10	10	To repeal sections 43.546, 210.482, 210.487, and 590.060, RSMo, and to enact in lieu thereof
11	11	forty-two new sections relating to criminal background checks.

13	13	Be it enacted by the General Assembly of the State of Missouri, as follows:
14	14	Section A. Sections 43.546, 210.482, 210.487, and 1
15	15	590.060, RSMo, are repealed and forty -two new sections enacted 2
16	16	in lieu thereof, to be known as sections 43.546, 168.014, 3
17	17	190.106, 208.222, 209.324, 210.482, 210.487, 301.551, 324.055, 4
18	18	324.129, 324.246, 324.488, 324.1105, 326.257, 330.025, 331.025, 5
19	19	332.015, 334.015, 334.403, 334.501, 334.701, 334.739, 334.805, 6
20	20	335.022, 335.042, 336.025 , 337.018, 337.308, 337.501, 337.605, 7
21	21	337.702, 338.052, 339.015, 339.510, 345.016, 374.711, 436.225, 8
22	22	443.702, 476.802, 484.125, 590.060, and 640.011, to read as 9

24	24	43.546. 1. Any state agency, board, or commission may 1
25	25	require the fingerprint ing of applicants in specified 2
26	26	occupations or appointments within the state agency, board, 3
27	27	or commission for the purpose of positive identification and 4
28	28	receiving criminal history record information when 5
29	29	determining an applicant's ability or fitness to serve in 6
30	30	such occupation or appointment. 7
31	31	2. In order to facilitate the criminal background 8
32	32	check under subsection 1 of this section on any person 9
33	33	employed or appointed by a state agency, board, or 10
34	34	commission, [and in accordance with section 43.54 3,] the 11 SB 636 2
35	35	applicant or employee shall submit a set of fingerprints 12
36	36	collected under the standards determined by the Missouri 13
37	37	highway patrol. The fingerprints and accompanying fees, 14
38	38	unless otherwise arranged, shall be forwarded to the highway 15
39	39	patrol to be used to search the state criminal history 16
40	40	repository and the fingerprints shall be forwarded to the 17
41	41	Federal Bureau of Investigation for a national criminal 18
42	42	background check under section 43.540. Notwithstanding the 19
43	43	provisions of section 610.120 to the contrary, all records 20
44	44	related to any criminal history information discovered shall 21
45	45	be accessible and available to the state agency making the 22
46	46	request. 23
47	47	168.014. 1. The state board of education may require 1
48	48	that fingerprint submiss ions be made as part of an 2
49	49	application seeking a certificate of license to teach or 3
50	50	substitute teach in public schools, as provided in sections 4
51	51	168.011, 168.021, and 168.036 and as required by section 5
52	52	168.133. 6
53	53	2. If the state board of education r equires that 7
54	54	fingerprint submissions be made as part of such application, 8
55	55	the state board of education shall require applicants to 9
56	56	submit the fingerprints to the Missouri state highway patrol 10
57	57	for the purpose of conducting a state and federal 11
58	58	fingerprint-based criminal history background check. 12
59	59	3. The fingerprints and any required fees shall be 13
60	60	sent to the Missouri state highway patrol's central 14
61	61	repository. The fingerprints shall be used for searching 15
62	62	the state criminal records repository and shall also be 16
63	63	forwarded to the Federal Bureau of Investigation for a 17
64	64	federal criminal records search under section 43.540. The 18
65	65	Missouri state highway patrol shall notify the state board 19
66	66	of education of any criminal history record information or 20 SB 636 3
67	67	lack of criminal history record information discovered on 21
68	68	the individual. Notwithstanding the provisions of section 22
69	69	610.120 to the contrary, all records related to any criminal 23
70	70	history information discovered shall be accessible and 24
71	71	available to the state b oard of education. 25
72	72	190.106. 1. The department of health and senior 1
73	73	services may require that fingerprint submissions be made as 2
74	74	part of an application seeking licensure as an emergency 3
75	75	medical technician or "EMT", an advanced emerge ncy medical 4
76	76	technician or "AEMT", or a paramedic, and an application 5
77	77	seeking certification as an emergency medical technician - 6
78	78	community paramedic or "EMT -CP", as such terms are defined 7
79	79	in section 190.100. 8
80	80	2. If the department of health and senior services 9
81	81	requires that fingerprint submissions be made as part of 10
82	82	such application, the department of health and senior 11
83	83	services shall require applicants to submit the fingerprints 12
84	84	to the Missouri state highway patrol for the purpose of 13
85	85	conducting a state and federal fingerprint -based criminal 14
86	86	history background check. 15
87	87	3. The fingerprints and any required fees shall be 16
88	88	sent to the Missouri state highway patrol's central 17
89	89	repository. The fingerprints shall be used for searching 18
90	90	the state criminal records repository and shall also be 19
91	91	forwarded to the Federal Bureau of Investigation for a 20
92	92	federal criminal records search under section 43.540. The 21
93	93	Missouri state highway patrol shall notify the department of 22
94	94	health and senior services of any c riminal history record 23
95	95	information or lack of criminal history record information 24
96	96	discovered on the individual. Notwithstanding the 25
97	97	provisions of section 610.120 to the contrary, all records 26
98	98	related to any criminal history information discovered shall 27 SB 636 4
99	99	be accessible and available to the department of health and 28
100	100	senior services. 29
101	101	208.222. 1. The Missouri Medicaid audit and 1
102	102	compliance unit within the department of social services may 2
103	103	require that fingerprint submissions be made as part of an 3
104	104	application seeking to be licensed as a MO HealthNet 4
105	105	provider for the purpose of providing MO HealthNet services 5
106	106	to eligible persons and obtaining from the department of 6
107	107	social services or its divisions reimbursement for eligible 7
108	108	services. 8
109	109	2. If the Missouri Medicaid audit and compliance unit 9
110	110	within the department of social services requires that 10
111	111	fingerprint submissions be made as part of such application, 11
112	112	the Missouri Medicaid audit and compliance unit within the 12
113	113	department of social services shall require applicants to 13
114	114	submit the fingerprints to the Missouri state highway patrol 14
115	115	for the purpose of conducting a state and federal 15
116	116	fingerprint-based criminal history background check. 16
117	117	3. The fingerprints and any required fees shall be 17
118	118	sent to the Missouri state highway patrol's central 18
119	119	repository. The fingerprints shall be used for searching 19
120	120	the state criminal records repository and shall also be 20
121	121	forwarded to the Federal Bureau of Investigation for a 21
122	122	federal criminal reco rds search under section 43.540. The 22
123	123	Missouri state highway patrol shall notify the Missouri 23
124	124	Medicaid audit and compliance unit within the department of 24
125	125	social services of any criminal history record information 25
126	126	or lack of criminal history record info rmation discovered on 26
127	127	the individual. Notwithstanding the provisions of section 27
128	128	610.120 to the contrary, all records related to any criminal 28
129	129	history information discovered shall be accessible and 29 SB 636 5
130	130	available to the Missouri Medicaid audit and compliance unit 30
131	131	within the department of social services. 31
132	132	4. For purposes of this section, the following terms 32
133	133	mean: 33
134	134	(1) "MO HealthNet provider", an individual or business 34
135	135	that enters into a contractor provider agreement with the 35
136	136	department of social services or its divisions for the 36
137	137	purpose of providing services to eligible persons and 37
138	138	obtaining from the department of social services or its 38
139	139	divisions reimbursement for such services; 39
140	140	(2) "MO HealthNet services", medical services defined 40
141	141	and determined by the department of social services or 41
142	142	listed specifically in section 208.152 in which eligible 42
143	143	persons receive as part of their Missouri Medicaid coverage. 43
144	144	209.324. 1. The state committee of interpreters may 1
145	145	require that fingerprint submissions be made as part of an 2
146	146	application seeking licensure as an interpreter, as such 3
147	147	term is defined in section 209.285, and temporary 4
148	148	interpreter, as provided in section 209.326. 5
149	149	2. If the state committee of interpreters requi res 6
150	150	that fingerprint submissions be made as part of such 7
151	151	application, the state committee of interpreters shall 8
152	152	require applicants to submit the fingerprints to the 9
153	153	Missouri state highway patrol for the purpose of conducting 10
154	154	a state and federal finger print-based criminal history 11
155	155	background check. 12
156	156	3. The fingerprints and any required fees shall be 13
157	157	sent to the Missouri state highway patrol's central 14
158	158	repository. The fingerprints shall be used for searching 15
