10 | 10 | | To repeal sections 579.097 and 579.101, RSMo, and to enact in lieu thereof two new sections |

11 | 11 | | relating to the inhalation of substances, with penalty provisions. |

13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
14 | 14 | | Section A. Sections 579.097 and 579.101, RSMo, are 1 |
---|
15 | 15 | | repealed and two new sections enacted in lieu thereof, to be 2 |
---|
16 | 16 | | known as sections 579.097 and 579.101, to read as follows:3 |
---|
17 | 17 | | 579.097. No person shall intentionally smell or inhale 1 |
---|
18 | 18 | | the fumes, gases, or vapors of any solvent, [particularly] 2 |
---|
19 | 19 | | chemical, reagent, refrigerant, or other substance 3 |
---|
20 | 20 | | including, but not limited to, difluoroethane, 4 |
---|
21 | 21 | | trifluoroethane, tetrafluoroethane, toluol, amyl nitrite, 5 |
---|
22 | 22 | | butyl nitrite, cyclohexyl nitrite, ethyl nitrite, pentyl 6 |
---|
23 | 23 | | nitrite, [and] or propyl nitrite and their iso -analogues or 7 |
---|
24 | 24 | | induce any other person to do so, for the purpose of causing 8 |
---|
25 | 25 | | a condition of, or inducing symptoms of, intoxication, 9 |
---|
26 | 26 | | elation, euphoria, dizziness, excitement, irrational 10 |
---|
27 | 27 | | behavior, exhilaration, hallucination, paralysis, 11 |
---|
28 | 28 | | stupefaction, or dulling of senses or nervous system, or for 12 |
---|
29 | 29 | | the purpose of, in any manner, changing, distort ing, or 13 |
---|
30 | 30 | | disturbing the audio, visual, or mental processes; except 14 |
---|
31 | 31 | | that this section shall not apply to the inhalation of any 15 |
---|
32 | 32 | | anesthesia for medical or dental purposes. 16 |

33 | 33 | | 579.101. 1. No person shall intentionally possess or 1 |

39 | 39 | | their iso-analogues for the purpose of inducing or aiding 7 |
---|
40 | 40 | | any other person to violate the provisions of sections 8 |
---|
41 | 41 | | 579.097 and 579.099. 9 |
---|
42 | 42 | | 2. Any person who violates any provision of sections 10 |
---|
43 | 43 | | 579.097 to 579.101 is guilty of a : 11 |
---|
44 | 44 | | (1) Class [B] D misdemeanor and, if allowed by law, is 12 |
---|
45 | 45 | | punishable by participation in a drug treatment program for 13 |
---|
46 | 46 | | the first violation [and a]; 14 |
---|
47 | 47 | | (2) Class [E felony] A misdemeanor for a second 15 |
---|
48 | 48 | | violation; and 16 |
---|
49 | 49 | | (3) Class D felony for any subsequent violations. 17 |
