88 To repeal sections 337.035, 337.330, 337.525, 337.630, and 337.730, RSMo, and to enact in lieu
99 thereof five new sections relating to conversion therapy for minors.

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Sections 337.035, 337.330, 337.525, 337.630, 1
1313 and 337.730, RSMo, are repealed and five new sections enacted 2
1414 in lieu thereof, to be known as sections 337.035, 337.330, 3
1515 337.525, 337.630, and 337.730, to read as follows:4
1616 337.035. 1. The committee may refuse to issue any 1
1717 certificate of registration or authority, permit or license 2
1818 required pursuant to this chapter for one or any combination 3
1919 of causes stated in subsection 2 of this section. The 4
2020 committee shall notify the applicant in wri ting of the 5
2121 reasons for the refusal and shall advise the applicant of 6
2222 the applicant's right to file a complaint with the 7
2323 administrative hearing commission as provided by chapter 621. 8
2424 2. The committee may cause a complaint to be filed 9
2525 with the administrative hearing commission as provided by 10
2626 chapter 621 against any holder of any certificate of 11
2727 registration or authority, permit or license required by 12
2828 this chapter or any person who has failed to renew or has 13
2929 surrendered the person's certificate o f registration or 14
3030 authority, permit or license for any one or any combination 15
3131 of the following causes: 16 SB 285 2
3232 (1) Use of any controlled substance, as defined in 17
3333 chapter 195, or alcoholic beverage to an extent that such 18
3434 use impairs a person's ability to perform the work of any 19
3535 profession licensed or regulated by this chapter; 20
3636 (2) The person has been finally adjudicated and found 21
3737 guilty, or entered a plea of guilty or nolo contendere, in a 22
3838 criminal prosecution under the laws of any state, of the 23
3939 United States, or of any country, for any offense directly 24
4040 related to the duties and responsibilities of the 25
4141 occupation, as set forth in section 324.012, regardless of 26
4242 whether or not sentence is imposed; 27
4343 (3) Use of fraud, deception, misrepresentat ion or 28
4444 bribery in securing any certificate of registration or 29
4545 authority, permit or license issued pursuant to this chapter 30
4646 or in obtaining permission to take any examination given or 31
4747 required pursuant to this chapter; 32
4848 (4) Obtaining or attempting to obtain any fee, charge, 33
4949 tuition or other compensation by fraud, deception or 34
5050 misrepresentation; 35
5151 (5) Incompetency, misconduct, gross negligence, fraud, 36
5252 misrepresentation or dishonesty in the performance of the 37
5353 functions or duties of any profess ion licensed or regulated 38
5454 by this chapter; 39
5555 (6) Violation of, or assisting or enabling any person 40
5656 to violate, any provision of this chapter, or of any lawful 41
5757 rule or regulation adopted pursuant to this chapter; 42
5858 (7) Impersonation of any person holding a certificate 43
5959 of registration or authority, permit or license or allowing 44
6060 any person to use his or her certificate of registration or 45
6161 authority, permit, license or diploma from any school; 46
6262 (8) Disciplinary action against the holder of a 47
6363 license or other right to practice any profession regulated 48 SB 285 3
6464 by this chapter granted by another state, territory, federal 49
6565 agency or country upon grounds for which revocation or 50
6666 suspension is authorized in this state; 51
6767 (9) A person is finally adjudge d insane or 52
6868 incapacitated by a court of competent jurisdiction; 53
6969 (10) Assisting or enabling any person to practice or 54
7070 offer to practice any profession licensed or regulated by 55
7171 this chapter who is not registered and currently eligible to 56
7272 practice as provided this chapter; 57
7373 (11) Issuance of a certificate of registration or 58
7474 authority, permit or license based upon a material mistake 59
7575 of fact; 60
7676 (12) Failure to display a valid certificate or license 61
7777 if so required by this chapter or any rule promulgated 62
7878 pursuant to this chapter; 63
7979 (13) Violation of any professional trust or confidence; 64
8080 (14) Use of any advertisement or solicitation which is 65
8181 false, misleading or deceptive to the general public or 66
8282 persons to whom the advertisement or solicitation is 67
8383 primarily directed; 68
8484 (15) Being guilty of unethical conduct as defined in 69
8585 "Ethical Rules of Conduct" as adopted by the committee and 70
8686 filed with the secretary of state ; 71
8787 (16) Engaging in conversion therapy with a minor. For 72
8888 purposes of this subdivision, the term "conversion therapy" 73
8989 means any practices or treatments that seek to change an 74
9090 individual's sexual orientation or gender identity, 75
9191 including efforts to change behaviors or gender expressions 76
