| 11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 12 | 12 | | Section A. Chapter 579, RSMo, is amended by add ing thereto 1 |
|---|
| 13 | 13 | | one new section, to be known as section 579.017, to read as 2 |
|---|
| 14 | 14 | | follows:3 |
|---|
| 15 | 15 | | 579.017. 1. (1) A person commits the offense of 1 |
|---|
| 16 | 16 | | possession of an abortifacient drug if he or she knowingly 2 |
|---|
| 17 | 17 | | possesses an abortifacient drug, including, but not limit ed 3 |
|---|
| 18 | 18 | | to, mifepristone (RU -486) or any other drug used alone or in 4 |
|---|
| 19 | 19 | | combination with another to induce an abortion, with the 5 |
|---|
| 20 | 20 | | intent to induce an abortion on themselves or another person. 6 |
|---|
| 21 | 21 | | (2) The offense of possession of an abortifacient drug 7 |
|---|
| 22 | 22 | | is a class C felony. 8 |
|---|
| 23 | 23 | | (3) It shall be an affirmative defense for any person 9 |
|---|
| 24 | 24 | | to allege to have violated this subsection that the person 10 |
|---|
| 25 | 25 | | knowingly possessed the abortifacient drug to induce an 11 |
|---|
| 26 | 26 | | abortion because of a medical emergency, as such term is 12 |
|---|
| 27 | 27 | | defined in section 188.015. 13 |
|---|
| 28 | 28 | | 2. (1) A person commits the offense of delivery of an 14 |
|---|
| 29 | 29 | | abortifacient drug if he or she knowingly distributes or 15 |
|---|
| 30 | 30 | | delivers, attempts to distribute or deliver, or knowingly 16 |
|---|
| 31 | 31 | | possess with an intent to distribute or deliver, an 17 |
|---|
| 32 | 32 | | abortifacient drug, including, but not limited to, 18 SB 119 2 |
|---|
| 33 | 33 | | mifepristone (RU-486) or any other drug used alone or in 19 |
|---|
| 34 | 34 | | combination with another to induce an abortion, with the 20 |
|---|
| 35 | 35 | | intent to induce, or otherwise assist in inducing, an 21 |
|---|
| 36 | 36 | | abortion on another person. 22 |
|---|
| 37 | 37 | | (2) The offense of delivery of an abortifacient drug 23 |
|---|
