18 2.Nomorethanthreemembersfromeachhouseshallbeofthesamepoliticalparty.
19 3.Thejointcommitteeshallmeetwithinthirtydaysafteritscreationandorganizeby
20selectingachairandvicechair,oneofwhomshallbethesenatejudiciarychairandoneof
21whomshallbethehousejudiciarychair.Thepositionsofchairandvicechairshallalternate
22everytwoyearsthereafterbetweenthesenateandhouse.Afteritsorganization,the
23committeeshallmeetregularly,atleasttwiceayear,atsuchtimeandplaceasthechair
24designates,includinglocationsotherthanJeffersonCity.Amajorityofthemembersofthe
25committeeshallconstituteaquorum,buttheconcurrenceofamajorityofthemembers,other
26thantheexofficiomembers,shallberequiredforthedeterminationofanymatterwithinthe
27committee'sduties.

43 5.ByJanuary15,2016,andeveryyearthereafter,itshallbethedutyofthejoint
44committeetofilewiththegeneralassemblyareportofitsactivities,alongwithanyfindings

46 6.ThejointcommitteeshallestablishapermanentsubcommitteeontheMissouri
47criminalcode,whichshallconductandsuperviseacontinuingprogramofrevisiondesigned
48tomaintainthecohesiveness,consistency,andeffectivenessofthecriminallawsofthestate.
49Inconnectionwiththisprogram,thecommitteemayselectanadvisorycommitteeonthe
50Missouricriminalcode,composedofarepresentativeoftheMissourisupremecourt,a
51representativeoftheofficeoftheattorneygeneral,andotherindividualsknowntobe
52interestedintheimprovementofthestate'scriminallaws,andmayauthorizethepaymentof

54thecommitteeorthesubcommitteeontheMissouricriminalcode.Thesubcommitteeonthe
55Missouricriminalcodeshallpresenttothegeneralassemblyineachtenthyearsuchcriminal
56coderevisionbillsasitfindsappropriatetoaccomplishitspurpose.
57 7.Thejointcommitteemaymakereasonablerequestsforstaffassistancefromthe
58researchandappropriationsstaffsofthesenateandhouseandthejointcommitteeon
59legislativeresearch,andmayemploysuchpersonnelasitdeemsnecessarytocarryoutthe
60dutiesimposedbythissection,withinthelimitsofanyappropriationforsuchpurpose.Inthe
61performanceofitsduties,thecommitteemayrequestassistanceorinformationfromall
62branchesofgovernmentandstatedepartments,agencies,boards,commissions,andoffices.
63 8.Themembersofthecommitteeshallservewithoutcompensation,butanyactual

4 2.Wheremurderinthefirstdegreeissubmittedtothetrierwithoutawaiverofthe
5deathpenalty,thetrialshallproceedintwostagesbeforethesametrier.Atthefirststagethe
6triershalldecideonlywhetherthedefendantisguiltyornotguiltyofanysubmittedoffense.

20aggravationandmitigationofpunishment,includingbutnotlimitedtoevidencesupporting
21anyoftheaggravatingormitigatingcircumstanceslistedinsubsection2or3ofsection
22565.032,maybepresentedsubjecttotherulesofevidenceatcriminaltrials.Suchevidence

26beinstructedonthelaw.Theattorneysmaythenarguetheissueofpunishmenttothejury,

5 (3)"Prosecutor"or"prosecutingattorney",theprosecutingattorney,circuitattorney,

7 2.(1)Notwithstandinganyotherprovisionoflawandsubjecttotheprovisionsof
8thissection,anypersonmayapplytoanycourtinwhichsuchpersonwaschargedorfound

100countywherethepetitionerwasarrestednoearlierthaneighteenmonthsfromthedateof
101arrest;providedthat,duringsuchtime,thepetitionerhasnotbeenchargedandthepetitioner
102hasnotbeenfoundguiltyofanymisdemeanororfelonyoffense.
103 8.Ifthecourtdeterminesthatsuchpersonmeetsallthecriteriasetforthinsubsection

2ExpungementFund",whichshallconsistofmoneysdepositedintothefundfromany
3sourceincluding,butnotlimitedto,gifts,donations,grants,andbequests.Thestate
4treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180,
5thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,
6uponappropriation,moneysinthisfundshallbeusedsolelyasprovidedinsubsection2
7ofthissection.
8 (2)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
9otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
10creditedtothefund.
