4141 29symptomsofsevereallergicreactionsincludinganaphylaxisandtheuseofepinephrine
4242 30auto-injectorsfromanationallyrecognizedorganizationexperiencedintraininglaypersonsin
4343 31emergencyhealthtreatmentoranotherentityorpersonapprovedbythedepartmentofhealth

5454 42communicationsdistrictortheambulancedispatchcenteroftheprimaryproviderof
5555 43emergencymedicalserviceswheretheepinephrineauto-injectorsaretobelocatedwithinthe
5656 44entity'sfacility.
5757 45 6.Nopersonshallprovideoradministeranepinephrineauto-injectortoany
5858 46individualwhoisundereighteenyearsofagewithouttheverbalconsentofaparentor
5959 47guardianwhoispresentatthetimewhenprovisionoradministrationoftheepinephrineauto-
6060 48injectorisneeded.Provided,however,thatapersonmayprovideoradministeran
6161 49epinephrineauto-injectortosuchanindividualwithouttheconsentofaparentorguardianif
6262 50theparentorguardianisnotphysicallypresentandthepersonreasonablybelievesthe
6363 51individualshallbeinimminentdangerwithouttheprovisionoradministrationofthe
6464 52epinephrineauto-injector.
6565 HB97 2 53 7.Thefollowingpersonsandentitiesshallnotbeliableforanyinjuriesorrelated
6666 54damagesthatresultfromtheadministrationorself-administrationofanepinephrineauto-
6767 55injectorinaccordancewiththissectionthatmayconstituteordinarynegligence:
6868 56 (1)Anauthorizedentitythatpossessesandmakesavailableepinephrineauto-
6969 57injectorsanditsemployees,agents,andothertrainedpersons;
7070 58 (2)Anypersonwhousesanepinephrineauto-injectormadeavailableunderthis

7878 66immunityfromliabilityprovidedunderthissubsectionisinadditiontoandnotinlieuofthat
7979 67providedundersection537.037.Anauthorizedentitylocatedinthisstateshallnotbeliable
8080 68foranyinjuriesorrelateddamagesthatresultfromtheprovisionoradministrationofan
8181 69epinephrineauto-injectorbyitsemployeesoragentsoutsideofthisstateiftheentityorits
8282 70employeeoragentisnotliableforsuchinjuriesorrelateddamagesunderthelawsofthestate
8383 71inwhichsuchprovisionoradministrationoccurred.Notrainedpersonwhoisincompliance
8484 72withthissectionandwhoingoodfaithandexercisingreasonablecarefailstoadministeran
8585 73epinephrineauto-injectorshallbeliableforsuchfailure.
8686 74 8.Allbasiclifesupportambulancesandstretchervansoperatedinthestateshallbe
8787 75equippedwithepinephrineauto-injectorsandbestaffedbyatleastoneindividualtrainedin
8888 76theuseofepinephrineauto-injectors.
8989 77 9.Theprovisionsofthissectionshallapplyinallcountieswithinthestateandany

9191 79 10.Nothinginthissectionshallbeconstruedassupersedingtheprovisionsofsection

9393 210.225.1.(1)BeforeJuly1,2027,eachlicensedchildcareprovidershalladopt
