88 To amend chapter 167, RSMo, by adding thereto one new section relating to school meals.

1010 Be it enacted by the General Assembly of the State of Missouri, as follows:
1111 Section A. Chapter 167, RSMo, is amended by adding thereto 1
1212 one new section, to be known as section 167.202, to read as 2
1313 follows:3
1414 167.202. 1. This section shall be known and may be 1
1515 cited as the "Missouri Free School Meals Program". 2
1616 2. As used in this section, the term "school" shall 3
1717 mean any school district, public sch ool, charter school, or 4
1818 private, religious, or parochial school. 5
1919 3. Each school that participates in the United States 6
2020 Department of Agriculture National School Lunch Program and 7
2121 has an identified student percentage below the federal 8
2222 percentage determined for all meals to be reimbursed at the 9
2323 free rate through the United States Department of 10
2424 Agriculture Community Eligibility Provision shall 11
2525 participate in the Missouri free school meals program. 12
2626 4. Each school that participates in the Unit ed States 13
2727 Department of Agriculture National School Lunch Program and 14
2828 has an identified student percentage at or above the federal 15
2929 percentage determined for all meals to be reimbursed at the 16
3030 free rate through the United States Department of 17
3131 Agriculture Community Eligibility Provision shall 18 SB 172 2
3232 participate in the Community Eligibility Provision in order 19
3333 to participate in the Missouri free school meals program. 20
3434 5. Each school that participates in the Missouri free 21
3535 school meals program shall: 22
3636 (1) Participate in the United States Department of 23
3737 Agriculture School Breakfast Program and the United States 24
3838 Department of Agriculture National School Lunch Program; and 25
3939 (2) Provide to all students at no cost up to two 26
4040 federally reimbursable meals per school day, with a maximum 27
4141 of one free breakfast and one free lunch. 28
4242 6. The department of elementary and secondary 29
4343 education shall provide to every school participating in the 30
4444 Missouri free school meals program state funding for each 31
4545 school lunch and breakfast served to a student, with a 32
4646 maximum of one breakfast and one lunch per student per 33
4747 school day. The amount of state aid per meal shall be equal 34
4848 to the difference between the applicable federal 35
4949 reimbursement rate at that school site for a free meal, as 36
5050 determined annually by the United States Department of 37
5151 Agriculture, and the actual federal reimbursement received 38
5252 by the participating school for the breakfast or lunch 39
5353 served to the student. 40
5454 7. The department of elementary an d secondary 41
5555 education shall promulgate rules to implement the provisions 42
5656 of this section. Any rule or portion of a rule, as that 43
5757 term is defined in section 536.010, that is created under 44
5858 the authority delegated in this section shall become 45
5959 effective only if it complies with and is subject to all of 46
6060 the provisions of chapter 536 and, if applicable, section 47
6161 536.028. This section and chapter 536 are nonseverable and 48
6262 if any of the powers vested with the general assembly 49
6363 pursuant to chapter 536 to rev iew, to delay the effective 50 SB 172 3
6464 date, or to disapprove and annul a rule are subsequently 51
6565 held unconstitutional, then the grant of rulemaking 52
6666 authority and any rule proposed or adopted after August 28, 53
6767 2025, shall be invalid and void. 54
