2MissouriresidentornationaloftheUnitedStatesoranoncitizenwithalawfulimmigration
3status,andaMissouriresidentbeforeacceptingtheapplication.Thedirectorshallnotissuea
4driver'slicenseforaperiodthatexceedsthedurationofanapplicant'slawfulimmigration
5statusintheUnitedStates.ThedirectormayestablishprocedurestoverifytheMissouri
6residencyorUnitedStatesnaturalizationorlawfulimmigrationstatusandMissouriresidency
7oftheapplicantandestablishthedurationofanydriver'slicenseissuedunderthissection.An

11mailingaddressoftheapplicant,andtheclassificationforwhichtheapplicanthasbeen
12licensed,and,ifso,whenandbywhatstate,andwhetherornotsuchlicensehaseverbeen
13suspended,revoked,ordisqualified,and,ifrevoked,suspendedordisqualified,thedateand
14reasonforsuchsuspension,revocationordisqualificationandwhethertheapplicantis
15makingaoneormoredollardonationtopromoteanorgandonationprogramasprescribedin
16subsection2ofthissection,topromoteablindnesseducation,screeningandtreatment
17programasprescribedinsubsection3ofthissection,ortheMissourimedalofhonor
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18recipientsfundprescribedinsubsection4ofthissection.Adriver'slicense,nondriver's
19license,orinstructionpermitissuedunderthischaptershallcontaintheapplicant'slegalname
20asitappearsonabirthcertificateoraslegallychangedthroughmarriageorcourtorder.No
21namechangebycommonusagebasedoncommonlawshallbepermitted.Theapplication
22shallalsocontainsuchinformationasthedirectormayrequiretoenablethedirectorto
23determinetheapplicant'squalificationfordrivingamotorvehicle;andshallstatewhetheror
24nottheapplicanthasbeenconvictedinthisoranyotherstateforviolatingthelawsofthisor
25anyotherstateoranyordinanceofanymunicipality,relatingtodrivingwithoutalicense,
26carelessdriving,ordrivingwhileintoxicated,orfailingtostopafteranaccidentand
27disclosingtheapplicant'sidentity,ordrivingamotorvehiclewithouttheowner'sconsent.
28Theapplicationshallcontainacertificationbytheapplicantastothetruthofthefactsstated
29therein.Everypersonwhoappliesforalicensetooperateamotorvehiclewhoislessthan
30twenty-oneyearsofageshallbeprovidedwitheducationalmaterialsrelatingtothehazardsof
31drivingwhileintoxicated,includinginformationonpenaltiesimposedbylawforviolationof
32theintoxication-relatedoffensesofthestate.BeginningJanuary1,2001,iftheapplicantis
33lessthaneighteenyearsofage,theapplicantmustcomplywithallrequirementsforthe
34issuanceofanintermediatedriver'slicensepursuanttosection302.178.Forpersons
35mobilizedanddeployedwiththeUnitedStatesArmedForces,anapplicationunderthis
36subsectionshallbeconsideredsatisfactorybythedepartmentofrevenueifitissignedbya
37personwhoholdsgeneralpowerofattorneyexecutedbythepersondeployed,providedthe
38applicantmeetsallotherrequirementssetbythedirector.
39 (2)Notwithstandingsubdivision(1)ofthissubsectionandanyotherlawtothe
40contrary,applicantsfornon-REALIDcompliantdriver'slicensesornondriver's
41licenseswhohaveneverhadaSocialSecuritynumberandwhoareUnitedStates
42citizensmaysubmitanaffidavitaffirmingcitizenshipinlieuofprovidingaSocial
43Securitynumbertothedirector.Theaffidavitshallstate:
44 "IdeclareunderpenaltyofperjuryunderthelawsoftheUnitedStatesthatthe
45followingistrueandcorrect:IhaveneverbeenissuedaSocialSecuritynumberbythe
46SocialSecurityAdministrationandIamacitizenoftheUnitedStates.".
