BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section40.490,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection40.490,toreadasfollows:
40.490.1.Membersofthestatemilitaryforcesofthisstatewhoareorderedtoactive
2statedutybythegovernororadjutantgeneral, anyMissouriemployeewhoisamemberof
3theNationalGuardofanotherstateandwhoiscalledintoactivestatedutybythegovernoror
4adjutantgeneralofthatstate,oranymemberofanyreservecomponentoftheArmedForces
5oftheUnitedStateswhoiscalledtoactivedutyshall,uponbeingrelievedfromsuchduty,be
6entitledtothesamereemploymentrightsprovidedbyTitle38oftheUnitedStatesCode,the
7RevisedStatutesofMissouri,andallamendmentsthereto.Theattorneygeneralshallenforce
8thereemploymentrightscontainedinthissectionformembersofthestatemilitaryforces
9whoareorderedtoactivestatedutybythegovernororadjutantgeneral.
10 2.MembersoftheMissouriNationalGuardwhoarecalledtoactivestateduty
11bythegovernororadjutantgeneralandanyMissouriemployeeswhoaremembersof
12theNationalGuardofanotherstateandarecalledtoactivestatedutybythegovernor
13oradjutantgeneralofthatstateshall,uponbeingrelievedfromsuchduty,beentitledto
14allrightsandprotectionsprovidedbytheServicemembersCivilReliefAct,50U.S.C.
15Section3901etseq.,andallamendmentsthereto.
16 3.AnymemberoftheMissouriNationalGuardandanyMissouriemployeewho
17isamemberoftheNationalGuardofanotherstatemaybringsuitinanycourtof
18competentjurisdictionandappropriatevenueifsuchindividualbelievesthathisorher
