83 (3)Thepersonhassatisfiedallobligationsrelatingtoanysuchdisposition,including 84thepaymentofanyfinesorrestitution; 85 (4)Thepersondoesnothavechargespending; 86 (5)Thepetitioner'shabitsandconductdemonstratethatthepetitionerisnotathreat 87tothepublicsafetyofthestate;and 88 (6)Theexpungementisconsistentwiththepublicwelfareandtheinterestsofjustice 89warranttheexpungement. 90 91Apleadingbythepetitionerthatsuchpetitionermeetstherequirementsofsubdivisions(5) 92and(6)ofthissubsectionshallcreatearebuttablepresumptionthattheexpungementis 93warrantedsolongasthecriteriacontainedinsubdivisions(1)to(4)ofthissubsectionare 94otherwisesatisfied.Theburdenshallshifttotheprosecutingattorneyorcircuitattorneyto 95rebutthepresumption.Avictimofacrimelistedinthepetitionshallhaveanopportunityto 96beheardatanyhearingheldunderthissection.Acourtmayfindthatthecontinuingimpact 97oftheoffenseuponthevictimrebutsthepresumptionthatexpungementiswarranted. 98 7.Apetitiontoexpungerecordsrelatedtoanarrestforaneligiblecrimemaybemade 99inaccordancewiththeprovisionsofthissectiontoacourtofcompetentjurisdictioninthe 100countywherethepetitionerwasarrestednoearlierthaneighteenmonthsfromthedateof 101arrest;providedthat,duringsuchtime,thepetitionerhasnotbeenchargedandthepetitioner 102hasnotbeenfoundguiltyofanymisdemeanororfelonyoffense. 103 8.Ifthecourtdeterminesthatsuchpersonmeetsallthecriteriasetforthinsubsection 1046ofthissectionforeachofthecrimeslistedinthepetitionforexpungement,thecourtshall 105enteranorderofexpungement.Inallcasesunderthissection,thecourtshallissueanorder 106ofexpungementordismissalwithinsixmonthsofthefilingofthepetition.Acopyofthe 107orderofexpungementshallbeprovidedtothepetitionerandeachentitypossessingrecords 108subjecttotheorder,and,uponreceiptoftheorder,eachentityshallcloseanyrecordinits 109possessionrelatingtoanycrimelistedinthepetition,inthemannerestablishedbysection 110610.120.Therecordsandfilesmaintainedinanyadministrativeorcourtproceedingina 111municipal,associate,orcircuitcourtforanycrimeorderedexpungedunderthissectionshall 112beconfidentialandonlyavailabletothepartiesorbyorderofthecourtforgoodcauseshown. 113ThecentralrepositoryshallrequesttheFederalBureauofInvestigationtoexpungethe 114recordsfromitsfiles. 115 9.Theordershallnotlimitanyofthepetitioner'srightsthatwererestrictedasa 116collateralconsequenceofsuchperson'scriminalrecord,andsuchrightsshallberestored 117uponissuanceoftheorderofexpungement.Exceptasotherwiseprovidedunderthissection, HCS#2HB953 9 118theeffectofsuchordershallbetofullyrestorethecivilrightsofsuchpersontothestatushe 119orsheoccupiedpriortosucharrests,pleas,trials,orconvictionsasifsucheventshadnever 120takenplace.Thisincludesfullyrestoringthecivilrightsofapersontotherighttovote,the 121righttoholdpublicoffice,andtoserveasajuror.Forpurposesof18U.S.C.Section921(a) 122(33)(B)(ii),anorderofexpungementgrantedpursuanttothissectionshallbeconsidereda 123completeremovalofalleffectsoftheexpungedconviction.Exceptasotherwiseprovided 124underthissection,theeffectofsuchordershallbetorestoresuchpersontothestatusheor 125sheoccupiedpriortosucharrests,pleas,trials,orconvictionsasifsucheventshadnever 126takenplace.Nopersonastowhomsuchorderhasbeenenteredshallbeheldthereafterunder 127anyprovisionoflawtobeguiltyofperjuryorotherwisegivingafalsestatementbyreasonof 128hisorherfailuretoreciteoracknowledgesucharrests,pleas,trials,convictions,or 129expungementinresponsetoaninquirymadeofhimorherandnosuchinquiryshallbemade 130forinformationrelatingtoanexpungement,exceptthepetitionershalldisclosetheexpunged 131crimetoanycourtwhenaskedoruponbeingchargedwithanysubsequentcrime.The 132expungedcrimemaybeconsideredaprioroffenseindeterminingasentencetobeimposed 133foranysubsequentoffensethatthepersonisfoundguiltyofcommitting. 