1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Sections 43.546, 210.482, 210.487, and 1
1515 590.060, RSMo, are repealed and forty -two new sections enacted 2
1616 in lieu thereof, to be known as sections 43.546, 168.014, 3
1717 190.106, 208.222, 209.324, 210.482, 210.487, 301.551, 324.055, 4

2424 43.546. 1. Any state agency, board, or commission may 1
2525 require the fingerprint ing of applicants in specified 2
2626 occupations or appointments within the state agency, board, 3
2727 or commission for the purpose of positive identification and 4
2828 receiving criminal history record information when 5
2929 determining an applicant's ability or fitness to serve in 6
3030 such occupation or appointment. 7
3131 2. In order to facilitate the criminal background 8
3232 check under subsection 1 of this section on any person 9
3333 employed or appointed by a state agency, board, or 10
3434 commission, [and in accordance with section 43.54 3,] the 11 SB 636 2
3535 applicant or employee shall submit a set of fingerprints 12
3636 collected under the standards determined by the Missouri 13
3737 highway patrol. The fingerprints and accompanying fees, 14
3838 unless otherwise arranged, shall be forwarded to the highway 15
3939 patrol to be used to search the state criminal history 16
4040 repository and the fingerprints shall be forwarded to the 17
4141 Federal Bureau of Investigation for a national criminal 18
4242 background check under section 43.540. Notwithstanding the 19
4343 provisions of section 610.120 to the contrary, all records 20
4444 related to any criminal history information discovered shall 21
4545 be accessible and available to the state agency making the 22
4646 request. 23
4747 168.014. 1. The state board of education may require 1
4848 that fingerprint submiss ions be made as part of an 2
4949 application seeking a certificate of license to teach or 3
5050 substitute teach in public schools, as provided in sections 4
5151 168.011, 168.021, and 168.036 and as required by section 5
5252 168.133. 6
5353 2. If the state board of education r equires that 7
5454 fingerprint submissions be made as part of such application, 8
5555 the state board of education shall require applicants to 9
5656 submit the fingerprints to the Missouri state highway patrol 10
5757 for the purpose of conducting a state and federal 11
5858 fingerprint-based criminal history background check. 12
5959 3. The fingerprints and any required fees shall be 13
6060 sent to the Missouri state highway patrol's central 14
6161 repository. The fingerprints shall be used for searching 15
6262 the state criminal records repository and shall also be 16
6363 forwarded to the Federal Bureau of Investigation for a 17
6464 federal criminal records search under section 43.540. The 18
6565 Missouri state highway patrol shall notify the state board 19
6666 of education of any criminal history record information or 20 SB 636 3
6767 lack of criminal history record information discovered on 21
6868 the individual. Notwithstanding the provisions of section 22
6969 610.120 to the contrary, all records related to any criminal 23
7070 history information discovered shall be accessible and 24
7171 available to the state b oard of education. 25
7272 190.106. 1. The department of health and senior 1
7373 services may require that fingerprint submissions be made as 2
7474 part of an application seeking licensure as an emergency 3
7575 medical technician or "EMT", an advanced emerge ncy medical 4
7676 technician or "AEMT", or a paramedic, and an application 5
7777 seeking certification as an emergency medical technician - 6
7878 community paramedic or "EMT -CP", as such terms are defined 7
7979 in section 190.100. 8
8080 2. If the department of health and senior services 9
8181 requires that fingerprint submissions be made as part of 10
8282 such application, the department of health and senior 11
8383 services shall require applicants to submit the fingerprints 12
8484 to the Missouri state highway patrol for the purpose of 13
8585 conducting a state and federal fingerprint -based criminal 14
8686 history background check. 15
8787 3. The fingerprints and any required fees shall be 16
8888 sent to the Missouri state highway patrol's central 17
8989 repository. The fingerprints shall be used for searching 18
9090 the state criminal records repository and shall also be 19
9191 forwarded to the Federal Bureau of Investigation for a 20
9292 federal criminal records search under section 43.540. The 21
9393 Missouri state highway patrol shall notify the department of 22
9494 health and senior services of any c riminal history record 23
9595 information or lack of criminal history record information 24
9696 discovered on the individual. Notwithstanding the 25
9797 provisions of section 610.120 to the contrary, all records 26
9898 related to any criminal history information discovered shall 27 SB 636 4
9999 be accessible and available to the department of health and 28
100100 senior services. 29
101101 208.222. 1. The Missouri Medicaid audit and 1
102102 compliance unit within the department of social services may 2
103103 require that fingerprint submissions be made as part of an 3
104104 application seeking to be licensed as a MO HealthNet 4
105105 provider for the purpose of providing MO HealthNet services 5
106106 to eligible persons and obtaining from the department of 6
107107 social services or its divisions reimbursement for eligible 7
108108 services. 8
109109 2. If the Missouri Medicaid audit and compliance unit 9
110110 within the department of social services requires that 10
111111 fingerprint submissions be made as part of such application, 11
112112 the Missouri Medicaid audit and compliance unit within the 12
113113 department of social services shall require applicants to 13
114114 submit the fingerprints to the Missouri state highway patrol 14
115115 for the purpose of conducting a state and federal 15
116116 fingerprint-based criminal history background check. 16
117117 3. The fingerprints and any required fees shall be 17
118118 sent to the Missouri state highway patrol's central 18
119119 repository. The fingerprints shall be used for searching 19
120120 the state criminal records repository and shall also be 20
121121 forwarded to the Federal Bureau of Investigation for a 21
122122 federal criminal reco rds search under section 43.540. The 22
123123 Missouri state highway patrol shall notify the Missouri 23
124124 Medicaid audit and compliance unit within the department of 24
125125 social services of any criminal history record information 25
