FIRST REGULAR SESSION SENATE BILL NO. 201 103RD GENERAL ASSEMBLY INTRODUCED BY SENATOR BEAN. 0666S.01I KRISTINA MARTIN, Secretary AN ACT To amend chapter 161, RSMo, by adding thereto one new section relating to appeals of decisions made by statewide activities associations. Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Chapter 161, RSMo, is amended by adding thereto 1 one new section, to be known as section 161.028, to read as 2 follows:3 161.028. 1. For purposes of this section, "activities 1 association" shall mean any nonprofit statewide organization 2 that facilitates interscholastic activities for secondary 3 school students, and whose members include at least one 4 public school district that pays any fees to such 5 association, including, but not limited to, activity 6 participation fees, tournament registration fees, membership 7 fees, or any other fees relating to membership in such 8 association or participation in any activities facilitated 9 by such association. 10 2. An activities association shall not serve as the 11 appellate body responsible for handling appeals relating to 12 any decisions or rulings made by such activities association. 13 3. The state board of education shall serve as the 14 appellate body responsible for handling appeals relating to 15 any decisions or rulings made by an activities association. 16 4. Within forty-eight hours of receiving an appeal 17 relating to a decision or ruling made by an activities 18 SB 201 2 association, the state board of education shall convene a 19 meeting to consider the appeal. Within twenty-four hours of 20 such meeting, the state board of educati on shall rule on the 21 appeal, and such ruling shall be final. 22 5. The state board of education shall promulgate rules 23 to implement the provisions of this section. Any rule or 24 portion of a rule, as that term is defined in section 25 536.010, that is created under the authority delegated in 26 this section shall become effective only if it complies with 27 and is subject to all of the provisions of chapter 536 and, 28 if applicable, section 536.028. This section and chapter 29 536 are nonseverable and if any o f the powers vested with 30 the general assembly pursuant to chapter 536 to review, to 31 delay the effective date, or to disapprove and annul a rule 32 are subsequently held unconstitutional, then the grant of 33 rulemaking authority and any rule proposed or adop ted after 34 August 28, 2025, shall be invalid and void. 35