134 10.Notwithstandingtheprovisionsofsubsection9ofthissectiontothecontrary,a 135persongrantedanexpungementshalldiscloseanyexpungedcrimewhenthedisclosureof 136suchinformationisnecessarytocompleteanyapplicationfor: 137 (1)Alicense,certificate,orpermitissuedbythisstatetopracticesuchindividual's 138profession; 139 (2)Anylicenseissuedunderchapter313orpermitissuedunderchapter571; 140 (3)Paidorunpaidemploymentwithanentitylicensedunderchapter313,anystate- 141operatedlottery,oranyemergencyservicesprovider,includinganylawenforcementagency; 142 (4)Employmentwithanyfederallyinsuredbankorsavingsinstitutionorcreditunion 143oranaffiliateofsuchinstitutionorcreditunionforthepurposesofcompliancewith12 144U.S.C.Section1829and12U.S.C.Section1785; 145 (5)Employmentwithanyentityengagedinthebusinessofinsuranceoranyinsurer 146forthepurposeofcomplyingwith18U.S.C.Section1033,18U.S.C.Section1034,orother 147similarlawwhichrequiresanemployerengagedinthebusinessofinsurancetoexclude 148applicantswithcertaincriminalconvictionsfromemployment;or 149 (6)Employmentwithanyemployerthatisrequiredtoexcludeapplicantswithcertain 150criminalconvictionsfromemploymentduetofederalorstatelaw,includingcorresponding 151rulesandregulations. 152 153Anemployershallnotifyanapplicantoftherequirementsundersubdivisions(4)to(6)ofthis 154subsection.Notwithstandinganyprovisionoflawtothecontrary,anexpungedcrimeshall HCS#2HB953 10 155notbegroundsforautomaticdisqualificationofanapplicant,butmaybeafactorfordenying 156employment,oraprofessionallicense,certificate,orpermit;exceptthat,acrimeexpunged 157undertheprovisionsofthissectionmaybegroundsforautomaticdisqualificationifthe 158applicationisforemploymentundersubdivisions(4)to(6)ofthissubsection. 159 11.Apersonwhohasbeengrantedanexpungementofrecordspertainingtoacrime 160mayanswer"no"toanemployer'sinquiryintowhetherthepersonhaseverbeenarrested, 161charged,orconvictedofacrimeif,afterthegrantingoftheexpungement,thepersonhasno 162publicrecordofacrime.Theperson,however,shallanswersuchaninquiryaffirmatively 163anddisclosehisorhercriminalconvictions,includinganyoffenseexpungedunderthis 164sectionorsimilarlaw,iftheemployerisrequiredtoexcludeapplicantswithcertaincriminal 165convictionsfromemploymentduetofederalorstatelaw,includingcorrespondingrulesand 166regulations. 167 12.Ifthecourtdeterminesthatthepetitionerhasnotmetthecriteriaforanyofthe 168crimeslistedinthepetitionforexpungementorthepetitionerhasknowinglyprovidedfalse 169informationinthepetition,thecourtshallenteranorderdismissingthepetition.Anyperson 170whosepetitionforexpungementhasbeendismissedbythecourtforfailuretomeetthe 171criteriasetforthinsubsection6ofthissectionmaynotrefileanotherpetitionuntilayearhas 172passedsincethedateoffilingforthepreviouspetition. 