36 (2)Careerandtechnicalstudentorganizationswhereappliedlearningand 37engagementareintegralcomponentsofinstructionforanapprovedcareerand 38technicaleducationprograminMissouri;or 39 (3)Integratedcocurricularactivitiesrequiringstudentstoparticipatein 40appropriatecourseworkandpreparationoftheirrelatedactivitiesduringtheschool 41day. 42 5.(1)Aschooldistrictorcharterschoolmayestablishadisciplinarypolicyor 43anattendancepolicy,orboth,foranyrequiredcoursework,rehearsals,practice 44sessions,ortrainingsessionsthataredirectlyrelatedtoandrequiredfortryingoutfor 45orparticipationinaneventoractivityofferedbythecharterschoolorbytheschool 46districtoranattendancecenteroftheschooldistrict. 47 (2)Aschooldistrictorcharterschoolshallapplysuchdisciplinarypolicyor 48attendancepolicythatisdirectlyrelatedtoandrequiredforparticipationinthesame 49mannertoallstudentswhoparticipateintheeventoractivitytowhichthepolicy 50applies. 51 (3)Aschooldistrictorcharterschoolshallneitherestablishnorapplyaseparate 52disciplinarypolicyorattendancepolicy,oranyprovisionthereof,forstudentswho 53receiveinstructionatanFPEschool,ahomeschool,oratavirtualschoolasafull-time 54equivalentstudent. 55 6.Ifastudentwhoseacademicperformanceordisciplinarystatuswould 56precludesuchstudentfromeligibilitytoparticipateinanyextracurriculareventor 57activityinthestudent'scharterschoolorresidentschooldistrictdisenrollsfromsuch 58charterschoolorschooldistrictinordertoreceiveinstructionatanFPEschool,ahome 59school,oratavirtualschoolasafull-timeequivalentstudent,suchstudentshallnotbe 60eligibletoparticipateinacharterschoolorpublicschooleventoractivityinthecharter 61schoolorschooldistrictofsuchstudent'sdisenrollmentfortwelvecalendarmonths 62fromthedateofdisenrollment. 63 7.Theparentorlegalguardianprovidingprimaryinstructionofastudentwho 64isreceivinginstructionatanFPEschoolorahomeschoolisresponsibleforoversightof HCSSSSB63 5 65academicstandardsdirectlyrelatingtothestudent'sparticipationinaneventoractivity 66offeredbyacharterschoolorschooldistrictorattendancecenterofaschooldistrict. 67 8.(1)AstudentwhoisreceivinginstructionatanFPEschool,ahomeschool,or 68atavirtualschoolasafull-timeequivalentstudentshallsatisfythefollowing 69requirementsinordertobeeligibletoparticipateinacharterschoolorpublicschool 70eventoractivityinthecharterschoolorthestudent'sschooldistrictofresidence 71pursuanttotheprovisionsofthissection: 72 (a)Proofofthestudent'sresidencyintheschooldistrictorwithinthe 73boundariesoftheapplicableattendancecenterorcharterschoolwherethestudent 74seekstoparticipateinapublicschoolorcharterschooleventoractivityshallbe 75providedtosuchdistrictorcharterschoolpursuanttotheprovisionsofsection167.020; 76 (b)Thestudentshallprovideaphysicaltoparticipateinsports,includingdetails 77onanyunderlyingconditionsrelevanttosuchparticipation; 78 (c)Thestudentshalladheretothesamebehavior,responsibility,performance, 79andcodeofconductstandardsdirectlyrelatedtotheeventoractivityasthoseenrolled 80inthecharterschoolorpublicschooldistrict;and 81 (d)Thestudentshallfulfillthesamefinancialrequirementsasthoserequiredof 82studentsenrolledinthecharterschoolorpublicschooldistrict. 83 (2)Anyrecordscreatedorretainedbyacharterschool,schooldistrict,or 84attendancecenterunderthissectionshallnotbedisclosedbysuchcharterschool, 85district,orattendancecenterforanypurposeexceptforcompliancewithfederalor 86statelaw. 87 9.(1)Theterm"eventoractivity"shallnotbeconstruedtoincludeother 88extracurriculargatheringsorspecialoccasionssponsored,organized,orprovidedfor 89studentsbyaschooldistrict,charterschool,orattendancecenterofaschooldistrictthat 90arenotathletics,fineartsactivities,integratedcocurricularactivities,orother 91extracurricularoccurrencesdirectlyrelatedtosuchathletics,fineartsactivities,or 92integratedcocurricularactivities. 