25 | 25 | | require the fingerprint ing of applicants in specified 2 |
---|
26 | 26 | | occupations or appointments within the state agency, board, 3 |
---|
27 | 27 | | or commission for the purpose of positive identification and 4 |
---|
28 | 28 | | receiving criminal history record information when 5 |
---|
29 | 29 | | determining an applicant's ability or fitness to serve in 6 |
---|
30 | 30 | | such occupation or appointment. 7 |
---|
31 | 31 | | 2. In order to facilitate the criminal background 8 |
---|
32 | 32 | | check under subsection 1 of this section on any person 9 |
---|
33 | 33 | | employed or appointed by a state agency, board, or 10 |
---|
34 | 34 | | commission, [and in accordance with section 43.54 3,] the 11 SB 636 2 |
---|
35 | 35 | | applicant or employee shall submit a set of fingerprints 12 |
---|
36 | 36 | | collected under the standards determined by the Missouri 13 |
---|
37 | 37 | | highway patrol. The fingerprints and accompanying fees, 14 |
---|
38 | 38 | | unless otherwise arranged, shall be forwarded to the highway 15 |
---|
39 | 39 | | patrol to be used to search the state criminal history 16 |
---|
40 | 40 | | repository and the fingerprints shall be forwarded to the 17 |
---|
41 | 41 | | Federal Bureau of Investigation for a national criminal 18 |
---|
42 | 42 | | background check under section 43.540. Notwithstanding the 19 |
---|
43 | 43 | | provisions of section 610.120 to the contrary, all records 20 |
---|
44 | 44 | | related to any criminal history information discovered shall 21 |
---|
45 | 45 | | be accessible and available to the state agency making the 22 |
---|
46 | 46 | | request. 23 |
---|
47 | 47 | | 168.014. 1. The state board of education may require 1 |
---|
48 | 48 | | that fingerprint submiss ions be made as part of an 2 |
---|
49 | 49 | | application seeking a certificate of license to teach or 3 |
---|
50 | 50 | | substitute teach in public schools, as provided in sections 4 |
---|
51 | 51 | | 168.011, 168.021, and 168.036 and as required by section 5 |
---|

53 | 53 | | 2. If the state board of education r equires that 7 |

54 | 54 | | fingerprint submissions be made as part of such application, 8 |
---|
55 | 55 | | the state board of education shall require applicants to 9 |
---|
56 | 56 | | submit the fingerprints to the Missouri state highway patrol 10 |
---|
57 | 57 | | for the purpose of conducting a state and federal 11 |
---|
58 | 58 | | fingerprint-based criminal history background check. 12 |
---|
59 | 59 | | 3. The fingerprints and any required fees shall be 13 |
---|
60 | 60 | | sent to the Missouri state highway patrol's central 14 |
---|
61 | 61 | | repository. The fingerprints shall be used for searching 15 |
---|
62 | 62 | | the state criminal records repository and shall also be 16 |
---|
63 | 63 | | forwarded to the Federal Bureau of Investigation for a 17 |
---|
64 | 64 | | federal criminal records search under section 43.540. The 18 |

134 | 134 | | (1) "MO HealthNet provider", an individual or business 34 |
---|
135 | 135 | | that enters into a contractor provider agreement with the 35 |
---|
136 | 136 | | department of social services or its divisions for the 36 |
---|
137 | 137 | | purpose of providing services to eligible persons and 37 |
---|
138 | 138 | | obtaining from the department of social services or its 38 |
---|
139 | 139 | | divisions reimbursement for such services; 39 |
---|
140 | 140 | | (2) "MO HealthNet services", medical services defined 40 |
---|
141 | 141 | | and determined by the department of social services or 41 |
---|
142 | 142 | | listed specifically in section 208.152 in which eligible 42 |
---|
143 | 143 | | persons receive as part of their Missouri Medicaid coverage. 43 |
---|
144 | 144 | | 209.324. 1. The state committee of interpreters may 1 |
---|
145 | 145 | | require that fingerprint submissions be made as part of an 2 |
---|
146 | 146 | | application seeking licensure as an interpreter, as such 3 |
---|
147 | 147 | | term is defined in section 209.285, and temporary 4 |
---|
148 | 148 | | interpreter, as provided in section 209.326. 5 |
---|
149 | 149 | | 2. If the state committee of interpreters requi res 6 |
---|
150 | 150 | | that fingerprint submissions be made as part of such 7 |
---|
151 | 151 | | application, the state committee of interpreters shall 8 |
---|
152 | 152 | | require applicants to submit the fingerprints to the 9 |
---|
153 | 153 | | Missouri state highway patrol for the purpose of conducting 10 |
---|
154 | 154 | | a state and federal finger print-based criminal history 11 |
---|
155 | 155 | | background check. 12 |
---|
156 | 156 | | 3. The fingerprints and any required fees shall be 13 |
---|
157 | 157 | | sent to the Missouri state highway patrol's central 14 |
---|
158 | 158 | | repository. The fingerprints shall be used for searching 15 |
---|
159 | 159 | | the state criminal records repository and shall also be 16 |
---|
160 | 160 | | forwarded to the Federal Bureau of Investigation for a 17 |
---|
161 | 161 | | federal criminal records search under section 43.540. The 18 SB 636 6 |