47 2.Anapplicantforalicensemaymakeadonationofanamountnotlessthanone
48dollartopromoteanorgandonorprogram.Thedirectorofrevenueshallcollectthedonations
49anddepositallsuchdonationsinthestatetreasurytothecreditoftheorgandonorprogram
50fundestablishedinsections194.297to194.304.Moneysintheorgandonorprogramfund
51shallbeusedsolelyforthepurposesestablishedinsections194.297to194.304exceptthat

68departmentofhealthandseniorservicesbyapplicationonthedepartmentofhealthandsenior
69services'website.Uponreceiptofanorgandonorstickersentbythedepartmentofhealthand
70seniorservices,theapplicantshallplacethestickeronthebackofhisorherdriver'slicenseor
71identificationcardtoindicatethatheorshehasmadeananatomicalgift.Thedirectorshall
72notifythedepartmentofhealthandseniorservicesofinformationobtainedfromapplicants
73whoindicatetothedirectorthattheyareinterestedinregistryparticipation,andthe
74departmentofhealthandseniorservicesshallenterthecompletename,address,dateofbirth,
75race,genderandauniquepersonalidentifierintheregistryestablishedinsubsection1of
76section194.304.
77 3.Anapplicantforalicensemaymakeadonationofonedollartopromotea
78blindnesseducation,screeningandtreatmentprogram.Thedirectorofrevenueshallcollect
79thedonationsanddepositallsuchdonationsinthestatetreasurytothecreditoftheblindness
80education,screeningandtreatmentprogramfundestablishedinsection209.015.Moneysin
81theblindnesseducation,screeningandtreatmentprogramfundshallbeusedsolelyforthe
82purposesestablishedinsection209.015;exceptthatthedepartmentofrevenueshallretainno
83morethanonepercentforitsadministrativecosts.Thedonationprescribedinthissubsection
84isvoluntaryandmayberefusedbytheapplicantforthelicenseatthetimeofissuanceor
85renewalofthelicense.Thedirectorshallinquireofeachapplicantatthetimethelicensee
86presentsthecompletedapplicationtothedirectorwhethertheapplicantisinterestedin
87makingtheonedollardonationprescribedinthissubsection.
88 4.AnapplicantforregistrationmaymakeadonationofonedollartotheMissouri
89medalofhonorrecipientsfund.Thedirectorofrevenueshallcollectthedonationsand
90depositallsuchdonationsinthestatetreasurytothecreditoftheMissourimedalofhonor
91recipientsfundasestablishedinsection226.925.Moneysinthemedalofhonorrecipients
HCSHB950	3 92fundshallbeusedsolelyforthepurposesestablishedinsection226.925,exceptthatthe
93departmentofrevenueshallretainnomorethanonepercentforitsadministrativecosts.The
94donationprescribedinthissubsectionisvoluntaryandmayberefusedbytheapplicantfor
95registrationatthetimeofissuanceorrenewal.Thedirectorshallinquireofeachapplicantat
96thetimetheapplicantpresentsthecompletedapplicationtothedirectorwhethertheapplicant
97isinterestedinmakingtheonedollardonationprescribedinthissubsection.
98 5.BeginningJuly1,2005,thedirectorshalldenythedrivingprivilegeofanyperson
99whocommitsfraudordeceptionduringtheexaminationprocessorwhomakesapplication
100foraninstructionpermit,driver'slicense,ornondriver'slicensewhichcontainsoris
101substantiatedwithfalseorfraudulentinformationordocumentation,orwhoknowingly
102concealsamaterialfactorotherwisecommitsafraudinanysuchapplication.Theperiodof
103denialshallbeoneyearfromtheeffectivedateofthedenialnoticesentbythedirector.The
104denialshallbecomeeffectivetendaysafterthedatethedenialnoticeismailedtotheperson.
105Thenoticeshallbemailedtothepersonatthelastknownaddressshownontheperson's
106drivingrecord.Thenoticeshallbedeemedreceivedthreedaysaftermailingunlessreturned
107bythepostalauthorities.Nosuchindividualshallreapplyforadriver'sexamination,
108instructionpermit,driver'slicense,ornondriver'slicenseuntiltheperiodofdenialis
109completed.Noindividualwhoisdeniedthedrivingprivilegeunderthissectionshallbe
110eligibleforalimiteddrivingprivilegeissuedundersection302.309.
111 6.Allappealsofdenialsunderthissectionshallbemadeasrequiredbysection
112302.311.
113 7.Theperiodoflimitationforcriminalprosecutionunderthissectionshallbe
114extendedundersubdivision(1)ofsubsection3ofsection556.036.
115 8.Thedirectormaypromulgaterulesandregulationsnecessarytoadministerand
116enforcethissection.Noruleorportionofarulepromulgatedpursuanttotheauthorityofthis
117sectionshallbecomeeffectiveunlessithasbeenpromulgatedpursuanttochapter536.
