| 8 | 8 | | To amend chapter 324, RSMo, by adding thereto one new section relating to the issuance of |

| 11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 12 | 12 | | Section A. Chapter 324, R SMo, is amended by adding thereto 1 |
|---|
| 13 | 13 | | one new section, to be known as section 324.1173, to read as 2 |
|---|
| 14 | 14 | | follows:3 |
|---|
| 15 | 15 | | 324.1173. 1. Notwithstanding any other provision of 1 |
|---|
| 16 | 16 | | law to the contrary, for purposes of obtaining a 2 |
|---|
| 17 | 17 | | professional or occupational license, a p erson has 3 |
|---|
| 18 | 18 | | demonstrated lawful presence and is eligible to obtain a 4 |
|---|
| 19 | 19 | | professional or occupational license if the person submits: 5 |
|---|
| 20 | 20 | | (1) An unexpired employment authorization document 6 |
|---|
| 21 | 21 | | issued by the United States Department of Homeland Security, 7 |
|---|
| 22 | 22 | | Form I-766; and 8 |
|---|
| 23 | 23 | | (2) Documentation issued by the United States 9 |
|---|
| 24 | 24 | | Department of Homeland Security, the United States 10 |
|---|
| 25 | 25 | | Citizenship and Immigration Services, or any other federal 11 |
|---|
| 26 | 26 | | agency, including a Form I -797 used by the United States 12 |
|---|
| 27 | 27 | | Citizenship and Immigrat ion Services, demonstrating that 13 |
|---|
| 28 | 28 | | such person is described in Section 202(c)(2)(B)(i) through 14 |
|---|
| 29 | 29 | | (ix) of the federal REAL ID Act of 2005, P.L. 109 -13. 15 |
|---|
| 30 | 30 | | 2. A professional or occupational license issued to a 16 |
|---|
| 31 | 31 | | person eligible pursuant to subsection 1 of th is section 17 SB 738 2 |
|---|
| 32 | 32 | | shall be valid only for the period of time during which such 18 |
|---|
| 33 | 33 | | person's employment authorization document is valid. 19 |
|---|
| 34 | 34 | | 3. Nothing in this section shall affect the 20 |
|---|
| 35 | 35 | | requirements to obtain a professional or occupational 21 |
|---|
| 36 | 36 | | license that are unrela ted to the lawful presence 22 |
|---|
| 37 | 37 | | requirements demonstrated pursuant to this section. 23 |
|---|
| 38 | 38 | | 4. Nothing in this section shall be construed to grant 24 |
|---|
| 39 | 39 | | eligibility for any public benefits other than obtaining a 25 |
|---|
| 40 | 40 | | professional or occupational license. 26 |
|---|
| 41 | 41 | | 5. Any person who has complied with the requirements 27 |
|---|
| 42 | 42 | | of this section shall have his or her employment 28 |
|---|
| 43 | 43 | | authorization document verified through the Systematic Alien 29 |
|---|
| 44 | 44 | | Verification for Entitlements Program operated by the United 30 |
|---|
| 45 | 45 | | States Department of Homeland Security or an equivalent 31 |
|---|
| 46 | 46 | | program designated by the United States Department of 32 |
|---|
| 47 | 47 | | Homeland Security. 33 |
|---|
| 48 | 48 | | 6. The general assembly enacts this section pursuant 34 |
|---|
| 49 | 49 | | to the authority provided in 8 U.S.C. Section 1621(d), as 35 |
|---|
| 50 | 50 | | such section existed on August 28, 2025. 36 |
