88 To amend chapter 71, RSMo, by adding thereto one new section relating to permits for
99 development of real property from political subdivisions.

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Chapter 71, RSMo, is amended by adding thereto 1
1313 one new section, to be known as section 71.295, to read as 2
1414 follows:3
1515 71.295. 1. For the purposes of this section, 1
1616 "request" shall mean an application to a political 2
1717 subdivision for a permit, license, varianc e, or any other 3
1818 type of prior approval from a political subdivision for an 4
1919 action related to the development or improvement of property. 5
2020 2. If an applicant submits a request to a political 6
2121 subdivision, then the political subdivision shall approve or 7
2222 deny the applicant's request within sixty days. 8
2323 (1) If the political subdivision fails to approve or 9
2424 deny the applicant's request within sixty days, then the 10
2525 request is approved. 11
2626 (2) The time limit in this subsection begins upon the 12
2727 political subdivision's receipt of a request from an 13
2828 applicant. 14
2929 (3) If the political subdivision approves the request, 15
3030 then the political subdivision may not impose on the 16
3131 applicant any additional requirements related to the request. 17 SB 229 2
3232 (4) If the political subdivision denies the request, 18
3333 then the political subdivision shall provide the applicant a 19
3434 statement in writing of the reasons for the denial. 20
3535 (5) If a political subdivision denies a request for 21
3636 being incomplete, then the political sub division shall 22
3737 provide the applicant a statement in writing of the reasons 23
3838 the request is incomplete. The request is incomplete if it 24
3939 fails to contain all information required by law or by a 25
4040 previously adopted rule, ordinance, or policy of the 26
4141 political subdivision. 27
4242 3. The time limit in subsection 2 of this section may 28
4343 be extended if: 29
4444 (1) A request requires prior approval of a state or 30
4545 federal agency, then the deadline shall be extended to sixty 31
4646 days after the required prior approval is granted. The 32
4747 extension shall not exceed sixty days, unless agreed to by 33
4848 the applicant; or 34
4949 (2) The applicant requests an extension in writing. 35
