1010 To repeal section 135.1670, RSMo, and to enact in lieu thereof one new section relating to
1111 incentives for interstate business relocation.

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 135.1670, RSMo, is repealed and one 1
1515 new section enacted in lieu thereof, to be known as section 2
1616 135.1670, to read as follows:3
1717 135.1670. 1. As used in this section, the following 1
1818 terms mean: 2
1919 (1) "Kansas border county", Johnson, Miami, or 3
2020 Wyandotte County in Kansas; 4
2121 (2) "Missouri border county", any county with a 5
2222 charter form of government and with more than s ix hundred 6
2323 thousand but fewer than seven hundred thousand inhabitants, 7
2424 any county of the first classification with more than eighty - 8
2525 three thousand but fewer than ninety -two thousand 9
2626 inhabitants and with a city of the fourth classification 10
2727 with more than four thousand five hundred but fewer than 11
2828 five thousand inhabitants as the county seat, any county of 12
2929 the first classification with more than two hundred thousand 13
3030 but fewer than two hundred sixty thousand inhabitants, or 14
3131 any county of the first clas sification with more than ninety - 15
3232 two thousand but fewer than one hundred one thousand 16
3333 inhabitants in Missouri. 17 SB 630 2
3434 2. If any job that qualifies for a tax credit under 18
3535 sections 100.700 to 100.850 or under sections 135.100 to 19
3636 135.258, for funding under section 620.1023, or for a tax 20
3737 credit or retention of state withholding taxes under 21
3838 sections 620.2000 to 620.2020, relocates to a Missouri 22
3939 border county from a Kansas border county, no tax credits 23
4040 shall be issued, funding provided, or retention of 24
4141 withholding taxes authorized for such job under such 25
4242 sections. 26
4343 3. If the director of the Missouri department of 27
4444 economic development determines that the state of Kansas has 28
4545 enacted legislation or the governor of Kansas issued an 29
4646 executive order or similar action which prohibits the Kansas 30
4747 Department of Commerce or any other Kansas executive 31
4848 department from providing economic incentives for jobs that 32
4949 are relocated from a Missouri border county to a Kansas 33
5050 border county, then the director shall ex ecute and deliver 34
5151 to the governor, the speaker of the house of 35
5252 representatives, and the president pro tempore of the senate 36
5353 a written certification of such determination. Upon the 37
5454 execution and delivery of such written certification and the 38
5555 parties receiving such certification providing a unanimous 39
5656 written affirmation, the provisions of subsection 2 of this 40
5757 section shall be effective unless otherwise provided in this 41
5858 section. The provisions of subsection 2 of this section 42
5959 shall not apply to incen tives reserved on behalf of and 43
6060 awarded to Missouri employers prior to the provisions of 44
6161 subsection 2 of this section taking effect. 45
6262 4. If the director of the Missouri department of 46
6363 economic development determines that the Kansas Department 47
6464 of Commerce or any other Kansas executive department is 48
6565 providing economic incentives for jobs that relocate from a 49 SB 630 3
6666 Missouri border county to a Kansas border county, then the 50
6767 director shall execute and deliver to the governor, the 51
6868 speaker of the house of re presentatives, and the president 52
6969 pro tempore of the senate a written certification of such 53
7070 determination. Upon the execution and delivery of such 54
7171 written certification and the parties receiving such 55
7272 certification providing a unanimous written affirmat ion, the 56
7373 provisions of subsection 2 of this section shall not be 57
7474 effective until such time as the director determines that 58
7575 the Kansas Department of Commerce or any other Kansas 59
7676 executive department is not providing economic incentives 60
7777 for jobs that relocate from a Missouri border county to a 61
7878 Kansas border county, and the director has executed and 62
7979 delivered to the governor, the speaker of the house of 63
8080 representatives, and the president pro tempore of the senate 64
8181 a written certification of such determ ination and the 65
8282 parties receiving such certification provide an unanimous 66
8383 written affirmation. 67
8484 5. The director of the Missouri department of economic 68
8585 development shall notify the revisor of statutes of all 69
8686 changes in whether subsection 2 of this section is effective. 70
8787 [6. The provisions of this section shall expire August 71
8888 28, 2021, unless at such time the provisions of subsection 2 72
8989 of this section are in effect. If the provisions of this 73
9090 section do not expire on August 28, 2021, the provi sions of 74
9191 this section shall expire on August 28, 2025. ] 75
