| 11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 12 | 12 | | Section A. Chapter 71, RSMo, is amended by adding thereto 1 |
|---|
| 13 | 13 | | one new section, to be known as section 71.295, to read as 2 |
|---|
| 14 | 14 | | follows:3 |
|---|
| 15 | 15 | | 71.295. 1. For the purposes of this section, 1 |
|---|
| 16 | 16 | | "request" shall mean an application to a political 2 |
|---|
| 17 | 17 | | subdivision for a permit, license, varianc e, or any other 3 |
|---|
| 18 | 18 | | type of prior approval from a political subdivision for an 4 |
|---|
| 19 | 19 | | action related to the development or improvement of property. 5 |
|---|
| 20 | 20 | | 2. If an applicant submits a request to a political 6 |
|---|
| 21 | 21 | | subdivision, then the political subdivision shall approve or 7 |
|---|
| 22 | 22 | | deny the applicant's request within sixty days. 8 |
|---|
| 23 | 23 | | (1) If the political subdivision fails to approve or 9 |
|---|
| 24 | 24 | | deny the applicant's request within sixty days, then the 10 |
|---|
| 25 | 25 | | request is approved. 11 |
|---|
| 26 | 26 | | (2) The time limit in this subsection begins upon the 12 |
|---|
| 27 | 27 | | political subdivision's receipt of a request from an 13 |
|---|
| 28 | 28 | | applicant. 14 |
|---|
| 29 | 29 | | (3) If the political subdivision approves the request, 15 |
|---|
| 30 | 30 | | then the political subdivision may not impose on the 16 |
|---|
| 31 | 31 | | applicant any additional requirements related to the request. 17 SB 229 2 |

| 32 | 32 | | (4) If the political subdivision denies the request, 18 |
|---|
| 33 | 33 | | then the political subdivision shall provide the applicant a 19 |
|---|
| 34 | 34 | | statement in writing of the reasons for the denial. 20 |
|---|
| 35 | 35 | | (5) If a political subdivision denies a request for 21 |
|---|
| 36 | 36 | | being incomplete, then the political sub division shall 22 |
|---|
| 37 | 37 | | provide the applicant a statement in writing of the reasons 23 |
|---|
| 38 | 38 | | the request is incomplete. The request is incomplete if it 24 |
|---|
| 39 | 39 | | fails to contain all information required by law or by a 25 |
|---|
| 40 | 40 | | previously adopted rule, ordinance, or policy of the 26 |
|---|
| 41 | 41 | | political subdivision. 27 |
|---|
| 42 | 42 | | 3. The time limit in subsection 2 of this section may 28 |
|---|
| 43 | 43 | | be extended if: 29 |
|---|
| 44 | 44 | | (1) A request requires prior approval of a state or 30 |
|---|
| 45 | 45 | | federal agency, then the deadline shall be extended to sixty 31 |
|---|
| 46 | 46 | | days after the required prior approval is granted. The 32 |
|---|
| 47 | 47 | | extension shall not exceed sixty days, unless agreed to by 33 |
|---|
| 48 | 48 | | the applicant; or 34 |
|---|