173 13.Apersonmaybegrantedmorethanoneexpungementunderthissectionprovided 174thatduringhisorherlifetime,thetotalnumberofcrimesforwhichordersofexpungement 175aregrantedtothepersonshallnotexceedthefollowinglimits: 176 (1)Notmorethanthreemisdemeanoroffensesorordinanceviolationsthathavean 177authorizedtermofimprisonment;and 178 (2)Notmorethantwofelonyoffenses. 179 180Apersonmaybegrantedexpungementunderthissectionforanynumberofinfractions. 181Nothinginthissectionshallbeconstruedtolimitorimpairinanywaythesubsequentuseof 182anyrecordexpungedunderthissectionofanyarrestsorfindingsofguiltbyalaw 183enforcementagency,criminaljusticeagency,prosecutingattorneyorcircuitattorney, 184includingitsuseasapriorcrime. 185 14.Thecourtshallmakeavailableaformforprosepetitionersseekingexpungement, 186whichshallincludethefollowingstatement:"Ideclareunderpenaltyofperjurythatthe 187statementsmadehereinaretrueandcorrecttothebestofmyknowledge,information,and 188belief.". 189 15.Nothinginthissectionshallbeconstruedtolimitorrestricttheavailabilityof 190expungementtoanypersonunderanyotherlaw.Anypersoneligibleforexpungement HCS#2HB953 11 191undersection610.141whohasfiledapetitionforexpungementunderthissectionshall 192begrantedanexpungement,subjecttosubsection3ofsection610.141. 610.141.1.Asusedinthissection,section610.140,andsections610.143and 2610.144,unlessthecontextotherwiseindicates,thefollowingtermsmean: 3 (1)"Automatedexpungement",technology-assisted,state-initiatedbulkclosing 4ofrecordsinthemannerestablishedundersection610.120; 68 b.Iftheoffenseswerecommittedbyanindividualwhohasattainedsixty-five 69yearsofageandhasnotbeenconvictedofanymisdemeanorsorfeloniesinthe 70immediatetenprecedingyearsinMissouri,allcleanslateeligibleoffensesshallbe 71expunged;and HCS#2HB953 13 72 c.Onlyconvictionscontainedwithinthestatewidecourtautomationcase 73managementsystemshallbeconsideredwhendeterminingeligibilityunderthissection. 74 (d)Thecourtshallmaintainrecordstoensurethatapersonhasnotexceededthe 75limitationsprovidedunderthissubsection.Nothinginthissectionshallbeconstruedto 76limitorimpairthesubsequentuseofanyrecordmaintainedbythecourtforthe 77purposeofanylawenforcementorprosecutorialinvestigationoractivity,includingany 78arrestorfindingsofguiltexpungedunderthissectionbyalawenforcementagency, 79criminaljusticeagency,prosecutingattorney,circuitattorney,ormunicipalprosecuting 80attorney,includingitsuseasaprioroffenseinasubsequentcriminalorcivil 81investigationorprosecution. 82 3.(1)Onaquarterlybasis,theofficeofstatecourtsadministratorshallidentify 83recordsthathavebecomeeligibleinthelastquarterandtransmit,orotherwisemake 84accessiblebyelectronicmeans,tothecentralrepositoryandeveryprosecutingagencyin 85thestateallcleanslateeligibleoffenserecordswithinonehundreddaysoftherecord 86becomingeligibleforautomatedexpungement. 87 (2)(a)Foranypersonwhoisconvictedforthefirsttimeofacleanslateeligible 88offensebeforeAugust28,2014,theperson'srecordorrecordsshallbeeligiblefor 89expungementbeginningAugust28,2035,inaccordancewiththeprovisionsofthis 90section. 91 (b)Foranypersonwhoisconvictedforthefirsttimeofacleanslateeligible 92offenseonorafterAugust28,2014,butbeforeAugust28,2024,theperson'srecordor 93recordsshallbeeligibleforexpungementbeginningAugust28,2033,inaccordancewith 94theprovisionsofthissection. 95 (c)Foranypersonwhoisconvictedforthefirsttimeofacleanslateeligible 96offenseonorafterAugust28,2024,butbeforeAugust28,2029,theperson'srecordor 97recordsshallbeeligibleforexpungementbeginningAugust28,2031,inaccordancewith 98theprovisionsofthissection. 