AN ACT 
To amend chapter 8, RSMo, by adding thereto one new section relating to state contracts for certain 
services. 
 
Be it enacted by the General Assembly of the State of Missouri, as follows: 
     Section A.  Chapter 8, RSMo, is amended by adding th ereto 1 
one new section, to be known as section 8.292, to read as 2 
follows:3 
     8.292.  1.  As used in this section, "master agreement" 1 
shall mean a contract for architecture, engineering, or land 2 
surveying services that will be performed on an as -needed  3 
basis for an indefinite quantity of projects over a defined 4 
period. 5 
     2.  The division of facilities management, design and 6 
construction of the office of administration may establish 7 
master agreements using a qualification -based selection  8 
process.  Master agreements may be used where the estimated 9 
fee for architecture, engineering, or land surveying 10 
services does not exceed one hundred thousand dollars per 11 
project. 12 
     3.  The division shall issue a request for 13 
qualifications for all master agr eements.  Each request for  14 
qualifications shall be published on the website of the 15 
division or advertised through an electronic medium 16 
available to the general public for a period of at least ten 17 
days before statements of qualifications are reviewed.  A  18   SB 789 	2 
request for qualifications for all master agreements shall 19 
also be published in a newspaper, as specified in section 20 
493.050, once per week for two consecutive weeks in the 21 
county or counties where the master agreement services are 22 
to be performed. 23 
     4.  The request for qualifications shall specify the 24 
number of master agreements to be awarded and the basis for 25 
establishing multiple master agreements.  Multiple master  26 
agreements may be awarded based on a set number, geographic 27 
region, or the type of projects or services to be performed. 28 
     5.  The division shall evaluate statements of 29 
qualifications for a master agreement based on the criteria 30 
set forth in subdivisions (1) to (4) of section 8.289. 31 
     6.  The period for each master agreeme nt shall not  32 
exceed two years, including all renewal periods and the 33 
total value of all services performed under the agreement 34 
may not exceed one million dollars per year. 35 
     7.  A master agreement shall set forth the agreed -upon  36 
terms and conditions and the fee schedule or hourly rate for 37 
the specified period.  The scope, schedule, and total fee 38 
for each project performed under the master agreement shall 39 
be established by a task order issued by the division. 40