159	159	the state criminal records repository and shall also be 16
160	160	forwarded to the Federal Bureau of Investigation for a 17
161	161	federal criminal records search under section 43.540. The 18 SB 636 6
162	162	Missouri state highway patrol shall notify the committee of 19
163	163	any criminal history record information or lack of criminal 20
164	164	history record information discovered on the individual. 21
165	165	Notwithstanding the provisions of section 610.120 to the 22
166	166	contrary, all records related to any criminal history 23
167	167	information discovered shall be accessible and available to 24
168	168	the committee. 25
169	169	210.482. 1. If the emergency placement of a child in 1
170	170	a private home is necessary due to the unexpected absence of 2
171	171	the child's parents, legal guardian, or custodian, the 3
172	172	juvenile court or children's division of the department of 4
173	173	social services: 5
174	174	(1) May request that a local or state law enforcement 6
175	175	agency or juvenile officer [, subject to any required federal 7
176	176	authorization,] immediately conduct a name -based criminal 8
177	177	history record check to include full orders of protection 9
178	178	and outstanding warrants of each person over the age of 10
179	179	[seventeen] eighteen residing in the home by using the 11
180	180	Missouri uniform law enforcement system (MULES) and the 12
181	181	National Crime Information Center to access the Interstate 13
182	182	Identification Index (III) maintained by the Federal Bureau 14
183	183	of Investigation; and 15
184	184	(2) Shall determine or, in the case of the juvenile 16
185	185	court, shall request the division to determine whether any 17
186	186	person over the age of [seventeen] eighteen years residing 18
187	187	in the home is liste d on the child abuse and neglect 19
188	188	registry. For any children less than [seventeen] eighteen 20
189	189	years of age residing in the home, the children's division 21
190	190	shall inquire of the person with whom an emergency placement 22
191	191	of a child will be made whether any chil dren less than 23
192	192	[seventeen] eighteen years of age residing in the home have 24 SB 636 7
193	193	ever been certified as an adult and convicted of or pled 25
194	194	guilty or nolo contendere to any crime. 26
195	195	2. If a name-based search has been conducted pursuant 27
196	196	to subsection 1 of t his section, within fifteen calendar 28
197	197	days of the Interstate Identification Index (III) name -based 29
198	198	check, after the emergency placement of the child in the 30
199	199	private home, and if the private home has not previously 31
200	200	been approved as a foster or adoptive ho me, all persons over 32
201	201	the age of [seventeen] eighteen residing in the home and all 33
202	202	children less than [seventeen] eighteen residing in the home 34
203	203	who the children's division has determined have been 35
204	204	certified as an adult for the commission of a crime shal l 36
205	205	[report to a local law enforcement agency for the purpose of 37
206	206	providing fingerprints and accompanying fees ] be 38
207	207	fingerprinted, pursuant to sections 43.530 and 43.540. The 39
208	208	fingerprints shall be used for searching the state criminal 40
209	209	records repository and shall also be forwarded to the 41
210	210	Federal Bureau of Investigation for a federal criminal 42
211	211	records search under section 43.540. Results of the checks 43
212	212	shall be provided to the juvenile court or children's 44
213	213	division office requesting such information. Any child 45
214	214	placed in emergency placement in a private home shall be 46
215	215	removed immediately if any person residing in the home fails 47
216	216	to provide fingerprints after being requested to do so, 48
217	217	unless the person refusing to provide fingerprints ceases to 49
218	218	reside in the private home. 50
219	219	3. If the placement of a child is denied as a result 51
220	220	of a name-based criminal history check and the denial is 52
221	221	contested, all persons over the age of [seventeen] eighteen 53
222	222	residing in the home and all children less than [seventeen] 54
223	223	eighteen years of age residing in the home who the 55
224	224	children's division has determined have been certified as an 56 SB 636 8
225	225	adult for the commission of a crime shall, within fifteen 57
226	226	calendar days of conducting the Interstate Identification 58
227	227	Index (III) name-based check, submit [to the juvenile court 59
228	228	or the children's division ] fingerprints and any required 60
229	229	fees, in the same manner described in subsection 2 of this 61
230	230	section[, accompanying fees, and written permission 62
231	231	authorizing the juvenile court or the child ren's division to 63
232	232	forward the fingerprints to the state criminal record 64
233	233	repository for submission to the Federal Bureau of 65
234	234	Investigation. 66
235	235	4. No person who submits fingerprints under this 67
236	236	section shall be required to submit additional fingerprints 68
237	237	under this section or section 210.487 unless the original 69
238	238	fingerprints retained by the division are lost or destroyed ]. 70
239	239	[5.] 4. Subject to appropriation, the total cost of 71
240	240	fingerprinting required by this section may be paid by the 72
241	241	state, including reimbursement of persons incurring 73
242	242	fingerprinting costs under this section. 74
243	243	[6.] 5. For the purposes of this section, "emergency 75
244	244	placement" refers to those limited instances when the 76
245	245	juvenile court or children's division is placing a child in 77
246	246	the home of private individuals, including neighbors, 78
247	247	friends, or relatives, as a result of a sudden 79
248	248	unavailability of the child's primary caretaker. 80
249	249	210.487. 1. The children's division of the department 1
250	250	of social services may requi re fingerprint submissions to 2
251	251	the Missouri state highway patrol for the purpose of 3
252	252	conducting a state and federal fingerprint -based criminal 4
253	253	background check. When conducting investigations of persons 5
254	254	for the purpose of foster parent licensing, the children's 6
255	255	division shall: 7 SB 636 9
256	256	(1) Conduct a search for all persons over the age of 8
257	257	[seventeen] eighteen in the applicant's household and for 9
258	258	any child less than [seventeen] eighteen years of age 10
259	259	residing in the applicant's home who the division has 11
260	260	determined has been certified as an adult for the commission 12
261	261	of a crime for evidence of full orders of protection. The 13
262	262	office of state courts administrator shall allow access to 14
263	263	the automated court information system by the division. The 15
264	264	clerk of each court contacted by the division shall provide 16
265	265	the division information within ten days of a request; 17
266	266	(2) Obtain fingerprints for any person over the age of 18
267	267	[seventeen] eighteen in the applicant's household and for 19
268	268	any child less than [seventeen] eighteen years of age 20
269	269	residing in the applicant's home who the division has 21
270	270	determined has been certified as an adult for the commission 22
271	271	of a crime [in the same manner set forth in subsection 2 of 23
272	272	section 210.482]. The fingerprints and any required fe es 24
273	273	shall be sent to the Missouri state highway patrol's central 25
274	274	repository. The fingerprints shall be used for searching 26
275	275	the state criminal records repository and shall also be 27
276	276	forwarded to the Federal Bureau of Investigation for a 28
277	277	federal criminal records search under section 43.540. The 29
278	278	Missouri state highway patrol shall notify the juvenile 30
279	279	court or the division of any criminal history record 31
280	280	information or lack of criminal history record information 32
281	281	discovered on the individual. Notwithstanding the 33
282	282	provisions of section 610.120 to the contrary, all records 34
283	283	related to any criminal history information discovered shall 35
284	284	be accessible and available to the juvenile court or the 36
285	285	division. The highway patrol shall assist the division and 37
286	286	provide the criminal fingerprint background information, 38 SB 636 10
287	287	upon request, under and in accordance with the provisions of 39
288	288	section 43.540; and 40
289	289	(3) Determine whether any person over the age of 41
290	290	[seventeen] eighteen residing in the home and any child less 42
291	291	than [seventeen] eighteen years of age residing in the 43
292	292	applicant's home who the division has determined has been 44
293	293	certified as an adult for the commission of a crime is 45
294	294	listed on the child abuse and neglect registry. For any 46
295	295	children less than [seventeen] eighteen years of age 47
296	296	residing in the applicant's home, the [children's] division 48
297	297	shall inquire of the applicant whether any children less 49
298	298	than [seventeen] eighteen years of age residing in the home 50
299	299	have ever been certified as an adult and been convict ed of 51
300	300	or pled guilty or nolo contendere to any crime. 52
