88 To amend chapter 387, RSMo, by adding thereto one new section relating to transportation

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Chapter 387, RSMo, is amended by adding th ereto 1
1313 one new section, to be known as section 387.435, to read as 2
1414 follows:3
1515 387.435. A TNC shall not be vicariously liable under 1
1616 any law by reason of owning, operating, or maintaining the 2
1717 digital network accessed by a TNC driver or rider, or by 3
1818 being the TNC affiliated with a TNC driver, for harm to 4
1919 persons or property that results or arises out of the use, 5
2020 operation, or possession of a motor vehicle operating as a 6
2121 TNC vehicle while the driver is logged on to the digital 7
2222 network if: 8
2323 (1) There is no negligence under sections 387.400 to 9
2424 387.440 or criminal wrongdoing under the federal or Missouri 10
2525 criminal code on the part of the TNC; and 11
2626 (2) The TNC has fulfilled all of its obligations under 12
2727 sections 387.400 to 387.440 with respect to the TNC driver. 13
