1012 Be it enacted by the General Assembly of the State of Missouri, as follows:
11-SectionA.Sections115.105and115.107,RSMo,arerepealedandninenewsections
12-2enactedinlieuthereof,tobeknownassections115.105,115.107,115.1630,130.170,
13-3130.173,130.176,130.179,130.185,and130.188,toreadasfollows:
14-115.105.1.Thechairofthecountycommitteeofeachpoliticalpartynamedonthe
15-2ballotshallhavetherighttodesignateachallengerforeachpollingplace,whomaybe
16-3present[untilall]whileballotsarecaston[thedayof]electionday,orinfirstclasscounties
17-4andchartercounties,duringtheabsenteevotingperiod, andachallengerforeachlocation
18-5atwhichabsenteeballotsarecounted,whomaybepresentwhiletheballotsarebeing
19-6preparedforcountingandcounted.Nolaterthanfourbusinessdaysbefore[theelection] a
20-7challengermayenterapollinglocation, thechairofeachcountycommitteeofeach
21-8politicalpartynamedontheballotshallprovidesignedofficialdesignationformswiththe
22-9namesofthedesignatedchallengersandsubstitutestothelocalelectionauthorityfor
23-10confirmationofeligibilitytoserveasachallenger.Thelocalelectionauthority,after
24-11verifyingtheeligibilityofeachdesignatedandsubstitutechallenger,shallsignoffonthe
25-12officialdesignationforms,unlessthechallengerisfoundnottohavethequalifications
26-13establishedbysubsection4ofthissection.Iftheelectionauthoritydeterminesthata
27-14challengerdoesnotmeetthequalificationsofsubsection4ofthissection,thedesignating
28-15partychairmaydesignateareplacementchallengerandprovidethelocalelectionauthority
29-16withthenameofthereplacementchallengerbefore5:00p.m.oftheMondayprecedingthe

37-23 3.Priortothecloseofthepolls,challengersmaylistandgiveoutthenamesofthose
38-24whohavevoted.Thelistingandgivingoutofnamesofthosewhohavevotedbyachallenger
39-25shallnotbeconsideredgivinginformationtendingtoshowthestateofthecount.
40-26 4.Allpersonsselectedaschallengersshallhavethesamequalificationsrequiredby
41-27section115.085forelectionjudges,exceptthatsuchchallengershallbearegisteredvoterin
42-28thejurisdictionoftheelectionauthorityforwhichthechallengerisdesignatedasachallenger.
43-29 5.Anychallengebyachallengertoavoter'sidentificationforvalidityshallbemade

54-7eligibilitytoserveasawatcher.Thelocalelectionauthority,afterverifyingtheeligibility

13+ Section A. Chapter 130, RSMo, is amended by adding thereto 1
14+six new sections, to be known as sections 130.170, 130.173, 2
15+130.176, 130.179, 130.185, and 130.188, to read as follows:3
16+ 130.170. For purposes of sections 130.170 to 130.188, 1
17+the following terms mean: 2
18+ (1) "Committee", the same meaning as otherwise 3
19+provided in section 130.011, except it shall not include 4
20+candidate committees; 5
21+ (2) "Directly or indirectly", acting either alone or 6
22+jointly with, through, or on behalf of any ot her committee, 7
23+organization, person, or other entity; 8
24+ (3) "Foreign national", any of the following: 9
25+ (a) An individual who is not a citizen or lawful 10
26+permanent resident of the United States of America; 11
27+ (b) A government, or subdivision, o f a foreign country 12
28+or municipality thereof; 13
29+ (c) A foreign political party; 14
30+ (d) Any entity, such as a partnership, association, 15
31+corporation, organization, or other combination of persons, 16 SS SB 152 2
32+that is organized under the laws of, or has its princ ipal 17
33+place of business in, a foreign country; or 18
34+ (e) Any entity organized pursuant to the laws of the 19
35+United States of America or any state thereof that is wholly 20
36+or majority owned by a person or entity described in 21
37+paragraphs (a) to (d) of this subdivision, unless: 22
38+ a. Any contribution or expenditure it makes derives 23
39+entirely from funds generated by the entity's United States 24
40+operations; and 25
41+ b. All decisions concerning the contribution or 26
42+expenditure are made by individuals who are United States 27
43+citizens or lawful permanent residents, except for setting 28
44+overall budget amounts; 29
45+ (4) "Funds obtained through the usual course of 30
46+business", funds generated entirely by the entity's United 31
47+States operations; 32
48+ (5) "Lobbyist", the same meaning as in section 105.470; 33
49+ (6) "Prohibited sources", contributions from or 34
50+expenditures by a foreign national made with the intent to 35
51+use such funds to influence an election on a ballot measure; 36
52+ (7) "Preliminary activity", include s, but is not 37
53+limited to, conducting a poll, drafting ballot measure 38
54+language, conducting a focus group, making telephone calls, 39
55+and travel; 40
56+ (8) "Tax-exempt organization", an organization that is 41
