AN ACT 
To amend chapter 162, RSMo, by adding thereto one new section relating to student electronic 
personal communications device usage. 
 
Be it enacted by the General Assembly of the State of Missouri, as follows: 
     Section A.  Chapter 162, RSMo, is amended by adding thereto 1 
one new section, to be known as section 162.207, to read as 2 
follows:3 
     162.207.  1.  For the 2026-27 school year and all 1 
subsequent school years, each school district and charter 2 
school governing board shall adopt a writt en policy  3 
governing a student's possession or use of an electronic 4 
personal communications device.  Such school district or 5 
governing board shall develop and design such policy to 6 
promote the educational interests of students and to provide 7 
a safe and effective working environment for school 8 
employees and volunteers. 9 
     2.  Such policy shall, at a minimum: 10 
     (1)  Prohibit a student from displaying or using an 11 
electronic personal communications device during regularly 12 
scheduled instructional act ivities; 13 
     (2)  Describe the disciplinary procedures and measures 14 
that will be taken if a student violates the policy; and 15 
     (3)  Provide exceptions to the prohibition that allow 16 
the display and use of an electronic personal communications 17 
device by a student: 18   SB 640 	2 
     (a)  In the case of an emergency; 19 
     (b)  When directed to use such device by a school 20 
employee or volunteer for an instructional purpose; and 21 
     (c)  When authorized by the following federal acts or 22 
their successor acts: 23 
     a.  The Individuals with Disabilities Education Act 24 
(IDEA), 20 U.S.C. Section 1400, et seq., as amended; 25 
     b.  The Americans with Disabilities Act, 42 U.S.C. 26 
Section 12101, et seq., as amended; or 27 
     c.  The Rehabilitation Act of 1973, 29 U.S.C. Section  28 
701, et seq., as amended. 29 
     3.  Each school district and charter school governing 30 
board shall publish the policy on such district's or charter 31 
school's website. 32 
     4.  A school district or charter school employee or 33 
volunteer shall be held harmle ss and immune from any 34 
liability for actions taken under this section if such 35 
employee or volunteer acts in good faith and follows the 36 
proper disciplinary procedures and measures adopted under 37 
this section by the school board or charter school governin g  38 
board. 39 

