1212 2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
1313 3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
1414 4adoptionorrejection,thefollowingamendmenttoArticleVIIoftheConstitutionofthestate

1616 SectionA.ArticleVII,ConstitutionofMissouri,isamendedbyadoptingtwonew
1717 2sections,tobeknownasSections15and16,toreadasfollows:
1818 Section15.1.Exceptasprovidedinsubsection2ofthissection,eachcountyand
1919 2anycitynotwithinacountyshallelectasheriffforatermoffouryearsbyamajorityof
2020 3thequalifiedvotersofthecountyvotingthereonatthetimeofvotingdesignatedfor
2121 4suchofficeprovidedbylawasoftheeffectivedateofthissectionandeveryfouryears

2323 6 2.Theprovisionsofsubsection1ofthissectionshallnotapplytoacountyin
2424 7whichtheofficeofsheriffisnotanelectedofficeasoftheeffectivedateofthissection.
2525 8Suchcountymayrestoretheofficeofsheriffasanelectedofficeasprovidedbylaw,and
2626 9suchrestorationshallbeirrevocable.Acountythatrestorestheofficeofsheriffasan

3333 15Constitutiontothecontrary,everysheriff,inadditiontodutiesassetinlaw,shall
3434 16quellandsuppressassaults,batteries,riots,routs,affrays,andinsurrectionsandshall:
3535 17 (1)Apprehendandcommittojailallfelonsandtraitors;
3636 18 (2)Attendeachdivisionofthecircuitcourtpresidedoverbyacircuitor
3737 19associatecircuitcourtjudgeheldinhisorhercounty,whensodirectedbythecourt;
3838 20and
3939 21 (3)Executeprocess,includingwritsofreplevin,attachments,andfinalprocess
4040 22issuedbycircuitandassociatecircuitjudges,unlessthesheriffofthecountydoesnot
4141 23performsuchdutiesasofAugust28,2026.
4242 24 4.Everysheriffisaconservatorofthepeacewithinhisorhercountyandshall
4343 25causealloffendersagainstthelawtoappearatthenexttermofthecircuitorassociate
4444 26courtofthecounty,andtobecommittedtojailincaseoffailuretogivethe
4545 27recognizance.
4646 28 5.Thesheriffofallcountiesshallhireandappointsuchdeputies,assistants,and
4747 29otheremployeesasthesheriffdeemsnecessaryfortheproperdischargeofthedutiesof
4848 30hisorheroffice,whoshallholdofficeatthewillandpleasureofthesheriff,andmayset
4949 31theircompensationwithinthelimitsoftheallocationsmadeforthatpurpose.