99 (d)Foranypersonwhoisconvictedforthefirsttimeofacleanslateeligible 100offenseonorafterAugust28,2029,theperson'srecordorrecordsshallbeeligiblefor 101expungementbeginningAugust28,2029,inaccordancewiththeprovisionsofthis 102section. 103 (3)Delinquentcourtcosts,fines,fees,orothersumsorderedbyacourt,except 104restitutionowedtoavictimofacrime,shallnotbeconsideredbytheofficeofstate 105courtsadministratorwhendeterminingeligibilityofarecordforautomated 106expungementundersubsection2ofthissection.However,theofficeofstatecourts 107administratormayseekasetoffofanyincometaxrefundandlotteryprizepayouts HCS#2HB953 14 108undersection488.5028foralldelinquentcourtcosts,fines,fees,orothersumsordered 109byacourtrelatingtoconvictionsexpungedundersubsection2ofthissection. 110 (4)Eachprosecutingagencyinthisstatehasnomorethansixtydaysfromthe 111dayonwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmitted,or 112otherwisemadeaccessiblebyelectronicmeans,toobjecttoanautomatedexpungement 113andtransmitsuchobjectiontotheofficeofstatecourtsadministratorandthecentral 114repository.Theprosecutingagencymayobjecttotheautomatedexpungementforany 115ofthefollowingreasons: 116 (a)Afterreviewingtheprosecutingagency'srecord,theagencybelievesthe 117recorddoesnotmeetthedefinitionofacleanslateeligibleoffense; 118 (b)Thepersonhasnotpaidcourt-orderedrestitutiontothevictim;or 119 (c)ThepersonhaschargespendingagainsttheminanothercaseinMissouri. 120 (5)Ifaprosecutingagencyobjectsforareasondescribedinsubdivision(4)of 121thissubsection,withinsixtydaysofthedayonwhichthenoticedescribedinsubdivision 122(1)ofthissubsectionistransmitted,orotherwisemadeaccessiblebyelectronicmeans, 123therecordshallnotbeexpunged. 124 (6)Thecentralrepositoryhasnomorethansixtydaysfromthedayonwhichthe 125noticedescribedinsubdivision(1)ofthissubsectionistransmitted,orotherwisemade 126accessiblebyelectronicmeans,toobjecttoanautomatedexpungementandtransmit 127suchobjectiontotheofficeofstatecourtsadministratorandtherelevantprosecutors. 128Thecentralrepositorymayobjecttotheautomatedexpungementiftheagencybelieves 129therecorddoesnotmeetthedefinitionofacleanslateeligibleoffensebasedontheir 130availabledata. 131 (7)Ifthecentralrepositoryobjectsforareasondescribedinsubdivision(6)of 132thissubsection,withinsixtydaysofthedayonwhichthenoticedescribedinsubdivision 133(1)ofthissubsectionistransmitted,orotherwisemadeaccessiblebyelectronicmeans, 134therecordshallnotbeexpunged. 135 (8)Ifsixtydayshavepassedwithoutanobjectionfromaprosecutingagencyor 136thecentralrepositoryforoneofthereasonssetforthunderthissubsection,theofficeof 137statecourtsadministratorshalltransmit,orotherwisemakeaccessiblebyelectronic 138means,withinfifteendaysalltherecordstobeexpunged,sortedbycircuit,tothe 139presidingjudgesofeverycircuitcourtinMissouri. 140 (9)Withinthirtydaysofreceivinganoticetoexpunge,thecircuitcourtshall 141issueordersforexpungementofallrecordsmaintainedinthecircuit. 