| 8 | 8 | | To repeal section 260.003, RSMo, and to enact in lieu thereof one new section relating to duties |

| 11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |

| 12 | 12 | | Section A. Section 260.003, RS Mo, is repealed and one new 1 |
|---|
| 13 | 13 | | section enacted in lieu thereof, to be known as section 260.003, 2 |
|---|
| 14 | 14 | | to read as follows:3 |

| 15 | 15 | | 260.003. Notwithstanding any provision of this 1 |
|---|
| 16 | 16 | | chapter, the department of natural resources shall require 2 |
|---|
| 17 | 17 | | that before any permit, lice nse, or grant of authority is 3 |
|---|
| 18 | 18 | | issued or renewed by the department of natural resources 4 |
|---|
| 19 | 19 | | pursuant to this chapter, the local jurisdiction shall 5 |
|---|
| 20 | 20 | | verify that the person and activity which is the subject of 6 |
|---|
| 21 | 21 | | such permit, license, or grant of authority to which any 7 |
|---|
| 22 | 22 | | preliminary or final application was first received by the 8 |
|---|
| 23 | 23 | | department, is in compliance with all applicable local 9 |
|---|
| 24 | 24 | | zoning, building, and health codes, ordinances, and orders 10 |
|---|
| 25 | 25 | | with regard to the person and activity regulated pursuant 11 |
|---|
| 26 | 26 | | to this chapter. Failure of the local jurisdiction to 12 |
|---|
| 27 | 27 | | respond to a request from the department of natural 13 |
|---|
| 28 | 28 | | resources for such verification within thirty days of such 14 |
|---|
| 29 | 29 | | request shall be deemed to be verification of local 15 |
|---|
| 30 | 30 | | compliance. The department of natural resourc es shall not 16 |
|---|
| 31 | 31 | | deny any preliminary or final application for a permit, 17 |
|---|
| 32 | 32 | | license, or grant of authority under this section based on a 18 SB 269 2 |
|---|
| 33 | 33 | | local zoning, building, health code, ordinance, or order if 19 |
|---|
| 34 | 34 | | the local zoning, building, health code, ordinance, or order 20 |
|---|
| 35 | 35 | | was enacted following the filing of the application. 21 |
