11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |

12 | 12 | | Section A. Section 441 .043, RSMo, is repealed and one new 1 |
---|
13 | 13 | | section enacted in lieu thereof, to be known as section 441.043, 2 |
---|
14 | 14 | | to read as follows:3 |
---|
15 | 15 | | 441.043. 1. No county or city, or county or city with 1 |
---|
16 | 16 | | a charter form of government may enact, maintain, or enforce 2 |
---|
17 | 17 | | any ordinance or resolution which regulates the amount of 3 |
---|
18 | 18 | | rent to be charged for privately -owned, single-family, or 4 |
---|
19 | 19 | | multiple-unit residential or commercial rental property. 5 |
---|
20 | 20 | | 2. No county or city, or county or city with a charter 6 |
---|
21 | 21 | | form of government, shall ena ct, maintain, or enforce any 7 |
---|
22 | 22 | | ordinance or resolution that: 8 |
---|
23 | 23 | | (1) Prohibits landlords from refusing to lease or rent 9 |
---|
24 | 24 | | a privately owned, single -family, or multiple-unit 10 |
---|
25 | 25 | | residential or commercial rental property to a person 11 |
---|
26 | 26 | | because the person's lawful source of income to pay rent 12 |
---|
27 | 27 | | includes funding from a federal housing assistance program; 13 |
---|
28 | 28 | | (2) Prohibits landlords from using income -qualifying 14 |
---|
29 | 29 | | methods, credit scores, credit reports, eviction or property 15 |
---|
30 | 30 | | damage history, or prohibits landlords from requesting such 16 |
---|
31 | 31 | | information, to determine whether to rent or lease a 17 |
---|
32 | 32 | | property to a prospective tenant; 18 SB 507 2 |

33 | 33 | | (3) Prohibits landlords from requesting criminal 19 |
---|
34 | 34 | | records from a prospective tenant; 20 |
---|
35 | 35 | | (4) Limits the amount of security deposit a landlord 21 |
---|
36 | 36 | | may require from a prospective tenant; or 22 |
---|
37 | 37 | | (5) Requires tenants to automatically receive the 23 |
---|
38 | 38 | | right of first refusal. 24 |
---|
39 | 39 | | 3. This section shall not be construed as prohibiting 25 |
---|
40 | 40 | | any county or city, or any authority created by a county or 26 |
---|
41 | 41 | | city for that purpose, from: 27 |
---|
42 | 42 | | (1) Regulating in any way property belonging to that 28 |
---|
43 | 43 | | city, county, or authority; 29 |
---|
44 | 44 | | (2) Entering into agreements with private persons 30 |
---|
45 | 45 | | which regulate the amount of rent charged for subsidized 31 |
---|
46 | 46 | | rental properties; or 32 |
---|
47 | 47 | | (3) Enacting ordinances or resolutions restricting 33 |
---|
48 | 48 | | rent for properties assisted with community development 34 |
---|
49 | 49 | | block grant funds. 35 |
