88 To amend chapter 590, RSMo, by adding thereto two new sections relating to grants for nonprofit

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Chapter 590, R SMo, is amended by adding thereto 1
1313 two new sections, to be known as sections 590.1400 and 590.1405, 2
1414 to read as follows:3
1515 590.1400. 1. This section shall establish the 1
1616 "Missouri Task Force on Safety and Security for Nonprofit 2
1717 Organizations", within the department of public safety. The 3
1818 task force shall study and make recommendations on the 4
1919 security needs of nonprofit organizations that are at 5
2020 elevated risk of terrorist attacks or threats which have the 6
2121 potential to endanger individuals or public safety in 7
2222 Missouri, including recommendations: 8
2323 (1) On the administration and funding of a grant 9
2424 program for eligible nonprofit entities as determined by the 10
2525 department to apply for security grants covering security 11
2626 personnel, security training, f acility hardening, and other 12
2727 necessary security measures; and 13
2828 (2) Outreach to and education for nonprofit entities 14
2929 about the grant program and the security grant application 15
3030 process, with a particular focus on engaging and assisting 16
3131 first-time grant applicants. 17 SB 173 2
3232 2. Members of the task force shall be appointed by the 18
3333 director of the department of public safety and shall 19
3434 include: 20
3535 (1) The director of the department of public safety, 21
3636 or his or her designee, who shall serve as chairperson of 22
3737 the task force; 23
3838 (2) The director of the Missouri state highway patrol, 24
3939 or his or her designee; 25
4040 (3) The executive director of the Missouri Sheriffs' 26
4141 Association, or his or her designee; 27
4242 (4) The executive director of the Missouri Pol ice 28
4343 Chiefs Association, or his or her designee; 29
4444 (5) The executive director of a state -wide interfaith 30
4545 or interreligious organization, or his or her designee; and 31
4646 (6) Three representatives from other nonprofit 32
4747 organizations, including faith -based groups, academia, or 33
4848 organizations that work on countering domestic terrorism and 34
4949 extremism. 35
5050 3. Members of the task force shall serve without 36
5151 compensation. Members appointed under subdivisions (5) and 37
5252 (6) of subsection 2 of this section sha ll serve a four year 38
5353 term and may be reappointed. The director of the department 39
5454 of public safety shall fill any vacancies on the task force 40
5555 for members appointed under subdivisions (5) and (6) of 41
5656 subsection 2 of this section. 42
5757 4. The task force shall fix a time and place for its 43
5858 meetings and shall meet at least quarterly. Additional 44
5959 meetings may be held upon the call of the chairperson. 45
6060 5. A majority of the total task force members shall 46
6161 constitute a quorum and any official action taken by the 47
6262 task force shall require an affirmative vote of a majority 48
6363 of the members present and voting. 49 SB 173 3
6464 6. The task force shall issue a report to the 50
6565 department of public safety of its findings and 51
6666 recommendations with respect to the security statu s and 52
6767 needs of nonprofit organizations that are at elevated risk 53
6868 of terrorist attacks in Missouri and recommendations on the 54
6969 appropriate formula and standards for determining security 55
7070 grant recipients. The report shall be issued annually and 56
7171 at such other times as deemed necessary by the task force. 57
7272 The report shall also be provided to the chairperson of the 58
7373 senate committee on appropriations and the house budget 59
7474 committee. 60
7575 7. The department shall develop a grant program to 61
7676 administer funds to eligible nonprofit organizations. 62
7777 8. The department of public safety shall adopt any 63
7878 rules or regulations necessary to create a grant application 64
7979 form identical or substantially similar to the form used by 65
8080 the United States Department of Homel and Security for a 66
8181 nonprofit security grant program. Any rule or portion of a 67
8282 rule, as that term is defined in section 536.010, that is 68
8383 created under the authority delegated in this section shall 69
8484 become effective only if it complies with and is subjec t to 70
8585 all of the provisions of chapter 536 and, if applicable, 71
8686 section 536.028. This section and chapter 536 are 72
8787 nonseverable and if any of the powers vested with the 73
8888 general assembly pursuant to chapter 536 to review, to delay 74
8989 the effective date, or to disapprove and annul a rule are 75
9090 subsequently held unconstitutional, then the grant of 76
9191 rulemaking authority and any rule proposed or adopted after 77
9292 August 28, 2025, shall be invalid and void. 78
9393 9. An eligible organization may receive a grant up to 79
9494 five percent of the available grant pool for that 80
9595 distribution. No grants shall be awarded until the 81 SB 173 4
9696 announcement of the recipients and the amount of the grants 82
9797 awarded under the federal nonprofit security grant program. 83
9898 590.1405. 1. There is hereby created in the state 1
9999 treasury the "Supplemental Nonprofit Safety and Security 2
100100 Grant Program Fund" which shall consist of moneys 3
101101 appropriated, donated, or otherwise made available to 4
102102 eligible nonprofit organizations pursuant to secti on 5
103103 590.1400 that are at elevated risk of terrorist attacks in 6
104104 Missouri. The state treasurer shall be custodian of the 7
105105 fund. In accordance with sections 30.170 and 30.180, the 8
106106 state treasurer may approve disbursements. The fund shall 9
107107 be a dedicated fund and money in the fund shall be used 10
108108 solely by nonprofit organizations for security enhancements 11
109109 or measures for security personnel, security training, 12
110110 facility hardening, and other necessary security measures. 13
111111 2. Notwithstanding the provision s of section 33.080 to 14
112112 the contrary, any moneys remaining in the fund at the end of 15
113113 the biennium shall not revert to the credit of the general 16
114114 revenue fund. 17
115115 3. The state treasurer shall invest moneys in the fund 18
116116 in the same manner as other funds are invested. Any 19
117117 interest and moneys earned on such investments shall be 20
118118 credited to the fund. 21
119119 4. No more than five percent of the funds available 22
120120 annually shall be used for administration expenses 23
121121 associated with the fund. 24
122122 5. The fund shall be used to defray the costs of 25
123123 security enhancements or measures for eligible nonprofit 26
124124 organizations, which shall include: 27
125125 (1) Safety and security planning; 28
126126 (2) Safety and security equipment; 29
127127 (3) Security-related technology; 30 SB 173 5
128128 (4) Safety and security training; 31
129129 (5) Safety and security exercises; 32
130130 (6) Threat awareness and response training; 33
131131 (7) Upgrades to existing structures that enhance 34
132132 safety and security; and 35
133133 (8) Vulnerability and threat assessments. 36
