1010 To repeal section 488.426, RSMo, and to enact in lieu thereof one new section relating to court

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 488.426, RSMo, is repealed and one new 1
1515 section enacted in lieu thereof, to be known as section 488.426, 2
1616 to read as follows:3
1717 488.426. 1. The judges of the circuit court, en banc, 1
1818 in any circuit in this state may require any party filing a 2
1919 civil case in the circuit court, at the time of filing the 3
2020 suit, to deposit with the clerk of the court a surcharge in 4
2121 addition to all other deposits required by law o r court 5
2222 rule. Sections 488.426 to 488.432 shall not apply to 6
2323 proceedings when costs are waived or are to be paid by the 7
2424 county or state or any city. 8
2525 2. The surcharge in effect on August 28, 2001, shall 9
2626 remain in effect until changed by the circu it court. The 10
2727 circuit court in any circuit, except the circuit court in 11
2828 Jackson County, the circuit court in the city of St. Louis, 12
2929 or the circuit court in any circuit that reimburses the 13
3030 state for the salaries of family court commissioners under 14
3131 and pursuant to section 487.020, may change the fee to any 15
3232 amount not to exceed fifteen dollars. The circuit court in 16
3333 Jackson County, the circuit court in the city of St. Louis, 17
3434 or the circuit court in any circuit that reimburses the 18 SB 18 2
3535 state for the salari es of family court commissioners under 19
3636 and pursuant to section 487.020 may change the fee to any 20
3737 amount not to exceed twenty dollars. A change in the fee 21
3838 shall become effective and remain in effect until further 22
3939 changed. 23
4040 3. Sections 488.426 to 4 88.432 shall not apply to 24
4141 proceedings when costs are waived or are paid by the county 25
4242 or state or any city. 26
4343 [4. In addition to any fee authorized by subsection 1 27
4444 of this section, any county of the first classification with 28
4545 more than one hundred o ne thousand but fewer than one 29
4646 hundred fifteen thousand inhabitants may impose an 30
4747 additional fee of ten dollars excluding cases concerning 31
4848 adoption and those in small claims court. The provisions of 32
4949 this subsection shall expire on December 31, 2019. ] 33