162 | 162 | | Missouri state highway patrol shall notify the committee of 19 |
---|
163 | 163 | | any criminal history record information or lack of criminal 20 |
---|
164 | 164 | | history record information discovered on the individual. 21 |
---|
165 | 165 | | Notwithstanding the provisions of section 610.120 to the 22 |

166 | 166 | | contrary, all records related to any criminal history 23 |

167 | 167 | | information discovered shall be accessible and available to 24 |

169 | 169 | | 210.482. 1. If the emergency placement of a child in 1 |

170 | 170 | | a private home is necessary due to the unexpected absence of 2 |
---|
171 | 171 | | the child's parents, legal guardian, or custodian, the 3 |
---|
172 | 172 | | juvenile court or children's division of the department of 4 |
---|
173 | 173 | | social services: 5 |
---|
174 | 174 | | (1) May request that a local or state law enforcement 6 |
---|
175 | 175 | | agency or juvenile officer [, subject to any required federal 7 |
---|
176 | 176 | | authorization,] immediately conduct a name -based criminal 8 |
---|
177 | 177 | | history record check to include full orders of protection 9 |
---|
178 | 178 | | and outstanding warrants of each person over the age of 10 |
---|
179 | 179 | | [seventeen] eighteen residing in the home by using the 11 |
---|
180 | 180 | | Missouri uniform law enforcement system (MULES) and the 12 |
---|
181 | 181 | | National Crime Information Center to access the Interstate 13 |
---|
182 | 182 | | Identification Index (III) maintained by the Federal Bureau 14 |
---|
183 | 183 | | of Investigation; and 15 |
---|
184 | 184 | | (2) Shall determine or, in the case of the juvenile 16 |
---|
185 | 185 | | court, shall request the division to determine whether any 17 |
---|
186 | 186 | | person over the age of [seventeen] eighteen years residing 18 |
---|
187 | 187 | | in the home is liste d on the child abuse and neglect 19 |
---|
188 | 188 | | registry. For any children less than [seventeen] eighteen 20 |
---|
189 | 189 | | years of age residing in the home, the children's division 21 |
---|
190 | 190 | | shall inquire of the person with whom an emergency placement 22 |
---|
191 | 191 | | of a child will be made whether any chil dren less than 23 |
---|
192 | 192 | | [seventeen] eighteen years of age residing in the home have 24 SB 636 7 |
---|
193 | 193 | | ever been certified as an adult and convicted of or pled 25 |
---|
194 | 194 | | guilty or nolo contendere to any crime. 26 |
---|
195 | 195 | | 2. If a name-based search has been conducted pursuant 27 |
---|
196 | 196 | | to subsection 1 of t his section, within fifteen calendar 28 |
---|
197 | 197 | | days of the Interstate Identification Index (III) name -based 29 |
---|
198 | 198 | | check, after the emergency placement of the child in the 30 |
---|
199 | 199 | | private home, and if the private home has not previously 31 |
---|
200 | 200 | | been approved as a foster or adoptive ho me, all persons over 32 |
---|
201 | 201 | | the age of [seventeen] eighteen residing in the home and all 33 |
---|
202 | 202 | | children less than [seventeen] eighteen residing in the home 34 |
---|
203 | 203 | | who the children's division has determined have been 35 |
---|
204 | 204 | | certified as an adult for the commission of a crime shal l 36 |

