1717 SectionA.Section36,ArticleI,ConstitutionofMissouri,isrepealedandonenew
1818 2sectionadoptedinlieuthereof,tobeknownasSection36(a),toreadasfollows:
1919 Section36(a).1.Exceptinthecaseofamedicalemergency,noabortionofa
2020 2viableunbornchildshallbeperformedorinducedunlesstheabortionisnecessaryto
2121 3preservethelifeofthepregnantwomanwhoselifeisendangered.
2222 4 2.Forpurposesofthissection,thefollowingtermsmean:
2323 5 (1)"Medicalemergency",aconditionthat,basedonreasonablemedical
2424 6judgment,socomplicatesthemedicalconditionofapregnantwomanastonecessitate
2525 7theimmediateabortionofherpregnancytoavertthedeathofthepregnantwomanor
2626 8forwhichadelaywillcreateaseriousriskofsubstantialandirreversiblephysical
2727 9impairmentofamajorbodilyfunctionofthepregnantwoman;and
2828 EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis

3434 3 2.TheGovernmentshallnotdenyorinfringeuponaperson's
3535 4 fundamentalrighttoreproductivefreedom,whichistherighttomakeand
3636 5 carryoutdecisionsaboutallmattersrelatingtoreproductivehealthcare,
3737 6 includingbutnotlimitedtoprenatalcare,childbirth,postpartumcare,birth
3838 7 control,abortioncare,miscarriagecare,andrespectfulbirthingconditions.
3939 8 3.Therighttoreproductivefreedomshallnotbedenied,interfered
4040 9 with,delayed,orotherwiserestrictedunlesstheGovernmentdemonstratesthat
4141 10 suchactionisjustifiedbyacompellinggovernmentalinterestachievedbythe
4242 11 leastrestrictivemeans.Anydenial,interference,delay,orrestrictionofthe
4343 12 righttoreproductivefreedomshallbepresumedinvalid.Forpurposesofthis
4444 13 Section,agovernmentalinterestiscompellingonlyifitisforthelimited
4545 14 purposeandhasthelimitedeffectofimprovingormaintainingthehealthofa
4646 15 personseekingcare,isconsistentwithwidelyacceptedclinicalstandardsof
4747 16 practiceandevidence-basedmedicine,anddoesnotinfringeonthatperson's
4848 17 autonomousdecision-making.
4949 18 4.Notwithstandingsubsection3ofthisSection,thegeneralassembly
5050 19 mayenactlawsthatregulatetheprovisionofabortionafterFetalViability
5151 20 providedthatundernocircumstanceshalltheGovernmentdeny,interfere
5252 21 with,delay,orotherwiserestrictanabortionthatinthegoodfaithjudgmentof
5353 22 atreatinghealthcareprofessionalisneededtoprotectthelifeorphysicalor
5454 23 mentalhealthofthepregnantperson.
5555 24 5.Nopersonshallbepenalized,prosecuted,orotherwisesubjectedto
5656 25 adverseactionbasedontheiractual,potential,perceived,orallegedpregnancy
5757 26 outcomes,includingbutnotlimitedtomiscarriage,stillbirth,orabortion.Nor
5858 27 shallanypersonassistingapersoninexercisingtheirrighttoreproductive
5959 28 freedomwiththatperson'sconsentbepenalized,prosecuted,orotherwise
6060 29 subjectedtoadverseactionfordoingso.
6161 30 6.TheGovernmentshallnotdiscriminateagainstpersonsprovidingor
6262 31 obtainingreproductivehealthcareorassistinganotherpersonindoingso.
6363 32 7.IfanyprovisionofthisSectionortheapplicationthereoftoanyone
6464 33 ortoanycircumstanceisheldinvalid,theremainderofthoseprovisionsand
6565 34 theapplicationofsuchprovisionstoothersorothercircumstancesshallnotbe
6666 35 affectedthereby.
6767 36 8.ForpurposesofthisSection,thefollowingtermsmean:
6868 37 (1)"FetalViability",thepointinpregnancywhen,inthegoodfaith
6969 38 judgmentofatreatinghealthcareprofessionalandbasedontheparticular
7070 39 factsofthecase,thereisasignificantlikelihoodofthefetus'ssustained
7171 40 survivaloutsidetheuteruswithouttheapplicationofextraordinarymedical
7272 41 measures.