118 9.Notwithstandinganyprovisionofthischapterthatrequiresanapplicanttoprovide
119proofofMissouriresidencyforrenewalofanoncommercialdriver'slicense,noncommercial

124 10.Notwithstandinganyprovisionofthischapter,fortherenewalofa
125noncommercialdriver'slicense,noncommercialinstructionpermit,ornondriver'slicense,a
126photocopyofanapplicant'sUnitedStatesbirthcertificatealongwithanotherformof
127identificationapprovedbythedepartmentofrevenue,including,butnotlimitedto,United
HCSHB950	4 128StatesmilitaryidentificationorUnitedStatesmilitarydischargepapers,shallconstitute
129sufficientproofofMissouricitizenship.
130 11.Notwithstandinganyotherprovisionofthischapter,ifanapplicantdoesnotmeet
131therequirementsofsubsection9ofthissectionanddoesnothavetherequireddocumentsto
132proveMissouriresidency,UnitedStatesnaturalization,orlawfulimmigrationstatus,the
133departmentmayissueaone-yeardriver'slicenserenewal.Thisone-timerenewalshallonly
134beissuedtoanapplicantwhopreviouslyhasheldaMissourinoncommercialdriver'slicense,
135noncommercialinstructionpermit,ornondriver'slicenseforaperiodoffifteenyearsormore
136andwhodoesnothavetherequireddocumentstoproveMissouriresidency,UnitedStates
137naturalization,orlawfulimmigrationstatus.Aftertheexpirationoftheone-yearperiod,no
138furtherrenewalshallbeprovidedwithouttheapplicantproducingproofofMissouri
139residency,UnitedStatesnaturalization,orlawfulimmigrationstatus.
302.181.1.Thelicenseissuedpursuanttotheprovisionsofsections302.010to
2302.340shallbeinsuchformasthedirectorshallprescribe,butthelicenseshallbeacard
3madeofplasticorothercomparablematerial.Alllicensesshallbemanufacturedofmaterials
4andprocessesthatwillprohibit,asnearlyaspossible,theabilitytoreproduce,alter,
5counterfeit,forge,orduplicateanylicensewithoutreadydetection.Thelicenseshallalso
6beartheexpirationdateofthelicense,theclassificationofthelicense,thename,dateofbirth,
7residenceaddressincludingthecountyofresidenceoracodenumbercorrespondingtosuch
8countyestablishedbythedepartment,andbriefdescriptionandcoloreddigitizedimageofthe
9licensee,andafacsimileofthesignatureofthelicensee.Thedirectorshallprovideby
10administrativeruletheprocedureandformatforalicenseetoindicateonthebackofthe
11licensetogetherwiththedesignationforananatomicalgiftasprovidedinsection194.240the
12nameandaddressofthepersondesignatedpursuanttosections404.800to404.865asthe
13licensee'sattorneyinfactforthepurposesofadurablepowerofattorneyforhealthcare
14decisions.Nolicenseshallbevaliduntilithasbeensosignedbythelicensee.Ifanyportion
15ofthelicenseispreparedbyaprivatefirm,anycontractwithsuchfirmshallbemadein
16accordancewiththecompetitivepurchasingproceduresasestablishedbythestatedirectorof
17thedivisionofpurchasing.
18 2.Alldigitalimagesproducedforlicensesshallbecomethepropertyofthe
19departmentofrevenue, exceptthatapplicantsfornon-REALIDcompliantdriver's
20licensesornondriver'slicensesmayrequestthatthedepartmentnotretainphotographs
21takenduringtheapplicationprocessandthedepartmentshallberequiredtocomply
22withsuchrequests.
23 3.Thelicenseissuedshallbecarriedatalltimesbytheholderthereofwhiledrivinga
24motorvehicle,andshallbedisplayedupondemandofanyofficerofthehighwaypatrol,or
25anypoliceofficerorpeaceofficer,oranyotherdulyauthorizedperson,forinspectionwhen
HCSHB950	5 26demandismadetherefor.Failureofanyoperatorofamotorvehicletoexhibithisorher
27licensetoanydulyauthorizedofficershallbepresumptiveevidencethatsuchpersonisnota
28dulylicensedoperator.
29 4.Thedirectorofrevenueshallnotissuealicensewithoutafacialdigitalimageof
30thelicenseapplicant,exceptasprovidedpursuanttosubsection7ofthissection.Adigital
31imageoftheapplicant'sfullfacialfeaturesshallbetakeninamannerprescribedbythe
32director.Nodigitalimageshallbetakenwearinganythingwhichcloaksthefacialfeaturesof
33theindividual.Notwithstandinganyprovisionoflawtothecontrary,thedepartment
34shallnotutilizefacialrecognitioncameraswhenproducingnon-REALIDcompliant
35driver'slicensesornondriver'slicenses.