126126 or lack of criminal history record info rmation discovered on 26
127127 the individual. Notwithstanding the provisions of section 27
128128 610.120 to the contrary, all records related to any criminal 28
129129 history information discovered shall be accessible and 29 SB 636 5
130130 available to the Missouri Medicaid audit and compliance unit 30
131131 within the department of social services. 31
132132 4. For purposes of this section, the following terms 32
133133 mean: 33
134134 (1) "MO HealthNet provider", an individual or business 34
135135 that enters into a contractor provider agreement with the 35
136136 department of social services or its divisions for the 36
137137 purpose of providing services to eligible persons and 37
138138 obtaining from the department of social services or its 38
139139 divisions reimbursement for such services; 39
140140 (2) "MO HealthNet services", medical services defined 40
141141 and determined by the department of social services or 41
142142 listed specifically in section 208.152 in which eligible 42
143143 persons receive as part of their Missouri Medicaid coverage. 43
144144 209.324. 1. The state committee of interpreters may 1
145145 require that fingerprint submissions be made as part of an 2
146146 application seeking licensure as an interpreter, as such 3
147147 term is defined in section 209.285, and temporary 4
148148 interpreter, as provided in section 209.326. 5
149149 2. If the state committee of interpreters requi res 6
150150 that fingerprint submissions be made as part of such 7
151151 application, the state committee of interpreters shall 8
152152 require applicants to submit the fingerprints to the 9
153153 Missouri state highway patrol for the purpose of conducting 10
154154 a state and federal finger print-based criminal history 11
155155 background check. 12
156156 3. The fingerprints and any required fees shall be 13
157157 sent to the Missouri state highway patrol's central 14
158158 repository. The fingerprints shall be used for searching 15
159159 the state criminal records repository and shall also be 16
160160 forwarded to the Federal Bureau of Investigation for a 17
161161 federal criminal records search under section 43.540. The 18 SB 636 6
162162 Missouri state highway patrol shall notify the committee of 19
163163 any criminal history record information or lack of criminal 20
164164 history record information discovered on the individual. 21
165165 Notwithstanding the provisions of section 610.120 to the 22
166166 contrary, all records related to any criminal history 23
167167 information discovered shall be accessible and available to 24
168168 the committee. 25
169169 210.482. 1. If the emergency placement of a child in 1
170170 a private home is necessary due to the unexpected absence of 2
171171 the child's parents, legal guardian, or custodian, the 3
172172 juvenile court or children's division of the department of 4
173173 social services: 5
174174 (1) May request that a local or state law enforcement 6
175175 agency or juvenile officer [, subject to any required federal 7
176176 authorization,] immediately conduct a name -based criminal 8
177177 history record check to include full orders of protection 9
178178 and outstanding warrants of each person over the age of 10
179179 [seventeen] eighteen residing in the home by using the 11
180180 Missouri uniform law enforcement system (MULES) and the 12
181181 National Crime Information Center to access the Interstate 13
182182 Identification Index (III) maintained by the Federal Bureau 14
183183 of Investigation; and 15
184184 (2) Shall determine or, in the case of the juvenile 16
185185 court, shall request the division to determine whether any 17
186186 person over the age of [seventeen] eighteen years residing 18
187187 in the home is liste d on the child abuse and neglect 19
188188 registry. For any children less than [seventeen] eighteen 20
189189 years of age residing in the home, the children's division 21
190190 shall inquire of the person with whom an emergency placement 22
191191 of a child will be made whether any chil dren less than 23
192192 [seventeen] eighteen years of age residing in the home have 24 SB 636 7
193193 ever been certified as an adult and convicted of or pled 25
194194 guilty or nolo contendere to any crime. 26
195195 2. If a name-based search has been conducted pursuant 27
196196 to subsection 1 of t his section, within fifteen calendar 28
197197 days of the Interstate Identification Index (III) name -based 29
198198 check, after the emergency placement of the child in the 30
199199 private home, and if the private home has not previously 31
200200 been approved as a foster or adoptive ho me, all persons over 32
201201 the age of [seventeen] eighteen residing in the home and all 33
202202 children less than [seventeen] eighteen residing in the home 34
203203 who the children's division has determined have been 35
204204 certified as an adult for the commission of a crime shal l 36
205205 [report to a local law enforcement agency for the purpose of 37
206206 providing fingerprints and accompanying fees ] be 38
207207 fingerprinted, pursuant to sections 43.530 and 43.540. The 39
208208 fingerprints shall be used for searching the state criminal 40
209209 records repository and shall also be forwarded to the 41
210210 Federal Bureau of Investigation for a federal criminal 42
211211 records search under section 43.540. Results of the checks 43
212212 shall be provided to the juvenile court or children's 44
213213 division office requesting such information. Any child 45
214214 placed in emergency placement in a private home shall be 46
215215 removed immediately if any person residing in the home fails 47
216216 to provide fingerprints after being requested to do so, 48
217217 unless the person refusing to provide fingerprints ceases to 49
218218 reside in the private home. 50
219219 3. If the placement of a child is denied as a result 51
220220 of a name-based criminal history check and the denial is 52
221221 contested, all persons over the age of [seventeen] eighteen 53
222222 residing in the home and all children less than [seventeen] 54
223223 eighteen years of age residing in the home who the 55
224224 children's division has determined have been certified as an 56 SB 636 8
225225 adult for the commission of a crime shall, within fifteen 57
226226 calendar days of conducting the Interstate Identification 58
227227 Index (III) name-based check, submit [to the juvenile court 59
228228 or the children's division ] fingerprints and any required 60
