Torepealsection217.425,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
funeralattendancebyanoffender.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section217.425,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection217.425,toreadasfollows:
217.425.1.(1)Thedirectormayextendthelimitsoftheplaceofconfinementofan
2offenderwho,hehasreasonablecausetobelieve,willhonorhistrust,byauthorizingthe
3offender,underprescribedconditions,tovisitspecificallydesignatedplaceswithinthestate
4foraperiodnottoexceedthirtydaysperyearandtoreturntothecustodyofthedepartment.
5Theauthorityhereinconferredmaybeexercisedtopermittheoffendertovisitarelativewho
6isill,toattendthefuneralofarelative,toobtainmedicalservicesnototherwiseavailable,to
7contactprospectiveemployersandtoparticipateinapprovedrehabilitationprograms.Ifthe
8offenderisenrolledinacommunityreleaseprogramorinneedofemergencymedical
9services,thethirtydayperannumlimitationmaybeextendedatthedirector'sdiscretion.
10 (2)Ifanoffenderdoesnotobtainafurloughbythedirectorundersubdivision
11(1)ofthissubsectiontoattendafuneralofarelative,theoffenderhastherighttoattend
12thefuneralif:
13 (a)Therelativeisanimmediatefamilymemberoftheoffender.Asusedinthis
14paragraph,"immediatefamilymember"meansaspouse,child,sibling,parent,
15grandparent,grandchild,stepparent,stepchild,stepsibling,oranadoptiverelationship;
16 (b)Theoffenderisescortedtothefuneralbyacorrectionalofficerormemberof
17theMissouristatehighwaypatrol;and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (c)Theoffenderpaysforanycostsassociatedwithattendingthefuneral,
19includingescortcostsunderparagraph(b)ofthissubdivision.Suchcostsshallbepaid
20bytheoffendertothedepartmentpriortothefuneral.
21 2.Acopyofanyorderofthedirectorshallbesenttothecircuitjudge,sheriffand
22prosecutingattorneyofthecountyorcircuitattorneyofanycitynotwithinacountyfrom
23whichtheoffenderwassentencedandthecountyoftheproposedvisitatleasttendaysin
24advanceofsuchorderexceptinthecaseofanorderpermittingthevisittoattendthefuneral
25ofarelativeorforanemergencymedicalfurlough.