142 (10)Onaquarterlybasis,eachcircuitcourtshalltransmit,orotherwisemake 143accessiblebyelectronicmeans,copiesofallordersforexpungementthatthecourtissues 144underthissectiontotheofficeofstatecourtsadministrator. HCS#2HB953 15 145 (11)Oncethetransmittedrecordsareexpunged,theofficeofstatecourts 146administratorshallprovidenoticetoallstateagenciesmaintainingofficialcopiesofthe 147recordsincluding,butnotlimitedto,theappropriatecircuitcourtclerk,theprosecuting 148orcircuitattorney,thearrestinglawenforcementagencyoragencies,thedepartmentof 149corrections,thecentralrepository,andthedepartmentofrevenuetoexpungethe 150recordswithinthirtydays.Therecordsandfilesmaintainedbyanysuchpersonsor 151entitiespertainingtoexpungedrecordsshallbeheldconfidentialfromthedateof 152expungementandonlymadeavailabletothepeopleandforthepurposesoutlinedin 153subdivision(12)ofthissubsection.Withrespecttoanypersonincluding,butnotlimited 154to,aconsumerreportingagencyorresearcher,whopurchasesrecordsforinformation 155pertainingtocriminalmattersofpublicrecordfromtheofficeofstatecourts 156administrator,suchofficeshallmakeavailabletothepersoninformationconcerningthe 157criminalmattersofpublicrecordthathavebeenerasedunderthissection.Such 158informationshallincludedocketnumbersorotherinformationsufficienttopermitthe 159persontoaccuratelyidentifyanddeleterecordsthathavebeenerasedunderthis 160section. 161 (12)(a)TheMissouristatehighwaypatrolshallretainanonpublicrecordofthe 162orderexpungingaconvictionorothernotificationregardingaconvictionthatwas 163automaticallyexpungedunderthissectionandoftherecordofthearrest,fingerprints, 164conviction,andsentenceofthepersoninthecasetowhichtheorderorother 165notificationapplies.Thenonpublicrecordshallbemadeavailableonlytoacourtof 166competentjurisdiction,anindependentdepartmentofthejudicialbranchofstate 167government,thedepartmentofcorrections,alawenforcementagency,aprosecuting 168attorney,theattorneygeneral,orthegovernoruponrequestandonlyforthefollowing 169purposes: 170 a.Toshowthatapersonwhohasfiledapetitiontoexpungeaconvictionhas 171previouslyhadaconvictionexpungedunderthissection; 172 b.Thecourt'sconsiderationindeterminingthesentencetobeimposedupon 173convictionforasubsequentoffensethatispunishableasafelonyorbyimprisonment 174formorethanoneyear; 175 c.Considerationbythegovernorifapersonwhoseconvictionhasbeen 176expungedappliesforapardonforanotheroffense; 177 d.Considerationbythedepartmentofcorrectionsoralawenforcementagency 178ifapersonwhoseconvictionhasbeenexpungedappliesforemploymentwiththe 179departmentofcorrectionsoralawenforcementagency; 180 e.Considerationbyacourt,lawenforcementagency,prosecutingattorney,or 181theattorneygeneralindeterminingwhetherapersonrequiredtoregisterunder HCS#2HB953 16 182sections589.400to589.425hascommittedanoffensethatrequiresregistrationunder 183sections589.400to589.425,orinprosecutingapersonforcommittinganoffense 184requiringregistrationundersections589.400to589.425; 185 f.Considerationbyacourt,lawenforcementagency,prosecutingattorney,or 186theattorneygeneralforuseinmakingdeterminationsregardingcharges,pleaoffers, 187andsentencing,asapplicable;or 188 g.Considerationbyanyentityresponsibleforissuingcommercialdriver's 189licensesforthepurposeofmeetingstateandfederalrequirementstoobtaincommercial 190driver'slicenses. 191 (b)Acopyofthenonpublicrecordcreatedunderparagraph(a)ofthis 192subdivisionmaybeprovideduponrequesttothepersonwhoseconvictionisexpunged 193underthissectionuponpaymentofafeedeterminedandchargedbytheMissouristate 194highwaypatrol. 195 (c)Thenonpublicrecordmaintainedunderparagraph(a)ofthissubdivisionis 196exemptfromdisclosureunderthischapter. 