36 5.Thedepartmentofrevenuemayissueatemporarylicenseorafulllicensewithout
37thephotographorwiththelastphotographordigitalimageinthedepartment'srecordsto
38membersoftheArmedForces,exceptthatwheresuchtemporarylicenseisissueditshallbe
39validonlyuntiltheapplicantshallhavehadtimetoappearandhavehisorherpicturetaken
40andalicensewithhisorherphotographissued.
41 6.Thedepartmentofrevenueshallissueuponrequestanondriver'slicensecard
42containingessentiallythesameinformationandphotographordigitalimage,exceptas
43providedpursuanttosubsection7ofthissection,asthedriver'slicenseuponpaymentofsix
44dollars.Allnondriver'slicensesshallexpireontheapplicant'sbirthdayinthesixthyearafter
45issuance.Apersonwhohaspassedhisorherseventiethbirthdayshalluponapplicationbe
46issuedanonexpiringnondriver'slicensecard.Notwithstandinganyotherprovisionofthis
47chapter,anondriver'slicensecontainingaconcealedcarryendorsementshallexpirethree
48yearsfromthedatethecertificateofqualificationwasissuedpursuanttosection571.101,as
49section571.101existedpriortoAugust28,2013.Thefeefornondriver'slicensesissuedfora
50periodexceedingthreeyearsissixdollarsorthreedollarsfornondriver'slicensesissuedfora
51periodofthreeyearsorless.Thenondriver'slicensecardshallbeusedforidentification
52purposesonlyandshallnotbevalidasalicense.
53 7.Ifotherwiseeligible,anapplicantmayreceiveadriver'slicenseornondriver's
54licensewithoutaphotographordigitalimageoftheapplicant'sfullfacialfeaturesexceptthat
55suchapplicant'sphotographordigitalimageshallbetakenandmaintainedbythedirectorand
56notprintedonsuchlicense.Inordertoqualifyforalicensewithoutaphotographordigital
57imagepursuanttothissectiontheapplicantmust:
58 (1)Presentaformprovidedbythedepartmentofrevenuerequestingtheapplicant's
59photographbeomittedfromthelicenseornondriver'slicenseduetoreligiousaffiliations.
60Theformshallbesignedbytheapplicantandanothermemberofthereligioustenant
61verifyingthephotographordigitalimageexemptiononthelicenseornondriver'slicenseis
HCSHB950	6 62requiredaspartoftheirreligiousaffiliation.Therequiredsignaturesontheprescribedform
63shallbeproperlynotarized;
64 (2)ProvidesatisfactoryprooftothedirectorthattheapplicanthasbeenaUnited
65Statescitizenforatleastfiveyearsandaresidentofthisstateforatleastoneyear,exceptthat
66anapplicantmovingtothisstatepossessingavaliddriver'slicensefromanotherstatewithout
67aphotographshallbeexemptfromtheone-yearstateresidencyrequirement.Thedirector
68mayestablishrulesnecessarytodeterminesatisfactoryproofofcitizenshipandresidency
69pursuanttothissection;
70 (3)Applicationsforadriver'slicenseornondriver'slicensewithoutaphotographor
71digitalimagemustbemadeinpersonatalicenseofficedeterminedbythedirector.The
72directorisauthorizedtolimitthenumberofofficesthatmayissueadriver'sornondriver's
73licensewithoutaphotographordigitalimagepursuanttothissection.
74 8.Thedepartmentofrevenueshallmakeavailable,atoneormorelocationswithin
75thestate,anopportunityforindividualstohavetheirfullfacialphotographtakenbyan
76employeeofthedepartmentofrevenue,ortheirdesignee,whoisofthesamesexasthe
77individualbeingphotographed,inasegregatedlocation.
78 9.BeginningJuly1,2005,thedirectorshallnotissueadriver'slicenseora
79nondriver'slicenseforaperiodthatexceedsanapplicant'slawfulpresenceintheUnited
80States.Thedirectormay,byruleorregulation,establishprocedurestoverifythelawful
81presenceoftheapplicantandestablishthedurationofanydriver'slicenseornondriver's
82licenseissuedunderthissection.
