Torepealsection302.181,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
driver'sandnondriver'slicensesforUnitedStatescitizens.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section302.181,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection302.181,toreadasfollows:
302.181.1.Thelicenseissuedpursuanttotheprovisionsofsections302.010to
2302.340shallbeinsuchformasthedirectorshallprescribe,butthelicenseshallbeacard
3madeofplasticorothercomparablematerial.Alllicensesshallbemanufacturedofmaterials
4andprocessesthatwillprohibit,asnearlyaspossible,theabilitytoreproduce,alter,
5counterfeit,forge,orduplicateanylicensewithoutreadydetection.Thelicenseshallalso
6beartheexpirationdateofthelicense,theclassificationofthelicense,thename,dateofbirth,
7residenceaddressincludingthecountyofresidenceoracodenumbercorrespondingtosuch
8countyestablishedbythedepartment,andbriefdescriptionandcoloreddigitizedimageofthe
9licensee,andafacsimileofthesignatureofthelicensee.Thedirectorshallprovideby
10administrativeruletheprocedureandformatforalicenseetoindicateonthebackofthe
11licensetogetherwiththedesignationforananatomicalgiftasprovidedinsection194.240the
12nameandaddressofthepersondesignatedpursuanttosections404.800to404.865asthe
13licensee'sattorneyinfactforthepurposesofadurablepowerofattorneyforhealthcare
14decisions.Nolicenseshallbevaliduntilithasbeensosignedbythelicensee.Ifanyportion
15ofthelicenseispreparedbyaprivatefirm,anycontractwithsuchfirmshallbemadein
16accordancewiththecompetitivepurchasingproceduresasestablishedbythestatedirectorof
17thedivisionofpurchasing.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 2.Alldigitalimagesproducedforlicensesshallbecomethepropertyofthe
19departmentofrevenue.
20 3.Thelicenseissuedshallbecarriedatalltimesbytheholderthereofwhiledrivinga
21motorvehicle,andshallbedisplayedupondemandofanyofficerofthehighwaypatrol,or
22anypoliceofficerorpeaceofficer,oranyotherdulyauthorizedperson,forinspectionwhen
23demandismadetherefor.Failureofanyoperatorofamotorvehicletoexhibithisorher
24licensetoanydulyauthorizedofficershallbepresumptiveevidencethatsuchpersonisnota
25dulylicensedoperator.
26 4.Thedirectorofrevenueshallnotissuealicensewithoutafacialdigitalimageof
27thelicenseapplicant,exceptasprovidedpursuanttosubsection7ofthissection.Adigital
28imageoftheapplicant'sfullfacialfeaturesshallbetakeninamannerprescribedbythe
29director.Nodigitalimageshallbetakenwearinganythingwhichcloaksthefacialfeaturesof
30theindividual.
31 5.Thedepartmentofrevenuemayissueatemporarylicenseorafulllicensewithout
32thephotographorwiththelastphotographordigitalimageinthedepartment'srecordsto
33membersoftheArmedForces,exceptthatwheresuchtemporarylicenseisissueditshallbe
34validonlyuntiltheapplicantshallhavehadtimetoappearandhavehisorherpicturetaken
35andalicensewithhisorherphotographissued.
36 6.Thedepartmentofrevenueshallissueuponrequestanondriver'slicensecard
37containingessentiallythesameinformationandphotographordigitalimage,exceptas
38providedpursuanttosubsection7ofthissection,asthedriver'slicenseuponpaymentofsix
39dollars.Allnondriver'slicensesshallexpireontheapplicant'sbirthdayinthesixthyearafter
40issuance.Apersonwhohaspassedhisorherseventiethbirthdayshalluponapplicationbe
41issuedanonexpiringnondriver'slicensecard.Notwithstandinganyotherprovisionofthis
42chapter,anondriver'slicensecontainingaconcealedcarryendorsementshallexpirethree
43yearsfromthedatethecertificateofqualificationwasissuedpursuanttosection571.101,as
44section571.101existedpriortoAugust28,2013.Thefeefornondriver'slicensesissuedfora
45periodexceedingthreeyearsissixdollarsorthreedollarsfornondriver'slicensesissuedfora
46periodofthreeyearsorless.Thenondriver'slicensecardshallbeusedforidentification
47purposesonlyandshallnotbevalidasalicense.
48 7.Ifotherwiseeligible,anapplicantmayreceiveadriver'slicenseornondriver's
49licensewithoutaphotographordigitalimageoftheapplicant'sfullfacialfeaturesexceptthat
50suchapplicant'sphotographordigitalimageshallbetakenandmaintainedbythedirectorand
51notprintedonsuchlicense.Inordertoqualifyforalicensewithoutaphotographordigital
52imagepursuanttothissectiontheapplicantmust:
53 (1)Presentaformprovidedbythedepartmentofrevenuerequestingtheapplicant's
54photographbeomittedfromthelicenseornondriver'slicenseduetoreligiousaffiliations.