229229 fees, in the same manner described in subsection 2 of this 61
230230 section[, accompanying fees, and written permission 62
231231 authorizing the juvenile court or the child ren's division to 63
232232 forward the fingerprints to the state criminal record 64
233233 repository for submission to the Federal Bureau of 65
234234 Investigation. 66
235235 4. No person who submits fingerprints under this 67
236236 section shall be required to submit additional fingerprints 68
237237 under this section or section 210.487 unless the original 69
238238 fingerprints retained by the division are lost or destroyed ]. 70
239239 [5.] 4. Subject to appropriation, the total cost of 71
240240 fingerprinting required by this section may be paid by the 72
241241 state, including reimbursement of persons incurring 73
242242 fingerprinting costs under this section. 74
243243 [6.] 5. For the purposes of this section, "emergency 75
244244 placement" refers to those limited instances when the 76
245245 juvenile court or children's division is placing a child in 77
246246 the home of private individuals, including neighbors, 78
247247 friends, or relatives, as a result of a sudden 79
248248 unavailability of the child's primary caretaker. 80
249249 210.487. 1. The children's division of the department 1
250250 of social services may requi re fingerprint submissions to 2
251251 the Missouri state highway patrol for the purpose of 3
252252 conducting a state and federal fingerprint -based criminal 4
253253 background check. When conducting investigations of persons 5
254254 for the purpose of foster parent licensing, the children's 6
255255 division shall: 7 SB 636 9
256256 (1) Conduct a search for all persons over the age of 8
257257 [seventeen] eighteen in the applicant's household and for 9
258258 any child less than [seventeen] eighteen years of age 10
259259 residing in the applicant's home who the division has 11
260260 determined has been certified as an adult for the commission 12
261261 of a crime for evidence of full orders of protection. The 13
262262 office of state courts administrator shall allow access to 14
263263 the automated court information system by the division. The 15
264264 clerk of each court contacted by the division shall provide 16
265265 the division information within ten days of a request; 17
266266 (2) Obtain fingerprints for any person over the age of 18
267267 [seventeen] eighteen in the applicant's household and for 19
268268 any child less than [seventeen] eighteen years of age 20
269269 residing in the applicant's home who the division has 21
270270 determined has been certified as an adult for the commission 22
271271 of a crime [in the same manner set forth in subsection 2 of 23
272272 section 210.482]. The fingerprints and any required fe es 24
273273 shall be sent to the Missouri state highway patrol's central 25
274274 repository. The fingerprints shall be used for searching 26
275275 the state criminal records repository and shall also be 27
276276 forwarded to the Federal Bureau of Investigation for a 28
277277 federal criminal records search under section 43.540. The 29
278278 Missouri state highway patrol shall notify the juvenile 30
279279 court or the division of any criminal history record 31
280280 information or lack of criminal history record information 32
281281 discovered on the individual. Notwithstanding the 33
282282 provisions of section 610.120 to the contrary, all records 34
283283 related to any criminal history information discovered shall 35
284284 be accessible and available to the juvenile court or the 36
285285 division. The highway patrol shall assist the division and 37
286286 provide the criminal fingerprint background information, 38 SB 636 10
287287 upon request, under and in accordance with the provisions of 39
288288 section 43.540; and 40
289289 (3) Determine whether any person over the age of 41
290290 [seventeen] eighteen residing in the home and any child less 42
291291 than [seventeen] eighteen years of age residing in the 43
292292 applicant's home who the division has determined has been 44
293293 certified as an adult for the commission of a crime is 45
294294 listed on the child abuse and neglect registry. For any 46
295295 children less than [seventeen] eighteen years of age 47
296296 residing in the applicant's home, the [children's] division 48
297297 shall inquire of the applicant whether any children less 49
298298 than [seventeen] eighteen years of age residing in the home 50
299299 have ever been certified as an adult and been convict ed of 51
300300 or pled guilty or nolo contendere to any crime. 52
301301 2. [After the initial investigation is completed under 53
302302 subsection 1 of this section: 54
303303 (1) No person who submits fingerprints under 55
304304 subsection 1 of this section or section 210.482 shall be 56
305305 required to submit additional fingerprints under this 57
306306 section or section 210.482 unless the original fingerprints 58
307307 retained by the division are lost or destroyed; 59
308308 (2) The highway patrol shall provide ongoing 60
309309 electronic updates to criminal history background checks of 61
310310 those persons previously submitted as part of the licensing 62
311311 or approval process under subsection 1 of this section. 63
312312 Ongoing electronic updates for such persons and for those in 64
313313 their households shall terminate when such persons ce ase to 65
314314 be applicant or licensed foster parents; and 66
315315 (3) The children's division and the department of 67
316316 health and senior services may waive the requirement for a 68
317317 fingerprint background check for any subsequent 69
318318 recertification. 70 SB 636 11
319319 3.] Subject to appropriation, the total cost of 71
320320 fingerprinting required by this section may be paid by the 72
321321 state, including reimbursement of persons incurring 73
322322 fingerprinting costs under this section. 74
323323 [4.] 3. The division may make arrangements with other 75
324324 executive branch agencies to obtain any investigative 76
325325 background information. 77
326326 [5.] 4. The division may promulgate rules that are 78
327327 necessary to implement the provisions of this section. Any 79
328328 rule or portion of a rule, as that term is defined in 80
329329 section 536.010, that is created under the authority 81
330330 delegated in this section shall become effective only if it 82
331331 complies with and is subject to all of the provisions of 83
332332 chapter 536 and, if applicable, section 536.028. This 84