205 | 205 | | [report to a local law enforcement agency for the purpose of 37 |

217 | 217 | | unless the person refusing to provide fingerprints ceases to 49 |

219 | 219 | | 3. If the placement of a child is denied as a result 51 |

220 | 220 | | of a name-based criminal history check and the denial is 52 |
---|
221 | 221 | | contested, all persons over the age of [seventeen] eighteen 53 |

244 | 244 | | placement" refers to those limited instances when the 76 |
---|
245 | 245 | | juvenile court or children's division is placing a child in 77 |

246 | 246 | | the home of private individuals, including neighbors, 78 |
---|
247 | 247 | | friends, or relatives, as a result of a sudden 79 |
---|
248 | 248 | | unavailability of the child's primary caretaker. 80 |

249 | 249 | | 210.487. 1. The children's division of the department 1 |

250 | 250 | | of social services may requi re fingerprint submissions to 2 |
---|
251 | 251 | | the Missouri state highway patrol for the purpose of 3 |
---|
252 | 252 | | conducting a state and federal fingerprint -based criminal 4 |
---|
253 | 253 | | background check. When conducting investigations of persons 5 |
---|
254 | 254 | | for the purpose of foster parent licensing, the children's 6 |
---|
255 | 255 | | division shall: 7 SB 636 9 |

256 | 256 | | (1) Conduct a search for all persons over the age of 8 |

257 | 257 | | [seventeen] eighteen in the applicant's household and for 9 |
---|
258 | 258 | | any child less than [seventeen] eighteen years of age 10 |

259 | 259 | | residing in the applicant's home who the division has 11 |
---|
260 | 260 | | determined has been certified as an adult for the commission 12 |

261 | 261 | | of a crime for evidence of full orders of protection. The 13 |

262 | 262 | | office of state courts administrator shall allow access to 14 |
---|
263 | 263 | | the automated court information system by the division. The 15 |
---|
264 | 264 | | clerk of each court contacted by the division shall provide 16 |
---|
265 | 265 | | the division information within ten days of a request; 17 |
---|
266 | 266 | | (2) Obtain fingerprints for any person over the age of 18 |
---|
267 | 267 | | [seventeen] eighteen in the applicant's household and for 19 |
---|
268 | 268 | | any child less than [seventeen] eighteen years of age 20 |
---|
269 | 269 | | residing in the applicant's home who the division has 21 |
---|
270 | 270 | | determined has been certified as an adult for the commission 22 |
---|
271 | 271 | | of a crime [in the same manner set forth in subsection 2 of 23 |
---|
272 | 272 | | section 210.482]. The fingerprints and any required fe es 24 |
---|
273 | 273 | | shall be sent to the Missouri state highway patrol's central 25 |

274 | 274 | | repository. The fingerprints shall be used for searching 26 |

275 | 275 | | the state criminal records repository and shall also be 27 |
---|

278 | 278 | | Missouri state highway patrol shall notify the juvenile 30 |

281 | 281 | | discovered on the individual. Notwithstanding the 33 |

---|
285 | 285 | | division. The highway patrol shall assist the division and 37 |

286 | 286 | | provide the criminal fingerprint background information, 38 SB 636 10 |

287 | 287 | | upon request, under and in accordance with the provisions of 39 |
---|
288 | 288 | | section 43.540; and 40 |
---|
289 | 289 | | (3) Determine whether any person over the age of 41 |

290 | 290 | | [seventeen] eighteen residing in the home and any child less 42 |
---|
291 | 291 | | than [seventeen] eighteen years of age residing in the 43 |
---|
292 | 292 | | applicant's home who the division has determined has been 44 |
---|
293 | 293 | | certified as an adult for the commission of a crime is 45 |
---|
294 | 294 | | listed on the child abuse and neglect registry. For any 46 |
---|
295 | 295 | | children less than [seventeen] eighteen years of age 47 |
---|
296 | 296 | | residing in the applicant's home, the [children's] division 48 |
---|
297 | 297 | | shall inquire of the applicant whether any children less 49 |
---|
298 | 298 | | than [seventeen] eighteen years of age residing in the home 50 |

299 | 299 | | have ever been certified as an adult and been convict ed of 51 |
---|

306 | 306 | | section or section 210.482 unless the original fingerprints 58 |
---|
307 | 307 | | retained by the division are lost or destroyed; 59 |