9292 or to eliminate or reduc e sexual or romantic attractions or 77
9393 feelings toward individuals of the same gender. The term 78
9494 "conversion therapy" shall not include counseling that 79
9595 provides assistance to a person undergoing gender transition 80 SB 285 4
9696 or counseling that provides acceptance, su pport, and 81
9797 understanding of a person or facilitates a person's coping, 82
9898 social support, and identity exploration and development, 83
9999 including sexual-orientation-neutral interventions to 84
100100 prevent or address unlawful conduct or unsafe sexual 85
101101 practices, as long as such counseling does not seek to 86
102102 change an individual's sexual orientation or gender identity . 87
103103 3. After the filing of such complaint, the proceedings 88
104104 shall be conducted in accordance with the provisions of 89
105105 chapter 621. Upon a finding by th e administrative hearing 90
106106 commission that the grounds, provided in subsection 2 of 91
107107 this section, for disciplinary action are met, the committee 92
108108 may, singly or in combination, censure or place the person 93
109109 named in the complaint on probation on such terms and 94
110110 conditions as the department deems appropriate for a period 95
111111 not to exceed five years, or may suspend, for a period not 96
112112 to exceed three years, or revoke the license, certificate, 97
113113 or permit. 98
114114 4. An interested third party may file a complaint or 99
115115 appear or present evidence relative to such complaint or 100
116116 another complaint filed pursuant to this section. For 101
117117 purposes of this section, an interested third party includes 102
118118 a parent or guardian of a person who received treatment by a 103
119119 psychologist or any person who is related within the second 104
120120 degree of consanguinity or affinity and who is financially 105
121121 responsible for the payment of such treatment. 106
122122 337.330. 1. The committee may refuse to issue any 1
123123 license required under this chapt er for one or any 2
124124 combination of causes stated in subsection 2 of this 3
125125 section. The committee shall notify the applicant in 4
126126 writing of the reasons for the refusal and shall advise the 5
127127 applicant of the applicant's right to file a complaint with 6 SB 285 5
128128 the administrative hearing commission as provided by chapter 7
129129 621. 8
130130 2. The committee may cause a complaint to be filed 9
131131 with the administrative hearing commission, as provided by 10
132132 chapter 621, against any holder of any license required by 11
133133 this chapter or any person who has failed to renew or has 12
134134 surrendered the person's license for any one or any 13
135135 combination of the following causes: 14
136136 (1) Use of any controlled substance, as defined in 15
137137 chapter 195, or alcoholic beverage to an extent that such 16
138138 use impairs a person's ability to perform the work of any 17

149149 chapter or in obtaining permission to take any examination 28
150150 given or required under sections 337.300 to 337.345; 29
151151 (4) Obtaining or attempting to obtain any fee, charge, 30
152152 tuition, or other compensation by fraud, deception or 31
153153 misrepresentation; 32
154154 (5) Incompetency, misconduct, gross negligence, fraud, 33
155155 misrepresentation, or dishonesty in the performance of the 34
156156 functions or duties of any profession licensed by sections 35
157157 337.300 to 337.345; 36 SB 285 6
158158 (6) Violation of, or assisting or enabling any person 37
159159 to violate, any provision of sections 337.300 to 337.345, or 38
160160 of any lawful rule adopted thereunder; 39
161161 (7) Impersonation of any person holding a certificate 40
162162 of registration or authority, permit or license or allowing 41
163163 any person to use his or her certificate of registration or 42
164164 authority, permit, license, or diploma from any school; 43
165165 (8) Disciplinary action against the holder of a 44
166166 license or other right to practice any profession regulated 45
167167 by sections 337.300 to 337.345 granted by another state, 46
168168 territory, federal agency, or country upon grounds for which 47
169169 revocation or suspension is authorized in this state; 48
170170 (9) A person is finally adjudged insa ne or 49
171171 incapacitated by a court of competent jurisdiction; 50
172172 (10) Assisting or enabling any person to practice or 51
173173 offer to practice any profession licensed or regulated by 52
174174 sections 337.300 to 337.345 who is not registered and 53
175175 currently eligible to p ractice as provided in sections 54
176176 337.300 to 337.345; 55
177177 (11) Issuance of a certificate of registration or 56
178178 authority, permit, or license based upon a material mistake 57
179179 of fact; 58
180180 (12) Failure to display a valid certificate or license 59
