JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections40(a),40(b),
43(a),43(b),and43(c)ofArticleIVoftheConstitutionofMissouri,andadopting
fournewsectionsinlieuthereofrelatingtothemanagementandfundingofthe
departmentofconservation.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIVoftheConstitutionofthestate
5ofMissouri:

2Missouri,arerepealedandfournewsectionsadoptedinlieuthereof,tobeknownasSections
340(a),43(a),43(b),and43(c),toreadasfollows:
Section40(a).1.Thecontrol,management,restoration,conservationandregulation
2ofthebird,fish,game,forestryandallwildliferesourcesofthestate,includinghatcheries,
3sanctuaries,refuges,reservationsandallotherpropertyowned,acquiredorusedforsuch
4purposesandtheacquisitionandestablishmentthereof,andtheadministrationofalllaws
5pertainingthereto,shallbevestedinaconservationcommission[consistingoffourmembers
6appointedbythegovernor,byandwiththeadviceandconsentofthesenate,notmorethan
7twoofwhom].
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 8 2.(1)Thenumber,qualifications,andtermsofthemembersoftheconservation
9commissionshallbefixedbylawandnotmorethanone-halfofthecommission's
10membersshallbeofthesamepoliticalparty.
11 (2)Themembersshallhaveknowledgeofandinterestinthestate'snatural
12resourcesorwildlifeconservation.
13 (3)Themembersshallholdofficefortermsofsixyearsbeginningonthefirstdayof
14Julyofconsecutiveoddyears.Twoofthetermsshallbeconcurrent;oneshallbegintwo
15yearsbeforeandonetwoyearsaftertheconcurrentterms.
16 (4)(a)Eachmembershallresideinacongressionaldistrictthatisdifferentfrom
17thecongressionaldistrictsinwhichtheothermembersreside.
18 (b)Upontheexpirationofamember'stermoruponavacancy,amember
19appointedbythegovernortobeginanewtermortofillthevacancyshallresideina
20congressionaldistrictthatisdifferentfrom:
21 a.Thecongressionaldistrictsinwhichtheothermembersreside;and
22 b.Thecongressionaldistrictinwhichthememberpreviouslyfillingtheoffice
23resided.
24 (5)Ifthegovernorfailstofillavacancywithinthirtydays,theremainingmembers
25shallfillthevacancyfortheunexpiredtermbyamajorityvoteoftheremainingmembers.
26Theremainingmembersshallchooseanindividualtofillthevacancyfromalistoften
27individualsprovidedbythegeneralassembly.EachyeartheMissourihouseof
28representativesshallcreatethelistoftenindividualsqualifiedtofillavacancyandthe
29generalassemblyshalladoptaconcurrentresolutioncontainingsuchlist.Thevoteby
30theremainingmembersofthecommissionontheindividualtofillthevacancyandany
31deliberationsonsuchvoteshallbepublic.
32 (6)Themembersshallreceivenosalaryorothercompensationfortheirservicesas
33members,butshallreceivetheirnecessarytravelingandotherexpensesincurredwhile
34actuallyengagedinthedischargeoftheirofficialduties.
35 (7)(a)Nomembershallacceptdirectlyorindirectlyagiftofanytangibleor
36intangibleitem,service,orthingofvaluefromanyindividualorentitythatreceivesor
37hasreceivedanyremunerationfromtheconservationcommissionorthatperforms
38servicesfororisavendororcontractorfortheconservationcommission.
39 (b)Uponreceivingaclaimthatamemberacceptedagiftinviolationof
40paragraph(a)ofthissubdivision,theMissouriethicscommissionoritssuccessorshall
41investigateanddeterminewhethersuchgiftinfluencedorattemptedtoinfluencea
42member'sperformanceofofficialduties.Iftheethicscommissiondeterminessuchgift
43influencedorattemptedtoinfluenceamember'sperformanceofofficialduties,the
44membershallimmediatelyforfeitandvacatetheofficeandtheethicscommissionshall
HJR43 2 45refersuchdeterminationtotheMissouriattorneygeneralforprosecutionoftheoffense
46ofbriberyofapublicservantunderstatelaw.
47 3.(1)Anyindividualorentitythatentersacontractwiththeconservation
48commissionshallreporteachtangibleorintangibleitem,service,orthingofvaluesuch
49individualorentityprovideddirectlyorindirectlytoeachmemberoftheconservation
50commissionortoapersonrelatedtosuchmemberwithinthefirstdegreeof
51consanguinity.
52 (2)Reportsmadeundersubdivision(1)ofthissubsectionshallbefiledquarterly
53withtheMissouriethicscommissionoritssuccessorasrequiredbygenerallaw.
54 (3)Thereportsrequiredundersubdivision(1)ofthissubsectionshalllisteach
55suchitem,service,orthingofvalueprovidedinthefiveyearsbeforethebeginningdate
56ofthecontractthroughthefiveyearsaftertheendingdateofthecontract.
Section43(a).1.Exceptasotherwiseprovidedinsubsection2ofthissection,for
2thepurposeofprovidingadditionalmoneystobeexpendedandusedbytheconservation
3commission,departmentofconservation,forthecontrol,management,restoration,
4conservationandregulationofthebird,fish,game,forestryandwildliferesourcesofthe
5state,includingthepurchaseorotheracquisitionofpropertyforsaidpurposes,andforthe
6administrationofthelawspertainingthereto,anadditionalsalestaxofone-eighthofone
7percentisherebyleviedandimposeduponallsellersfortheprivilegeofsellingtangible
8personalpropertyorrenderingtaxableservicesatretailinthisstateuponthesalesand
9serviceswhichnowareorhereafterarelistedandsetforthin,and,exceptastotheamountof
10tax,subjecttotheprovisionsofandtobecollectedasprovidedinthe"SalesTaxLaw"and
11subjecttotherulesandregulationspromulgatedinconnectiontherewith;andanadditional
12usetaxofone-eighthofonepercentisleviedandimposedfortheprivilegeofstoring,using
13orconsumingwithinthisstateanyarticleoftangiblepersonalpropertyassetforthand
14providedinthe"CompensatingUseTaxLaw"and,exceptastotheamountofthetax,subject
15totheprovisionsofandtobecollectedasprovidedinthe"CompensatingUseTaxLaw"and
16subjecttotherulesandregulationspromulgatedinconnectiontherewith.