HB861 2 55Theformshallbesignedbytheapplicantandanothermemberofthereligioustenant
56verifyingthephotographordigitalimageexemptiononthelicenseornondriver'slicenseis
57requiredaspartoftheirreligiousaffiliation.Therequiredsignaturesontheprescribedform
58shallbeproperlynotarized;
59 (2)ProvidesatisfactoryprooftothedirectorthattheapplicanthasbeenaUnited
60Statescitizenforatleastfiveyearsandaresidentofthisstateforatleastoneyear,exceptthat
61anapplicantmovingtothisstatepossessingavaliddriver'slicensefromanotherstatewithout
62aphotographshallbeexemptfromtheone-yearstateresidencyrequirement.Thedirector
63mayestablishrulesnecessarytodeterminesatisfactoryproofofcitizenshipandresidency
64pursuanttothissection;
65 (3)Applicationsforadriver'slicenseornondriver'slicensewithoutaphotographor
66digitalimagemustbemadeinpersonatalicenseofficedeterminedbythedirector.The
67directorisauthorizedtolimitthenumberofofficesthatmayissueadriver'sornondriver's
68licensewithoutaphotographordigitalimagepursuanttothissection.
69 8.Thedepartmentofrevenueshallmakeavailable,atoneormorelocationswithin
70thestate,anopportunityforindividualstohavetheirfullfacialphotographtakenbyan
71employeeofthedepartmentofrevenue,ortheirdesignee,whoisofthesamesexasthe
72individualbeingphotographed,inasegregatedlocation.
73 9.BeginningJuly1,2005,thedirectorshallnotissueadriver'slicenseora
74nondriver'slicenseforaperiodthatexceedsanapplicant'slawfulpresenceintheUnited
75States.Thedirectormay,byruleorregulation,establishprocedurestoverifythelawful
76presenceoftheapplicantandestablishthedurationofanydriver'slicenseornondriver's
77licenseissuedunderthissection.
78 10.(1)Notwithstandinganybiometricdatarestrictionscontainedinsection302.170,
79thedepartmentofrevenueisherebyauthorizedtodesignandimplementasecuredigital
80driver'slicenseprogramthatallowsapplicantsapplyingforadriver'slicenseinaccordance
81withthischaptertoobtainasecuredigitaldriver'slicenseinadditiontothephysicalcard-
82basedlicensespecifiedinthissection.
83 (2)Adigitaldriver'slicenseasdescribedinthissubsectionshallbeacceptedforall
84purposesforwhichalicense,asdefinedinsection302.010,isused.
85 (3)Thedepartmentmaycontractwithoneormoreentitiestodevelopthesecure
86digitaldriver'slicensesystem.Thedepartmentorentitymaydevelopamobilesoftware
87applicationcapableofbeingutilizedthroughaperson'selectronicdevicetoaccessthe
88person'ssecuredigitaldriver'slicense.
89 (4)Thedepartmentshallsuspend,disable,orterminateaperson'sparticipationinthe
90securedigitaldriver'slicenseprogramif:
HB861 3 91 (a)Theperson'sdrivingprivilegeissuspended,revoked,denied,withdrawn,or
92cancelledasprovidedinthischapter;or
93 (b)Thepersonreportsthattheperson'selectronicdevicehasbeenlost,stolen,or
94compromised.
95 11.BeginningJuly1,2026,anydriver'slicenseornondriver'slicenseissuedtoa
96personwhoisacitizenoftheUnitedStates,includingnaturalizedcitizens,shallhavea
97distinguishingmarkonthefrontofthelicensethatspecifiesthatthelicenseholderisa
98citizenoftheUnitedStates.ThedepartmentofrevenueshallcoordinatewiththeUnited
99StatesDepartmentofStatetoestablishcriteriaforestablishingcitizenstatusanda
100procedureforverifyingstatus.Ifthepersonmeetstheexemptionrequirementsof
101subsection9or11ofsection302.171,andprovidessatisfactoryprooftothedirectorthat
102theapplicanthasbeenaUnitedStatescitizenforatleastfiveyearsandsignsan
103affidavittothateffect,theapplicant'sdriver'slicenseornondriver'slicenseshallhavea
104distinguishingmarkonthefrontofthelicenseandshallbereadableandreferencedbya
105scannablecodeonthebackofthelicensethatspecifiesthatthelicenseholderisacitizen
106oftheUnitedStates.
107 [11.]12.Thedirectorofthedepartmentofrevenuemaypromulgaterulesas
108necessaryfortheimplementationofthissection.Anyruleorportionofarule,asthattermis
109definedinsection536.010thatiscreatedundertheauthoritydelegatedinthissectionshall
110becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536
111and,ifapplicable,section536.028.Thissectionandchapter536arenonseverableandifany
112ofthepowersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
113effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then
114thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2020,
115shallbeinvalidandvoid.