197 (d)Anentityshallnotbeliablefordamagesorsubjecttocriminalpenaltiesfor 198reportingapublicrecordofconvictionthathasbeenexpungedbycourtorderor 199operationoflawpriortoAugust28,2030,ifthatrecordwasavailableasapublicrecord 200onthedateofthereport. 201 4.Anycourtsentencinganindividualforacleanslateeligibleoffenseshall 202providetheindividualadocumentoutliningthestate'scleanslateexpungement 203programatthetimeofsentencing. 204 5.Anyprobationorparoleofficereleasinganindividualfromsupervisionfora 205cleanslateeligibleoffenseshallprovidetheindividualadocumentoutliningthestate's 206cleanslateexpungementprogramatthetimeofsentencing. 207 6.Theprovisionsofthissectionshallapplyretroactivelytoanyarrest,charge, 208trial,orconvictionforwhichthereisanelectronicrecordregardlessofthedatethatthe 209arrestwasmade,thechargeorchargeswerebrought,thetrialoccurred,orthe 210convictionwasentered. 211 7.Nothinginthissectionprecludesanindividualfromfilingapetitionfor 212expungementofrecordsundersection610.140ifanindividualiseligibleforautomated 213expungementunderthissectionbutsuchautomatedexpungementhasnotyetoccurred 214orcannotoccur. 215 8.Ifitisdeterminedthataconvictionwasimproperlyorerroneouslyexpunged 216underthissectionbecausetheconvictionwasnoteligibletobeexpungedunderthis 217section,thecourtshall,onitsownmotion,reinstatetheconviction. HCS#2HB953 17 218 9.(1)Upontheentryofanorderundersection610.140,orupontheautomated 219expungementofaconvictionunderthissection,thepetitioner,forpurposesofthelaw,is 220considerednottohavebeenpreviouslyconvicted,exceptasprovidedunderthis 221subsectionandsubsection10ofsection610.140. 222 (2)Thepetitionershallnotbeentitledtotheremissionofanyfine,costs,orother 223moneyspaidasaconsequenceofaconvictionthatisexpunged. 224 (3)Thissectionshallnotaffecttherightofthepetitionertorelyuponthe 225convictiontobarsubsequentproceedingsforthesameoffense. 226 (4)Thissectionshallnotaffecttherightofavictimofanoffensetobringor 227defendacivilactionfordamages. 228 (5)Thissectionshallnotcreatearighttocommenceanactionfordamagesfor 229incarcerationunderthesentencethatthepetitionerservedbeforetheconvictionis 230expungedunderthissection. 231 (6)Thissectionshallnotrelieveanyobligationtopayrestitutionowedtothe 232victimofanoffensenorshallsuchsectionaffectthejurisdictionoftheconvictingcourt 233ortheauthorityofanycourtorderwithregardtoenforcinganorderforrestitution. 234 (7)Aconviction,includinganyrecordsrelatingtotheconvictionandany 235recordsconcerningacollateralaction,thathasbeenexpungedunderthissectionshall 236notbeusedasevidenceinanactionfornegligenthiring,admission,orlicensureagainst 237anyperson. 238 (8)Aconvictionthatisexpungedunderthissectionorsection610.140maybe 239consideredapriorconvictionbyacourt,lawenforcementagency,prosecutingattorney, 240ortheattorneygeneral,asapplicable,forpurposesofchargingacrimeasasecondor 241subsequentoffenseorforsentencingundersection558.016. 610.143.1.Acreditbureaumayreportrecordsofarrests,indictmentspending 2trial,andconvictionsofcrimesfornolongerthansevenyearsfromfinaldisposition. 3Recordsofarrests,indictmentspendingtrial,andconvictionsofcrimesshallnolonger 4bereportedifatanytimeafteraconvictionitislearnedthatafullpardonor 5expungementhasbeengrantedforthatconviction,oratanytimeafteranarrestor 6indictmentitislearnedthataconvictiondidnotresult. 