17 2.(1)BeginningonJanuaryfirstofthecalendaryearimmediatelyfollowingthe
18effectivedateofthissubsection,thepercentagesofthetotalrevenuesdescribedin
19subdivision(2)ofthissubsectionthatarederivedfromthesalesandusetaxesleviedand
20imposedundersubsection1ofthissectionshallbeexpendedandusedsolelyasprovided
21insubdivision(2)ofthissubsection.
22 (2)Thepercentagesofthetotalrevenuesdescribedinthissubdivisionthatare
23derivedfromthesalesandusetaxesleviedandimposedundersubsection1ofthis
24sectionshallbeexpendedandusedasfollows:
HJR43 3 25 (a)Fordutiesandresponsibilitiesofthedivisionofstateparksofthedepartment
26ofnaturalresources,tenpercent;and
27 (b)Fordutiesandresponsibilitiesoflocalpoliticalsubdivisionsinwhichland
28ownedbythedepartmentofconservationislocated,tenpercent.
29 (3)(a)Ofthetenpercentofrevenuesforlocalpoliticalsubdivisionsunder
30paragraph(b)ofsubdivision(2)ofthissubsection,theamountapportionedtoeach
31politicalsubdivisionshallbebasedonthenumberofacresoflandownedbythe
32departmentofconservationwithineachsuchpoliticalsubdivision.Suchrevenuesshall
33bedividedanddistributedtosuchpoliticalsubdivisionsinthesameproportionsandin
34thesamemannerasotherrealpropertytaxrevenuesaredividedanddistributedinsuch
35politicalsubdivisions.
36 (b)Theamountsdividedanddistributedunderparagraph(a)ofthissubdivision
37shallbeseparatefromandinadditiontoanypaymentsinlieuofrealpropertytaxes
38madeundersubsection2ofsection43(b)ofthisarticle.
Section43(b).1.Exceptasotherwiseprovidedinsubsection2ofsection43(a)of
2thisarticle,themoneysarisingfromtheadditionalsalesandusetaxesprovidedforin
3subsection1ofsection43(a)[hereof] ofthisarticleandallfees,moneysorfundsarising
4fromtheoperationandtransactionsoftheconservationcommission,departmentof
5conservation,andfromtheapplicationandtheadministrationofthelawsandregulations
6pertainingtothebird,fish,game,forestryandwildliferesourcesofthestateandfromthesale
7ofpropertyusedforsaidpurposes,shallbeexpendedandusedbytheconservation
8commission,departmentofconservation,forthecontrol,management,restoration,
9conservationandregulationofthebird,fish,game,forestryandwildliferesourcesofthe
10state,includingthepurchaseorotheracquisitionofpropertyforsaidpurposes,andforthe
11administrationofthelawspertainingthereto,andfornootherpurpose.
12 2.Exceptasotherwiseprovidedinsubsection1ofsection43(a)ofthisarticle,the
13moneysandfundsoftheconservationcommissionarisingfromtheadditionalsalesanduse
14taxesprovidedforinsubsection1ofsection43(a)[hereof] ofthisarticleshallalsobeused
15bytheconservationcommission,departmentofconservation,tomakepaymentstocounties
16fortheunimprovedvalueoflandfordistributiontotheappropriatepoliticalsubdivisionsas
17paymentinlieuofrealpropertytaxesforallprivatelyownedlandacquiredbythe
18commission[afterJuly1,1977] andforlandclassifiedasforestcroplandintheforest
19croplandprogramadministeredbythedepartmentofconservationinsuchamountsasmaybe
20determinedbytheconservationcommission,butinnoeventshalltheamountdeterminedbe
21lessthanthepropertytaxbeingpaid[atthetimeofpurchaseofacquiredlands] onreal
22propertyownedbyprivatecitizenswithinsuchpoliticalsubdivisionasdeterminedby
HJR43 4 23theannualassessmentofrealpropertyinsuchpoliticalsubdivisionasprovidedunder
24generallaw.
25 3.Thegeneralassemblyshallreviewanyproposedsaleofrealproperty
26administeredbythedepartmentofconservationandanyproposedpurchaseofreal
27propertyfordepartmentofconservationpurposesbeforesuchsaleorpurchaseismade
28final.Aftersuchreview,ifthegeneralassemblydisapprovesofsuchsaleorpurchase,
29thegeneralassemblyshalladoptaconcurrentresolutioninaccordancewithArticleIV,
30Section8oftheConstitutionofMissouritodisapproveandannulsuchsaleorpurchase.
Section43(c).[TheeffectivedateofthisamendmentshallbeJuly1,1977.Alllaws
2inconsistentwiththisamendmentshallnolongerremaininfullforceandeffectafterJuly1,
31977.] Alloftheprovisionsofsections[43(a)-(c)] 43(a)to43(c)ofthisarticleshallbeself-
4enforcingexceptthatthegeneralassemblyshalladjustbracketsforthecollectionofthesales
5andusetaxes.