181181 if so required by sections 337.300 to 337.345 or any rule 60
182182 promulgated thereunder; 61
183183 (13) Violation of any professional trust or confidence; 62
184184 (14) Use of any advertisement or solicitation which is 63
185185 false, misleading, or deceptive to the general public or 64
186186 persons to whom the advertisement or solicitation is 65

188188 (15) Being guilty of unethical conduct as defined in 67
189189 the code of conduct as adopted by the committee and filed 68
190190 with the secretary of state ; 69
191191 (16) Engaging in conversion thera py with a minor. For 70
192192 purposes of this subdivision, the term "conversion therapy" 71
193193 means any practices or treatments that seek to change an 72
194194 individual's sexual orientation or gender identity, 73
195195 including efforts to change behaviors or gender expressions 74
196196 or to eliminate or reduce sexual or romantic attractions or 75
197197 feelings toward individuals of the same gender. The term 76
198198 "conversion therapy" shall not include counseling that 77
199199 provides assistance to a person undergoing gender transition 78
200200 or counseling that provides acceptance, support, and 79
201201 understanding of a person or facilitates a person's coping, 80
202202 social support, and identity exploration and development, 81
203203 including sexual-orientation-neutral interventions to 82
204204 prevent or address unlawful conduct or unsafe sexual 83
205205 practices, as long as such counseling does not seek to 84
206206 change an individual's sexual orientation or gender identity . 85
207207 3. After the filing of such complaint, the proceedings 86
208208 shall be conducted in accordance with the provisions of 87
209209 chapter 621. Upon a finding by the administrative hearing 88
210210 commission that the grounds, provided in subsection 2 of 89
211211 this section, for disciplinary action are met, the committee 90

220220 337.500 to 337.540 for one or any combination of causes 3
221221 stated in subsection 2 of this section. The committee shall 4
222222 notify the applicant in writing of the reas ons for the 5
223223 refusal and shall advise the applicant of his or her right 6
224224 to file a complaint with the administrative hearing 7
225225 commission as provided by chapter 621. 8
226226 2. The committee may cause a complaint to be filed 9
227227 with the administrative hearing c ommission as provided by 10
228228 chapter 621 against any holder of any license required by 11
229229 sections 337.500 to 337.540 or any person who has failed to 12
230230 renew or has surrendered his license for any one or any 13
231231 combination of the following causes: 14
232232 (1) Use of any controlled substance, as defined in 15
233233 chapter 195, or alcoholic beverage to an extent that such 16
234234 use impairs a person's ability to engage in the occupation 17
235235 of professional counselor; 18
236236 (2) The person has been finally adjudicated and found 19
237237 guilty, or entered a plea of guilty or nolo contendere, in a 20
238238 criminal prosecution under the laws of any state, of the 21
239239 United States, or of any country, for any offense directly 22
240240 related to the duties and responsibilities of the 23
241241 occupation, as set forth in sect ion 324.012, regardless of 24
242242 whether or not sentence is imposed; 25
243243 (3) Use of fraud, deception, misrepresentation or 26
244244 bribery in securing any license issued pursuant to the 27
245245 provisions of sections 337.500 to 337.540 or in obtaining 28
246246 permission to take a ny examination given or required 29
247247 pursuant to the provisions of sections 337.500 to 337.540; 30
248248 (4) Obtaining or attempting to obtain any fee, charge, 31
249249 tuition or other compensation by fraud, deception or 32
250250 misrepresentation; 33 SB 285 9
251251 (5) Incompetency, misconduct, fraud, misrepresentation 34
252252 or dishonesty in the performance of the functions or duties 35
253253 of a professional counselor; 36
254254 (6) Violation of, or assisting or enabling any person 37
255255 to violate, any provision of sections 337.500 to 337.540, or 38
256256 of any lawful rule or regulation adopted pursuant to 39
257257 sections 337.500 to 337.540; 40
258258 (7) Impersonation of any person holding a license or 41
259259 allowing any person to use his or her license or diploma 42
260260 from any school; 43
261261 (8) Revocation or suspension of a license or other 44
262262 right to practice counseling granted by another state, 45
263263 territory, federal agency or country upon grounds for which 46
264264 revocation or suspension is authorized in this state; 47
265265 (9) A person is finally adjudged incapacitated by a 48
266266 court of competent jurisdiction; 49
267267 (10) Assisting or enabling any person to practice or 50
268268 offer to practice professional counseling who is not 51
269269 licensed and currently eligible to practice under the 52
