HB91	3 3 2.Theboardofnaturopathicmedicineshallconsistoffivemembersappointed
4bythegovernor,allofwhomshallberesidentsofthisstate.Threemembersshallbe
5naturopathicdoctorsasdescribedinsubsection5ofthissection,onemembershallbea
6physicianlicensedunderchapter334,andonemembershallbeapublicmemberas
7describedinsubsection6ofthissection.
8 3.Theinitialmembersoftheboardshallbeappointedforstaggeredterms,the
9longestofwhichshallnotexceedfouryears.Followingtheinitialappointments,all
10termsshallbeforthreeyears,andnomemberoftheboardshallservemorethanthree
11terms.
12 4.Theinitialphysicianmemberlicensedunderchapter334shallhaveatleast
13fouryearsofexperienceinthepracticeofmedicineorosteopathicmedicine.
14 5.(1)Theinitialthreenaturopathicdoctormembersshallhaveatleastfour
15yearsofexperienceinthepracticeofnaturopathicmedicineandshallbeeligibleto
16becomelicensedundersections324.1900to324.1970.
17 (2)Anynaturopathicdoctormemberappointedfollowingtheinitial
18appointmentstotheboardshallbelicensedundersections324.1900to324.1970and
19shallactivelypracticenaturopathicmedicineinthisstateforthedurationofhisorher
20appointment.
21 6.Thepublicmembershallbe,atthetimeofthemember'sappointment,a
22citizenoftheUnitedStates,aresidentofthisstateforaperiodofoneyear,anda
23registeredvoter.Thepublicmembershallnothavebeenamemberofanyprofession
24licensedorregulatedundersections324.1900to324.1970oranimmediatefamily
25memberofsuchaperson.Thepublicmembershallnothavehadamaterialfinancial
26interestintheprovisionofnaturopathicmedicineorinanactivityororganization
27directlyrelatedtoanyprofessionlicensedorregulatedundersections324.1900to
28324.1970.Thedutiesofthepublicmembershallnotincludeanydeterminationofthe
29technicalrequirementstobemetforlicensureorwhetheranycandidateforlicensure
30meetssuchtechnicalrequirementsoranydeterminationofthetechnicalcompetenceor
31technicaljudgmentofalicenseeorcandidateforlicensure.
32 7.Intheeventofdeath,resignation,orremovalofanymemberoftheboard
33beforetheexpirationofthetermtowhichheorshewasappointed,thevacancyshallbe
34filledfortheunexpiredportionoftheterminthesamemannerastheoriginal
35appointment.
36 8.Theboardshall,withinthirtydaysaftertheappointmentofallmembers,and
37atleastannuallythereafter,holdameetingandelectfromitsmembershipachair,avice
38chair,andasecretary.Theboardmayholdadditionalmeetingsasmayberequiredin
39theperformanceofitsdutiesatthecallofthechairoruponthewrittenrequestofany

41leastthreedaysbeforethedateofthemeeting.
42 9.Theboardmayappointsuchcommitteesasitconsidersnecessarytocarryout

45affirmativevoteofamajorityofaquorumoftheboardshallberequiredtocarrya
46motionorresolution,toadoptarule,ortopassameasure.
47 11.Thegovernormayremoveaboardmemberformisconduct,incompetence,
48orneglectofofficialdutiesaftergivingtheboardmemberwrittennoticeofthecharges
49andanopportunitytobeheard.
50 12.Notwithstandinganyotherprovisionoflaw,anyappointedmemberofthe
51boardshallreceiveascompensationanamountestablishedbythedirectorofthe
52division,nottoexceedseventy-fivedollarspermemberperdayforcommissionbusiness
53plusactualandnecessaryexpensesincluding,butnotlimitedto,travelexpenses.The
54directorofthedivisionshallestablishbyruleguidelinesforpayment.Allstaffforthe
55boardshallbeprovidedbythedivision.
324.1915.1.Theboardshalladoptrulesthatarenecessaryorproperforthe
2administrationofsections324.1900to324.1970including,butnotlimitedto,ruleson:
3 (1)Regulatingthelicensureofnaturopathicdoctorsanddeterminingthehours
4ofcontinuingeducationunitsrequiredformaintaininglicensureasanaturopathic
5doctor;
6 (2)Establishingthemannerinwhichrecordsofexaminationsandtreatments
7shallbekeptandmaintained;
8 (3)Establishingstandardsforprofessionalresponsibilityandconduct;
9 (4)Identifyingdisciplinaryactionsandcircumstancesthatrequiredisciplinary
10action;
11 (5)Developingameanstoprovideinformationtoalllicenseesinthestate;

45createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
46complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
47section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
48vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
49effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
50thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
5128,2025,shallbeinvalidandvoid.
324.1920.1.Thereisherebycreatedinthestatetreasurythe"Boardof
2NaturopathicMedicineFund".Allfeesauthorizedtobechargedbytheboardshallbe
3collectedbythedirectorofthedivisionandshallbetransmittedtothedepartmentof
4revenuefordepositinthestatetreasuryforcredittothisfund.Thestatetreasurershall
5becustodianofthefund.Inaccordancewithsections30.170and30.180,thestate
6treasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,upon
HB91	6 7appropriation,moneysinthisfundshallbeusedsolelyinpaymentofexpensesof
8maintainingtheboardandfortheenforcementoftheprovisionsoflawconcerningthe
9practiceofnaturopathicmedicine.
10 2.Notwithstandingtheprovisionsofsection33.080tothecontrary,moneysin
11thisfundshallnotbetransferredandplacedtothecreditofgeneralrevenueuntilthe
12amountinthefundattheendofthebienniumexceedsthreetimestheamountofthe
13appropriationfromthefundfortheprecedingfiscalyear.Theamount,ifany,inthe
14fundthatshalllapseisthatamountinthefundthatexceedstheappropriatemultipleof
15theappropriationsfromthefundfortheprecedingfiscalyear.
16 3.Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
17otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
18creditedtothefund.
324.1925.Theboardshallissuealicensetoanapplicantwho:
2 (1)Isofgoodmoralcharacter,inaccordancewithstandardsestablishedbyrules
3oftheboard;
4 (2)Submits,inaccordancewithrulesoftheboard,thefollowingitemstothe
5board:
6 (a)Anapplicationforlicensuredesignedandapprovedbytheboardand
7submittedinaccordancewithrulesoftheboard;
8 (b)Anapplicationfeesubmittedinanamountandmannerestablishedbyrules
9oftheboard;
10 (c)Evidencethattheapplicanthasgraduatedfromanapprovednaturopathic
11medicaleducationprogram;
12 (d)Evidencethattheapplicanthassuccessfullycompletedaprofessional
13examinationor,forgraduatesofapprovednaturopathicmedicaleducationprogramsin
14theUnitedStatespriortotheexistenceoftheCouncilonNaturopathicMedical
15Education,acompetency-basedstatenaturopathicmedicinelicensingexaminationor
16equivalentCanadianprovinciallicensingexaminationforthepracticeofnaturopathic
17medicineapprovedbytheboard;
18 (e)Evidencethattheapplicanthaspassedapharmacyexaminationauthorized
19byrulesoftheboardandadministeredbytheNorthAmericanBoardofNaturopathic
20Examiners;
21 (f)Evidencethattheapplicanthaspassedastatejurisprudenceexamination
22thatmeetsstandardsestablishedinrulesoftheboard;and
23 (g)Evidenceofprofessionalliabilityinsurance;
24 (3)Isdeterminedbytheboardtobephysicallyandmentallycapableofsafely
25practicingnaturopathicmedicinewithorwithoutreasonableaccommodation;and
HB91	7 26 (4)Hasnothadalicensetopracticenaturopathicmedicineorotherhealthcare
27license,registration,orcertificaterefused,revoked,orsuspendedbyanyother
28jurisdictionforreasonsthatrelatetotheapplicant'sabilitytoskillfullyandsafely
29practicenaturopathicmedicineunlessthatlicense,registration,orcertificationhasbeen
30restoredtogoodstandingbythatjurisdiction.
324.1930.1.Theboardshallestablishbyruleguidelinesforthelicensure
2requirementsdescribedinsection324.1925relatingtograduationfromanapproved
3naturopathicmedicaleducationprogram.Theguidelinesshallmeettherequirementsof
4thissectionandtheboard'sspecificationsfortheeducationofnaturopathicdoctors.
5 2.Therequirementforgraduationfromanapprovednaturopathicmedical
6educationprogramshallbeinterpretedintheguidelinesasrequiring,ataminimum,
7graduationfrom:
8 (1)AnaturopathicmedicaleducationprogramintheUnitedStatesproviding
9thedegreeofdoctorofnaturopathicmedicine,whichshall:
10 (a)Offergraduate-level,full-timedidacticandsupervisedclinicaltraining;
11 (b)Beaccreditedorhaveachievedcandidacystatusforaccreditationbythe
12CouncilonNaturopathicMedicalEducationoranequivalentfederallyrecognized
13accreditingbodyfornaturopathicmedicalprogramsalsorecognizedbytheboard;and
14 (c)Beaninstitutionofhighereducationorpartofaninstitutionofhigher
15educationthatiseitheraccreditedorisacandidateforaccreditationbyaregionalor
16nationalinstitutionalaccreditingagencyrecognizedbytheUnitedStatesSecretaryof
17Education;
18 (2)Adegree-grantinginstitutionofhighereducationthat,priortotheexistence
19oftheCouncilonNaturopathicMedicalEducation,offeredafull-time,structured
20curriculuminbasicsciencesandsupervisedpatientcarecomprisingadoctoral
21naturopathicmedicaleducationrequiringnotlessthanonehundredthirty-twoweeksof
22courseworktobecompletedwithinaperiodofnotlessthanthirty-fivemonths,which
23wasreputableandingoodstandinginthejudgmentoftheboardandwhichifstillin
24existencehascurrentprogrammaticaccreditationbytheCouncilonNaturopathic
25MedicalEducationorafederallyrecognizedequivalentaccreditingagency;
26 (3)Adiploma-granting,degree-equivalentinstitutionofhighereducation
27locatedinCanadathat,priortotheexistenceoftheCouncilonNaturopathicMedical
28Education,hadprovincialapprovalforparticipationingovernment-fundedstudentaid
29programs,offeredafull-time,structuredcurriculuminbasicsciencesandsupervised
30patientcarecomprisingadoctoralnaturopathicmedicaleducationrequiringnotless
31thanonehundredthirty-twoweeksofcourseworktobecompletedwithinaperiodof
32notlessthanthirtymonths,wasreputableandingoodstandinginthejudgmentofthe
HB91	8 33board,andifstillinexistence,hascurrentprogrammaticaccreditationbytheCouncil
34onNaturopathicMedicalEducationorafederallyrecognizedequivalentaccrediting
35agencyandcurrentlyhasprovincialapprovalforparticipationingovernment-funded
36studentaidprograms;or
37 (4)Adiploma-granting,degree-equivalentinstitutionofhighereducation
38locatedinCanadathathasprovincialapprovalforparticipationingovernment-funded
39studentaidprograms,offersgraduate-level,full-timedidacticandsupervisedclinical