301	301	2. [After the initial investigation is completed under 53
302	302	subsection 1 of this section: 54
303	303	(1) No person who submits fingerprints under 55
304	304	subsection 1 of this section or section 210.482 shall be 56
305	305	required to submit additional fingerprints under this 57
306	306	section or section 210.482 unless the original fingerprints 58
307	307	retained by the division are lost or destroyed; 59
308	308	(2) The highway patrol shall provide ongoing 60
309	309	electronic updates to criminal history background checks of 61
310	310	those persons previously submitted as part of the licensing 62
311	311	or approval process under subsection 1 of this section. 63
312	312	Ongoing electronic updates for such persons and for those in 64
313	313	their households shall terminate when such persons ce ase to 65
314	314	be applicant or licensed foster parents; and 66
315	315	(3) The children's division and the department of 67
316	316	health and senior services may waive the requirement for a 68
317	317	fingerprint background check for any subsequent 69
318	318	recertification. 70 SB 636 11
319	319	3.] Subject to appropriation, the total cost of 71
320	320	fingerprinting required by this section may be paid by the 72
321	321	state, including reimbursement of persons incurring 73
322	322	fingerprinting costs under this section. 74
323	323	[4.] 3. The division may make arrangements with other 75
324	324	executive branch agencies to obtain any investigative 76
325	325	background information. 77
326	326	[5.] 4. The division may promulgate rules that are 78
327	327	necessary to implement the provisions of this section. Any 79
328	328	rule or portion of a rule, as that term is defined in 80
329	329	section 536.010, that is created under the authority 81
330	330	delegated in this section shall become effective only if it 82
331	331	complies with and is subject to all of the provisions of 83
332	332	chapter 536 and, if applicable, section 536.028. This 84
333	333	section and chapter 536 are nonsever able and if any of the 85
334	334	powers vested with the general assembly pursuant to chapter 86
335	335	536 to review, to delay the effective date, or to disapprove 87
336	336	and annul a rule are subsequently held unconstitutional, 88
337	337	then the grant of rulemaking authority and any rule proposed 89
338	338	or adopted after August 28, 2004, shall be invalid and void. 90
339	339	301.551. 1. The department of revenue may require 1
340	340	that fingerprint submissions be made as part of an 2
341	341	application seeking licensure for a new motor vehicle 3
342	342	franchise dealer, used motor vehicle dealer, powersport 4
343	343	dealer, wholesale motor vehicle dealer, motor vehicle 5
344	344	dealer, public motor vehicle auction, recreational motor 6
345	345	vehicle dealer, trailer dealer, boat dealer, manufacturer, 7
346	346	or boat manufacturer, as such t erms are defined in section 8
347	347	301.550. 9
348	348	2. If the department of revenue requires that 10
349	349	fingerprint submissions be made as part of such application, 11
350	350	the department of revenue shall require applicants to submit 12 SB 636 12
351	351	the fingerprints to the Missouri state hi ghway patrol for 13
352	352	the purpose of conducting a state and federal fingerprint - 14
353	353	based criminal history background check. 15
354	354	3. The fingerprints and any required fees shall be 16
355	355	sent to the Missouri state highway patrol's central 17
356	356	repository. The fingerprints shall be used for searching 18
357	357	the state criminal records repository and shall also be 19
358	358	forwarded to the Federal Bureau of Investigation for a 20
359	359	federal criminal records search under section 43.540. The 21
360	360	Missouri state highway patrol shall notify the depa rtment of 22
361	361	any criminal history record information or lack of criminal 23
362	362	history record information discovered on the individual. 24
363	363	Notwithstanding the provisions of section 610.120 to the 25
364	364	contrary, all records related to any criminal history 26
365	365	information discovered shall be accessible and available to 27
366	366	the department. 28
367	367	324.055. 1. The Missouri board of occupational 1
368	368	therapy may require that fingerprint submissions be made as 2
369	369	part of an application seeking licensure as an occupational 3
370	370	therapist or an occupational therapy assistant, or a limited 4
371	371	permit to practice occupational therapy, as such terms are 5
372	372	defined in section 324.050 and as provided in section 6
373	373	324.077. 7
374	374	2. If the Missouri board of occupational therapy 8
375	375	requires that fingerprint submissions be made as part of 9
376	376	such application, the Missouri board of occupational therapy 10
377	377	shall require applicants to submit the fingerprints to the 11
378	378	Missouri state highway patrol for the purpose of conducting 12
379	379	a state and federal fingerpri nt-based criminal history 13
380	380	background check. 14
381	381	3. The fingerprints and any required fees shall be 15
382	382	sent to the Missouri state highway patrol's central 16 SB 636 13
383	383	repository. The fingerprints shall be used for searching 17
384	384	the state criminal records repository and shall also be 18
385	385	forwarded to the Federal Bureau of Investigation for a 19
386	386	federal criminal records search under section 43.540. The 20
387	387	Missouri state highway patrol shall notify the Missouri 21
388	388	board of occupational therapy of any criminal history record 22
389	389	information or lack of criminal history record information 23
390	390	discovered on the individual. Notwithstanding the 24
391	391	provisions of section 610.120 to the contrary, all records 25
392	392	related to any criminal history information discovered shall 26
393	393	be accessible and available to the Missouri board of 27
394	394	occupational therapy. 28
395	395	324.129. 1. The state board of registration for the 1
396	396	healing arts may require that fingerprint submissions be 2
397	397	made as part of an application seeking licensure as a 3
398	398	licensed clinical pe rfusionist and provisional clinical 4
399	399	licensed perfusionist, as defined in section 324.128. 5
400	400	2. If the state board of registration for the healing 6
401	401	arts requires that fingerprint submissions be made as part 7
402	402	of such application, the state board of regi stration for the 8
403	403	healing arts shall require applicants to submit the 9
404	404	fingerprints to the Missouri state highway patrol for the 10
405	405	purpose of conducting a state and federal fingerprint -based 11
406	406	criminal history background check. 12
407	407	3. The fingerprints and any required fees shall be 13
408	408	sent to the Missouri state highway patrol's central 14
409	409	repository. The fingerprints shall be used for searching 15
410	410	the state criminal records repository and shall also be 16
411	411	forwarded to the Federal Bureau of Investigation for a 17
412	412	federal criminal records search under section 43.540. The 18
413	413	Missouri state highway patrol shall notify the state board 19
414	414	of registration for the healing arts of any criminal history 20 SB 636 14
415	415	record information or lack of criminal history record 21
416	416	information discovered on the individual. Notwithstanding 22
417	417	the provisions of section 610.120 to the contrary, all 23
418	418	records related to any criminal history information 24
419	419	discovered shall be accessible and available to the state 25
420	420	board of registration for the healing arts. 26
421	421	324.246. 1. The board of therapeutic massage may 1
422	422	require that fingerprint submissions be made as part of an 2
423	423	application seeking a license, provisional license, or 3
424	424	student license as a massage therapist and a license as a 4
425	425	massage business, as such terms are defined in section 5
426	426	324.240 and as provided in sections 324.247 and 324.265. 6
427	427	2. If the board of therapeutic massage requires that 7
428	428	fingerprint submissions be made as part of such application, 8
429	429	the board of therapeutic massa ge shall require applicants to 9
430	430	submit the fingerprints to the Missouri state highway patrol 10
431	431	for the purpose of conducting a state and federal 11
432	432	fingerprint-based criminal history background check. 12
433	433	3. The fingerprints and any required fees shall be 13
434	434	sent to the Missouri state highway patrol's central 14
435	435	repository. The fingerprints shall be used for searching 15
436	436	the state criminal records repository and shall also be 16
437	437	forwarded to the Federal Bureau of Investigation for a 17
438	438	federal criminal records search under section 43.540. The 18
439	439	Missouri state highway patrol shall notify the board of 19
440	440	therapeutic massage of any criminal history record 20
441	441	information or lack of criminal history record information 21
442	442	discovered on the individual. Notwithstanding the 22
443	443	provisions of section 610.120 to the contrary, all records 23
444	444	related to any criminal history information discovered shall 24
445	445	be accessible and available to the board of therapeutic 25