7 2.Anycreditbureauoruserofinformationthatwillfullyfailstocomplywith 8anyrequirementofthissectionwithrespecttoanyconsumerisliabletothatconsumer 9inanamountequalto: 10 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure; 11 (2)Punitivedamagesasthecourtmayallow;and 12 (3)Inthecaseofanysuccessfulactionunderthissection,costsoftheactionand 13reasonableattorney'sfeesasdeterminedbythecourt. HCS#2HB953 18 14 3.Anycreditbureauoruserofinformationthatisnegligentinfailingtocomply 15withanyrequirementofthissectionwithrespecttoanyconsumerisliabletothat 16consumerinanamountequalto: 17 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure;and 18 (2)Inthecaseofanysuccessfulactionunderthissection,costsoftheactionand 19reasonableattorney'sfeesasdeterminedbythecourt. 20 4.Injunctivereliefshallbeavailabletoanyconsumeraggrievedbyaviolationor 21athreatenedviolationofthissectionregardlessofwhethertheconsumerseeksanyother 22remedyunderthissection. 23 5.Anemployer,volunteerorganization,orlandlordwhoemploys,qualifies,or 24otherwiseengagesanindividualwhosecriminalhistoryrecordhasbeenexpungedshall 25beimmunefromliabilityforanyclaimarisingoutofthemisconductoftheindividualif 26themisconductrelatestotheportionofthecriminalhistoryrecordthathasbeen 27expunged. 28 6.Apersongrantedanexpungementshalldiscloseanyexpungedoffenseifthe 29disclosureofsuchinformationisnecessarytocompleteanyapplicationforemployment 30withany: 31 (1)Federallyinsuredbankorsavingsinstitutionorcreditunionoranaffiliateof 32suchinstitutionorcreditunionforthepurposeofcompliancewith12U.S.C.Section 331829and12U.S.C.Section1785;or 34 (2)Entityengagedinthebusinessofinsuranceoranyinsurerforthepurposeof 35complyingwith18U.S.C.Section1033,18U.S.C.Section1034,orothersimilarlawthat 36requiresanemployerengagedinthebusinessofinsurancetoexcludeapplicantswith 37certaincriminalconvictionsfromemployment. 610.144.1.(1)Thereisherebycreatedinthestatetreasurythe"Missouri 2ExpungementFund",whichshallconsistofmoneysdepositedintothefundfromany 3sourceincluding,butnotlimitedto,gifts,donations,grants,andbequests.Thestate 4treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180, 5thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand, 6uponappropriation,moneysinthisfundshallbeusedsolelyasprovidedinsubsection2 7ofthissection. 8 (2)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 9otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 10creditedtothefund. 11 2.Theofficeofstatecourtsadministrator,thedepartmentofpublicsafety,and 12theinformationtechnologyservicesdivisionwithintheofficeofadministrationshall 13expendmoneysfromthefund,uponappropriation,onthestatewidecourtautomation HCS#2HB953 19 14systemandtheMissouricriminalhistoryrecordinformationsystemestablishedunder 15sections43.500to43.530foroneormoreofthefollowingpurposes: 16 (1)Expensesthatmaybeincurredtodevelop,establish,maintain,oroperate 17anyinformationtechnologyequipment,software,systems,orservicesassociatedwith 18theexpungementorclosingofrecordsunderMissourilaw,includingthedevelopment 19andimplementationofanytechnology-assisted,state-initiatedbulkexpungementor 20sealingofrecordsunderMissourilaw;or 21 (2)Thecostofnecessarypersonnelorcontractors. 22 23Theofficeofstatecourtsadministrator,thedepartmentofpublicsafety,andthe 24informationtechnologyservicesdivisionwithintheofficeofadministrationshalleach 25receiveone-thirdofanytotalamountappropriatedfromthefundforafiscalyear. ✔ HCS#2HB953 20