93 (2)Nocharterschool,schooldistrict,orattendancecenterofaschooldistrict 94shallberequiredtoestablishorprohibitedfromestablishingapolicythatincludesor 95excludestheparticipationofastudentwhoreceivesinstructionatanFPEschool,a 96homeschool,oratavirtualschoolasafull-timeequivalentstudentinsuchother 97extracurriculargatheringsorspecialoccasions. 167.850.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Board",thestateboardofeducation; 3 (2)"Commissioner",thecommissionerofeducation; HCSSSSB63 6 4 (3)"Recoveryhighschool",a[public] highschoolthatserveseligiblestudents 5diagnosedwithsubstanceusedisorderordependencyasdefinedbythemostrecent 6DiagnosticandStatisticalManualofMentalDisordersandthatprovidesbotha 7comprehensivefour-yearhighschooleducationinanalternative[public] schoolsetting 8andastructuredplanofrecovery; 9 (4)"Sendingdistrict",theschooldistrictwhereastudentattendingorplanningto 10attendtherecoveryhighschoolresidesandfromwhichthestudentisreferredforenrollment 11inarecoveryhighschool; 12 (5)"Sponsoringentity",thestatedepartmentofelementaryandsecondary 13education,aschooldistrict,amagnetschool,acharterschool,aprivateschoolas 14definedinsection166.700,oranycombinationofsuchentities. 15 2.(1)Thecommissionermayapproveandauthorizeuptofourpilotrecoveryhigh 16schools,geographicallylocatedinmetropolitanareasthroughoutthestate,tobeestablished 17by[schooldistrictsorgroupsofschooldistricts] asponsoringentityforthepurposeof 18demonstratingtheeffectivenessoftherecoveryhighschoolmodelinthisstate.The 19commissionershallissuearequestforproposalsfrom[schooldistricts] sponsoringentities 20tooperateapilotrecoveryhighschool.Suchproposalsmaybesubmittedbyanindividual 21[schooldistrict] sponsoringentityproposingtooperatearecoveryhighschoolorbyagroup 22of[schooldistricts] sponsoringentitiesproposingtojointlyoperatesuchaschool.Such 23proposalsshallbesubmittedtothecommissionernolaterthanJulyfirstoftheschoolyear 24priortotheschoolyearinwhichtherecoveryhighschoolisproposedtobeginoperation.The 25approvaloftheboardshallberequiredfortherecoveryhighschooltobeginoperation. 26 (2)Proposalsshalldetailhowthe[districtordistricts] sponsoringentitywillsatisfy 27thecriteriaforahighschooleducationprogramunderstatelawandboardruleandhowthe 28recoveryhighschoolwillsatisfytherequirementsforaccreditationbytheAssociationof 29RecoverySchoolsoranotherrecoveryschoolaccreditationorganizationauthorizedbythe 30board.Theproposalshallincludeafinancialplanoutliningtheanticipatedpublicandprivate 31fundingthatwillallowtherecoveryhighschooltooperateandmeettheschool'seducational 32andrecoverycriteria.The[districtordistricts] sponsoringentitymaypartnerwithoneor 33morelocalnonprofitorganizationsorotherlocaleducationalagenciesregarding 34establishmentandoperationofarecoveryhighschoolandmayestablishajointboardto 35overseetheoperationoftherecoveryhighschoolasprovidedinamemorandumof 36understandingenteredwithsuchorganizationororganizations. 37 (3)Byapprovaloftheproposalupontherecommendationofthecommissioner,the 38boardshallbedeemedtohaveauthorizedallnecessaryequivalenciesandwaiversof 39regulationsenumeratedintheproposal. HCSSSSB63 7 40 (4)Thecommissionermayspecifyanauthorizationperiodfortherecoveryhigh 41school,whichshallbenolessthanfouryears.BeforeJulyfirstofeachyeartherecoveryhigh 42schoolisinoperation,the[schooldistrictorgroupofschooldistricts] sponsoringentity, in 43consultationwiththerecoveryhighschool,shallsubmittothecommissionerananalysisof 44therecoveryhighschool'seducational,recovery,andotherrelatedoutcomesasspecifiedin 45theproposal.Thecommissionershallreviewtheanalysisandrenewanyrecoveryhigh 46schoolmeetingtherequirementsofthissectionandtherequirementsoftheschool'sproposal 47andmayincludetermsandconditionstoaddressareasneedingcorrectionorimprovement. 48Thecommissionermayrevokeorsuspendtheauthorizationofarecoveryhighschoolnot 49meetingtherequirementsofthissectionortherequirementsoftheschool'sproposal. 