447	447	324.488. 1. The state board of chiropractic examiners 1
448	448	may require that fingerprint submissions be made as part of 2

475	475	seeking licensure as a private investigator or pr ivate fire 4
476	476	investigator or as an employee of a private investigator 5
477	477	agency or private fire investigator agency, as such terms 6

528	528	330.025. 1. The state board of podiatric medicine may 1
529	529	require that fingerprint submissions be made as part of an 2
530	530	application seeking a permanent license or a temporary 3
531	531	license to practice podiatric m edicine, as provided in 4
532	532	sections 330.045 and 330.065, or a permanent podiatric 5
533	533	medicine license with ankle certification, as such term is 6
534	534	defined in subsection 4 of this section. 7

556	556	4. For purposes of this section, the term "permanent 29
557	557	podiatric medicine license with ankle certification" means a 30
558	558	license issued to a doctor of podiatric medicine who has met 31
559	559	the requirements for performing surgery on the ankle as 32
560	560	provided in section 330.010. 33
561	561	331.025. 1. The state board of chiropractic examiners 1
562	562	may require that fingerprint submissions be made as part of 2
563	563	an application seeking licensure to engage in the practice 3
564	564	of chiropractic, as such term is defined in section 331.010. 4

588	588	application seeking licensure as a dentist, a dental 3
589	589	specialist, a volunteer dentist, a temporary dentist, a 4
590	590	dental hygienist, or a volunteer dental hygienist, a limited 5
591	591	dental teaching license, and a dental faculty permit, as 6
592	592	provided in sections 332.091, 332.112, 332.113, 332.171, 7
593	593	332.181, 332.183, 332.201, and 332.425. 8
594	594	2. If the Missouri dental board requires that 9
595	595	fingerprint submissions be made as part of such application, 10
596	596	the Missouri dental board shall require appl icants to submit 11

614	614	healing arts may require that finger print submissions be 2
615	615	made as part of an application for a permanent license, 3
616	616	temporary license, or limited license as a physician and 4
617	617	assistant physician, as provided in sections 334.035, 5
618	618	334.036, 334.045, 334.046, and 334.112. 6

620	620	arts requires that fingerprint submissions be made as part 8
621	621	of such application, the state board of registration for the 9

780	780	sent to the Missouri state highway patrol's central 7
781	781	repository. The fingerprints shall be used for searching 8

785	785	Missouri state highway patrol shall notify the state board 12
786	786	of nursing of any criminal history record information or 13

790	790	history information discovered shall be accessible and 17

792	792	335.042. 1. The state board of nursing may require 1
793	793	that fingerprint submissions be made as part of an 2
794	794	application seeking licensure to practice as a registered 3
795	795	nurse, practical nurse, and advanced practice registered 4
796	796	nurse, as such terms are defined in section 335.016. 5 SB 636 26

814	814	history information discovered shall be accessible and 23
815	815	available to the state board of nursing. 24
816	816	336.025. 1. The state board of optometry may require 1
817	817	that fingerprint submissions be made as part of an 2
818	818	application seeking licensur e to practice as an optometrist, 3
819	819	as provided in sections 336.010 and 336.030. 4
820	820	2. If the state board of optometry requires that 5
821	821	fingerprint submissions be made as part of such application, 6
822	822	the state board of optometry shall require applicants to 7
823	823	submit the fingerprints to the Missouri state highway patrol 8
824	824	for the purpose of conducting a state and federal 9
825	825	fingerprint-based criminal history background check. 10

839	839	337.018. 1. The state committee of psychologists may 1
840	840	require that fingerprint submissions be m ade as part of an 2
841	841	application seeking licensure as a licensed psychologist, 3
842	842	provisional licensed psychologist, and temporary license for 4
843	843	a licensed psychologist. 5
844	844	2. If the state committee of psychologists requires 6
845	845	that fingerprint submissions be made as part of such 7
846	846	application, the state committee of psychologists shall 8
847	847	require applicants to submit the fingerprints to the 9
848	848	Missouri state highway patrol for the purpose of conducting 10
849	849	a state and federal fingerprint -based criminal history 11
850	850	background check. 12
851	851	3. The fingerprints and any required fees shall be 13
852	852	sent to the Missouri state highway patrol's central 14
853	853	repository. The fingerprints shall be used for searching 15
854	854	the state criminal records repository and shall also be 16

