JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections2(b)and3(c)
ofArticleXIIoftheConstitutionofMissouri,andadoptingthreenewsectionsinlieu
thereofrelatingtoconstitutionalamendments.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleXIIoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections2(b)and3(c),ArticleXII,ConstitutionofMissouri,arerepealed
2andthreenewsectionsadoptedinlieuthereof,tobeknownasSections2(b),2(c),and3(c),to
3readasfollows:
Section2(b).Allamendmentsproposedbythegeneralassemblyorbytheinitiative
2shallbesubmittedtotheelectorsfortheirapprovalorrejectionbyofficialballottitleasmay
3beprovidedbylaw,onaseparateballotwithoutpartydesignation,atthenextgeneral
4election,orataspecialelectioncalledbythegovernorpriorthereto,atwhichhemaysubmit
5anyoftheamendments.Nosuchproposedamendmentshallcontainmorethanoneamended
6andrevisedarticleofthisconstitution,oronenewarticlewhichshallnotcontainmorethan
7onesubjectandmattersproperlyconnectedtherewith.Ifpossible,eachproposedamendment
8shallbepublishedonceaweekfortwoconsecutiveweeksintwonewspapersofdifferent
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 9politicalfaithineachcounty,thelastpublicationtobenotmorethanthirtynorlessthan
10fifteendaysnextprecedingtheelection.Iftherebebutonenewspaperinanycounty,
11publicationforfourconsecutiveweeksshallbemade.Notwithstandingtheprovisionsof
12ArticleIIIofthisconstitution,ifamajorityofthevotescastthereonstatewideandineach
13ofmorethanhalfofthecongressionaldistrictsinthestateisinfavorofanyamendment,
14thesameshalltakeeffectattheendofthirtydaysaftertheelection.Morethanone
15amendmentatthesameelectionshallbesosubmittedastoenabletheelectorstovoteoneach
16amendmentseparately.
Section2(c).Nopersonshallbeeligibletovoteonanymeasuresubmittedtothe
2peoplethatamends,repeals,orreplacesthisconstitution,whetherunderthisarticleor
3ArticleIII,unlesssuchpersonisalegalresidentofthestateofMissouriandacitizenof
4theUnitedStatesofAmerica.
Section3(c).Anyproposedconstitutionorconstitutionalamendmentadoptedbythe
2conventionshallbesubmittedtoavoteoftheelectorsofthestateatsuchtime,insuch
3mannerandcontainingsuchseparateandalternativepropositionsandonsuchofficialballot
4asmaybeprovidedbytheconvention,ataspecialelectionnotlessthansixtydaysnormore
5thansixmonthsaftertheadjournmentoftheconvention.Upontheapprovalofthe
6constitutionorconstitutionalamendmentsbyamajorityofthevotescastthereonstatewide
7andineachofmorethanhalfofthecongressionaldistrictsinthestate,thesameshall
8takeeffectattheendofthirtydaysaftertheelection.Theresultoftheelectionshallbe
9proclaimedbythegovernor.
SectionB.Pursuanttochapter116,andotherapplicableconstitutionalprovisionsand
2lawsofthisstateallowingthegeneralassemblytoadoptballotlanguageforthesubmissionof
3thisjointresolutiontothevotersofthisstate,theofficialsummarystatementofthis
4resolutionshallbeasfollows:
5 "ShalltheMissouriConstitutionbeamendedto:
6 •SpecifythatonlylegalresidentsofMissouriwhoarecitizensoftheUnitedStates
7mayvoteonanychangetothestateconstitution;and
8 •Requireforratificationbothamajorityofvotesstatewideandamajorityofvotesin
9morethanhalfthecongressionaldistrictsinthestate?".