324.1935.1.Apersonwhoholdsalicenseundersections324.1900to324.1970
2shalldisplaythelicensee'slicenseinthelicensee'splaceofbusinessinalocationclearly
3visibletothelicensee'spatientsandshallalsodisplayevidenceofthelicenseehaving
4completedanapprovednaturopathicmedicaleducationprogram.
5 2.Apersonwhopractices,conductsaffairs,orisemployedatmorethanone
6locationandwhomaintainsacontinuingactivityasauthorizedbythelicenseshall
7displayaduplicateofsuchdocumentissuedbytheboardateachlocation.
324.1940.Alicenseemaypracticenaturopathicmedicinetoprovideprimary
2careinalignmentwithnaturopathicmedicaleducationby:
3 (1)Performingcommondiagnosticprocedures;
4 (2)Administering,dispensing,andorderingnaturopathictherapies;
5 (3)Recommending,prescribing,administering,dispensing,andordering:
6 (a)Alllegenddrugsandover-the-counterdrugs;
7 (b)ControlledsubstanceswithinSchedulesIII,IV,andVofsection195.017,
8excludingallopioidsandopioidderivatives;and
9 (c)Durablemedicalequipmentanddevices;
10 (4)Administeringsubstancesauthorizedforintradermal,subcutaneous,
11intramuscular,intravenous,ligamentous,tendinous,periarticular,intra-articular,

324.1945.Anaturopathicdoctorwhoprescribesinaccordancewithsection
2324.1940shall:
3 (1)Recordeachprescriptionorderinwriting,whichmayincludean
4electronicallyrecordedandtransmittedcommunication.Theordershallincludethe
5name,address,andtelephonenumberofthenaturopathicdoctor;
6 (2)Prescribeonlywhenthenaturopathicdoctorhasadequateeducation,
7training,andexperiencetosafelymanagethemedicalregimen;and
8 (3)RegisterwiththeUnitedStatesDrugEnforcementAdministration(DEA)in
9ordertoprescribecontrolledsubstancesauthorizedbysections324.1900to324.1970.
324.1950.Alicenseeshallrefertoaphysicianlicensedandauthorizedtoengage
2inthepracticeofmedicineasdescribedinsection334.010anypatientwhosemedical
3conditionshould,atthetimeofevaluationortreatment,bedeterminedtobebeyondthe
4scopeofpracticeofthelicensee.
324.1955.Alicenseeshallnot:
2 (1)Performmajorsurgery;
3 (2)Usegeneralorspinalanesthetics;
4 (3)Administerionizingradioactivesubstancesfortherapeuticpurposes;
5 (4)Performasurgicalprocedureusingalaserdevice;
6 (5)Performasurgicalprocedureinvolvinganyofthefollowingareasofthebody
7thatextendsbeyondsuperficialtissue:eyes,ears,tendons,nerves,veins,orarteries;
8 (6)Performasurgicalormedicalabortion;

10licenseeoradulylicensedprofessionalintheinstructedfield;
