99 AN ACT
1010 To repeal sections 579.097 and 579.101, RSMo, and to enact in lieu thereof two new sections
1111 relating to the inhalation of substances, with penalty provisions.

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Sections 579.097 and 579.101, RSMo, are 1
1515 repealed and two new sections enacted in lieu thereof, to be 2
1616 known as sections 579.097 and 579.101, to read as follows:3
1717 579.097. No person shall intentionally smell or inhale 1
1818 the fumes, gases, or vapors of any solvent, [particularly] 2
1919 chemical, reagent, refrigerant, or other substance 3
2020 including, but not limited to, difluoroethane, 4
2121 trifluoroethane, tetrafluoroethane, toluol, amyl nitrite, 5
2222 butyl nitrite, cyclohexyl nitrite, ethyl nitrite, pentyl 6
2323 nitrite, [and] or propyl nitrite and their iso -analogues or 7
2424 induce any other person to do so, for the purpose of causing 8
2525 a condition of, or inducing symptoms of, intoxication, 9
2626 elation, euphoria, dizziness, excitement, irrational 10
2727 behavior, exhilaration, hallucination, paralysis, 11
2828 stupefaction, or dulling of senses or nervous system, or for 12
2929 the purpose of, in any manner, changing, distort ing, or 13
3030 disturbing the audio, visual, or mental processes; except 14
3131 that this section shall not apply to the inhalation of any 15
3232 anesthesia for medical or dental purposes. 16
3333 579.101. 1. No person shall intentionally possess or 1
3434 buy any solvent, [particularly] chemical, reagent, 2 SB 354 2
3535 refrigerant, or other substance including, but not limited 3
3636 to, difluoroethane, trifluoroethane, tetrafluoroethane, 4
3737 toluol, amyl nitrite, butyl nitrite, cyclohexyl nitrite, 5
3838 ethyl nitrite, pentyl nitrite, [and] or propyl nitrite and 6
3939 their iso-analogues for the purpose of inducing or aiding 7
4040 any other person to violate the provisions of sections 8
4141 579.097 and 579.099. 9
4242 2. Any person who violates any provision of sections 10
4343 579.097 to 579.101 is guilty of a : 11
4444 (1) Class [B] D misdemeanor and, if allowed by law, is 12
4545 punishable by participation in a drug treatment program for 13
4646 the first violation [and a]; 14
4747 (2) Class [E felony] A misdemeanor for a second 15
4848 violation; and 16
4949 (3) Class D felony for any subsequent violations. 17