50 (5)Pupilattendance,dropoutrate,studentperformanceonstatewideassessments,and 51otherdataconsideredintheMissourischoolimprovementprogramandschoolaccreditation 52shallnotbeattributedtothegeneralaccreditationofeitherasendingdistrictorthe[districtor 53districts] sponsoringentityoperatingtherecoveryhighschoolandmaybeusedbythe 54commissioneronlyintherenewalprocessfortherecoveryhighschoolasprovidedinthis 55subsection. 56 3.(1)Aschooldistrictmayenterintoanagreementwitha[districtordistricts] 57sponsoringentityoperatingarecoveryhighschoolfortheenrollmentofaneligiblestudent 58whoiscurrentlyenrolledinorresidesinthesendingdistrict. 59 (2)Aparentorguardianmayseektoenrollaneligiblestudentresidinginasending 60districtinarecoveryhighschoolcreatedunderthissection.Astudentovereighteenyearsof 61ageresidinginasendingdistrictmayseektoenrollinarecoveryhighschool. 62 (3)An"eligiblestudent"shallmeanastudentwhoisinrecoveryfromsubstanceuse 63disorderorsubstancedependency,orsuchaconditionalongwithco-occurringdisorderssuch 64asanxiety,depression,andattentiondeficithyperactivitydisorder,andwhoisdeterminedby 65therecoveryhighschooltobeastudentwhowouldacademicallyandclinicallybenefitfrom 66placementintherecoveryhighschoolandiscommittedtoworkingonthestudent'srecovery. 67Therecoveryhighschoolshallconsideravailableinformationincluding,butnotlimitedto, 68anyrecommendationofadrugcounselor,alcoholismcounselor,orsubstanceabusecounselor 69licensedorcertifiedunderapplicablelawsandregulations. 70 (4)Arecoveryhighschoolshallnotlimitordenyadmissiontoaneligiblestudent 71basedonrace,ethnicity,nationalorigin,disability,incomelevel,proficiencyintheEnglish 72language,orathleticability. 73 4.(1)Therecoveryhighschoolshallannuallyadoptapolicyestablishingatuition 74rateforitsstudentsnolaterthanFebruaryfirstoftheprecedingschoolyear. 75 (2)Thesendingdistrictofaneligiblestudentwhoisenrolledinandattendinga 76recoveryhighschoolshallpaytuitiontotherecoveryhighschoolequaltothelesserof: HCSSSSB63 8 77 (a)Thetuitionrateestablishedundersubdivision(1)ofthissubsection;or 78 (b)Thestateadequacytarget,asdefinedinsection163.011,plustheaveragesum 79producedperchildbythelocaltaxeffortabovethestateadequacytargetofthesending 80district. 81 (3)Ifcostsassociatedwiththeprovisionofspecialeducationandrelateddisability 82servicestothestudentexceedthetuitiontobepaidundersubdivision(2)ofthissubsection, 83thesendingdistrictshallremainresponsibleforpayingtheexcesscosttotherecoveryhigh 84school. 85 (4)Thecommissionermayenterintoanagreementwiththeappropriateofficialor 86agencyofanotherstatetodevelopareciprocityagreementforotherwiseeligible,nonresident 87studentsseekingtoattendarecoveryhighschoolinthisstate.Arecoveryhighschoolmay 88enrollotherwiseeligiblestudentsresidinginastateotherthanthisstateasprovidedinsuch 89reciprocityagreement.Suchreciprocityagreementshallrequiretheout-of-statestudent's 90districtofresidencetopaytotherecoveryhighschoolanannualamountequaltoonehundred 91fivepercentofthetuitionratefortherecoveryhighschoolestablishedunderthissubsection. 92Ifanotherwiseeligiblestudentresidesinastatethatisnotsubjecttoareciprocityagreement, 93suchstudentmayattendarecoveryhighschoolprovidedsuchstudentpaystotheschoolone 94hundredfivepercentofthetuitionratefortherecoveryhighschoolestablishedunderthis 95subsection.Nostudentenrolledandattendingarecoveryhighschoolunderthissubdivision 96shallbeincludedasaresidentpupilforanystateaidpurposeunderchapter163. 97 5.Theboard,inconsultationwiththedepartmentofmentalhealth,maypromulgate 98rulestoimplementtheprovisionsofthissection.Anyruleorportionofarule,asthattermis 99definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 100becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536 101and,ifapplicable,section536.028.Thissectionandchapter536arenonseverableandifany 102ofthepowersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe 103effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then 104thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2022, 105shallbeinvalidandvoid. ✔ HCSSSSB63 9
