| 13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 14 | 14 | | Section A. Section 488.426, RSMo, is repealed and one new 1 |
|---|
| 15 | 15 | | section enacted in lieu thereof, to be known as section 488.426, 2 |
|---|
| 16 | 16 | | to read as follows:3 |
|---|
| 17 | 17 | | 488.426. 1. The judges of the circuit court, en banc, 1 |
|---|
| 18 | 18 | | in any circuit in this state may require any party filing a 2 |
|---|
| 19 | 19 | | civil case in the circuit court, at the time of filing the 3 |
|---|
| 20 | 20 | | suit, to deposit with the clerk of the court a surcharge in 4 |
|---|
| 21 | 21 | | addition to all other deposits required by law o r court 5 |
|---|
| 22 | 22 | | rule. Sections 488.426 to 488.432 shall not apply to 6 |
|---|
| 23 | 23 | | proceedings when costs are waived or are to be paid by the 7 |
|---|
| 24 | 24 | | county or state or any city. 8 |
|---|
| 25 | 25 | | 2. The surcharge in effect on August 28, 2001, shall 9 |
|---|
| 26 | 26 | | remain in effect until changed by the circu it court. The 10 |
|---|
| 27 | 27 | | circuit court in any circuit, except the circuit court in 11 |
|---|
| 28 | 28 | | Jackson County, the circuit court in the city of St. Louis, 12 |
|---|
| 29 | 29 | | or the circuit court in any circuit that reimburses the 13 |
|---|
| 30 | 30 | | state for the salaries of family court commissioners under 14 |
|---|
| 31 | 31 | | and pursuant to section 487.020, may change the fee to any 15 |
|---|
| 32 | 32 | | amount not to exceed fifteen dollars. The circuit court in 16 |
|---|
| 33 | 33 | | Jackson County, the circuit court in the city of St. Louis, 17 |
|---|
| 34 | 34 | | or the circuit court in any circuit that reimburses the 18 SB 18 2 |

| 35 | 35 | | state for the salari es of family court commissioners under 19 |

| 36 | 36 | | and pursuant to section 487.020 may change the fee to any 20 |

| 37 | 37 | | amount not to exceed twenty dollars. A change in the fee 21 |