333333 section and chapter 536 are nonsever able and if any of the 85
334334 powers vested with the general assembly pursuant to chapter 86
335335 536 to review, to delay the effective date, or to disapprove 87
336336 and annul a rule are subsequently held unconstitutional, 88
337337 then the grant of rulemaking authority and any rule proposed 89
338338 or adopted after August 28, 2004, shall be invalid and void. 90
339339 301.551. 1. The department of revenue may require 1
340340 that fingerprint submissions be made as part of an 2
341341 application seeking licensure for a new motor vehicle 3
342342 franchise dealer, used motor vehicle dealer, powersport 4
343343 dealer, wholesale motor vehicle dealer, motor vehicle 5
344344 dealer, public motor vehicle auction, recreational motor 6
345345 vehicle dealer, trailer dealer, boat dealer, manufacturer, 7
346346 or boat manufacturer, as such t erms are defined in section 8
347347 301.550. 9
348348 2. If the department of revenue requires that 10
349349 fingerprint submissions be made as part of such application, 11
350350 the department of revenue shall require applicants to submit 12 SB 636 12
351351 the fingerprints to the Missouri state hi ghway patrol for 13
352352 the purpose of conducting a state and federal fingerprint - 14
353353 based criminal history background check. 15
354354 3. The fingerprints and any required fees shall be 16
355355 sent to the Missouri state highway patrol's central 17
356356 repository. The fingerprints shall be used for searching 18
357357 the state criminal records repository and shall also be 19
358358 forwarded to the Federal Bureau of Investigation for a 20
359359 federal criminal records search under section 43.540. The 21
360360 Missouri state highway patrol shall notify the depa rtment of 22
361361 any criminal history record information or lack of criminal 23
362362 history record information discovered on the individual. 24
363363 Notwithstanding the provisions of section 610.120 to the 25
364364 contrary, all records related to any criminal history 26
365365 information discovered shall be accessible and available to 27
366366 the department. 28
367367 324.055. 1. The Missouri board of occupational 1
368368 therapy may require that fingerprint submissions be made as 2
369369 part of an application seeking licensure as an occupational 3
370370 therapist or an occupational therapy assistant, or a limited 4
371371 permit to practice occupational therapy, as such terms are 5
372372 defined in section 324.050 and as provided in section 6
373373 324.077. 7
374374 2. If the Missouri board of occupational therapy 8
375375 requires that fingerprint submissions be made as part of 9
376376 such application, the Missouri board of occupational therapy 10
377377 shall require applicants to submit the fingerprints to the 11
378378 Missouri state highway patrol for the purpose of conducting 12
379379 a state and federal fingerpri nt-based criminal history 13
380380 background check. 14
381381 3. The fingerprints and any required fees shall be 15
382382 sent to the Missouri state highway patrol's central 16 SB 636 13
383383 repository. The fingerprints shall be used for searching 17
384384 the state criminal records repository and shall also be 18
385385 forwarded to the Federal Bureau of Investigation for a 19
386386 federal criminal records search under section 43.540. The 20
387387 Missouri state highway patrol shall notify the Missouri 21
388388 board of occupational therapy of any criminal history record 22
389389 information or lack of criminal history record information 23
390390 discovered on the individual. Notwithstanding the 24
391391 provisions of section 610.120 to the contrary, all records 25
392392 related to any criminal history information discovered shall 26
393393 be accessible and available to the Missouri board of 27
394394 occupational therapy. 28
395395 324.129. 1. The state board of registration for the 1
396396 healing arts may require that fingerprint submissions be 2
397397 made as part of an application seeking licensure as a 3
398398 licensed clinical pe rfusionist and provisional clinical 4
399399 licensed perfusionist, as defined in section 324.128. 5
400400 2. If the state board of registration for the healing 6
401401 arts requires that fingerprint submissions be made as part 7
402402 of such application, the state board of regi stration for the 8
403403 healing arts shall require applicants to submit the 9
404404 fingerprints to the Missouri state highway patrol for the 10
405405 purpose of conducting a state and federal fingerprint -based 11
406406 criminal history background check. 12
407407 3. The fingerprints and any required fees shall be 13
408408 sent to the Missouri state highway patrol's central 14
409409 repository. The fingerprints shall be used for searching 15
410410 the state criminal records repository and shall also be 16
411411 forwarded to the Federal Bureau of Investigation for a 17
412412 federal criminal records search under section 43.540. The 18
413413 Missouri state highway patrol shall notify the state board 19
414414 of registration for the healing arts of any criminal history 20 SB 636 14
415415 record information or lack of criminal history record 21
416416 information discovered on the individual. Notwithstanding 22
417417 the provisions of section 610.120 to the contrary, all 23
418418 records related to any criminal history information 24
419419 discovered shall be accessible and available to the state 25
420420 board of registration for the healing arts. 26
421421 324.246. 1. The board of therapeutic massage may 1
422422 require that fingerprint submissions be made as part of an 2
423423 application seeking a license, provisional license, or 3
424424 student license as a massage therapist and a license as a 4
425425 massage business, as such terms are defined in section 5
426426 324.240 and as provided in sections 324.247 and 324.265. 6
427427 2. If the board of therapeutic massage requires that 7
428428 fingerprint submissions be made as part of such application, 8
429429 the board of therapeutic massa ge shall require applicants to 9
430430 submit the fingerprints to the Missouri state highway patrol 10
431431 for the purpose of conducting a state and federal 11
432432 fingerprint-based criminal history background check. 12
433433 3. The fingerprints and any required fees shall be 13
434434 sent to the Missouri state highway patrol's central 14
435435 repository. The fingerprints shall be used for searching 15
