99 AN ACT
1010 To repeal section 42.300, RSMo, and to enact in lieu thereof one new section relating to the
1111 distribution of certain funds for memorials and museums dedicated to veterans.

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 42.300, RSMo, is repealed and one new 1
1515 section enacted in lieu thereof, to be known as section 42.300, 2
1616 to read as follows:3
1717 42.300. 1. There is hereby created in the state 1
1818 treasury the "Veterans Commission Capital Improvement Trust 2
1919 Fund" which shall consist of money collected under section 3
2020 313.835. The state treasurer shall administer the veterans 4
2121 commission capital improvement trust fund, and the moneys in 5
2222 such fund shall be used solely, upon appropriation, by the 6
2323 Missouri veterans commission for: 7
2424 (1) The construction, maintenance or renovation or 8
2525 equipment needs of veterans' homes in thi s state; 9
2626 (2) The construction, maintenance, renovation, 10
2727 equipment needs and operation of veterans' cemeteries in 11
2828 this state; 12
2929 (3) Fund transfers to Missouri veterans' homes fund 13
3030 established under the provisions of section 42.121, as 14
3131 necessary to maintain solvency of the fund; 15
3232 (4) Fund transfers to any municipality with a 16
3333 population greater than four hundred thousand and located in 17
3434 part of a county with a population greater than six hundred 18 SB 745 2
3535 thousand in this state which has established a fund for the 19
3636 sole purpose of the restoration, renovation , and maintenance 20
3737 of a memorial or museum or both dedicated to World War I. 21
3838 Appropriations from the veterans commission capital 22
3939 improvement trust fund to such memorial fund shall be 23
4040 provided only as a one-time match for other funds devoted to 24
4141 the project and shall not exceed five million dollars. 25
4242 Additional appropriations not to exceed ten million dollars 26
4343 total may be made from the veterans commission capital 27
4444 improvement trust fund as a m atch to other funds for the new 28
4545 construction or renovation of other facilities dedicated as 29
4646 veterans' memorials in the state. All appropriations for 30
4747 renovation, new construction, reconstruction, and 31
4848 maintenance of veterans' memorials shall be made onl y for 32
4949 applications received by the Missouri veterans commission 33
5050 prior to July 1, 2004; 34
5151 (5) The issuance of matching fund grants for veterans' 35
5252 service officer programs to any federally chartered 36
5353 veterans' organization or municipal government agenc y that 37
5454 is certified by the Veterans Administration to process 38
5555 veteran claims within the Veterans Administration System; 39
5656 provided that such veterans' organization has maintained a 40
5757 veterans' service officer presence within the state of 41
5858 Missouri for the three-year period immediately preceding the 42
5959 issuance of any such grant. A total of one million five 43
6060 hundred thousand dollars in grants shall be made available 44
6161 annually for service officers and joint training and 45
6262 outreach between veterans' service orga nizations and the 46
6363 Missouri veterans commission with grants being issued in 47
6464 July of each year. Application for the matching grants 48
6565 shall be made through and approved by the Missouri veterans 49 SB 745 3
6666 commission based on the requirements established by the 50
6767 commission; 51
6868 (6) For payment of Missouri National Guard and 52
6969 Missouri veterans commission expenses associated with 53
7070 providing medals, medallions and certificates in recognition 54
7171 of service in the Armed Forces of the United States during 55
7272 World War II, the Korean Conflict, and the Vietnam War under 56
7373 sections 42.170 to 42.226. Any funds remaining from the 57
7474 medals, medallions and certificates shall not be transferred 58
7575 to any other fund and shall only be utilized for the 59
7676 awarding of future medals, medallions , and certificates in 60
7777 recognition of service in the Armed Forces; 61
7878 (7) Fund transfers totaling ten million dollars to any 62
7979 municipality with a population greater than three hundred 63
8080 fifty thousand inhabitants and located in part in a county 64
8181 with a population greater than six hundred thousand 65
8282 inhabitants and with a charter form of government, for the 66
8383 sole purpose of the construction, restoration, renovation , 67
8484 and maintenance of a memorial or museum or both dedicated to 68
8585 World War I; [and] 69
8686 (8) Fund transfers totaling no more than five hundred 70
8787 thousand dollars to any county with more than seventeen 71
8888 thousand six hundred but fewer than nineteen thousand 72
8989 inhabitants and with a county seat with more than eight 73
9090 thousand but fewer than ten thousand inhabitants, for the 74
9191 sole purpose of the restoration, renovation, and maintenance 75
9292 of a memorial or museum or both dedicated to Missouri and 76
9393 United States veterans and their service; and 77
9494 (9) The administration of the Missouri veterans 78
9595 commission. 79
9696 2. Any interest which accrues to the fund shall remain 80
9797 in the fund and shall be used in the same manner as moneys 81 SB 745 4
9898 which are transferred to the fund under this section. 82
9999 Notwithstanding the provisions of section 33.080 to the 83
100100 contrary, moneys in the veterans commission capital 84
101101 improvement trust fund at the end of any biennium shall not 85
102102 be transferred to the credit of the general revenue fund. 86
103103 3. Upon request by the veterans commission, the 87
104104 general assembly may appropriate moneys from the veterans 88
105105 commission capital improvement trust fund to the Missouri 89
106106 National Guard trust fund to support the activities 90
107107 described in section 41.958. 91