57+described in section 501(c) of the Internal Revenu e Code of 42
58+1986 and is exempt from taxation under section 501(a) of 43
59+such Code. A political organization organized pursuant to 44
60+section 527 of such Code shall not be considered a tax - 45
61+exempt organization. 46
62+ 130.173. 1. Upon creating, forming, or registering a 1
63+committee, the treasurer shall file an accompanying 2 SS SB 152 3
64+certification that no preliminary activity was funded by 3
65+prohibited sources, whether directly or indirectly. 4
66+ 2. After a committee has been created, formed, or 5
67+registered, the committee shall not knowingly or willfully 6
68+receive, solicit, or accept contributions from a prohibited 7
69+source, whether directly or indirectly. 8
70+ 3. Any report filed pursuant to this chapter shall 9
71+include an affirmation that the committee has no t knowingly 10
72+or willfully received, solicited, or accepted, directly or 11
73+indirectly, contributions from a prohibited source. 12
74+ 4. Any committee or person that makes an expenditure 13
75+in support of or in opposition to a ballot measure shall 14
76+keep records of any contribution or expenditure and retain 15
77+such records in the same manner and for the same period of 16
78+time as is required by section 130.036. 17
79+ 130.176. 1. Upon a committee's receipt of a 1
80+contribution of more than two thousand doll ars, the 2
81+treasurer shall obtain from the donor an affirmation that 3
82+the donor is not a foreign national and has not knowingly or 4
83+willfully accepted funds, directly or indirectly, 5
84+aggregating in excess of ten thousand dollars from one or 6
85+more prohibited sources within the two -year period 7
86+immediately preceding the date the contribution is made, in 8
87+the case of an individual, or within the four -year period 9
88+immediately preceding the date the contribution is made, in 10
89+case of any other entity. Receipt of an affirmation by a 11
90+committee pursuant to this subsection shall create a 12
91+rebuttable presumption of compliance with this subsection on 13
92+the part of the committee. Nothing in this subsection shall 14
93+prohibit the attorney general from pursuing any action 15
94+pursuant to section 130.188 if the attorney general has 16
95+found a willful violation of this subsection. 17 SS SB 152 4
96+ 2. Each disclosure report filed pursuant to section 18
97+130.041 shall require the treasurer of a committee to affirm 19
98+that the donor associated with ea ch contribution is not a 20
99+foreign national and has not knowingly or willfully 21
100+received, solicited, or accepted, whether directly or 22
101+indirectly, contributions from one or more prohibited 23
102+sources aggregating in excess of ten thousand dollars within 24
103+the four-year period immediately preceding the date of the 25
104+contribution. 26
105+ 3. Within forty-eight hours of making one or more 27
106+expenditures supporting or opposing a ballot measure, the 28
107+entity making the expenditure shall affirm to the Missouri 29
108+ethics commission that it has not knowingly or willfully 30
109+accepted funds, directly or indirectly, aggregating in 31
110+excess of ten thousand dollars from one or more prohibited 32
111+sources within the four -year period immediately preceding 33
112+the date the expenditure is made a nd that it will not do so 34
113+through the remainder of the calendar year in which the 35
114+ballot measure will appear on the ballot. Each disclosure 36
115+report filed pursuant to section 130.041 shall require the 37
116+entity making the expenditure to affirm that it has not 38
117+knowingly or willfully accepted funds, directly or 39
118+indirectly, aggregating in excess of ten thousand dollars 40
119+from one or more prohibited sources within the four -year 41
120+period immediately preceding the date the expenditure is 42
121+made. Receipt of an affirmation from a donor that it is not 43
122+a foreign national shall create a rebuttable presumption 44
123+that the entity has not knowingly or willingly accepted 45
124+funds, directly or indirectly, aggregating in excess of ten 46
125+thousand dollars from one or more prohibit ed sources. 47
126+Nothing in this subsection shall prohibit the attorney 48
127+general from pursuing any action pursuant to section 130.188 49 SS SB 152 5
128+if the attorney general has found a willful violation of 50
129+this subsection. 51
130+ 4. Notwithstanding any provision of this se ction to 52
131+the contrary, a donor or entity that makes a contribution to 53