436436 the state criminal records repository and shall also be 16
437437 forwarded to the Federal Bureau of Investigation for a 17
438438 federal criminal records search under section 43.540. The 18
439439 Missouri state highway patrol shall notify the board of 19
440440 therapeutic massage of any criminal history record 20
441441 information or lack of criminal history record information 21
442442 discovered on the individual. Notwithstanding the 22
443443 provisions of section 610.120 to the contrary, all records 23
444444 related to any criminal history information discovered shall 24
445445 be accessible and available to the board of therapeutic 25
446446 massage. 26 SB 636 15
447447 324.488. 1. The state board of chiropractic examiners 1
448448 may require that fingerprint submissions be made as part of 2
449449 an application seeking licensure as an acupuncturist, as 3
450450 such term is defined in section 324.475. 4
451451 2. If the state board of chiropractic examiners 5
452452 requires that fingerprint submissions b e made as part of 6
453453 such application, the state board of chiropractic examiners 7
454454 shall require applicants to submit the fingerprints to the 8
455455 Missouri state highway patrol for the purpose of conducting 9
456456 a state and federal fingerprint -based criminal history 10
457457 background check. 11
458458 3. The fingerprints and any required fees shall be 12
459459 sent to the Missouri state highway patrol's central 13
460460 repository. The fingerprints shall be used for searching 14
461461 the state criminal records repository and shall also be 15
462462 forwarded to the Federal Bureau of Investigation for a 16
463463 federal criminal records search under section 43.540. The 17
464464 Missouri state highway patrol shall notify the state board 18
465465 of chiropractic examiners of any criminal history record 19
466466 information or lack of criminal history record information 20
467467 discovered on the individual. Notwithstanding the 21
468468 provisions of section 610.120 to the contrary, all records 22
469469 related to any criminal history information discovered shall 23

974974 338.052. 1. The board of pharmacy may require that 1
975975 fingerprint submissions be made as part of an application 2
976976 seeking a license to practice pharmacy as a pharmacist, a 3
977977 certificate of registration as a pharmacy technician, a 4
978978 license as an intern pharmacist, a license as a wholesale 5
979979 drug distributor, a license as a third -party logistics 6
980980 provider, a temporary license as a pharmacist, a permit for 7
981981 the practice of pharmac y to be conducted at a pharmacy, and 8
982982 a license as a drug outsourcer, as provided in sections 9
983983 338.010, 338.013, 338.035, 338.043, 338.050, 338.210, and 10
984984 338.330, and a manager -in-charge, wholesale drug distributor 11
985985 facility manager, third -party logistics provider facility 12
986986 manager, wholesale drug distributor facility owner, or third - 13 SB 636 32
987987 party logistics provider facility owner, as such terms are 14
988988 defined in subsection 4 of this section. 15
989989 2. If the board of pharmacy requires that fingerprint 16
990990 submissions be made as part of such application, the board 17
991991 of pharmacy shall require applicants to submit the 18
992992 fingerprints to the Missouri state highway patrol for the 19
993993 purpose of conducting a state and federal fingerprint -based 20
994994 criminal history background check. 21
995995 3. The fingerprints and any required fees shall be 22
996996 sent to the Missouri state highway patrol's central 23
997997 repository. The fingerprints shall be used for searching 24
998998 the state criminal records repository and shall also be 25
999999 forwarded to the Federal Bureau of Investigation for a 26
10001000 federal criminal records search under section 43.540. The 27
10011001 Missouri state highway patrol shall notify the board of 28
10021002 pharmacy of any criminal history record information or lack 29
10031003 of criminal history record information discovered on the 30
10041004 individual. Notwithstanding the provisions of section 31
10051005 610.120 to the contrary, all records related to any criminal 32
10061006 history information discovered shall be accessible and 33
10071007 available to the board of pharmacy. 34
10081008 4. For purposes of this section, th e following terms 35
10091009 mean: 36
10101010 (1) "Manager-in-charge", a person who directly 37
10111011 supervises a licensed wholesale drug distributor or a third - 38
10121012 party logistics provider, as such terms are defined in 39
10131013 section 338.330, and whose fingerprints are required by 40
10141014 federal or state law for licensure of a wholesale drug 41
10151015 distributor facility or third -party logistics provider 42
10161016 facility; 43
10171017 (2) "Third-party logistics provider facility manager", 44
10181018 a person who is a manager and direct supervisor of a 45 SB 636 33
10191019 licensed third-party logistics provider, as such term is 46
10201020 defined in section 338.330, and whose fingerprints are 47
10211021 required by federal or state law for licensure of a third - 48
10221022 party logistics provider facility; 49
10231023 (3) "Third-party logistics provider facility owner", a 50
10241024 person who is an owner with greater than ten percent 51
10251025 ownership interest of a licensed third -party logistics 52
10261026 provider, as such term is defined in section 338.330, and 53
10271027 whose fingerprints are required by federal or state law for 54
10281028 licensure of a third -party logistics provider facility; 55
10291029 (4) "Wholesale drug distributor facility manager", a 56
10301030 person who is a manager of a wholesale drug distributor, as 57
10311031 such term is defined in section 338.330, and whose 58
10321032 fingerprints are required by federal or state law for 59
10331033 licensure of a wholesale drug distributor facility; 60
10341034 (5) "Wholesale drug distributor facility owner", a 61
10351035 person who is an owner with greater than ten percent 62
10361036 ownership interest of a licensed wholesale drug distributor, 63
10371037 as such term is defined in section 338.330, and whose 64
10381038 fingerprints are required by federal or state law for 65
10391039 licensure of a wholesale drug distributor facility. 66
10401040 339.015. 1. The Missouri real estate commission may 1
10411041 require that fingerprint submissions be made as part of an 2
10421042 application seeking licensure as a real estate broker, real 3
