7-To amend chapter 37, RSMo, by adding thereto three
8-new sections relating to the Missouri geospatial
9-advisory council.

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
12- Section A. Chapter 37, RSMo, is amended by adding thereto
13-three new sections, to be known as sections 37.1300, 37.1310,
14-and 37.1320, to read as follows:
15- 37.1300. For the purposes of sections 37.1300 to
16-37.1330, the following terms mean:
17- (1) "Council", the Missouri geospatial advisory
18-council established in section 37.1310;
19- (2) "Geographic information system (GIS)", a computer
20-system for capturing, storing, checking, and displaying data
21-related to positions on the Earth's surface that enables
22-easily seeing, analyzing, and understanding patterns and
23-relationships;
24- (3) "Geospatial", relating to or denoting data that is
25-associated with a particular location;
26- (4) "Missouri Spatial Data Information Service" or
27-"MSDIS", Missouri's primary spatial data clearinghouse
28-responsible for collecting and distributing vector data,
29-aerial photography, and light detection and ranging
30-elevation data that are generated, updated, and funded by
31-state, local, and regional agencies and governments.
32- 37.1310. There is hereby established within the office
33-of administration the "Missouri Geospatial Advisory
34-Council", which is charged with assisting and advising the
35-state in ensuring the availability, implementation, and
36- 2
37-enhancement of a statewide geospatial data infrastructure
38-common to all jurisdictions. The council shall be
39-established within the information technology services
40-division of the office of administration. The council shall
41-serve to support the exist ing geospatial infrastructure
42-within the state of Missouri, including oversight of MSDIS
43-and strive toward immediate access to statewide geospatial
44-data for all citizens of this state, especially life -safety
45-entities including NG9 -1-1.
46- 37.1320. 1. The council shall consist of members that
47-represent a cross-section of subject matter experts striking
48-a geographic balance from all regions across the state.
49-Representation should at a minimum include:
50- (1) The commissioner of admini stration, or the
51-commissioner's designee;
52- (2) The director of the department of conservation, or
53-the director's designee;
54- (3) The director of the department of economic
55-development, or the director's designee;
56- (4) The director of the d epartment of health and
57-senior services, or the director's designee;
58- (5) The director of the department of natural
59-resources, or the director's designee;
60- (6) The adjutant general of the department of the
61-national guard, or the adjutant gener al's designee;
62- (7) The director of the department of public safety,
63-or the director's designee;
64- (8) The director of the department of transportation,
65-or the director's designee;
66- (9) The director of the United States Geological
67-Survey, or the director's designee;

69- (10) The director of the United States Department of
70-Agriculture – Natural Resource Conservation Service, or the
71-director's designee;
72- (11) The director of the Missouri 911 service board,
73-or the director's designee ;
74- (12) The director of the Missouri Spatial Data
75-Information Service, or the director's designee;
76- (13) The director of the state land surveyor program,
77-or the director's designee; and
78- (14) No less than fourteen citizens of Missouri,
79-appointed by the commissioner of administration or the
80-commissioner's designee. Such individuals shall represent
81-federal, city, county, and local government; the private
82-sector; public safety; and academia.
83- 2. By invitation of the council, addition al subject
84-matter experts may participate in activities as non -council
85-members and do not require an appointment by the
86-commissioner of administration.
87- 3. Appointed members of the council shall serve two -
88-year terms and shall serve until their suc cessors are
89-appointed. Vacancies on the council shall be filled in the
90-same manner as the original appointment and such member
91-appointed shall serve the remainder of the unexpired term.
92- 4. The council shall convene, at a minimum, quarterly
93-and as otherwise required by the commissioner of
94-administration or the office of geospatial information.
95- 5. The council shall designate from its members a
96-chair and chair-elect for one-year terms and shall adopt
97-written guidelines to govern the managem ent of the council.
98- 6. Each appointed member of the council shall serve
99-without compensation but may be reimbursed for the actual
100-and necessary expenses incurred in the performance of their
101- 4
102-duties as members of the council, subject to appropriatio ns
103-for the council.
104- 7. The council shall designate from its members an
105-executive secretary for the council, who shall maintain the
106-records and decisions of the council's activities in
107-accordance with state statute and shall be responsible for
108-correspondence between the council and other agencies.
109- 8. The council shall not collect any personally
110-identifiable information of any individual person. For
111-purposes of this subsection, the term "personally
112-identifiable information" means informat ion that can be used
113-to distinguish or trace an individual's identity, such as
114-name, social security number, or biometric data records,
115-either alone or when combined with other personal or
116-identifying information that is linked or linkable to a
117-specific individual.

38+training, and education. The council shall represent all 7
39+entities and jurisdictions before appropriate policy -making 8
40+authorities and the general assembly and shall strive 9
41+towards the immediate access to statewide geospatial data 10
42+for all citizens of this state, especially life -safety 11
43+entities. The council shall be established within the 12
44+office of the commissioner of administration. 13
45+ 37.1320. 1. The council shall consist of members as 1
46+follows: 2
47+ (1) The commissioner of administration, or the 3
48+commissioner's designee; 4
49+ (2) The director of the department of agriculture, or 5
50+the director's designee; 6
51+ (3) The director of the department of conser vation, or 7
52+the director's designee; 8
53+ (4) The director of the department of economic 9
54+development, or the director's designee; 10
55+ (5) The director of the department of elementary and 11
56+secondary education, or the director's designee; 12
57+ (6) The director of the department of health and 13
58+senior services, or the director's designee; 14
59+ (7) The director of the department of natural 15
60+resources, or the director's designee; 16
61+ (8) The Missouri military advocate, or the advocate's 17

