1818 2sectionadoptedinlieuthereof,tobeknownasSection23,toreadasfollows:
1919 Section23.[Thattherightofeverycitizentokeepandbeararms,ammunition,and
2020 2accessoriestypicaltothenormalfunctionofsucharms,indefenseofhishome,person,
2121 3familyandproperty,orwhenlawfullysummonedinaidofthecivilpower,shallnotbe
2222 4questioned.Therightsguaranteedbythissectionshallbeunalienable.Anyrestrictionon
2323 5theserightsshallbesubjecttostrictscrutinyandthestateofMissourishallbeobligatedto

3333 14notwithstandinganyotherprovisionoflaw,subjecttothefollowing:
3434 15 (1)Anordinanceauthorizingtheissuanceofapermitorcertificatemayprovide
3535 16forthecityorcountytochargeafeethatissufficienttocoverthecostsofissuing
3636 17permitsorcertificatesbutthatdoesnotexceedthecoststherefor.Anypermitsor
3737 18certificatesissuedinaccordancewithsuchordinanceshallnotbevalidformorethan
3838 19fiveyears.Thecityorcountymayobtainbackgroundcheckinformationfromthe
3939 20federalNationalInstantCriminalBackgroundCheckSystemoranyother
4040 21governmentalagencyprovidingsuchinformationservice;
4141 22 (2)Anyordinanceadoptedinaccordancewiththissectionmayapplyto
4242 23nonresidentsaswellasresidentsofthecityorcountybutshallrecognizeasvalidany
4343 24permitorcertificateauthorizingthepossessionorcarryingoffirearmsissuedbythe
4444 25countyofresidenceofthepermitholderorcertificateholder.Anysuchordinanceshall
4545 26alsoexemptanyactivedutyorretiredlawenforcementofficerwhoiscurrentlycertified
4646 27ascompliantwiththepeaceofficerstandardsandtrainingrequiredinthisstate,any
4747 28full-timejudge,andanypersonwhoisrequiredtobearmedasaconditionof
4848 29employmentduringactiveemploymentasalicensedsecurityguardorasagovernment
4949 30employee,includinganymemberofthemilitary;and
5050 31 (3)Anyordinanceadoptedinaccordancewiththissectionmayprovidepenalties
5151 32forviolation,butsuchpenaltiesshallnotexceedafineofonethousanddollarsor
5252 33imprisonmentinthecountyjailforatermofuptooneyear,orboth.Anysuch
5353 34ordinancemayalsoauthorizealawenforcementofficer,uponprobablecause,toseize
5454 35anyfirearminthepossessionofapersonwhoisineligiblebylawtopossessthefirearm.