308 | 308 | | (2) The highway patrol shall provide ongoing 60 |

309 | 309 | | electronic updates to criminal history background checks of 61 |
---|
310 | 310 | | those persons previously submitted as part of the licensing 62 |
---|
311 | 311 | | or approval process under subsection 1 of this section. 63 |

312 | 312 | | Ongoing electronic updates for such persons and for those in 64 |
---|
313 | 313 | | their households shall terminate when such persons ce ase to 65 |
---|
314 | 314 | | be applicant or licensed foster parents; and 66 |

316 | 316 | | health and senior services may waive the requirement for a 68 |

317 | 317 | | fingerprint background check for any subsequent 69 |

---|
1102 | 1102 | | the following functions o n behalf of a lender, financial 37 |
---|
1103 | 1103 | | institution, or client: 38 |

1104 | 1104 | | (a) Administer an appraiser panel; 39 |
---|
1105 | 1105 | | (b) Recruit, qualify, verify licensing or 40 |
---|
1106 | 1106 | | certification, and negotiate fees and service level 41 |
---|
1107 | 1107 | | expectations with persons who are part of an appraiser p anel; 42 |
---|
1108 | 1108 | | (c) Receive an order for an appraisal from one 43 |
---|
1109 | 1109 | | individual and deliver the order for the appraisal to an 44 |
---|
1110 | 1110 | | appraiser that is part of an appraiser panel for completion; 45 |
---|
1111 | 1111 | | (d) Track and determine the status of orders for 46 |
---|
1112 | 1112 | | appraisals performed by appraisers who are part of an 47 |
---|

1114 | 1114 | | (e) Conduct quality control of a completed appraisal 49 |
---|
1115 | 1115 | | performed by an appraiser who is part of an appraisal panel 50 |

1117 | 1117 | | ordered the appraisal; and 52 |
---|
1118 | 1118 | | (f) Provide a completed appraisal performed by an 53 |
---|
1119 | 1119 | | appraiser who is part of an appraisal panel to one or more 54 |
---|
1120 | 1120 | | individuals who have ordered an appraisal; 55 |
---|
1121 | 1121 | | (3) "Certified general appraiser", an individual who 56 |
---|
1122 | 1122 | | is qualified by education, expe rience, and examination to 57 |
---|
1123 | 1123 | | appraise any real property, and whose fingerprints are 58 |
---|
1124 | 1124 | | required for licensure; 59 |
---|
1125 | 1125 | | (4) "Certified general appraiser trainee", an 60 |
---|
1126 | 1126 | | individual who, under supervision, is qualified to appraise 61 |
---|
1127 | 1127 | | certain real property and whose fi ngerprints are required 62 |
---|
1128 | 1128 | | for licensure; 63 |
---|
1129 | 1129 | | (5) "Certified residential appraiser", an individual 64 |
---|
1130 | 1130 | | who is qualified to appraise certain real property and whose 65 |
---|
1131 | 1131 | | fingerprints are required for licensure; 66 |
---|
1132 | 1132 | | (6) "Certified residential appraiser trainee", an 67 |
---|
1133 | 1133 | | individual who, under supervision, is qualified to appraise 68 |
---|
1134 | 1134 | | certain real property and whose fingerprints are required 69 |
---|
1135 | 1135 | | for licensure; 70 |
---|
1136 | 1136 | | (7) "Controlling person of an appraisal management 71 |
---|

1138 | 1138 | | (a) An owner of an appraisal management com pany; 73 |

1139 | 1139 | | (b) An individual employed, appointed, or authorized 74 |
---|
1140 | 1140 | | by an appraisal management company that has the authority to 75 |

1141 | 1141 | | enter into a contractual relationship with other persons for 76 |
---|

---|
1143 | 1143 | | authority to enter into agreements with appraisers for the 78 |
---|

1153 | 1153 | | (9) "State-licensed appraiser", an individual who is 88 |
---|
1154 | 1154 | | qualified to appraise certain real property and whose 89 |
---|
1155 | 1155 | | fingerprints are required for licensure; 90 |
---|
1156 | 1156 | | (10) "State-licensed appraiser trainee", an individual 91 |
---|
1157 | 1157 | | who, under supervision, is qualified to appraise certain 92 |
---|
1158 | 1158 | | real property and whose fingerprints are required for 93 |
---|
