10 | 10 | | To repeal sections 57.010 and 57.530, RSMo, and to enact in lieu thereof two new sections relating |

13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
14 | 14 | | Section A. Sections 57.010 and 57.530, RSMo, are repealed 1 |
---|
15 | 15 | | and two new sections enacted in lieu thereof, to be known as 2 |
---|
16 | 16 | | sections 57.010 and 57.530, to read as follows:3 |
---|
17 | 17 | | 57.010. 1. At the general election to be held in 1 |
---|
18 | 18 | | 1948, and at each general election held every four years 2 |
---|
19 | 19 | | thereafter, the voters in every county in this state shall 3 |
---|
20 | 20 | | elect some suitable person sheriff. No person shall be 4 |
---|
21 | 21 | | eligible for the office of sheriff who has been convicted of 5 |
---|
22 | 22 | | a felony. Such person shall be a resident taxpayer and 6 |
---|
23 | 23 | | elector of said county, shall have resided in said county 7 |
---|
24 | 24 | | for more than one whole year next before filing for said 8 |
---|
25 | 25 | | office and shall be a person capab le of efficient law 9 |
---|
26 | 26 | | enforcement. When any person shall be elected sheriff, such 10 |
---|
27 | 27 | | person shall enter upon the discharge of the duties of such 11 |
---|
28 | 28 | | person's office as chief law enforcement officer of that 12 |
---|
29 | 29 | | county on the first day of January next succeeding sai d 13 |
---|
30 | 30 | | election. 14 |

31 | 31 | | 2. No person shall be eligible for the office of 15 |
---|
32 | 32 | | sheriff who does not hold a valid peace officer license 16 |
---|
33 | 33 | | pursuant to chapter 590. Any person filing for the office 17 |
---|
34 | 34 | | of sheriff shall have a valid peace officer license at the 18 SB 192 2 |

35 | 35 | | time of filing for office. This subsection shall not apply 19 |
---|
36 | 36 | | to the sheriff of any county of the first classification 20 |
---|
37 | 37 | | with a charter form of government with a population over 21 |
---|
38 | 38 | | nine hundred thousand or of any city not within a county. 22 |

39 | 39 | | 3. The sheriff of any cit y not within a county shall 23 |
---|
40 | 40 | | be required to hold a valid peace officer license pursuant 24 |
---|
41 | 41 | | to chapter 590 within two years of being elected as sheriff. 25 |

42 | 42 | | 57.530. The sheriff of the City of St. Louis shall, 1 |
---|
43 | 43 | | with the approval of a majority o f the circuit judges of the 2 |
---|
44 | 44 | | circuit court of said city, appoint as many deputies and 3 |
---|
45 | 45 | | assistants as may be necessary to perform the duties of his 4 |
---|
46 | 46 | | or her office[, and ]. The annual compensation for 5 |
---|
47 | 47 | | sheriff's deputies shall be no less than fifty thousand 6 |
---|
48 | 48 | | dollars. The sheriff shall fix the compensation for [their 7 |
---|
49 | 49 | | services] deputy assistants, which compensation, however, 8 |
---|
50 | 50 | | shall not in any case exceed the annual rate of compensation 9 |
---|
51 | 51 | | fixed by the board of aldermen of the City of St. Louis 10 |