83 10.(1)Notwithstandinganybiometricdatarestrictionscontainedinsection302.170,
84thedepartmentofrevenueisherebyauthorizedtodesignandimplementasecuredigital
85driver'slicenseprogramthatallowsapplicantsapplyingforadriver'slicenseinaccordance
86withthischaptertoobtainasecuredigitaldriver'slicenseinadditiontothephysicalcard-
87basedlicensespecifiedinthissection.
88 (2)Adigitaldriver'slicenseasdescribedinthissubsectionshallbeacceptedforall
89purposesforwhichalicense,asdefinedinsection302.010,isused.
90 (3)Thedepartmentmaycontractwithoneormoreentitiestodevelopthesecure
91digitaldriver'slicensesystem.Thedepartmentorentitymaydevelopamobilesoftware
92applicationcapableofbeingutilizedthroughaperson'selectronicdevicetoaccessthe
93person'ssecuredigitaldriver'slicense.
94 (4)Thedepartmentshallsuspend,disable,orterminateaperson'sparticipationinthe
95securedigitaldriver'slicenseprogramif:
96 (a)Theperson'sdrivingprivilegeissuspended,revoked,denied,withdrawn,or
97cancelledasprovidedinthischapter;or
HCSHB950	7 98 (b)Thepersonreportsthattheperson'selectronicdevicehasbeenlost,stolen,or
99compromised.
100 11.Thedirectorofthedepartmentofrevenuemaypromulgaterulesasnecessaryfor
101theimplementationofthissection.Anyruleorportionofarule,asthattermisdefinedin
102section536.010thatiscreatedundertheauthoritydelegatedinthissectionshallbecome
103effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,if
104applicable,section536.028.Thissectionandchapter536arenonseverableandifanyofthe
105powersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
106effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then
107thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2020,
108shallbeinvalidandvoid.
302.735.1.AnapplicationshallnotbetakenfromanonresidentafterSeptember30,
22005.Theapplicationforacommercialdriver'slicenseshallinclude,butnotbelimitedto,
3theapplicant'slegalname,mailingandresidenceaddress,ifdifferent,aphysicaldescription
4oftheperson,includingsex,height,weightandeyecolor,theperson'sSocialSecurity
5number,dateofbirth, andanyotherinformationdeemedappropriatebythedirector.The
6applicationshallalsorequire,beginningSeptember30,2005,theapplicanttoprovidethe
7namesofallstateswheretheapplicanthasbeenpreviouslylicensedtodriveanytypeof
8motorvehicleduringtheprecedingtenyears.Notwithstandinganyprovisionofthis
9chaptertothecontrary,theSocialSecuritynumberrequirementofthissubsectionshall
10bewaivedfornon-REALIDcompliantlicenses,providedthat:
11 (1)Theapplicantsubmitsanaffidavitasspecifiedundersubdivision(2)of
12subsection1ofsection302.171;and
13 (2)Awaiverofsuchrequirementdoesnotconflictwithanyrequirementunder
14federallaw.
15 2.Acommercialdriver'slicenseshallexpireontheapplicant'sbirthdayinthesixth
16yearafterissuance,unlessthelicensemustbeissuedforashorterperiodduetoother
17requirementsoflaworfortransitionorstaggeringofworkasdeterminedbythedirector,and
18mustberenewedonorbeforethedateofexpiration.Whenapersonchangessuchperson's
19nameanapplicationforaduplicatelicenseshallbemadetothedirectorofrevenue.Whena
20personchangessuchperson'smailingaddressorresidencetheapplicantshallnotifythe
21directorofrevenueofsaidchange,however,noapplicationforaduplicatelicenseisrequired.
22Acommerciallicenseissuedpursuanttothissectiontoanapplicantlessthantwenty-one
23yearsofageandseventyyearsofageandoldershallexpireontheapplicant'sbirthdayinthe
24thirdyearafterissuance,unlessthelicensemustbeissuedforashorterperiodasdetermined
25bythedirector.
HCSHB950	8 26 3.Acommercialdriver'slicensecontainingahazardousmaterialsendorsementissued
27toanapplicantwhoisbetweentheageoftwenty-oneandsixty-nineshallnotbeissuedfora
28periodexceedingfiveyearsfromtheapprovaldateofthesecuritythreatassessmentas
29determinedbytheTransportationSecurityAdministration.

66 13.Foranycourt-orderedsuspensionundersubsection9,10,or11ofthissection,the
67directorofthedepartmentshallimposesuchsuspensionassetforthinthecourtorder.The
68orderofsuspensionshallincludethenameoftheoffender,theoffender'sdriver'slicense
69number,SocialSecuritynumberunlesssuchrequirementiswaivedasprovidedunder