858	858	committee of psychologists of any criminal history record 20

862	862	related to any criminal history information discovered shall 24
863	863	be accessible and available to the state committee of 25

865	865	337.308. 1. The behavior analyst advisory board may 1
866	866	require that fingerprint submissions be made as part of an 2
867	867	application seeking licensure, provisional licensure, or 3
868	868	temporary licensure as a licensed behavior analyst or a 4
869	869	licensed assistant behavior analyst, as such terms are 5
870	870	defined in section 337.300. 6
871	871	2. If the behavior analyst advisory board requires 7
872	872	that fingerprint submissions be made as part of such 8
873	873	application, the behavior analyst advisory board shall 9
874	874	require applicants to submit the fingerprints to the 10

876	876	a state and federal fingerprint -based criminal history 12

889	889	related to any criminal history information discovered shall 25
890	890	be accessible and available to the behavior analyst advisory 26

894	894	an application seeking licensure as a licensed professional 3

918	918	337.605. 1. The state committee for social workers 1
919	919	may require that fingerprint submissions be made as part of 2
920	920	an application seeking a license or a temporary permit to 3
921	921	practice as a licensed clinical social worker, licensed 4
922	922	advanced macro social worker, licensed master social worker, 5
923	923	and licensed baccalaureate social worker, as such terms are 6 SB 636 30
924	924	defined in section 337.600 and as provided in section 7
925	925	337.621. 8
926	926	2. If the state committee for social workers requires 9
927	927	that fingerprint submissions be made as part of such 10
928	928	application, the state committee for social workers shall 11
929	929	require applicants to submit the fingerprints to the 12
930	930	Missouri state highway patrol for the p urpose of conducting 13
931	931	a state and federal fingerprint -based criminal history 14

933	933	3. The fingerprints and any required fees shall be 16

944	944	related to any criminal history informatio n discovered shall 27
945	945	be accessible and available to the state committee for 28
946	946	social workers. 29
947	947	337.702. 1. The state committee of marital and family 1
948	948	therapists may require that fingerprint submissions be made 2
949	949	as part of an application s eeking licensure as a licensed 3
950	950	marital and family therapist or provisional licensed marital 4
951	951	and family therapist as such terms are defined in section 5
952	952	337.700. 6
953	953	2. If the state committee of marital and family 7
954	954	therapists requires that fingerprint su bmissions be made as 8
955	955	part of such application, the state committee of marital and 9 SB 636 31
956	956	family therapists shall require applicants to submit the 10

