13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
14 | 14 | | Section A. Section 135.1670, RSMo, is repealed and one 1 |
---|
15 | 15 | | new section enacted in lieu thereof, to be known as section 2 |
---|
16 | 16 | | 135.1670, to read as follows:3 |
---|
17 | 17 | | 135.1670. 1. As used in this section, the following 1 |
---|
18 | 18 | | terms mean: 2 |
---|
19 | 19 | | (1) "Kansas border county", Johnson, Miami, or 3 |
---|
20 | 20 | | Wyandotte County in Kansas; 4 |
---|
21 | 21 | | (2) "Missouri border county", any county with a 5 |
---|
22 | 22 | | charter form of government and with more than s ix hundred 6 |
---|
23 | 23 | | thousand but fewer than seven hundred thousand inhabitants, 7 |
---|
24 | 24 | | any county of the first classification with more than eighty - 8 |
---|
25 | 25 | | three thousand but fewer than ninety -two thousand 9 |
---|
26 | 26 | | inhabitants and with a city of the fourth classification 10 |
---|
27 | 27 | | with more than four thousand five hundred but fewer than 11 |
---|
28 | 28 | | five thousand inhabitants as the county seat, any county of 12 |
---|
29 | 29 | | the first classification with more than two hundred thousand 13 |
---|
30 | 30 | | but fewer than two hundred sixty thousand inhabitants, or 14 |
---|
31 | 31 | | any county of the first clas sification with more than ninety - 15 |
---|
32 | 32 | | two thousand but fewer than one hundred one thousand 16 |
---|

34 | 34 | | 2. If any job that qualifies for a tax credit under 18 |
---|
35 | 35 | | sections 100.700 to 100.850 or under sections 135.100 to 19 |
---|
36 | 36 | | 135.258, for funding under section 620.1023, or for a tax 20 |
---|
37 | 37 | | credit or retention of state withholding taxes under 21 |
---|
38 | 38 | | sections 620.2000 to 620.2020, relocates to a Missouri 22 |
---|
39 | 39 | | border county from a Kansas border county, no tax credits 23 |
---|
40 | 40 | | shall be issued, funding provided, or retention of 24 |
---|
41 | 41 | | withholding taxes authorized for such job under such 25 |
---|
42 | 42 | | sections. 26 |
---|
43 | 43 | | 3. If the director of the Missouri department of 27 |
---|
44 | 44 | | economic development determines that the state of Kansas has 28 |
---|
45 | 45 | | enacted legislation or the governor of Kansas issued an 29 |
---|
46 | 46 | | executive order or similar action which prohibits the Kansas 30 |
---|
47 | 47 | | Department of Commerce or any other Kansas executive 31 |
---|
48 | 48 | | department from providing economic incentives for jobs that 32 |
---|
49 | 49 | | are relocated from a Missouri border county to a Kansas 33 |
---|
50 | 50 | | border county, then the director shall ex ecute and deliver 34 |
---|
51 | 51 | | to the governor, the speaker of the house of 35 |
---|
52 | 52 | | representatives, and the president pro tempore of the senate 36 |
---|
53 | 53 | | a written certification of such determination. Upon the 37 |
---|
54 | 54 | | execution and delivery of such written certification and the 38 |
---|
55 | 55 | | parties receiving such certification providing a unanimous 39 |
---|
56 | 56 | | written affirmation, the provisions of subsection 2 of this 40 |
---|
57 | 57 | | section shall be effective unless otherwise provided in this 41 |
---|
58 | 58 | | section. The provisions of subsection 2 of this section 42 |
---|
59 | 59 | | shall not apply to incen tives reserved on behalf of and 43 |
---|
60 | 60 | | awarded to Missouri employers prior to the provisions of 44 |
---|
61 | 61 | | subsection 2 of this section taking effect. 45 |
---|
62 | 62 | | 4. If the director of the Missouri department of 46 |
---|
63 | 63 | | economic development determines that the Kansas Department 47 |
---|
64 | 64 | | of Commerce or any other Kansas executive department is 48 |
---|
65 | 65 | | providing economic incentives for jobs that relocate from a 49 SB 630 3 |

66 | 66 | | Missouri border county to a Kansas border county, then the 50 |
---|
67 | 67 | | director shall execute and deliver to the governor, the 51 |
---|
68 | 68 | | speaker of the house of re presentatives, and the president 52 |
---|
69 | 69 | | pro tempore of the senate a written certification of such 53 |
---|
70 | 70 | | determination. Upon the execution and delivery of such 54 |
---|
71 | 71 | | written certification and the parties receiving such 55 |
---|
72 | 72 | | certification providing a unanimous written affirmat ion, the 56 |
---|
73 | 73 | | provisions of subsection 2 of this section shall not be 57 |
---|
74 | 74 | | effective until such time as the director determines that 58 |
---|
75 | 75 | | the Kansas Department of Commerce or any other Kansas 59 |
---|
76 | 76 | | executive department is not providing economic incentives 60 |
---|
77 | 77 | | for jobs that relocate from a Missouri border county to a 61 |
---|
78 | 78 | | Kansas border county, and the director has executed and 62 |
---|
79 | 79 | | delivered to the governor, the speaker of the house of 63 |
---|
80 | 80 | | representatives, and the president pro tempore of the senate 64 |
---|
81 | 81 | | a written certification of such determ ination and the 65 |
---|
82 | 82 | | parties receiving such certification provide an unanimous 66 |
---|
83 | 83 | | written affirmation. 67 |
---|
84 | 84 | | 5. The director of the Missouri department of economic 68 |
---|
85 | 85 | | development shall notify the revisor of statutes of all 69 |
---|
86 | 86 | | changes in whether subsection 2 of this section is effective. 70 |
---|
87 | 87 | | [6. The provisions of this section shall expire August 71 |
---|
88 | 88 | | 28, 2021, unless at such time the provisions of subsection 2 72 |
---|
89 | 89 | | of this section are in effect. If the provisions of this 73 |
---|
90 | 90 | | section do not expire on August 28, 2021, the provi sions of 74 |
