1010 Be it enacted by the General Assembly of the State of Missouri, as follows:
11- Section A. Chapter 92, RSMo, is amended by adding thereto
12-one new section, to be known as section 92.205, to read as
13-follows:
14- 92.205. 1. For the purposes of this section, the
15-following terms mean:
16- (1) "Distressed community", the same meaning as
17-provided in section 135.530;
18- (2) "Earnings tax opportunity zone", each opportunity
19-zone cluster wholly comprised of qualified census tracts
20-located wholly or partially in a distressed community
21-imposing the earnings tax under sections 92.105 to 92.200;
22- (3) "Opportunity zone cluster", areas designated as a
23-qualified opportunity zone under 26 U.S.C. Section 1400Z -1
24-organized within a distressed co mmunity to connect and
25-reinforce priority areas for investment, redevelopment, and
26-economic growth;
27- (4) "Qualified census tract", the same meaning as
28-provided in section 253.545.
29- 2. Notwithstanding any other provision of law to the
30-contrary, for all tax years beginning on or after January 1,
31-2026, the following shall be exempt from the earnings tax
32-imposed under sections 92.105 to 92.200:
33- (1) The salaries, wages, commissions, and other
34-compensation earned by any resident of an earni ngs tax
35-opportunity zone;

37- (2) The salaries, wages, commissions, and other
38-compensation earned by any person who earns salaries, wages,
39-commissions, and other compensation for work done or
40-services performed or rendered in an earnings tax
41-opportunity zone;
42- (3) The net profits of associations, businesses, or
43-other activities conducted by any person in an earnings tax
44-opportunity zone; and
45- (4) The net profits earned by all corporations as the
46-result of work done or services performed or rendered and
47-business or other activities in an earnings tax opportunity
48-zone.
49- 3. Any distressed community imposing the earnings tax
50-under sections 92.105 to 92.200 shall publish and maintain
51-an updated map of earnings tax opportunity zones on its
52-website and shall provide a copy of such map upon request.
53- 4. The provisions of this section shall not apply to
54-any earnings tax opportunity zone that includes or overlaps
55-with the federally designated site of the National
56-Geospatial-Intelligence Agency (NGA) West campus located in
57-a city not within a county.