969	969	record information discovered on the individual. 23
970	970	Notwithstanding the provisions of section 610.120 to the 24
971	971	contrary, all records related to any criminal history 25
972	972	information discovered shall be accessible and ava ilable to 26
973	973	the state committee of marital and family therapists. 27
974	974	338.052. 1. The board of pharmacy may require that 1
975	975	fingerprint submissions be made as part of an application 2
976	976	seeking a license to practice pharmacy as a pharmacist, a 3
977	977	certificate of registration as a pharmacy technician, a 4
978	978	license as an intern pharmacist, a license as a wholesale 5
979	979	drug distributor, a license as a third -party logistics 6
980	980	provider, a temporary license as a pharmacist, a permit for 7
981	981	the practice of pharmac y to be conducted at a pharmacy, and 8
982	982	a license as a drug outsourcer, as provided in sections 9
983	983	338.010, 338.013, 338.035, 338.043, 338.050, 338.210, and 10
984	984	338.330, and a manager -in-charge, wholesale drug distributor 11
985	985	facility manager, third -party logistics provider facility 12
986	986	manager, wholesale drug distributor facility owner, or third - 13 SB 636 32
987	987	party logistics provider facility owner, as such terms are 14
988	988	defined in subsection 4 of this section. 15
989	989	2. If the board of pharmacy requires that fingerprint 16
990	990	submissions be made as part of such application, the board 17
991	991	of pharmacy shall require applicants to submit the 18
992	992	fingerprints to the Missouri state highway patrol for the 19
993	993	purpose of conducting a state and federal fingerprint -based 20
994	994	criminal history background check. 21
995	995	3. The fingerprints and any required fees shall be 22
996	996	sent to the Missouri state highway patrol's central 23
997	997	repository. The fingerprints shall be used for searching 24
998	998	the state criminal records repository and shall also be 25
999	999	forwarded to the Federal Bureau of Investigation for a 26
1000	1000	federal criminal records search under section 43.540. The 27
1001	1001	Missouri state highway patrol shall notify the board of 28
1002	1002	pharmacy of any criminal history record information or lack 29
1003	1003	of criminal history record information discovered on the 30
1004	1004	individual. Notwithstanding the provisions of section 31
1005	1005	610.120 to the contrary, all records related to any criminal 32
1006	1006	history information discovered shall be accessible and 33
1007	1007	available to the board of pharmacy. 34
1008	1008	4. For purposes of this section, th e following terms 35
1009	1009	mean: 36
1010	1010	(1) "Manager-in-charge", a person who directly 37
1011	1011	supervises a licensed wholesale drug distributor or a third - 38
1012	1012	party logistics provider, as such terms are defined in 39
1013	1013	section 338.330, and whose fingerprints are required by 40
1014	1014	federal or state law for licensure of a wholesale drug 41
1015	1015	distributor facility or third -party logistics provider 42
1016	1016	facility; 43
1017	1017	(2) "Third-party logistics provider facility manager", 44
1018	1018	a person who is a manager and direct supervisor of a 45 SB 636 33
1019	1019	licensed third-party logistics provider, as such term is 46
1020	1020	defined in section 338.330, and whose fingerprints are 47
1021	1021	required by federal or state law for licensure of a third - 48
1022	1022	party logistics provider facility; 49
1023	1023	(3) "Third-party logistics provider facility owner", a 50
1024	1024	person who is an owner with greater than ten percent 51
1025	1025	ownership interest of a licensed third -party logistics 52
1026	1026	provider, as such term is defined in section 338.330, and 53
1027	1027	whose fingerprints are required by federal or state law for 54
1028	1028	licensure of a third -party logistics provider facility; 55
1029	1029	(4) "Wholesale drug distributor facility manager", a 56
1030	1030	person who is a manager of a wholesale drug distributor, as 57
1031	1031	such term is defined in section 338.330, and whose 58
1032	1032	fingerprints are required by federal or state law for 59
1033	1033	licensure of a wholesale drug distributor facility; 60
1034	1034	(5) "Wholesale drug distributor facility owner", a 61
1035	1035	person who is an owner with greater than ten percent 62
1036	1036	ownership interest of a licensed wholesale drug distributor, 63
1037	1037	as such term is defined in section 338.330, and whose 64
1038	1038	fingerprints are required by federal or state law for 65
1039	1039	licensure of a wholesale drug distributor facility. 66
1040	1040	339.015. 1. The Missouri real estate commission may 1
1041	1041	require that fingerprint submissions be made as part of an 2
1042	1042	application seeking licensure as a real estate broker, real 3
1043	1043	estate salesperson, and real estate broker -salesperson, as 4
1044	1044	such terms are defined in section 339.010 and as provided in 5
1045	1045	sections 339.030 and 339.040. 6
1046	1046	2. If the Missouri real estate c ommission requires 7
1047	1047	that fingerprint submissions be made as part of such 8
1048	1048	application, the Missouri real estate commission shall 9
1049	1049	require applicants to submit the fingerprints to the 10
1050	1050	Missouri state highway patrol for the purpose of conducting 11 SB 636 34
1051	1051	a state and federal fingerprint-based criminal history 12
1052	1052	background check. 13
1053	1053	3. The fingerprints and any required fees shall be 14
1054	1054	sent to the Missouri state highway patrol's central 15
1055	1055	repository. The fingerprints shall be used for searching 16
1056	1056	the state criminal reco rds repository and shall also be 17
1057	1057	forwarded to the Federal Bureau of Investigation for a 18
1058	1058	federal criminal records search under section 43.540. The 19
1059	1059	Missouri state highway patrol shall notify the Missouri real 20
1060	1060	estate commission of any criminal history re cord information 21
1061	1061	or lack of criminal history record information discovered on 22
1062	1062	the individual. Notwithstanding the provisions of section 23
1063	1063	610.120 to the contrary, all records related to any criminal 24
1064	1064	history information discovered shall be accessible and 25
1065	1065	available to the Missouri real estate commission. 26
1066	1066	339.510. 1. The Missouri real estate appraisers 1
1067	1067	commission may require that fingerprint submissions be made 2
1068	1068	as part of an application seeking licensure as a certified 3
1069	1069	residential appraiser, a certified residential appraiser 4
1070	1070	trainee, a certified general appraiser, a certified general 5
1071	1071	appraiser trainee, a state -licensed appraiser, a state - 6
1072	1072	licensed appraiser trainee, an appraisal management company, 7
1073	1073	a controlling person of an appra isal management company, and 8
1074	1074	an owner of an appraisal management company. 9
1075	1075	2. If the Missouri real estate appraisers commission 10
1076	1076	requires that fingerprint submissions be made as part of 11
1077	1077	such application, the Missouri real estate appraisers 12
1078	1078	commission shall require applicants to submit the 13
1079	1079	fingerprints to the Missouri state highway patrol for the 14
1080	1080	purpose of conducting a state and federal fingerprint -based 15
1081	1081	criminal history background check. 16 SB 636 35
1082	1082	3. The fingerprints and any required fees shall be 17
1083	1083	sent to the Missouri state highway patrol's central 18
1084	1084	repository. The fingerprints shall be used for searching 19
1085	1085	the state criminal records repository and shall also be 20
1086	1086	forwarded to the Federal Bureau of Investigation for a 21
1087	1087	federal criminal records search under section 43.540. The 22
1088	1088	Missouri state highway patrol shall notify the Missouri real 23
1089	1089	estate appraisers commission of any criminal history record 24
1090	1090	information or lack of criminal history record information 25
1091	1091	discovered on the individual. Notwithstanding the 26
1092	1092	provisions of section 610.120 to the contrary, all records 27
1093	1093	related to any criminal history information discovered shall 28
1094	1094	be accessible and available to the Missouri real estate 29
1095	1095	appraisers commission. 30
1096	1096	4. For purposes of this section, the fol lowing terms 31
1097	1097	mean: 32
1098	1098	(1) "Appraisal management company", an individual that 33
1099	1099	utilizes an appraisal panel and performs appraisal 34
1100	1100	management services for licensure; 35
1101	1101	(2) "Appraisal management services", to perform any of 36
1102	1102	the following functions o n behalf of a lender, financial 37
1103	1103	institution, or client: 38
1104	1104	(a) Administer an appraiser panel; 39
1105	1105	(b) Recruit, qualify, verify licensing or 40
1106	1106	certification, and negotiate fees and service level 41
1107	1107	expectations with persons who are part of an appraiser p anel; 42
1108	1108	(c) Receive an order for an appraisal from one 43
1109	1109	individual and deliver the order for the appraisal to an 44
1110	1110	appraiser that is part of an appraiser panel for completion; 45
1111	1111	(d) Track and determine the status of orders for 46
1112	1112	appraisals performed by appraisers who are part of an 47
1113	1113	appraisal panel; 48 SB 636 36
1114	1114	(e) Conduct quality control of a completed appraisal 49
1115	1115	performed by an appraiser who is part of an appraisal panel 50
1116	1116	prior to the delivery of the appraisal to the individual who 51
1117	1117	ordered the appraisal; and 52
1118	1118	(f) Provide a completed appraisal performed by an 53
1119	1119	appraiser who is part of an appraisal panel to one or more 54
1120	1120	individuals who have ordered an appraisal; 55
1121	1121	(3) "Certified general appraiser", an individual who 56
1122	1122	is qualified by education, expe rience, and examination to 57
1123	1123	appraise any real property, and whose fingerprints are 58
1124	1124	required for licensure; 59
1125	1125	(4) "Certified general appraiser trainee", an 60
1126	1126	individual who, under supervision, is qualified to appraise 61
1127	1127	certain real property and whose fi ngerprints are required 62
1128	1128	for licensure; 63
1129	1129	(5) "Certified residential appraiser", an individual 64
1130	1130	who is qualified to appraise certain real property and whose 65
1131	1131	fingerprints are required for licensure; 66
1132	1132	(6) "Certified residential appraiser trainee", an 67
1133	1133	individual who, under supervision, is qualified to appraise 68
1134	1134	certain real property and whose fingerprints are required 69
1135	1135	for licensure; 70
1136	1136	(7) "Controlling person of an appraisal management 71
1137	1137	company": 72
1138	1138	(a) An owner of an appraisal management com pany; 73
1139	1139	(b) An individual employed, appointed, or authorized 74
1140	1140	by an appraisal management company that has the authority to 75
1141	1141	enter into a contractual relationship with other persons for 76
1142	1142	the performance of appraisal management services and has the 77
1143	1143	authority to enter into agreements with appraisers for the 78
1144	1144	performance of appraisals; or 79 SB 636 37
1145	1145	(c) An individual who possesses the power to direct or 80
1146	1146	cause the direction of the management or policies of an 81
1147	1147	appraisal management company whose fingerprints are required 82
1148	1148	for licensure; 83
1149	1149	(8) "Owner of an appraisal management company", an 84
1150	1150	individual who owns ten percent or more of a licensed 85
1151	1151	appraisal management company and whose fingerprints are 86
1152	1152	required for licensure; 87
1153	1153	(9) "State-licensed appraiser", an individual who is 88
