax.Ifthedirectorofrevenuefindsthatthe
3amountoftaxshownonthereturnislessthanthecorrectamount,heshallnotifythetaxpayer
4oftheamountofthedeficiencyproposedtobeassessed.Ifthedirectorofrevenuefindsthat
5thetaxpaidismorethanthecorrectamount,heshallcredittheoverpaymentagainstanytaxes
6dueundersections143.011to143.996fromthetaxpayerandrefundthedifference.No
7deficiencyshallbeproposedandnorefundshallbemadepursuanttothisoranysectionof
8sections143.011to143.996unlesstheamountexceedsonedollar.
9 2.Ifthetaxpayerfailstofileanincometaxreturn,thedirectorofrevenueshall
10estimatethetaxpayer'staxableincomeandthetaxthereonfromanyavailableinformationand
11notifythetaxpayeroftheamountproposedtobeassessedasinthecaseofadeficiency.
12 3.Thenoticerequiredbysubsections1and2ofthissection,hereafterreferredtoasa
13noticeofdeficiency,shallsetforththereasonfortheproposedassessment.Fortaxpayers
14otherthanindividuals,thenoticeofdeficiencyshallbemailedbycertifiedorregistered
15mailtothetaxpayerathislastknownaddressordeliveredelectronicallyatthetaxpayer's
16request. Fortaxpayersthatareindividuals,thenoticeofdeficiencymaybemailedby
17registeredmailordeliveredelectronicallyatthetaxpayer’srequest.Inthecaseofa
18combinedreturn,thenoticeofdeficiencymaybeasinglecombinednoticeexceptthatifthe
19directorofrevenueisnotifiedbyeitherspousethatseparateresidenceshavebeenestablished
20heshallmailnoticestoeachspouse.Ifthetaxpayerisdeceased,isunderalegaldisability,or,
21inthecaseofacorporation,hasterminateditsexistence,anoticeofdeficiencymaybemailed
22tohislastknownaddressunlessthedirectorofrevenuehasreceivednoticeoftheexistence
23andaddressofapersontoreceivenoticeswithrespecttosuchtaxpayer.
209.030.1.Everyadultblindperson,eighteenyearsofageorover,ofgoodmoral
2characterwhoshallhavebeenaresidentofthestateofMissouriforoneyearormorenext
3precedingthetimeofmakingapplicationforthepensionhereinprovidedandeveryadult
4blindpersoneighteenyearsofageoroverwhomayhavelosthisorhersightwhileabona
5fideresidentofthisstateandwhohasbeenacontinuousresidentthereofsincesuchlossof
6sight,shallbeentitledtoreceive,whenenrolledundertheprovisionsofsections209.010to
7209.160,anannualpensionasprovidedforherein,payableinequalmonthlyinstallments,
8provided,thatnosuchpersonshallbeentitledtoorbepaidablindpensionwho:
9 (1)Ownspropertyorhasaninterestinpropertytothevalueofthirtythousanddollars
10ormore,orifmarriedandactuallylivingwithhusbandorwife,ifthevalueofhisorher
11interestinproperty,togetherwiththatofsuchhusbandorwife,exceedssaidamount;
HB85	3 12providedthat,thefirstonehundredthousanddollarsinanindividual'sABLEaccountunder
13sections209.600to209.645shallbeexcludedfromsuchassetlimit;provided,further,thatin
14determiningthetotalvalueofpropertyowned,therealestateoccupiedbytheblindpersonor
15spouseasthehome,shallbeexcluded;
16 (2)Obtains,maintains,orrenewsavaliddriver'slicenseinthisoranyotherstateor
17territory,unlesssuchlicensehasbeenrelinquishedtothedepartmentofrevenueandthe
18personprovidessatisfactoryproofofsuchrelinquishmenttothedepartmentofsocialservices.
19Thedepartmentofsocialservicesshallnotifyeligibleblindpersonswithvaliddriver's
20licensesthattheyshallsurrendersuchlicenseswithinsixtydaysofapprovalforablind
21pension.Uponreceiptofarelinquishedlicenseunderthissubdivision,thedepartmentof
22revenueshall,ifrequestedbytheperson,issueanondriver'slicensecardcompliantwiththe
23provisionsofchapter302atnochargetotheperson.Thedepartmentofsocialservicesand
24thedepartmentofrevenueshalljointlyestablishproceduresandshallshareanyinformation
25necessarytoimplementthissubdivision;
26 (3)Operatesamotorvehiclewithorwithoutavaliddriver'slicense;
27 (4)Hasasightedspouseresidentinthisstatewhoupontheinvestigationofthe
28familysupportdivisionmaybefoundtobeabletoprovideforthereasonablesupportofsuch
29applicantifthesightedspouse'sannualincomeisequaltoorgreaterthanfivehundredpercent
30ofthefederalpovertylevelforeachstatefiscalyear;
31 (5)Publiclysolicitsalmsinanymannerorthroughanyartificeinanypartofthis
32state;
33 (6)Ismaintainedinaprivateorendowedinstitutionorisaninmateofapublic
34institution,exceptasapatientinapublicmedicalinstitution[;], provided[,] thatbenefitsshall
35notbepaidtoablindpersonundersixty-fiveyearsofage,whoisapatientinaninstitution
36formentaldiseasesortuberculosis.Inordertocomplywithfederallawsandregulationsand
37stateplansinmakingpaymentstooronbehalfofmentallyillindividualssixty-fiveyearsof
38age,orover,whoarepatientsinastatementalinstitution,thefamilysupportdivisionshall
39requireagreementsorotherarrangementswiththeinstitutiontoprovideaframeworkfor
40cooperationandtoassurethatstateplanrequirementsandfederallawsandregulations
41relatingtosuchpaymentwillbeobserved.Intheeventthefederallawsorregulationswill
42notpermitapprovalofthestateplanforbenefitpaymentstooronbehalfofanindividualwho
43issixty-fiveyearsofage,orover,andisapatientinastateinstitutionformentaldiseases,this
44portionofthissubdivisionshallbeinoperativeuntilapprovalofastateplanisobtained;
45 (7)Isotherwisenotblindandnoteligibleforablindpensionunderthischapter;or
46 (8)Pleadsguiltyorhasbeenfoundtohaveviolatedsection209.140.
47 2.Anyapplicantfororanyrecipientofablindpensionwhodoesnotsubmit,without
48goodcauseorasotherwisespecifiedbythedepartmentofsocialservices,toavisiontestas
HB85	4 49requiredundersection209.040withinthirtydaysofarequestbythedepartmentshallnotbe
50eligibleforablindpensionandthedepartmentshallterminatepaymentafternoticeandan
51opportunityforahearing.
52 3.Theapplicantfororrecipientofablindpensionshallinformthedepartmentofany
53changeofaddressorothercontactinformationandanyotherchangeofcircumstancesthat
54mayimpacttheapplicantorrecipient'seligibilityforablindpensionwithintendaysofthe
55change.Anynoticeservedontheapplicantorrecipientshallbesentby[certified] mail
56deliveredbytheUnitedStatesPostalServiceattheapplicant'sorrecipient'saddressofrecord
57andshallbedeemedserviceforallpurposesundersections209.010to209.160, exceptthat
