88 To repeal section 43.505, RSMo, and to enact in lieu thereof one new section relating to collecting
99 the immigration status of criminal offenders.

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Section 43.505, RSMo, is repealed and one new 1
1313 section enacted in lieu thereof, to be known as section 43.505, 2
1414 to read as follows:3
1515 43.505. 1. The department of public safety is hereby 1
1616 designated as the central repository for the collection, 2
1717 maintenance, analysis and reporting of crime incident 3
1818 activity generated by law enforcement agencies in this 4
1919 state. The department shall develop and operate a uniform 5
2020 crime reporting system that is compatible with the national 6
2121 uniform crime reporting system op erated by the Federal 7
2222 Bureau of Investigation. 8
2323 2. The department of public safety shall: 9
2424 (1) Develop, operate and maintain an information 10
2525 system for the collection, storage, maintenance, analysis 11
2626 and retrieval of crime incident and arrest re ports from 12
2727 Missouri law enforcement agencies; 13
2828 (2) Compile the statistical data and forward such data 14
2929 as required to the Federal Bureau of Investigation or the 15
3030 appropriate Department of Justice agency in accordance with 16
3131 the standards and procedure s of the national system; 17 SB 583 2
3232 (3) Provide the forms, formats, procedures, standards 18
3333 and related training or training assistance to all law 19
3434 enforcement agencies in the state as necessary for such 20
3535 agencies to report incident and arrest activity for time ly 21
3636 inclusion into the statewide system; 22
3737 (4) Annually publish a report on the nature and extent 23
3838 of crime and submit such report to the governor and the 24
3939 general assembly. Such report and other statistical reports 25
4040 shall be made available to state a nd local law enforcement 26
4141 agencies and the general public through an electronic or 27
4242 manual medium; 28
4343 (5) Maintain the privacy and security of information 29
4444 in accordance with applicable state and federal laws, 30
4545 regulations and orders; and 31
4646 (6) Establish such rules and regulations as are 32
4747 necessary for implementing the provisions of this section. 33
4848 Any rule or portion of a rule, as that term is defined in 34
4949 section 536.010, that is created under the authority 35
5050 delegated in this section shall become ef fective only if it 36
5151 complies with and is subject to all of the provisions of 37
5252 chapter 536 and, if applicable, section 536.028. This 38
5353 section and chapter 536 are nonseverable and if any of the 39
5454 powers vested with the general assembly pursuant to chapter 40
5555 536 to review, to delay the effective date or to disapprove 41
5656 and annul a rule are subsequently held unconstitutional, 42
5757 then the grant of rulemaking authority and any rule proposed 43
5858 or adopted after August 28, 2000, shall be invalid and void. 44
5959 3. Every law enforcement agency in the state shall: 45
6060 (1) Submit crime incident reports to the department of 46
6161 public safety on forms or in the format prescribed by the 47

6363 (2) Submit any other crime incident information which 49
6464 may be required by the department of public safety , 50
6565 including information pertaining to the immigration status 51
6666 of any criminal offender, indicating whether the offender is 52
6767 a citizen of the United States, is a lawfully present 53
6868 immigrant, or does not possess the inform ation to show that 54
6969 he or she is a citizen of the United States or a lawfully 55
7070 present immigrant. 56
7171 4. Any law enforcement agency that violates this 57
7272 section after December 31, 2021, may be ineligible to 58
7373 receive state or federal funds which would othe rwise be paid 59
7474 to such agency for law enforcement, safety or criminal 60
7575 justice purposes. 61