63+ (9) The adjutant general of the department of the 19
64+national guard, or the adjutant general's designee; 20
65+ (10) The director of the department of public safety, 21
66+or the director's designee; 22
67+ (11) The director of the department of revenue, or the 23

70+services, or the director's designee; 26
71+ (13) The director of the department of transportation, 27
72+or the director's designee; 28
73+ (14) The director of the United States Geological 29
74+Survey, or the director's designee; 30
75+ (15) The director of the United States Department of 31
76+Agriculture – Natural Resource Conservation Service, or the 32
77+director's designee; 33
78+ (16) The director of the Missouri 911 service board, 34
79+or the director's designee; 35
80+ (17) The president of the University of Missouri 36
81+system, or the president's designee; 37
82+ (18) The director of the Missouri Spatial Data 38
83+Information Service, or the director's designee; 39
84+ (19) The director of the National Geospatial 40
85+Intelligence Agency-West, or the director's designee; 41
86+ (20) A member of the state senate, appointed by the 42
87+president pro tempore of the senate; 43
88+ (21) A member of the house of representatives, 44
89+appointed by the speaker of the house of represent atives; 45
90+ (22) Thirteen citizens of Missouri, appointed by the 46
91+commissioner of administration. Such individuals shall 47
92+represent a geographic balance from within the state, 48
93+representing both rural and urban areas with at least one 49
94+individual from each of the seven Missouri economic 50 SB 204 4
95+development regions, as determined by the Missouri economic 51
96+research information center. Such individuals shall 52
97+additionally represent city, county, and local government; 53
98+the private sector; public safety; and academ ia; and 54
99+ (23) Additional subject matter experts may participate 55
100+in activities as non -council members. 56
101+ 2. Appointed members of the council shall serve three - 57
102+year terms and shall serve until their successors are 58
103+appointed. Vacancies on the cou ncil shall be filled in the 59
104+same manner as the original appointment and such member 60
105+appointed shall serve the remainder of the unexpired term. 61
106+ 3. The council shall meet monthly and as otherwise 62
107+required by the commissioner of the office of adminis tration. 63
108+ 4. The council shall designate from its members a 64
109+chair and chair-elect for one-year terms and shall adopt 65
110+written guidelines to govern the management of the council. 66
111+ 5. Each member of the council shall serve without 67
112+compensation but may be reimbursed for his or her actual and 68
113+necessary expenses incurred in the performance of his or her 69
114+duties as a member of the council. 70
115+ 6. The commissioner of the office of administration 71
116+shall designate an employee of the office of administ ration 72
117+as executive secretary for the council, who shall serve as a 73
118+nonvoting member and shall maintain the records of the 74
119+council's activities and decisions and shall be responsible 75
120+for correspondence between the council and other agencies. 76
121+ 7. The council may apply for federal and state grant 77
122+programs to sponsor and publish surveys of the condition and 78
123+needs of geographic information in the state of Missouri and 79
124+to solicit or develop proposals for projects to be carried 80
125+out in the state for b uilding and improving the state 81
126+geospatial data infrastructure and workforce. 82 SB 204 5
127+ 8. The council may apply for federal and state grant 83
128+programs and conduct other business as it relates to the 84
129+development of geospatial workforce within Missouri. 85
130+ 9. The council shall provide recommendations on budget 86
131+and staffing needs as it relates to the development of 87
132+geospatial related projects and initiatives to the office of 88
133+administration. 89
134+ 37.1330. The council shall have the following duties: 1
135+ (1) To establish public and private partnerships 2
136+throughout Missouri to maximize value, minimize cost, and 3
137+avoid redundant activities in the development and 4
138+implementation of geographic information systems; 5
139+ (2) To foster efficient an d secure methods for data 6
140+sharing at all levels of government; 7
141+ (3) To coordinate, review, and provide recommendations 8
142+on geographic information systems programs and investments, 9
143+and to provide assistance with dispute resolution among 10
144+geographic systems partners; 11
145+ (4) To continue to establish Missouri's leadership 12
146+role in the national effort to improve capabilities for 13
147+sharing geographic information and ideas with other states; 14
148+ (5) To promote the use of geographic information 15
149+systems technologies as tools for breaking through 16
150+structural and administrative boundaries in order to 17
151+collaborate on shared problems and enhance information 18
152+analysis and decision -making processes within all levels of 19
153+government; 20
154+ (6) To provide input and recommendations for the 21
155+development of a strategy for the maintenance and funding of 22
156+a statewide base map and geographic information system; 23
157+ (7) To work jointly with officials from other state 24
158+agencies, organizations, and county, municipal, and tribal 25 SB 204 6
159+governments as well as with businesses and organizations in 26
160+the private sector that are concerned with the efficient 27
161+management of the state's geographic information systems 28
162+resources; 29
163+ (8) To recommend the development and adoption of 30
164+policies and procedures related to geographic information 31
165+and geographic information systems; 32
166+ (9) To serve as the statewide governing body for 33
167+sharing and managing geospatial framework data; and 34
168+ (10) To provide oversight and guidance to the Misso uri 35
169+spatial data information service and provide recommendations 36
170+on budget and staffing needs to the office of administration 37
171+to implement the Missouri geospatial advisory council 38
172+recommendations. 39
