4andsoldunderstatemilkinspectionandthesamehasalsobeenproducedorpasteurizedas
5requiredbyaregulationauthorizedbysection196.939andunderproperpermitsissued
6thereunder.Onlypasteurizedgradedfluidmilkandfluidmilkproductsasdefinedin
7[subdivision(3)of]section196.931shallbesoldtothefinalconsumer,ortorestaurants,soda
8fountains,grocerystores,orsimilarestablishments;exceptthat:
9 (1)GradeAretailrawmilkorcreamproducedinMissourimaybesoldtoretail
10establishmentsaslongas:
11 (a)ThegradeAretailrawmilkorcreamisclearlylabeled"NOTFORHUMAN
12CONSUMPTION" inlettersatleastone-halfinchheight.Anyrawmilkorrawmilk
13productdispensedshallalsoincludeonitslabelthestatement"ITISNOTLEGALTO
14SELLRAWMILKFORHUMANCONSUMPTION INMISSOURI".Thislabeling
15requirementshallnotapplytorawmilkorrawmilkproductspurchasedfromafarm
16byanindividualfortheindividual'sownuse;and
17 (b)IfthegradeAretailrawmilkorcreamissoldinamannerthatdoesnot
18allowthefinalconsumertoseetheproductwiththelabeldescribedinparagraph(a)of
19thissubdivision,thelabelispresentedtotheconsumerthroughawrittennotice
20availabletothecustomer;and
21 (2)Anindividualwhoisthefinalconsumermaypurchaseandhavedeliveredto
22[him] theindividualfor[his]theindividual'sownuserawmilkorcreamfromafarm.
23 2.NobottlerordistributorofgradeAretailrawmilkorcreamshallexposefor
24sale,transport,ordeliveranymilkinthisstateunlessthemilkhasbeeninspectedbythe
25statemilkboardatanintervalsetbytheboardbutnolessthanquarterly.
26 3.AnydairyfarmproducinggradeAretailrawmilkorcreamshallhaveits
27herdaccreditedorcertifiedbytheUnitedStatesDepartmentofAgricultureasa
28tuberculosis-freeandabrucellosis-freeherd.Whiletheherdisintheprocessof
29qualifyingforsuchUnitedStatesDepartmentofAgricultureaccreditationor
30certification,allanimalsintheherdshallbetestedannuallyfortuberculosisand
31brucellosisuntilsuchherdisaccreditedorcertified.