10431043 estate salesperson, and real estate broker -salesperson, as 4
10441044 such terms are defined in section 339.010 and as provided in 5
10451045 sections 339.030 and 339.040. 6
10461046 2. If the Missouri real estate c ommission requires 7
10471047 that fingerprint submissions be made as part of such 8
10481048 application, the Missouri real estate commission shall 9
10491049 require applicants to submit the fingerprints to the 10

10611061 or lack of criminal history record information discovered on 22
10621062 the individual. Notwithstanding the provisions of section 23
10631063 610.120 to the contrary, all records related to any criminal 24
10641064 history information discovered shall be accessible and 25
10651065 available to the Missouri real estate commission. 26
10661066 339.510. 1. The Missouri real estate appraisers 1
10671067 commission may require that fingerprint submissions be made 2
10681068 as part of an application seeking licensure as a certified 3
10691069 residential appraiser, a certified residential appraiser 4
10701070 trainee, a certified general appraiser, a certified general 5
10711071 appraiser trainee, a state -licensed appraiser, a state - 6
10721072 licensed appraiser trainee, an appraisal management company, 7
10731073 a controlling person of an appra isal management company, and 8
10741074 an owner of an appraisal management company. 9
10751075 2. If the Missouri real estate appraisers commission 10
10761076 requires that fingerprint submissions be made as part of 11
10771077 such application, the Missouri real estate appraisers 12
10781078 commission shall require applicants to submit the 13
10791079 fingerprints to the Missouri state highway patrol for the 14
10801080 purpose of conducting a state and federal fingerprint -based 15

10891089 estate appraisers commission of any criminal history record 24
10901090 information or lack of criminal history record information 25
10911091 discovered on the individual. Notwithstanding the 26
10921092 provisions of section 610.120 to the contrary, all records 27
10931093 related to any criminal history information discovered shall 28
10941094 be accessible and available to the Missouri real estate 29
10951095 appraisers commission. 30
10961096 4. For purposes of this section, the fol lowing terms 31
10971097 mean: 32
10981098 (1) "Appraisal management company", an individual that 33
10991099 utilizes an appraisal panel and performs appraisal 34
11001100 management services for licensure; 35
11011101 (2) "Appraisal management services", to perform any of 36
11021102 the following functions o n behalf of a lender, financial 37
11031103 institution, or client: 38
11041104 (a) Administer an appraiser panel; 39
11051105 (b) Recruit, qualify, verify licensing or 40
11061106 certification, and negotiate fees and service level 41
11071107 expectations with persons who are part of an appraiser p anel; 42
11081108 (c) Receive an order for an appraisal from one 43
11091109 individual and deliver the order for the appraisal to an 44
11101110 appraiser that is part of an appraiser panel for completion; 45
11111111 (d) Track and determine the status of orders for 46
11121112 appraisals performed by appraisers who are part of an 47
11131113 appraisal panel; 48 SB 636 36
11141114 (e) Conduct quality control of a completed appraisal 49
11151115 performed by an appraiser who is part of an appraisal panel 50
11161116 prior to the delivery of the appraisal to the individual who 51
11171117 ordered the appraisal; and 52
11181118 (f) Provide a completed appraisal performed by an 53
11191119 appraiser who is part of an appraisal panel to one or more 54
11201120 individuals who have ordered an appraisal; 55
11211121 (3) "Certified general appraiser", an individual who 56
11221122 is qualified by education, expe rience, and examination to 57
11231123 appraise any real property, and whose fingerprints are 58
11241124 required for licensure; 59
11251125 (4) "Certified general appraiser trainee", an 60
11261126 individual who, under supervision, is qualified to appraise 61
11271127 certain real property and whose fi ngerprints are required 62
11281128 for licensure; 63
11291129 (5) "Certified residential appraiser", an individual 64
11301130 who is qualified to appraise certain real property and whose 65
11311131 fingerprints are required for licensure; 66
11321132 (6) "Certified residential appraiser trainee", an 67
11331133 individual who, under supervision, is qualified to appraise 68
11341134 certain real property and whose fingerprints are required 69
11351135 for licensure; 70
11361136 (7) "Controlling person of an appraisal management 71
11371137 company": 72
11381138 (a) An owner of an appraisal management com pany; 73
11391139 (b) An individual employed, appointed, or authorized 74
11401140 by an appraisal management company that has the authority to 75
11411141 enter into a contractual relationship with other persons for 76
11421142 the performance of appraisal management services and has the 77
11431143 authority to enter into agreements with appraisers for the 78
11441144 performance of appraisals; or 79 SB 636 37
11451145 (c) An individual who possesses the power to direct or 80
11461146 cause the direction of the management or policies of an 81
11471147 appraisal management company whose fingerprints are required 82
11481148 for licensure; 83
11491149 (8) "Owner of an appraisal management company", an 84
11501150 individual who owns ten percent or more of a licensed 85
11511151 appraisal management company and whose fingerprints are 86
11521152 required for licensure; 87
11531153 (9) "State-licensed appraiser", an individual who is 88
11541154 qualified to appraise certain real property and whose 89
11551155 fingerprints are required for licensure; 90
11561156 (10) "State-licensed appraiser trainee", an individual 91
11571157 who, under supervision, is qualified to appraise certain 92
11581158 real property and whose fingerprints are required for 93
11591159 licensure. 94
11601160 345.016. 1. The state board of registration for the 1
11611161 healing arts may require that fingerprint submissions be 2
11621162 made as part of an application seeking a license, as 3
11631163 described in section 345.020, or provisional license, as 4
11641164 described in section 345.021, as an audiologist, an 5
11651165 audiology aide, a speech -language pathologist, a speech - 6
11661166 language pathology aide, and a speech -language pathology 7
11671167 assistant, as such terms are defined in section 3 45.015. 8
11681168 2. If the state board of registration for the healing 9
