8 | 8 | | To amend chapter 167, RSMo, by adding thereto one new section relating to school meals. |

10 | 10 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |

11 | 11 | | Section A. Chapter 167, RSMo, is amended by adding thereto 1 |
---|
12 | 12 | | one new section, to be known as section 167.202, to read as 2 |
---|
13 | 13 | | follows:3 |
---|
14 | 14 | | 167.202. 1. This section shall be known and may be 1 |
---|
15 | 15 | | cited as the "Missouri Free School Meals Program". 2 |
---|
16 | 16 | | 2. As used in this section, the term "school" shall 3 |
---|
17 | 17 | | mean any school district, public sch ool, charter school, or 4 |
---|
18 | 18 | | private, religious, or parochial school. 5 |
---|
19 | 19 | | 3. Each school that participates in the United States 6 |
---|
20 | 20 | | Department of Agriculture National School Lunch Program and 7 |
---|
21 | 21 | | has an identified student percentage below the federal 8 |
---|
22 | 22 | | percentage determined for all meals to be reimbursed at the 9 |
---|
23 | 23 | | free rate through the United States Department of 10 |
---|
24 | 24 | | Agriculture Community Eligibility Provision shall 11 |
---|
25 | 25 | | participate in the Missouri free school meals program. 12 |
---|
26 | 26 | | 4. Each school that participates in the Unit ed States 13 |
---|
27 | 27 | | Department of Agriculture National School Lunch Program and 14 |
---|
28 | 28 | | has an identified student percentage at or above the federal 15 |
---|
29 | 29 | | percentage determined for all meals to be reimbursed at the 16 |
---|
30 | 30 | | free rate through the United States Department of 17 |
---|
31 | 31 | | Agriculture Community Eligibility Provision shall 18 SB 172 2 |

32 | 32 | | participate in the Community Eligibility Provision in order 19 |
---|
33 | 33 | | to participate in the Missouri free school meals program. 20 |
---|
34 | 34 | | 5. Each school that participates in the Missouri free 21 |
---|
35 | 35 | | school meals program shall: 22 |
---|
36 | 36 | | (1) Participate in the United States Department of 23 |
---|
37 | 37 | | Agriculture School Breakfast Program and the United States 24 |
---|
38 | 38 | | Department of Agriculture National School Lunch Program; and 25 |
---|
39 | 39 | | (2) Provide to all students at no cost up to two 26 |
---|
40 | 40 | | federally reimbursable meals per school day, with a maximum 27 |
---|
41 | 41 | | of one free breakfast and one free lunch. 28 |
---|
42 | 42 | | 6. The department of elementary and secondary 29 |
---|
43 | 43 | | education shall provide to every school participating in the 30 |
---|
44 | 44 | | Missouri free school meals program state funding for each 31 |
---|
45 | 45 | | school lunch and breakfast served to a student, with a 32 |
---|
46 | 46 | | maximum of one breakfast and one lunch per student per 33 |
---|
47 | 47 | | school day. The amount of state aid per meal shall be equal 34 |
---|
48 | 48 | | to the difference between the applicable federal 35 |
---|
49 | 49 | | reimbursement rate at that school site for a free meal, as 36 |
---|
50 | 50 | | determined annually by the United States Department of 37 |
---|
51 | 51 | | Agriculture, and the actual federal reimbursement received 38 |
---|
52 | 52 | | by the participating school for the breakfast or lunch 39 |
---|
53 | 53 | | served to the student. 40 |
---|
54 | 54 | | 7. The department of elementary an d secondary 41 |
---|
55 | 55 | | education shall promulgate rules to implement the provisions 42 |
---|
56 | 56 | | of this section. Any rule or portion of a rule, as that 43 |
---|
57 | 57 | | term is defined in section 536.010, that is created under 44 |
---|
58 | 58 | | the authority delegated in this section shall become 45 |
---|
59 | 59 | | effective only if it complies with and is subject to all of 46 |
---|
60 | 60 | | the provisions of chapter 536 and, if applicable, section 47 |
---|
61 | 61 | | 536.028. This section and chapter 536 are nonseverable and 48 |
---|
62 | 62 | | if any of the powers vested with the general assembly 49 |
---|
63 | 63 | | pursuant to chapter 536 to rev iew, to delay the effective 50 SB 172 3 |
---|
64 | 64 | | date, or to disapprove and annul a rule are subsequently 51 |
---|
65 | 65 | | held unconstitutional, then the grant of rulemaking 52 |
---|
66 | 66 | | authority and any rule proposed or adopted after August 28, 53 |
---|
67 | 67 | | 2025, shall be invalid and void. 54 |