270270 provisions of sections 337.500 to 337.540; 53
271271 (11) Issuance of a license based upon a material 54
272272 mistake of fact; 55
273273 (12) Failure to display a valid license if so required 56
274274 by sections 337.500 to 337.540 or any rule promulgated 57
275275 hereunder; 58
276276 (13) Violation of any professional trust or confidence; 59
277277 (14) Use of any advertisement or solicitation which is 60
278278 false, misleading or deceptive to the general public or 61
279279 persons to whom the advertisement or solicitation is 62
280280 primarily directed; 63 SB 285 10
281281 (15) Being guilty of unethical conduct as defined in 64
282282 the ethical standards for counselors adopted by the division 65
283283 and filed with the secretary of state ; 66
284284 (16) Engaging in conversion therapy with a minor. For 67
285285 purposes of this subdivision, the term "conversion therapy" 68
286286 means any practices or treatments that seek to change an 69
287287 individual's sexual orientation or gender identity, 70
288288 including efforts to change behaviors or gender expressions 71
289289 or to eliminate or reduce sexual or romantic attractions or 72
290290 feelings toward individuals of the same gender. The term 73
291291 "conversion therapy" shall not include counseling that 74
292292 provides assistance to a person undergoing gender transition 75
293293 or counseling that provides acceptance, support, and 76
294294 understanding of a person or facilitates a person's coping, 77
295295 social support, and identity exploration and development, 78
296296 including sexual-orientation-neutral interventions to 79
297297 prevent or address unlawful conduct or unsafe sexual 80
298298 practices, as long as such counseling does not seek to 81
299299 change an individual's sexual orientation or gender identity . 82
300300 3. Any person, organization, association or 83
301301 corporation who reports or provides information to the 84
302302 committee pursuant to the provisions of this chapter and who 85
303303 does so in good faith shall not be subject to an action for 86
304304 civil damages as a result thereof. 87
305305 4. After the filing of such complaint, the proceedings 88
306306 shall be conducted in accordance with the provisions of 89
307307 chapter 621. Upon a finding by the administrative hearing 90
308308 commission that the grounds, provided in subsection 2 of 91
309309 this section, for di sciplinary action are met, the committee 92
310310 may censure or place the person named in the complaint on 93
311311 probation on such terms and conditions as the committee 94
312312 deems appropriate for a period not to exceed five years, or 95 SB 285 11
313313 may suspend, for a period not to exce ed three years, or 96
314314 revoke the license. 97
315315 337.630. 1. The committee may refuse to issue or 1
316316 renew any license required by the provisions of sections 2
317317 337.600 to 337.689 for one or any combination of causes 3
318318 stated in subsection 2 of this section. The committee shall 4
319319 notify the applicant in writing of the reasons for the 5
320320 refusal and shall advise the applicant of the applicant's 6
321321 right to file a complaint with the administrative hearing 7
322322 commission as provided by chapter 621. 8
323323 2. The committee may cause a complaint to be filed 9
324324 with the administrative hearing commission as provided by 10
325325 chapter 621 against any holder of any license required by 11
326326 sections 337.600 to 337.689 or any person who has failed to 12
327327 renew or has surrendered the p erson's license for any one or 13
328328 any combination of the following causes: 14
329329 (1) Use of any controlled substance, as defined in 15
330330 chapter 195, or alcoholic beverage to an extent that such 16
331331 use impairs a person's ability to engage in the occupation 17
332332 of social work licensed under this chapter; except that the 18
333333 fact that a person has undergone treatment for past 19
334334 substance or alcohol abuse and/or has participated in a 20
335335 recovery program, shall not by itself be cause for refusal 21
336336 to issue or renew a license; 22
337337 (2) The person has been finally adjudicated and found 23
338338 guilty, or entered a plea of guilty or nolo contendere, in a 24
339339 criminal prosecution pursuant to the laws of any state, of 25
340340 the United States, or of any country, for any offense 26
341341 directly related to the duties and responsibilities of the 27
342342 occupation, as set forth in section 324.012, regardless of 28
343343 whether or not sentence is imposed; 29 SB 285 12
344344 (3) Use of fraud, deception, misrepresentation or 30
345345 bribery in securing any license issued pursuant to the 31
346346 provisions of sections 337.600 to 337.689 or in obtaining 32
347347 permission to take any examination given or required 33
348348 pursuant to the provisions of sections 337.600 to 337.689; 34
