88 To repeal section 1.205, RSMo, and to enact in lieu thereof one new section relating to unborn

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Section 1.205, RSMo, is repealed and one new 1
1313 section enacted in lieu thereof, to be known as section 1.205, 2
1414 to read as follows:3
1515 1.205. 1. The general assembly of this state finds 1
1616 that: 2
1717 (1) The life of each human being begins at conception; 3
1818 (2) Unborn children have protectable int erests in 4
1919 life, health, and well -being and are entitled to the same 5
2020 rights, powers, privileges, justice, and protections as are 6
2121 secured or granted by the laws of this state to any other 7
2222 human person; 8
2323 (3) The natural parents of unborn children hav e 9
2424 protectable interests in the life, health, and well -being of 10
2525 their unborn child. 11
2626 2. Effective January 1, 1988, the laws of this state 12
2727 shall be interpreted and construed to acknowledge on behalf 13
2828 of the unborn child at every stage of development, all the 14
2929 rights, privileges, and immunities available to other 15
3030 persons, citizens, and residents of this state, subject only 16
3131 to the Constitution of the United States, and decisional 17
3232 interpretations thereof by the United States Supreme Court 18 SB 591 2
3333 and specific provisions to the contrary in the statutes and 19
3434 constitution of this state. 20
3535 3. As used in this section, the term "unborn children" 21
3636 or "unborn child" shall include all unborn child or children 22
3737 or the offspring of human beings from the moment of 23
3838 conception until birth at every stage of biological 24
3939 development. 25
4040 4. Nothing in this section shall be interpreted as 26
4141 creating a cause of action against a woman for indirectly 27
4242 harming her unborn child by failing to properly care for 28
4343 herself or by failing to follow any particular program of 29
4444 prenatal care. 30