132+a committee or an expenditure in support of or in opposition 54
133+to a ballot measure from its own funds obtained through the 55
134+usual course of business or in any commercial or other 56
135+transaction from any source and which are not contributions 57
136+does not violate this section. 58
137+ 5. A committee shall not accept an in -kind 59
138+contribution from any foreign national or from any 60
139+individual or entity that has knowingly or willfully 61
140+accepted funds, directly or indirectly, aggregating in 62
141+excess of ten thousand dollars from one or more foreign 63
142+nationals within the four year period immediately preceding 64
143+the date the in-kind contribution is made. A foreign 65
144+national shall not make an in -kind expenditure for the 66
145+purpose of supporting or opposing any ballot measure. 67
146+ 130.179. 1. A foreign national may not direct, 1
147+dictate, control, or directly or indirectly participate in 2
148+the decision-making process of any person with regard to 3
149+that person's activities to influence an election on a 4
150+ballot measure, such as decisions concerning the making of 5
151+contributions to influence an election on a ballot measure. 6
152+ 2. A foreign national may not solicit, directly or 7
153+indirectly, the makin g of a donation, contribution, or 8
154+expenditure by another person to influence an election on a 9
155+ballot measure. 10
156+ 3. Nothing in sections 130.170 to 130.188 shall be 11
157+deemed to create or eliminate any existing rights or duties 12
158+beyond those specifically enumerated in such sections. 13 SS SB 152 6
159+ 130.185. 1. Lawful donors to a tax -exempt 1
160+organization possess a right of privacy in their donations. 2
161+Any investigation of an alleged violation of sections 3
162+130.170 to 130.188 shall occur in a manner th at shields the 4
163+identity of lawful donors as much as possible. The attorney 5
164+general shall not collect or require the submission of 6
165+information on the identity of any donor to a tax -exempt 7
166+organization other than those directly related to an alleged 8
167+violation of sections 130.170 to 130.188. Any collection or 9
168+required submission of information by the attorney general 10
169+regarding the identity of any donor to a tax -exempt 11
170+organization beyond that permitted by sections 130.170 to 12
171+130.188 shall be deemed a violation of section 105.1500. 13
172+ 2. The attorney general shall not disclose to the 14
173+public, or another government official not directly involved 15
174+in the investigation, information revealing the identity of 16
175+the entity under investigation or any donor to a tax-exempt 17
176+organization, unless the information is regarding the 18
177+identity of the entity or of a donor that engaged in conduct 19
178+prohibited by sections 130.170 to 130.188 after a final 20
179+determination has been made that the entity or donor 21
180+violated sections 130.170 to 130.188. The unlawful 22
181+disclosure of information revealing the identity of any 23
182+entity under investigation or donor to a tax -exempt 24
183+organization in connection with a committee shall be deemed 25
184+a violation of section 105.1500. 26
185+ 130.188. 1. (1) If the attorney general has 1
186+reasonable cause to believe that a person or entity has 2
187+engaged in, is engaging in, or is about to engage in, a 3
188+violation of sections 130.170 to 130.185, the attorney 4
189+general may execute in writing and cause to be served upon 5
190+any person who is believed to have information, documentary 6 SS SB 152 7
191+material, or physical evidence relevant to the alleged or 7
192+suspected violation, a civil investigative demand requiring 8
193+such person to appear and testify , or to produce relevant 9
194+documentary material or physical evidence or examination, at 10
195+such reasonable time and place as may be stated in the civil 11
196+investigative demand, concerning the subject matter of the 12
197+investigation. Service of any civil investiga tive demand, 13
198+notice, or subpoena may be made by any person authorized by 14
199+law to serve process or by any duly authorized employee of 15
200+the attorney general. 16
201+ (2) In the process of a civil investigative demand 17
202+being executed pursuant to subdivision (1 ) of this 18
203+subsection, the provisions of sections 407.040 to 407.090 19
204+shall apply. 20
205+ 2. (1) If the attorney general has reasonable cause 21
206+to believe that a committee, person, or other entity has 22
207+engaged in, is engaging in, or is about to engage in, a 23