349349 (4) Obtaining or attempting to obtain any fee, charge, 35
350350 tuition or other compensation by fraud, deception or 36
351351 misrepresentation; 37
352352 (5) Incompetency, misconduct, fraud, misrepresentation 38
353353 or dishonesty in the performance of the functions or duties 39
354354 of a social worker licensed pursuant to this chapter; 40
355355 (6) Violation of, or assistin g or enabling any person 41
356356 to violate, any provision of sections 337.600 to 337.689, or 42
357357 of any lawful rule or regulation adopted pursuant to 43
358358 sections 337.600 to 337.689; 44
359359 (7) Impersonation of any person holding a license or 45
360360 allowing any person to us e the person's license or diploma 46
361361 from any school; 47
362362 (8) Revocation or suspension of a license or other 48
363363 right to practice social work licensed pursuant to this 49
364364 chapter granted by another state, territory, federal agency 50
365365 or country upon grounds for which revocation or suspension 51
366366 is authorized in this state; 52
367367 (9) Final adjudication as incapacitated by a court of 53
368368 competent jurisdiction; 54
369369 (10) Assisting or enabling any person to practice or 55
370370 offer to practice social work licensed pursuant to this 56
371371 chapter who is not licensed and currently eligible to 57
372372 practice pursuant to the provisions of sections 337.600 to 58
373373 337.689; 59
374374 (11) Obtaining a license based upon a material mistake 60
375375 of fact; 61 SB 285 13
376376 (12) Failure to display a valid license if so re quired 62
377377 by sections 337.600 to 337.689 or any rule promulgated 63
378378 hereunder; 64
379379 (13) Violation of any professional trust or confidence; 65
380380 (14) Use of any advertisement or solicitation which is 66
381381 false, misleading or deceptive to the general public or 67
382382 persons to whom the advertisement or solicitation is 68
383383 primarily directed; 69
384384 (15) Being guilty of unethical conduct as defined in 70
385385 the ethical standards for clinical social workers adopted by 71
386386 the committee by rule and filed with the secretary of state ; 72
387387 (16) Engaging in conversion therapy with a minor. For 73
388388 purposes of this subdivision, the term "conversion therapy" 74
389389 means any practices or treatments that seek to change an 75
390390 individual's sexual orientation or gender identity, 76
391391 including efforts to change behaviors or gender expressions 77
392392 or to eliminate or reduce sexual or romantic attractions or 78
393393 feelings toward individuals of the same gender. The term 79
394394 "conversion therapy" shall not include counseling that 80
395395 provides assistance to a person undergoi ng gender transition 81
396396 or counseling that provides acceptance, support, and 82
397397 understanding of a person or facilitates a person's coping, 83
398398 social support, and identity exploration and development, 84
399399 including sexual-orientation-neutral interventions to 85
400400 prevent or address unlawful conduct or unsafe sexual 86
401401 practices, as long as such counseling does not seek to 87
402402 change an individual's sexual orientation or gender identity . 88
403403 3. Any person, organization, association or 89
404404 corporation who reports or provides in formation to the 90
405405 committee pursuant to the provisions of sections 337.600 to 91
406406 337.689 and who does so in good faith shall not be subject 92
407407 to an action for civil damages as a result thereof. 93 SB 285 14
408408 4. After the filing of such complaint, the proceedings 94
409409 shall be conducted in accordance with the provisions of 95
410410 chapter 621. Upon a finding by the administrative hearing 96
411411 commission that the grounds, provided in subsection 2 of 97
412412 this section, for disciplinary action are met, the committee 98
413413 may censure or place t he person named in the complaint on 99
414414 probation on such terms and conditions as the committee 100
415415 deems appropriate for a period not to exceed five years, or 101
416416 may suspend, for a period not to exceed three years, or 102
417417 revoke the license. 103
418418 337.730. 1. The committee may refuse to issue or 1
419419 renew any license required by the provisions of sections 2
420420 337.700 to 337.739 for one or any combination of causes 3
421421 stated in subsection 2 of this section. The committee shall 4
422422 notify the applicant in writing of the reasons for the 5
423423 refusal and shall advise the applicant of the applicant's 6
424424 right to file a complaint with the administrative hearing 7
425425 commission as provided by chapter 621. 8
426426 2. The committee may cause a complaint to be filed 9
427427 with the administrative hearing commission as provided by 10
428428 chapter 621 against any holder of any license required by 11
429429 sections 337.700 to 337.739 or any person who has failed to 12
