88 To repeal section 441.043, RSMo, and to enact in lieu thereof one new section relating to local

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Section 441 .043, RSMo, is repealed and one new 1
1313 section enacted in lieu thereof, to be known as section 441.043, 2
1414 to read as follows:3
1515 441.043. 1. No county or city, or county or city with 1
1616 a charter form of government may enact, maintain, or enforce 2
1717 any ordinance or resolution which regulates the amount of 3
1818 rent to be charged for privately -owned, single-family, or 4
1919 multiple-unit residential or commercial rental property. 5
2020 2. No county or city, or county or city with a charter 6
2121 form of government, shall ena ct, maintain, or enforce any 7
2222 ordinance or resolution that: 8
2323 (1) Prohibits landlords from refusing to lease or rent 9
2424 a privately owned, single -family, or multiple-unit 10
2525 residential or commercial rental property to a person 11
2626 because the person's lawful source of income to pay rent 12
2727 includes funding from a federal housing assistance program; 13
2828 (2) Prohibits landlords from using income -qualifying 14
2929 methods, credit scores, credit reports, eviction or property 15
3030 damage history, or prohibits landlords from requesting such 16
3131 information, to determine whether to rent or lease a 17
3232 property to a prospective tenant; 18 SB 507 2
3333 (3) Prohibits landlords from requesting criminal 19
3434 records from a prospective tenant; 20
3535 (4) Limits the amount of security deposit a landlord 21
3636 may require from a prospective tenant; or 22
3737 (5) Requires tenants to automatically receive the 23
3838 right of first refusal. 24
3939 3. This section shall not be construed as prohibiting 25
4040 any county or city, or any authority created by a county or 26
4141 city for that purpose, from: 27
4242 (1) Regulating in any way property belonging to that 28
4343 city, county, or authority; 29
4444 (2) Entering into agreements with private persons 30
4545 which regulate the amount of rent charged for subsidized 31
4646 rental properties; or 32
4747 (3) Enacting ordinances or resolutions restricting 33
4848 rent for properties assisted with community development 34
4949 block grant funds. 35
