4444 190.109.1.Thedepartmentshall,withinareasonabletimeafterreceiptofan
4545 2application,causesuchinvestigationasthedepartmentdeemsnecessarytobemadeofthe
4646 3applicantforagroundambulancelicense.
4747 4 2.AnypersonthatownedandoperatedalicensedambulanceonDecember31,1997,
4848 5shallreceiveanambulanceservicelicensefromthedepartment,unlesssuspended,revokedor
4949 6terminated,forthatambulanceserviceareawhichwas,onDecember31,1997,describedand
5050 7filedwiththedepartmentastheprimaryserviceareaforitslicensedambulancesonAugust
5151 828,1998,providedthatthepersonmakesapplicationandadherestotherulesandregulations
5252 9promulgatedbythedepartmentpursuanttosections190.001to190.245.
5353 10 3.Thedepartmentshallissueanewgroundambulanceservicelicensetoan
5454 11ambulanceservicethatisnotcurrentlylicensedbythedepartment,oriscurrentlylicensedby
5555 12thedepartmentandisseekingtoexpanditsambulanceservicearea,exceptasprovidedin
5656 13subsection4ofthissection,tobevalidforaperiodoffiveyears,unlesssuspended,revoked
5757 14orterminated,whenthedirectorfindsthattheapplicantmeetstherequirementsofambulance
5858 15servicelicensureestablishedpursuanttosections190.100to190.245andtherulesadoptedby
5959 16thedepartmentpursuanttosections190.001to190.245.Inordertobeconsideredforanew
6060 17ambulanceservicelicense,anambulanceserviceshallsubmittothedepartmentaletterof
6161 18endorsementfromeachambulancedistrictorfireprotectiondistrictthatisauthorizedto
6262 19provideambulanceservice,orfromeachmunicipalitynotwithinanambulancedistrictorfire
6363 20protectiondistrictthatisauthorizedtoprovideambulanceservice,inwhichtheambulance
6464 21serviceproposestooperate.Ifanambulanceserviceproposestooperateinunincorporated
6565 22portionsofacountynotwithinanambulancedistrictorfireprotectiondistrictthatis
6666 HB922 2 23authorizedtoprovideambulanceservice,inordertobeconsideredforanewambulance
6767 24servicelicense,theambulanceserviceshallsubmittothedepartmentaletterofendorsement
6868 25fromthecounty.Anyletterofendorsementrequiredpursuanttothissectionshallverifythat
6969 26thepoliticalsubdivisionhasconductedapublichearingregardingtheendorsementandthat
7070 27thegoverningbodyofthepoliticalsubdivisionhasadoptedaresolutionapprovingthe
7171 28endorsement.Theletterofendorsementshallaffirmativelystatethattheproposedambulance

7373 30 (1)Willprovideabenefittopublichealththatoutweighstheassociatedcosts;
7474 31 (2)Willmaintainorenhancethepublic'saccesstoambulanceservices;
7575 32 (3)Willmaintainorimprovethepublichealthandpromotethecontinued
7676 33developmentoftheregionalemergencymedicalservicesystem;
7777 34 (4)Hasdemonstratedtheappropriateexpertiseintheoperationofambulance
7878 35services;and
7979 36 (5)Hasdemonstratedthefinancialresourcesnecessaryfortheoperationofthe
8080 37proposedambulanceservice.
8181 38 4.Acontractbetweenapoliticalsubdivisionandalicensedambulanceserviceforthe
8282 39provisionofambulanceservicesforthatpoliticalsubdivisionshallexpand,withoutfurther
8383 40actionbythedepartment,theambulanceserviceareaofthelicensedambulanceserviceto
8484 41includethejurisdictionalboundariesofthepoliticalsubdivision.Theterminationofthe
8585 42aforementionedcontractshallresultinareductionofthelicensedambulanceservice's
8686 43ambulanceserviceareabyremovingthegeographicareaofthepoliticalsubdivisionfromits
8787 44ambulanceservicearea,exceptthatlicensedambulanceserviceprovidersmayprovide