11691169 arts requires that fingerprint submissions be made as part 10
11701170 of such application, the state board of registration for the 11
11711171 healing arts shall require applicants to submit the 12
11721172 fingerprints to the Missouri state highway patrol for the 13
11731173 purpose of conducting a state and federal fingerprint -based 14
11741174 criminal history background check. 15
11751175 3. The fingerprints and any required fees shall be 16
11761176 sent to the Missouri state highway patrol's central 17 SB 636 38
11771177 repository. The fingerprints shall be used for searching 18
11781178 the state criminal records repository and shall also be 19
11791179 forwarded to the Federal Bureau of Investigation for a 20
11801180 federal criminal records search under section 43.540. The 21

11891189 374.711. 1. The department of commerce and insurance 1

11911191 an application seeking a license, or renewal of a license, 3
11921192 for a general bail bond agent, a bail bond agent, or a 4
11931193 surety recovery agent, as such terms are defined in section 5
11941194 374.700. 6

12101210 history record information discovered on the individual. 22
12111211 Notwithstanding the provisions of section 610.120 to the 23
12121212 contrary, all records related to any criminal history 24
12131213 information discovered shall be accessible and available to 25
12141214 the department. 26
12151215 436.225. 1. The director of the division of 1
12161216 professional registration may require that fingerprint 2
12171217 submissions be made as part of an application seeking 3
12181218 licensure as an athlete agent. 4
12191219 2. If the director of the division of professional 5
12201220 registration requires that fingerprint submissions be made 6
12211221 as part of such application, the director of the division of 7
12221222 professional registration shall require applicants to submit 8
12231223 the fingerprints to the Mis souri state highway patrol for 9
12241224 the purpose of conducting a state and federal fingerprint - 10
12251225 based criminal history background check. 11
12261226 3. The fingerprints and any required fees shall be 12
12271227 sent to the Missouri state highway patrol's central 13
12281228 repository. The fingerprints shall be used for searching 14
12291229 the state criminal records repository and shall also be 15
12301230 forwarded to the Federal Bureau of Investigation for a 16
12311231 federal criminal records search under section 43.540. The 17
12321232 Missouri state highway patrol shall n otify the director of 18
12331233 the division of professional registration of any criminal 19
12341234 history record information or lack of criminal history 20
12351235 record information discovered on the individual. 21
12361236 Notwithstanding the provisions of section 610.120 to the 22
12371237 contrary, all records related to any criminal history 23
12381238 information discovered shall be accessible and available to 24
12391239 the director of the division of professional registration. 25 SB 636 40
12401240 4. For purposes of this section, the term "athlete 26
12411241 agent" means an individual who: 27
12421242 (1) Recruits or solicits a student athlete to enter 28
12431243 into an agency contract or, for compensation, procures 29
12441244 employment or offers, promises, attempts, or negotiates to 30
12451245 obtain employment for a student athlete as a professional 31
12461246 athlete or member of a professional sports team or 32
12471247 organization; 33
12481248 (2) For compensation or in anticipation of 34
12491249 compensation related to a student athlete's participation in 35
12501250 athletics: 36
12511251 (a) Serves the student athlete in an advisory capacity 37
12521252 on a matter related to fina nces, business pursuits, or 38
12531253 career management decisions, unless the individual is an 39
12541254 employee of an educational institution acting exclusively as 40
12551255 an employee of the educational institution for the benefit 41
12561256 of the educational institution; or 42
12571257 (b) Manages the business affairs of the student 43
12581258 athlete by providing assistance with bills, payments, 44
12591259 contracts, or taxes; or 45
12601260 (3) In anticipation of representing a student athlete 46
12611261 for a purpose related to the student athlete's participation 47
12621262 in athletics: 48
12631263 (a) Gives consideration to the student athlete or 49
12641264 another person; 50
12651265 (b) Serves the student athlete in an advisory capacity 51
12661266 on a matter related to finances, business pursuits, or 52
12671267 career management decisions; or 53
12681268 (c) Manages the business affairs of the student 54
12691269 athlete by providing assistance with bills, payments, 55
12701270 contracts, or taxes. 56 SB 636 41
12711271 443.702. 1. The division of finance may require that 1
12721272 fingerprint submissions be made as part of an application 2
12731273 seeking licensure to act as a residential mortgage loan 3
12741274 broker or a mortgage loan originator. 4

12761276 fingerprint submissions be made as part of such application, 6
12771277 the division of finance shall require applicants to submit 7
12781278 the fingerprints to the Missouri state highway patrol for 8
12791279 the purpose of conducting a state and federal fingerprint - 9
12801280 based criminal history background check. 10
12811281 3. The fingerprints and any required fees shall be 11
12821282 sent to the Missouri state highway patrol's cent ral 12
12831283 repository. The fingerprints shall be used for searching 13
12841284 the state criminal records repository and shall also be 14
12851285 forwarded to the Federal Bureau of Investigation for a 15
12861286 federal criminal records search under section 43.540. The 16
12871287 Missouri state highway patrol shall notify the division of 17
12881288 finance of any criminal history record information or lack 18
12891289 of criminal history record information discovered on the 19
12901290 individual. Notwithstanding the provisions of section 20
12911291 610.120 to the contrary, all records rela ted to any criminal 21
12921292 history information discovered shall be accessible and 22
12931293 available to the division of finance. 23
12941294 4. For purposes of this section, the following terms 24
12951295 mean: 25
12961296 (1) "Mortgage loan originator", an individual who for 26
12971297 compensation or gain or in the expectation of compensation 27
12981298 or gain takes a residential mortgage loan application, or 28