1154	1154	qualified to appraise certain real property and whose 89
1155	1155	fingerprints are required for licensure; 90
1156	1156	(10) "State-licensed appraiser trainee", an individual 91
1157	1157	who, under supervision, is qualified to appraise certain 92
1158	1158	real property and whose fingerprints are required for 93
1159	1159	licensure. 94
1160	1160	345.016. 1. The state board of registration for the 1
1161	1161	healing arts may require that fingerprint submissions be 2
1162	1162	made as part of an application seeking a license, as 3
1163	1163	described in section 345.020, or provisional license, as 4
1164	1164	described in section 345.021, as an audiologist, an 5
1165	1165	audiology aide, a speech -language pathologist, a speech - 6
1166	1166	language pathology aide, and a speech -language pathology 7
1167	1167	assistant, as such terms are defined in section 3 45.015. 8
1168	1168	2. If the state board of registration for the healing 9
1169	1169	arts requires that fingerprint submissions be made as part 10
1170	1170	of such application, the state board of registration for the 11
1171	1171	healing arts shall require applicants to submit the 12
1172	1172	fingerprints to the Missouri state highway patrol for the 13
1173	1173	purpose of conducting a state and federal fingerprint -based 14
1174	1174	criminal history background check. 15
1175	1175	3. The fingerprints and any required fees shall be 16
1176	1176	sent to the Missouri state highway patrol's central 17 SB 636 38
1177	1177	repository. The fingerprints shall be used for searching 18
1178	1178	the state criminal records repository and shall also be 19
1179	1179	forwarded to the Federal Bureau of Investigation for a 20
1180	1180	federal criminal records search under section 43.540. The 21
1181	1181	Missouri state highway pat rol shall notify the state board 22
1182	1182	of registration for the healing arts of any criminal history 23
1183	1183	record information or lack of criminal history record 24
1184	1184	information discovered on the individual. Notwithstanding 25
1185	1185	the provisions of section 610.120 to the cont rary, all 26
1186	1186	records related to any criminal history information 27
1187	1187	discovered shall be accessible and available to the state 28
1188	1188	board of registration for the healing arts. 29
1189	1189	374.711. 1. The department of commerce and insurance 1
1190	1190	may require that fingerprint submissions be made as part of 2
1191	1191	an application seeking a license, or renewal of a license, 3
1192	1192	for a general bail bond agent, a bail bond agent, or a 4
1193	1193	surety recovery agent, as such terms are defined in section 5
1194	1194	374.700. 6
1195	1195	2. If the department of commerce and insurance 7
1196	1196	requires that fingerprint submissions be made as part of 8
1197	1197	such application, the department of commerce and insurance 9
1198	1198	shall require applicants to submit the fingerprints to the 10
1199	1199	Missouri state highway patrol for the purpose o f conducting 11
1200	1200	a state and federal fingerprint -based criminal history 12
1201	1201	background check. 13
1202	1202	3. The fingerprints and any required fees shall be 14
1203	1203	sent to the Missouri state highway patrol's central 15
1204	1204	repository. The fingerprints shall be used for searching 16
1205	1205	the state criminal records repository and shall also be 17
1206	1206	forwarded to the Federal Bureau of Investigation for a 18
1207	1207	federal criminal records search under section 43.540. The 19
1208	1208	Missouri state highway patrol shall notify the department of 20 SB 636 39
1209	1209	any criminal history record information or lack of criminal 21
1210	1210	history record information discovered on the individual. 22
1211	1211	Notwithstanding the provisions of section 610.120 to the 23
1212	1212	contrary, all records related to any criminal history 24
1213	1213	information discovered shall be accessible and available to 25
1214	1214	the department. 26
1215	1215	436.225. 1. The director of the division of 1
1216	1216	professional registration may require that fingerprint 2
1217	1217	submissions be made as part of an application seeking 3
1218	1218	licensure as an athlete agent. 4
1219	1219	2. If the director of the division of professional 5
1220	1220	registration requires that fingerprint submissions be made 6
1221	1221	as part of such application, the director of the division of 7
1222	1222	professional registration shall require applicants to submit 8
1223	1223	the fingerprints to the Mis souri state highway patrol for 9
1224	1224	the purpose of conducting a state and federal fingerprint - 10
1225	1225	based criminal history background check. 11
1226	1226	3. The fingerprints and any required fees shall be 12
1227	1227	sent to the Missouri state highway patrol's central 13
1228	1228	repository. The fingerprints shall be used for searching 14
1229	1229	the state criminal records repository and shall also be 15
1230	1230	forwarded to the Federal Bureau of Investigation for a 16
1231	1231	federal criminal records search under section 43.540. The 17
1232	1232	Missouri state highway patrol shall n otify the director of 18
1233	1233	the division of professional registration of any criminal 19
1234	1234	history record information or lack of criminal history 20
1235	1235	record information discovered on the individual. 21
1236	1236	Notwithstanding the provisions of section 610.120 to the 22
1237	1237	contrary, all records related to any criminal history 23
1238	1238	information discovered shall be accessible and available to 24
1239	1239	the director of the division of professional registration. 25 SB 636 40
1240	1240	4. For purposes of this section, the term "athlete 26
1241	1241	agent" means an individual who: 27
1242	1242	(1) Recruits or solicits a student athlete to enter 28
1243	1243	into an agency contract or, for compensation, procures 29
1244	1244	employment or offers, promises, attempts, or negotiates to 30
1245	1245	obtain employment for a student athlete as a professional 31
1246	1246	athlete or member of a professional sports team or 32
1247	1247	organization; 33
1248	1248	(2) For compensation or in anticipation of 34
1249	1249	compensation related to a student athlete's participation in 35
1250	1250	athletics: 36
1251	1251	(a) Serves the student athlete in an advisory capacity 37
1252	1252	on a matter related to fina nces, business pursuits, or 38
1253	1253	career management decisions, unless the individual is an 39
1254	1254	employee of an educational institution acting exclusively as 40
1255	1255	an employee of the educational institution for the benefit 41
1256	1256	of the educational institution; or 42
1257	1257	(b) Manages the business affairs of the student 43
1258	1258	athlete by providing assistance with bills, payments, 44
1259	1259	contracts, or taxes; or 45
1260	1260	(3) In anticipation of representing a student athlete 46
1261	1261	for a purpose related to the student athlete's participation 47
1262	1262	in athletics: 48
1263	1263	(a) Gives consideration to the student athlete or 49
1264	1264	another person; 50
1265	1265	(b) Serves the student athlete in an advisory capacity 51
1266	1266	on a matter related to finances, business pursuits, or 52
1267	1267	career management decisions; or 53
1268	1268	(c) Manages the business affairs of the student 54
1269	1269	athlete by providing assistance with bills, payments, 55
1270	1270	contracts, or taxes. 56 SB 636 41
1271	1271	443.702. 1. The division of finance may require that 1
1272	1272	fingerprint submissions be made as part of an application 2
1273	1273	seeking licensure to act as a residential mortgage loan 3
1274	1274	broker or a mortgage loan originator. 4
1275	1275	2. If the division of finance requires that 5
1276	1276	fingerprint submissions be made as part of such application, 6
1277	1277	the division of finance shall require applicants to submit 7
1278	1278	the fingerprints to the Missouri state highway patrol for 8
1279	1279	the purpose of conducting a state and federal fingerprint - 9
1280	1280	based criminal history background check. 10
1281	1281	3. The fingerprints and any required fees shall be 11
1282	1282	sent to the Missouri state highway patrol's cent ral 12
1283	1283	repository. The fingerprints shall be used for searching 13
1284	1284	the state criminal records repository and shall also be 14
1285	1285	forwarded to the Federal Bureau of Investigation for a 15
1286	1286	federal criminal records search under section 43.540. The 16
1287	1287	Missouri state highway patrol shall notify the division of 17
1288	1288	finance of any criminal history record information or lack 18
1289	1289	of criminal history record information discovered on the 19
1290	1290	individual. Notwithstanding the provisions of section 20
1291	1291	610.120 to the contrary, all records rela ted to any criminal 21
1292	1292	history information discovered shall be accessible and 22
1293	1293	available to the division of finance. 23
1294	1294	4. For purposes of this section, the following terms 24
1295	1295	mean: 25
1296	1296	(1) "Mortgage loan originator", an individual who for 26
1297	1297	compensation or gain or in the expectation of compensation 27
1298	1298	or gain takes a residential mortgage loan application, or 28
1299	1299	offers or negotiates terms of a residential mortgage loan. 29
1300	1300	Mortgage loan originator does not include: 30 SB 636 42
1301	1301	(a) An individual engaged solely as a loa n processor 31
1302	1302	or underwriter except as otherwise provided in sections 32
1303	1303	443.701 to 443.893; 33
1304	1304	(b) An individual that only performs real estate 34
1305	1305	brokerage activities and is licensed or registered in 35
1306	1306	accordance with the law of this state, unless the perso n is 36
1307	1307	compensated by a lender, a mortgage broker, or other 37
1308	1308	mortgage loan originator or by any agent of such lender, 38
1309	1309	mortgage broker, or other mortgage loan originator; 39
1310	1310	(c) An individual solely involved in extensions of 40
1311	1311	credit relating to time -share plans, as the term time -share 41
1312	1312	plans is defined in 11 U.S.C. Section 101(53D); 42
1313	1313	(d) An individual who is servicing a mortgage loan; or 43
1314	1314	(e) An individual employed by a licensed mortgage 44
1315	1315	broker or loan originator who accepts or receives 45
1316	1316	residential mortgage loan applications; 46
1317	1317	(2) "Residential mortgage loan broker", an individual, 47
1318	1318	other than an exempt individual, engaged in the business of 48
1319	1319	brokering, funding, servicing, or purchasing residential 49
1320	1320	mortgage loans. 50
1321	1321	476.802. 1. The office of state courts administrator 1
1322	1322	may require that fingerprint submissions be made as part of 2
1323	1323	the application of certification as a qualified interpreter, 3
1324	1324	pursuant to section 476.800. 4
1325	1325	2. If the office of state courts administrator 5
1326	1326	requires that fingerprint submissions be made as part of 6
1327	1327	such application, the office of state courts administrator 7
1328	1328	shall submit fingerprints to the Missouri state highway 8
1329	1329	patrol for the purpose of conducting a state and federal 9
1330	1330	fingerprint-based criminal history background check on 10
1331	1331	applicants. 11 SB 636 43
1332	1332	3. The fingerprints and any required fees shall be 12
1333	1333	sent to the Missouri state highway patrol's central 13
1334	1334	repository. The fingerprints shall be used for searching 14
1335	1335	the state criminal records repository and shall also be 15
1336	1336	forwarded to the Federal Bureau of Investigation for a 16
1337	1337	federal criminal records search under section 43.540. The 17
1338	1338	Missouri state highway patrol shall notify the office of 18
1339	1339	state courts administrator of any criminal history record 19

