88 To amend chapter 135, RSMo, by adding thereto one new section relating to tax credits.

1010 Be it enacted by the General Assembly of the State of Missouri, as follows:
1111 Section A. Chapter 135, RSMo, is amended by adding thereto 1
1212 one new section, to b e known as section 135.2560, to read as 2
1313 follows:3
1414 135.2560. 1. Notwithstanding any provision of law to 1
1515 the contrary, no person or entity shall be authorized to 2
1616 receive any tax credit pursuant to any provision of law if 3
1717 such person or entity pays for an employee of such person or 4
1818 entity to obtain an abortion, as such term is defined in 5
1919 section 188.015. The payment of all or any portion of an 6
2020 employee's health insurance premiums shall not be considered 7
2121 a payment for the purposes of this section . 8
2222 2. Administering agencies, as such term is defined in 9
2323 section 135.800, may promulgate rules to implement the 10
2424 provisions of this section. Any rule or portion of a rule, 11
2525 as that term is defined in section 536.010, that is created 12
2626 under the authority delegated in this section shall become 13
2727 effective only if it complies with and is subject to all of 14
2828 the provisions of chapter 536 and, if applicable, section 15
2929 536.028. This section and chapter 536 are nonseverable and 16
3030 if any of the powers vested wi th the general assembly 17
3131 pursuant to chapter 536 to review, to delay the effective 18
3232 date, or to disapprove and annul a rule are subsequently 19 SB 253 2
3333 held unconstitutional, then the grant of rulemaking 20
3434 authority and any rule proposed or adopted after August 28, 21
3535 2025, shall be invalid and void. 22
