88 To amend chapter 579, RSMo, by adding thereto one new section relating to abortifacient drugs,

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Chapter 579, RSMo, is amended by add ing thereto 1
1313 one new section, to be known as section 579.017, to read as 2
1414 follows:3
1515 579.017. 1. (1) A person commits the offense of 1
1616 possession of an abortifacient drug if he or she knowingly 2
1717 possesses an abortifacient drug, including, but not limit ed 3
1818 to, mifepristone (RU -486) or any other drug used alone or in 4
1919 combination with another to induce an abortion, with the 5
2020 intent to induce an abortion on themselves or another person. 6
2121 (2) The offense of possession of an abortifacient drug 7
2222 is a class C felony. 8
2323 (3) It shall be an affirmative defense for any person 9
2424 to allege to have violated this subsection that the person 10
2525 knowingly possessed the abortifacient drug to induce an 11
2626 abortion because of a medical emergency, as such term is 12
2727 defined in section 188.015. 13
2828 2. (1) A person commits the offense of delivery of an 14
2929 abortifacient drug if he or she knowingly distributes or 15
3030 delivers, attempts to distribute or deliver, or knowingly 16
3131 possess with an intent to distribute or deliver, an 17
3232 abortifacient drug, including, but not limited to, 18 SB 119 2
3333 mifepristone (RU-486) or any other drug used alone or in 19
3434 combination with another to induce an abortion, with the 20
3535 intent to induce, or otherwise assist in inducing, an 21
3636 abortion on another person. 22
3737 (2) The offense of delivery of an abortifacient drug 23
3838 is a class C felony. 24
3939 (3) It shall be an affirmative defense for any person 25
4040 to allege to have violated this subsection that the person 26
4141 knowingly distributed or delivered the abortifacient drug to 27
4242 induce an abortion because of a medical emergency, as such 28
4343 term is defined in section 188.015. 29