430430 renew or has surrendered the person's license for any one or 13
431431 any combination of the following causes: 14
432432 (1) Use of any controlled substance, as defined in 15
433433 chapter 195, or alcoholic beverage to an extent that such 16
434434 use impairs a person's ability to engage in the occupation 17
435435 of marital and family therapist; except the fact that a 18
436436 person has undergone treatment for past substance or alcohol 19
437437 abuse or has participated in a recovery program, shall not 20
438438 by itself be cause for refusal to issue or renew a license; 21 SB 285 15
439439 (2) The person has been finally adjudicated and found 22
440440 guilty, or entered a plea of guilty in a criminal 23
441441 prosecution under the laws of any state, of the United 24
442442 States, or of any country, for any offense directly related 25
443443 to the duties and responsibilities of the occupation, as set 26
444444 forth in section 324.012, regardless of whether or n ot 27
445445 sentence is imposed; 28
446446 (3) Use of fraud, deception, misrepresentation or 29
447447 bribery in securing any license issued pursuant to the 30
448448 provisions of sections 337.700 to 337.739 or in obtaining 31
449449 permission to take any examination given or required 32
450450 pursuant to the provisions of sections 337.700 to 337.739; 33
451451 (4) Obtaining or attempting to obtain any fee, charge, 34
452452 tuition or other compensation by fraud, deception or 35
453453 misrepresentation; 36
454454 (5) Incompetency, misconduct, fraud, misrepresentation 37
455455 or dishonesty in the performance of the functions or duties 38
456456 of a marital and family therapist; 39
457457 (6) Violation of, or assisting or enabling any person 40
458458 to violate, any provision of sections 337.700 to 337.739 or 41
459459 of any lawful rule or regulation adopted pu rsuant to 42
460460 sections 337.700 to 337.739; 43
461461 (7) Impersonation of any person holding a license or 44

471471 (10) Assisting or enabling any person to practice or 54
472472 offer to practice marital and family therapy who is not 55
473473 licensed and is not currently eligible to practice under the 56
474474 provisions of sections 337.700 to 337.739; 57
475475 (11) Obtaining a license based u pon a material mistake 58
476476 of fact; 59
477477 (12) Failure to display a valid license if so required 60
478478 by sections 337.700 to 337.739 or any rule promulgated 61
479479 hereunder; 62
480480 (13) Violation of any professional trust or confidence; 63
481481 (14) Use of any advertisem ent or solicitation which is 64
482482 false, misleading or deceptive to the general public or 65
483483 persons to whom the advertisement or solicitation is 66
484484 primarily directed; 67
485485 (15) Being guilty of unethical conduct as defined in 68
486486 the ethical standards for marital a nd family therapists 69
487487 adopted by the committee by rule and filed with the 70
488488 secretary of state; 71
489489 (16) Engaging in conversion therapy with a minor. For 72
490490 purposes of this subdivision, the term "conversion therapy" 73
491491 means any practices or treatments that seek to change an 74
492492 individual's sexual orientation or gender identity, 75
493493 including efforts to change behaviors or gender expressions 76
494494 or to eliminate or reduce sexual or romantic attractions or 77
495495 feelings toward individuals of the same gender. The term 78
496496 "conversion therapy" shall not include counseling that 79
497497 provides assistance to a person undergoing gender transition 80
498498 or counseling that provides acceptance, support, and 81
499499 understanding of a person or facilitates a person's coping, 82
500500 social support, and ident ity exploration and development, 83
501501 including sexual-orientation-neutral interventions to 84
502502 prevent or address unlawful conduct or unsafe sexual 85 SB 285 17
503503 practices, as long as such counseling does not seek to 86
504504 change an individual's sexual orientation or gender ident ity. 87
505505 3. Any person, organization, association or 88
506506 corporation who reports or provides information to the 89
507507 committee under sections 337.700 to 337.739 and who does so 90
508508 in good faith shall not be subject to an action for civil 91
509509 damages as a result ther eof. 92
510510 4. After filing of such complaint, the proceedings 93
511511 shall be conducted in accordance with the provisions of 94
512512 chapter 621. Upon a finding by the administrative hearing 95
513513 commission that the grounds provided in subsection 2 of this 96
514514 section for disciplinary action are met, the division may 97
515515 censure or place the person named in the complaint on 98
516516 probation on such terms and conditions as the committee 99
517517 deems appropriate for a period not to exceed five years, or 100
518518 may suspend for a period not to exceed three years, or 101
519519 revoke the license. 102