1342	1342	provisions of section 610.120 to the contrary, all records 22
1343	1343	related to any criminal history information discovered shall 23
1344	1344	be accessible and available t o the office of state courts 24
1345	1345	administrator of Missouri. 25
1346	1346	484.125. 1. The Missouri supreme court may require 1
1347	1347	that fingerprint submissions be made as part of an 2
1348	1348	application of licensure for admission or reinstatement to 3
1349	1349	the Missouri Bar in order to engage in the practice of law 4
1350	1350	or law business, as such terms are defined in section 5
1351	1351	484.010. 6
1352	1352	2. If the Missouri supreme court requires that 7
1353	1353	fingerprint submissions be made as part of such application, 8
1354	1354	the Missouri supreme court sha ll submit the fingerprints to 9
1355	1355	the Missouri state highway patrol for the purpose of 10
1356	1356	conducting a state and federal fingerprint -based criminal 11
1357	1357	history background check. 12
1358	1358	3. The fingerprints and any required fees shall be 13
1359	1359	sent to the Missouri state h ighway patrol's central 14
1360	1360	repository. The fingerprints shall be used for searching 15
1361	1361	the state criminal records repository and shall also be 16
1362	1362	forwarded to the Federal Bureau of Investigation for a 17
1363	1363	federal criminal records search under section 43.540. The 18 SB 636 44
1364	1364	Missouri state highway patrol shall notify the Missouri 19
1365	1365	supreme court of any criminal history record information or 20
1366	1366	lack of criminal history record information discovered on 21
1367	1367	the individual. Notwithstanding the provisions of section 22
1368	1368	610.120 to the contrary, all records related to any criminal 23
1369	1369	history information discovered shall be accessible and 24
1370	1370	available to the Missouri supreme court. 25
1371	1371	590.060. 1. The POST commission shall establish 1
1372	1372	minimum standards for training instructors an d training 2
1373	1373	centers, and the director shall establish minimum 3
1374	1374	qualifications for admittance into a basic training course. 4
1375	1375	2. The director shall license training instructors, 5
1376	1376	centers, and curricula, and may probate, suspend and revoke 6
1377	1377	such licenses upon written notice stating the reasons for 7
1378	1378	such action. Any person aggrieved by a decision pursuant to 8
1379	1379	this subsection may appeal as provided in chapter 536. 9
1380	1380	3. Each person seeking entrance into a basic training 10
1381	1381	program shall submit [a fingerprint card and authorization ] 11
1382	1382	fingerprints for the purpose of conducting a [criminal 12
1383	1383	history] state and federal fingerprint -based background 13
1384	1384	check [to include the records of the Federal Bureau of 14
1385	1385	Investigation to the training center where such person is 15
1386	1386	seeking entrance. The training center shall cause a 16
1387	1387	criminal history background check to be made and shall cause 17
1388	1388	the resulting report to be forwarded to the director. The 18
1389	1389	person seeking entrance may be charged a fee for the cost of 19
1390	1390	this procedure]. Fingerprints and any required fees shall 20
1391	1391	be sent to the Missouri state highway patrol's central 21
1392	1392	repository. The fingerprints shall be used for searching 22
1393	1393	the state criminal records repository and shall also be 23
1394	1394	forwarded to the Federal Bureau of Invest igation for a 24
1395	1395	federal criminal records search under section 43.540. The 25 SB 636 45
1396	1396	Missouri state highway patrol shall notify the director of 26
1397	1397	any criminal history record information or lack of criminal 27
1398	1398	history record information discovered on the individual. 28
1399	1399	Notwithstanding the provisions of section 610.120 to the 29
1400	1400	contrary, all records related to any criminal history 30
1401	1401	information discovered shall be accessible and available to 31
1402	1402	the director. 32
1403	1403	640.011. 1. The department of natural resources may 1
1404	1404	require that fingerprint submissions be made as part of an 2
1405	1405	application seeking employment or to volunteer with the 3
1406	1406	department of natural resources. 4

1408	1408	that fingerprint submissions be made as par t of such 6
1409	1409	application, the department of natural resources shall 7
1410	1410	require applicants to submit the fingerprints to the 8
1411	1411	Missouri state highway patrol for the purpose of conducting 9
1412	1412	a state and federal fingerprint -based criminal history 10
1413	1413	background check. 11
