| 8 | 8 | | To amend chapter 135, RSMo, by adding thereto one new section relating to tax credits. |

| 10 | 10 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 11 | 11 | | Section A. Chapter 135, RSMo, is amended by adding thereto 1 |
|---|
| 12 | 12 | | one new section, to b e known as section 135.2560, to read as 2 |
|---|
| 13 | 13 | | follows:3 |
|---|
| 14 | 14 | | 135.2560. 1. Notwithstanding any provision of law to 1 |
|---|
| 15 | 15 | | the contrary, no person or entity shall be authorized to 2 |
|---|
| 16 | 16 | | receive any tax credit pursuant to any provision of law if 3 |
|---|
| 17 | 17 | | such person or entity pays for an employee of such person or 4 |
|---|
| 18 | 18 | | entity to obtain an abortion, as such term is defined in 5 |
|---|
| 19 | 19 | | section 188.015. The payment of all or any portion of an 6 |
|---|
| 20 | 20 | | employee's health insurance premiums shall not be considered 7 |
|---|
| 21 | 21 | | a payment for the purposes of this section . 8 |
|---|
| 22 | 22 | | 2. Administering agencies, as such term is defined in 9 |
|---|
| 23 | 23 | | section 135.800, may promulgate rules to implement the 10 |
|---|
| 24 | 24 | | provisions of this section. Any rule or portion of a rule, 11 |
|---|
| 25 | 25 | | as that term is defined in section 536.010, that is created 12 |
|---|
| 26 | 26 | | under the authority delegated in this section shall become 13 |
|---|
| 27 | 27 | | effective only if it complies with and is subject to all of 14 |
|---|
| 28 | 28 | | the provisions of chapter 536 and, if applicable, section 15 |
|---|
| 29 | 29 | | 536.028. This section and chapter 536 are nonseverable and 16 |
|---|
| 30 | 30 | | if any of the powers vested wi th the general assembly 17 |
|---|
| 31 | 31 | | pursuant to chapter 536 to review, to delay the effective 18 |
|---|
| 32 | 32 | | date, or to disapprove and annul a rule are subsequently 19 SB 253 2 |

| 33 | 33 | | held unconstitutional, then the grant of rulemaking 20 |
|---|
| 34 | 34 | | authority and any rule proposed or adopted after August 28, 21 |
