11 | 11 | Be it enacted by the General Assembly of the State of Missouri, as follows: | |
12 | 12 | Section A. Chapter 387, RSMo, is amended by adding th ereto 1 | |
13 | 13 | one new section, to be known as section 387.435, to read as 2 | |
14 | 14 | follows:3 | |
15 | 15 | 387.435. A TNC shall not be vicariously liable under 1 | |
16 | 16 | any law by reason of owning, operating, or maintaining the 2 | |
17 | 17 | digital network accessed by a TNC driver or rider, or by 3 | |
18 | 18 | being the TNC affiliated with a TNC driver, for harm to 4 | |
19 | 19 | persons or property that results or arises out of the use, 5 | |
20 | 20 | operation, or possession of a motor vehicle operating as a 6 | |
21 | 21 | TNC vehicle while the driver is logged on to the digital 7 | |
22 | 22 | network if: 8 | |
23 | 23 | (1) There is no negligence under sections 387.400 to 9 | |
24 | 24 | 387.440 or criminal wrongdoing under the federal or Missouri 10 | |
25 | 25 | criminal code on the part of the TNC; and 11 | |
26 | 26 | (2) The TNC has fulfilled all of its obligations under 12 | |
27 | 27 | sections 387.400 to 387.440 with respect to the TNC driver. 13 | |