12991299 offers or negotiates terms of a residential mortgage loan. 29
13001300 Mortgage loan originator does not include: 30 SB 636 42
13011301 (a) An individual engaged solely as a loa n processor 31
13021302 or underwriter except as otherwise provided in sections 32
13031303 443.701 to 443.893; 33
13041304 (b) An individual that only performs real estate 34
13051305 brokerage activities and is licensed or registered in 35
13061306 accordance with the law of this state, unless the perso n is 36
13071307 compensated by a lender, a mortgage broker, or other 37
13081308 mortgage loan originator or by any agent of such lender, 38
13091309 mortgage broker, or other mortgage loan originator; 39
13101310 (c) An individual solely involved in extensions of 40
13111311 credit relating to time -share plans, as the term time -share 41
13121312 plans is defined in 11 U.S.C. Section 101(53D); 42
13131313 (d) An individual who is servicing a mortgage loan; or 43
13141314 (e) An individual employed by a licensed mortgage 44
13151315 broker or loan originator who accepts or receives 45
13161316 residential mortgage loan applications; 46
13171317 (2) "Residential mortgage loan broker", an individual, 47
13181318 other than an exempt individual, engaged in the business of 48
13191319 brokering, funding, servicing, or purchasing residential 49
13201320 mortgage loans. 50
13211321 476.802. 1. The office of state courts administrator 1
13221322 may require that fingerprint submissions be made as part of 2
13231323 the application of certification as a qualified interpreter, 3
13241324 pursuant to section 476.800. 4
13251325 2. If the office of state courts administrator 5
13261326 requires that fingerprint submissions be made as part of 6
13271327 such application, the office of state courts administrator 7
13281328 shall submit fingerprints to the Missouri state highway 8
13291329 patrol for the purpose of conducting a state and federal 9
13301330 fingerprint-based criminal history background check on 10

13331333 sent to the Missouri state highway patrol's central 13
13341334 repository. The fingerprints shall be used for searching 14

13371337 federal criminal records search under section 43.540. The 17
13381338 Missouri state highway patrol shall notify the office of 18
13391339 state courts administrator of any criminal history record 19
13401340 information or lack of criminal history record information 20
13411341 discovered on the individual. Notwithstanding the 21
13421342 provisions of section 610.120 to the contrary, all records 22
13431343 related to any criminal history information discovered shall 23
13441344 be accessible and available t o the office of state courts 24
13451345 administrator of Missouri. 25
13461346 484.125. 1. The Missouri supreme court may require 1
13471347 that fingerprint submissions be made as part of an 2
13481348 application of licensure for admission or reinstatement to 3
13491349 the Missouri Bar in order to engage in the practice of law 4
13501350 or law business, as such terms are defined in section 5
13511351 484.010. 6
13521352 2. If the Missouri supreme court requires that 7
13531353 fingerprint submissions be made as part of such application, 8
13541354 the Missouri supreme court sha ll submit the fingerprints to 9
13551355 the Missouri state highway patrol for the purpose of 10
13561356 conducting a state and federal fingerprint -based criminal 11
13571357 history background check. 12
13581358 3. The fingerprints and any required fees shall be 13
13591359 sent to the Missouri state h ighway patrol's central 14
13601360 repository. The fingerprints shall be used for searching 15
13611361 the state criminal records repository and shall also be 16
13621362 forwarded to the Federal Bureau of Investigation for a 17
13631363 federal criminal records search under section 43.540. The 18 SB 636 44
13641364 Missouri state highway patrol shall notify the Missouri 19
13651365 supreme court of any criminal history record information or 20
13661366 lack of criminal history record information discovered on 21
13671367 the individual. Notwithstanding the provisions of section 22
13681368 610.120 to the contrary, all records related to any criminal 23
13691369 history information discovered shall be accessible and 24
13701370 available to the Missouri supreme court. 25
13711371 590.060. 1. The POST commission shall establish 1
13721372 minimum standards for training instructors an d training 2
13731373 centers, and the director shall establish minimum 3
13741374 qualifications for admittance into a basic training course. 4
13751375 2. The director shall license training instructors, 5
13761376 centers, and curricula, and may probate, suspend and revoke 6
13771377 such licenses upon written notice stating the reasons for 7
13781378 such action. Any person aggrieved by a decision pursuant to 8
13791379 this subsection may appeal as provided in chapter 536. 9
13801380 3. Each person seeking entrance into a basic training 10
13811381 program shall submit [a fingerprint card and authorization ] 11
13821382 fingerprints for the purpose of conducting a [criminal 12
13831383 history] state and federal fingerprint -based background 13
13841384 check [to include the records of the Federal Bureau of 14
13851385 Investigation to the training center where such person is 15
13861386 seeking entrance. The training center shall cause a 16
13871387 criminal history background check to be made and shall cause 17
13881388 the resulting report to be forwarded to the director. The 18
13891389 person seeking entrance may be charged a fee for the cost of 19
13901390 this procedure]. Fingerprints and any required fees shall 20
13911391 be sent to the Missouri state highway patrol's central 21
13921392 repository. The fingerprints shall be used for searching 22
13931393 the state criminal records repository and shall also be 23
13941394 forwarded to the Federal Bureau of Invest igation for a 24
13951395 federal criminal records search under section 43.540. The 25 SB 636 45
13961396 Missouri state highway patrol shall notify the director of 26
13971397 any criminal history record information or lack of criminal 27
13981398 history record information discovered on the individual. 28
13991399 Notwithstanding the provisions of section 610.120 to the 29
14001400 contrary, all records related to any criminal history 30
14011401 information discovered shall be accessible and available to 31

14101410 require applicants to submit the fingerprints to the 8
14111411 Missouri state highway patrol for the purpose of conducting 9
