JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSection12ofArticle
IVoftheConstitutionofMissouri,andadoptingtwonewsectionsinlieuthereof
relatingtothedepartmentofthehighwaypatrol.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIVoftheConstitutionofthestate
5ofMissouri:
SectionA.Section12,ArticleIV,ConstitutionofMissouri,isrepealedandtwonew
2sectionsadoptedinlieuthereof,tobeknownasSections12and55,toreadasfollows:
Section12.Theexecutivedepartmentshallconsistofallstateelectiveandappointive
2officialsandemployeesexceptofficialsandemployeesofthelegislativeandjudicial
3departments.Inadditiontothegovernorandlieutenantgovernorthereshallbeastate
4auditor,secretaryofstate,attorneygeneral,astatetreasurer,anofficeofadministration,a
5departmentofagriculture,adepartmentofconservation,adepartmentofnaturalresources,a
6departmentofelementaryandsecondaryeducation,adepartmentofhighereducation,a
7departmentofhighwaysandtransportation,adepartmentofinsurance,adepartmentoflabor
8andindustrialrelations,adepartmentofeconomicdevelopment,adepartmentofpublic
9safety,adepartmentofrevenue,adepartmentofsocialservices,adepartmentoftheNational

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 10Guard,adepartmentofthehighwaypatrol,andadepartmentofmentalhealth.Inaddition
11totheelectedofficers,thereshallnotbemorethan[sixteen] seventeendepartmentsandthe
12officeofadministration.Thegeneralassemblymaycreatebylawtwodepartments,in
13additiontothosenamed,providedthatthedepartmentsshallbeheadedbyadirectoror
14commissionappointedbythegovernorontheadviceandconsentofthesenate.Thedirector
15orcommissionshallhaveadministrativeresponsibilityandauthorityforthedepartment
16createdbylaw.Unlessdiscontinuedallpresentorfutureboards,bureaus,commissionsand
17otheragenciesofthestateexercisingadministrativeorexecutiveauthorityshallbeassigned
18bylaworbythegovernorasprovidedbylawtotheofficeofadministrationortooneofthe
19[sixteen] seventeenadministrativedepartmentstowhichtheirrespectivepowersandduties
20aregermane.
Section55.ThereshallbeestablishedaMissouriDepartmentoftheHighway
2Patrolinchargeofthesuperintendentappointedbyandservingatthepleasureofthe
3governor,byandwiththeadviceandconsentofthesenate,whoshallprovideforthe
4safetyuponthehighwaysandenforcetrafficlaws.
