11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |

12 | 12 | | Section A. Section 1.205, RSMo, is repealed and one new 1 |
---|
13 | 13 | | section enacted in lieu thereof, to be known as section 1.205, 2 |
---|
14 | 14 | | to read as follows:3 |

15 | 15 | | 1.205. 1. The general assembly of this state finds 1 |
---|
16 | 16 | | that: 2 |
---|
17 | 17 | | (1) The life of each human being begins at conception; 3 |
---|
18 | 18 | | (2) Unborn children have protectable int erests in 4 |
---|
19 | 19 | | life, health, and well -being and are entitled to the same 5 |
---|
20 | 20 | | rights, powers, privileges, justice, and protections as are 6 |
---|
21 | 21 | | secured or granted by the laws of this state to any other 7 |
---|
22 | 22 | | human person; 8 |
---|
23 | 23 | | (3) The natural parents of unborn children hav e 9 |
---|
24 | 24 | | protectable interests in the life, health, and well -being of 10 |
---|
25 | 25 | | their unborn child. 11 |
---|
26 | 26 | | 2. Effective January 1, 1988, the laws of this state 12 |
---|
27 | 27 | | shall be interpreted and construed to acknowledge on behalf 13 |
---|
28 | 28 | | of the unborn child at every stage of development, all the 14 |
---|
29 | 29 | | rights, privileges, and immunities available to other 15 |
---|
30 | 30 | | persons, citizens, and residents of this state, subject only 16 |
---|
31 | 31 | | to the Constitution of the United States, and decisional 17 |
---|
32 | 32 | | interpretations thereof by the United States Supreme Court 18 SB 591 2 |
---|
33 | 33 | | and specific provisions to the contrary in the statutes and 19 |
---|
34 | 34 | | constitution of this state. 20 |
---|
35 | 35 | | 3. As used in this section, the term "unborn children" 21 |
---|
36 | 36 | | or "unborn child" shall include all unborn child or children 22 |
---|
37 | 37 | | or the offspring of human beings from the moment of 23 |
---|
38 | 38 | | conception until birth at every stage of biological 24 |
---|
39 | 39 | | development. 25 |
---|
40 | 40 | | 4. Nothing in this section shall be interpreted as 26 |
---|
41 | 41 | | creating a cause of action against a woman for indirectly 27 |
---|
42 | 42 | | harming her unborn child by failing to properly care for 28 |
---|
43 | 43 | | herself or by failing to follow any particular program of 29 |
---|
44 | 44 | | prenatal care. 30 |
