88 To repeal section 217.575, RSMo, and to enact in lieu thereof one new section relating to the

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Section 217.57 5, RSMo, is repealed and one new 1
1313 section enacted in lieu thereof, to be known as section 217.575, 2
1414 to read as follows:3
1515 217.575. 1. All goods manufactured, services provided 1
1616 or produce of the vocational enterprises program of the 2
1717 state shall, upon the requisition of the proper official, be 3
1818 furnished to the state, to any public institution owned, 4
1919 managed or controlled by the state, or to any private entity 5
2020 that is leasing space to any agency of the state government 6
2121 for use in space leased to the state agency, at such prices 7
2222 as shall be determined as provided in subsection 4 of this 8
2323 section. 9
2424 2. No goods or services so manufactured, provided or 10
2525 produced shall be purchased from any other source for the 11
2626 state or public institutions of the st ate unless the 12
2727 department shall certify the goods or services included in 13
2828 the requisition cannot be furnished or supplied by the 14
2929 vocational enterprises program within ninety days, or, in 15
3030 the event the same goods or services cannot be procured on 16
3131 the open market within ninety days, that the vocational 17
3232 enterprises program cannot supply them within a reasonable 18 SB 652 2
3333 time. No claims for the payment of such goods or services 19
3434 shall be audited or paid without this certificate. One copy 20
3535 each of the requisitio n or certificate shall be retained by 21
3636 the department. This subsection shall not apply to goods or 22
3737 services with a market price of less than six hundred 23
3838 dollars. 24
3939 3. The division of purchasing and the division of 25
4040 facilities management, design and construction shall 26
4141 cooperate with the department in seeking to promote for use 27
4242 by state agencies and in state -owned or -occupied facilities 28
4343 the products manufactured and services provided by the 29
4444 vocational enterprises program. 30
4545 4. The vocational enterprises program shall fix and 31
4646 determine the prices at which goods and produce so 32
4747 manufactured and produced and services so provided shall be 33
4848 furnished, and the prices shall be uniform to all. The cost 34
4949 shall not be fixed at more than the market pric e for like 35
5050 goods and services. 36
5151 5. Any differences between the vocational enterprises 37
5252 program and the state, its departments, divisions, agencies, 38
5353 institutions, or the political subdivisions of the state as 39
5454 to style, design, price or quality of go ods shall be 40
5555 submitted to arbitrators whose decision shall be final. One 41
5656 of the arbitrators shall be named by the program, one by the 42
5757 office, department, political subdivision or institution 43
5858 concerned, and one by agreement of the other two. The 44
5959 arbitrators shall receive no compensation; however, their 45
6060 necessary expenses shall be paid by the office, department, 46
6161 political subdivision or institution against which the award 47
6262 is given, or, in the event of a compromise decision, by both 48
6363 parties, the amount to be paid by each party in portions to 49
6464 be determined by the arbitrators. 50 SB 652 3
6565 6. The vocational enterprises program may sell office 51
6666 systems and furniture to any department, agency, or 52
6767 institution of the state or any political subdivision of the 53
6868 state either through outright purchase or through payment 54
6969 plan agreement, including handling charges, over a specified 55
7070 number of months contingent on the solvency of the working 56
7171 capital revolving fund. Prior approval shall be required by 57
7272 the division of facilities management, design and 58
7373 construction for state agencies in situations where the 59
7474 office of administration controlled state -owned office space 60
7575 is involved and space in which a lease contract executed by 61
7676 the office of administration is in effe ct. 62