208+violation of sections 130.170 to 130.185, the attorney 24
209+general may bring a civil action to enforce sections 130.170 25
210+to 130.188. The provisions of section 130.054 and 105.957 26
211+to 105.963 shall not apply to violations of sections 130.170 27
212+to 130.188. 28
213+ (2) A committee, person, or other entity alleged to 29
214+have violated sections 130.170 to 130.188 shall be provided 30
215+a notice of the civil action, with opportunity for discovery 31
216+and opportunity to be heard as provided by law for civil 32
217+actions generally before being found liable for a violation 33
218+of sections 130.170 to 130.188. 34
219+ (3) In all actions brought pursuant to this section, 35
220+the burden of proof shall be on the attorney general. 36
221+ (4) (a) Prior to discovery, the court shall set a 37
222+hearing to determine if there is probable cause to believe 38 SS SB 152 8
223+that a committee, person, or other entity has violated 39
224+sections 130.170 to 130.188. 40
225+ (b) If, after the hearing, the court determines that 41
226+no probable cause exists to believe that a violation of 42
227+sections 130.170 to 130.188 has occurred, the court shall 43
228+enter an order of dismissal. 44
229+ (c) If, after the hearing, the court determines that 45
230+probable cause does exist to believe that a violation of 46
231+sections 130.170 to 130.188 has occurred, the court s hall 47
232+enter an order to that effect and the case should proceed to 48
233+trial on an expedited basis. 49
234+ (5) Subject to the provisions of section 130.185, the 50
235+committee, person, or other entity alleged to have violated 51
236+sections 130.170 to 130.188 may, at a time to be determined 52
237+by the court prior to the scheduling of trial, present 53
238+evidence sufficient to rebut the probable cause finding by 54
239+making an ex parte presentation of records to the court for 55
240+in-camera review. 56
241+ (6) A non-prevailing party unde r paragraph (c) of 57
242+subdivision (4) of this subsection has the right to: 58
243+ (a) An interlocutory expedited appeal; and 59
244+ (b) A stay of proceedings in the trial court. 60
245+ 3. (1) Within thirty days of a court finding that a 61
246+committee has violated sections 130.170 to 130.188, the 62
247+committee shall refund the contribution to the original 63
248+contributor. In the event of an appeal, the contribution 64
249+shall be placed in escrow, after which the funds shall be 65
250+disbursed in accordance with the final order. 66
251+ (2) If the committee is unable to return the funds, 67
252+the directors, officers, or executive members of the 68
253+campaign committee shall be liable in their personal 69 SS SB 152 9
254+capacity, jointly and severally, for the refund of said 70
255+funds. 71
256+ 4. Within thirty days of a court finding that a 72
257+committee, person, or other entity making an expenditure 73
258+covered by sections 130.170 to 130.188 has violated such 74
259+sections, the committee, person, or other entity shall 75
260+disgorge to the attorney general funds in an amount eq ual to 76
261+the reported cost of the expenditure. If the committee, 77
262+person, or entity is unable to disgorge the requisite funds, 78
263+the person or the directors, officers, or executive members 79
264+of the committee or other entity shall be liable in their 80
265+personal capacities, jointly and severally, for the payment 81
266+of the amount due. In the event of an appeal, the funds 82
267+subject to disgorgement shall be placed in escrow, after 83
268+which they shall be disbursed in accordance with the final 84
269+order. 85
270+ 5. If any lobbyist violates any of the provisions of 86
271+sections 130.170 to 130.188, the lobbyist's registration may 87
272+be revoked or suspended and the lobbyist may be enjoined 88
273+from receiving compensation or making expenditures for 89
274+lobbying. 90
275+ 6. If the attorney gener al prevails in an action 91
276+brought under this section, the court shall award: 92
277+ (1) Injunctive relief sufficient to prevent the 93
278+defendant from violating sections 130.170 to 130.188 or 94
279+engaging in acts that aid or abet violations of such 95
280+sections; and 96
281+ (2) Statutory damages up to twice the amount of the 97
282+prohibited contribution or expenditure. 98
283+ 7. In addition to the penalties in subsection 6 of 99
284+this section and any other remedies provided by law, if the 100
285+court finds a knowingly or willful vi olation of sections 101 SS SB 152 10
286+130.170 to 130.188, the court may assess a penalty of up to 102
287+three times the statutory damages. 103
