FIRST REGULAR SESSION SENATE BILL NO. 212 103RD GENERAL ASSEMBLY INTRODUCED BY SENATOR FITZWATER. 0636S.01I KRISTINA MARTIN, Secretary AN ACT To amend chapter 171, RSMo, by adding thereto one new section relating to the physical privacy of students. Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Chapter 171, RSMo, is amended by adding th ereto 1 one new section, to be known as section 171.425, to read as 2 follows:3 171.425. 1. For the purposes of this section, the 1 following terms shall mean: 2 (1) "Biological sex", the physical condition of being 3 male or female, identified at bir th by a person's anatomy 4 and indicated on their birth certificate; 5 (2) "Public school", the same as defined in section 6 160.011. 7 2. In every public school setting in which a student 8 may be in a state of undress in the presence of other 9 students, school personnel shall provide separate, distinct 10 areas designated for use by students based on their 11 biological sex to ensure the personal privacy and safety of 12 students. 13 3. Every public school shower room, locker room, and 14 restroom designated for student use and which is accessible 15 by multiple students at the same time shall be designated 16 for and used only by students of the same biological sex. 17 At no time shall a student be allowed to access a public 18 SB 212 2 school shower room, locker room, o r restroom designated for 19 use by the opposite biological sex. 20 4. (1) A student who asserts to school officials that 21 his or her gender is different from his or her biological 22 sex may be provided with alternative shower room, locker 23 room, or restroom accommodations, provided that a parent or 24 legal guardian of a minor child who makes such assertion 25 shall provide written consent to use of such alternative 26 accommodations. Such accommodations shall not include the 27 use of student shower rooms, lock er rooms, or restrooms 28 designated for use by students of the opposite biological 29 sex. 30 (2) Acceptable accommodations may include, but are not 31 limited to, controlled use of faculty shower rooms, locker 32 rooms, or restrooms, or access to single -stall restrooms and 33 unisex bathrooms. 34
